Definitions1 In this regulation,

"approved" means approved and listed or labelledunder the inspection service of

(a) the Canadian Standards Association (hereinreferred to as C.S.A.),

(b) the Underwriters Laboratories of CanadaLimited (herein referred to as U.L.C.), or

(c) the Canadian Gas Association,

or approved by the minister; (« approuvé »)

"board" means a board of examiners appointed underthe Act; (« comité »)

"chief inspector" means the chief inspector of theMechanical and Engineering Division of theDepartment of Labour; (« inspecteur en chef »)

"CGA" means the Canadian Gas Association; (« ACG»)

"crank-case oil" means oil that has been used in thebase of an internal-combustion engine or that hasbeen used for the purpose of washing or cleaning, orthat has been diluted with a more volatile oil; (« huilepour moteur »)

"CSA" means the Canadian Standards Association;(« CSA »)

"department" means the Department of Labour;(« ministère »)

"flammable liquid" means a petroleum product usedas a fuel oil; (« liquide inflammable »)

"fuel oil" means a flammable liquid having aflashpoint that meets the requirements of CanadianStandards Association Standard B139, as amendedfrom time to time; (« combustible liquide »)

"furnace" means an apparatus used for heating one ormore buildings or part of a building by means of hotair, hot water, or steam; (« chaudière »)

"inspector" means an inspector of the department;(« inspecteur »)

Board of examiners2(1) A board of examiners appointed undersection 4 of the Act may review applications for licencesfor which provision is made in the Act or this regulation,and may discharge such other duties as the minister mayfrom time to time determine.

2(3) Of the members of a board first appointed,one shall hold office for three years, one for two years andone for one year, as may be prescribed in the order incouncil appointing them, and thereafter each membershall hold office for three years, one member retiring eachyear.

2(5) A board shall, upon reference by the chiefinspector pursuant to subsection 7(2) or (3) or otherwiseunder this regulation, or by the minister, conducthearings relating to matters involving the cancellation orrevocation of any licence under the Act or the non-renewalthereof.

Procedure of board of examiners on references3(1) When any matter is, as provided herein,referred to a board, the board shall fix a place and a dateat which the matter will be considered by it, and shallnotify the applicant or the licence-holder, as the case maybe, as well as all others concerned, and shall also notifythe Deputy Minister of Labour.

4(2) Following the hearing, the board shall makeits report in writing to the minister and, if the report isadverse to the applicant or licensee, as the case may be,a copy of the report shall be furnished to the applicant orlicensee, by prepaid registered mail, addressed to theapplicant or licensee at the address last furnished by theapplicant or licensee to the department.

Licence to install and service of oil burning equipment6(1) Subject to subsection (5), no person shallinstall or service oil burning equipment unless thatperson has first passed the examination prescribed by aboard, and is the holder of a subsisting licence that hasbeen issued by the minister and is in a form set by theminister.

56(2) A person may apply for a licence to beissued under this regulation if that person has

(a) two years' experience in the installation andservicing of oil burners and equipment under thedirect personal supervision of a licensed installer; or

(b) completed an apprenticeship in a related trade andhas had six months' continuous experience in theinstallation and servicing of oil burners andequipment under the direct personal supervision of alicensed installer.

6(3) Where the holder of a licence authorizing theinstallation and servicing of oil burning equipment fails toobtain, for two consecutive calendar years, a renewalthereof, the minister, in the minister's discretion, mayrequire the holder to pass another examination beforeissuing a new licence.

6(5) Where the minister is satisfied that a personhas a specialized knowledge of a class of oil burningequipment, the minister may, without requiring theperson to pass an examination set by a board, issue alicence authorizing the person to install, service or repairthe class of oil burning equipment, as specified in thelicence.

7(1) Where an applicant for any licence for whichprovision is made in the Act or this regulation does not,in the opinion of the chief inspector, establish adequatequalifications for the issue of a licence, the chief inspectorshall notify the applicant of the chief inspector's opinion,and the applicant has seven days within which to furnishadditional proof of qualification.

7(2) Where a question arises as to theadvisability or propriety of issuing a licence to anapplicant, for reasons other than a lack of technicalqualification, the chief inspector shall notify the applicantand shall refer the matter to a board.

Oil burning equipment9(1) No person shall, within the province byhimself or herself, or by a clerk, servant, employee, oragent sell or offer for sale, or deliver or install in anypremises, oil burning equipment that is not approved.

9(2) The minister may prohibit the use, forheating purposes within the province by any person, of oilburning equipment that the minister, decides is unsafe.

9(3) Where the chief inspector is of the opinionthat any oil burning equipment is unsafe for use, the chiefinspector shall give notice to the owner thereof, and wherethe equipment has been installed in or upon anyproperty, the chief inspector shall also notify the occupierof the property of the chief inspector's opinion, and shallgive reasons therefor.

9(5) Upon receiving a notice undersubsection (3), the person receiving the notice, or anyother person affected thereby, may, within 10 days,appeal to the minister for a review, and the minister mayrefer the matter to a board.

9(6) When the minister receives therecommendations of the board, the minister shall makea decision which is final and not subject to review.

Permits for installations of oil burners and fuel tanks10(1) No person shall

(a) install an oil burner or fuel oil tank; or

(b) make any alteration of, or addition to, an oilburner;

without first applying for a permit from the minister tomake the installation, alteration, or addition, except thatnormal servicing and maintenance of an installed oilburner does not constitute the making of an alteration oraddition thereto, for the purpose of this subsection.

10(2) Every application for a permit as requiredunder subsection (1) shall be in writing, on formssupplied by the minister, and shall include, with referenceto the proposed installation, alteration, or addition,

(a) particulars of

(i) the location of the premises, and

(ii) the location and capacity of the oil burner ortank; and

(b) a complete description of the oil burner or tank,including the name of the manufacturer, model anddetails of listing or labelling, and showing that the oilburner or part thereof is approved.

10(2) Les demandes de permis prévues auparagraphe (1) sont présentées par écrit, au moyen deformules fournies par le ministre. En ce qui concernel'installation, la transformation ou l'ajout projeté, cesdemandes doivent donner les renseignements suivants :

a) des précisions sur :

(i) l'emplacement des locaux,

b) une description complète du brûleur à mazout oudu réservoir à mazout, indiquant notamment le nomdu fabricant, le modèle et des détails touchant saclassification ou son catalogage et établissant que lebrûleur, ou l'une de ses parties, est approuvé.

10(3) In addition to the information requiredunder subsection (2), and except in residentialinstallations, the applicant shall, if requested by the chiefinspector, submit such drawings and specifications withrespect to the proposed installation in the building andpremises as will provide the chief inspector with completedetails of the extent and character of the proposed work.

10(4) No permit for the installation or alterationof, or addition to, an oil burner shall be issued unless thechief inspector is satisfied that all matters in theapplication, and in drawings and specifications, ifrequired, are in accordance with this regulation.

10(4) Un permis d'installation ou detransformation d'un brûleur à mazout, ou d'ajout à cebrûleur, ne peut être accordé que si l'inspecteur en chefest convaincu que tous les éléments de la demande, ainsique des plans et des devis, le cas échéant, sont conformesaux dispositions du présent règlement.

10(5) The chief inspector shall notify, in writing,the person who installed, altered, or added to, the oilburner, and the owner thereof, of any defects found uponinspection, and shall state in the notice the period of timewithin which those defects shall be corrected, and theperson who installed, altered, or added to, the oil burner,shall forthwith remedy the defects and notify the chiefinspector that this has been done.

10(5) L'inspecteur en chef avise par écrit lepropriétaire d'un brûleur à mazout et la personne qui l'ainstallé, transformé ou qui y a apporté un ajout, de toutedéfectuosité découverte lors d'une inspection. 10(6) Where, during an inspection, the inspectorfinds an installation or alteration of, or addition to, an oilburner, that is not in accordance with this regulation, theinspector may order the owner of the building orpremises in which the oil burner is installed to notcommence operation of the burner, or to discontinueoperation, until the installation or alteration of, oraddition to, the oil burner is made to conform to thisregulation.

10(7) No fuel tank shall be installed until it andthe location in which it is to be placed, have beenapproved by the chief inspector.

10(8) Where strict compliance with therequirements of this regulation with respect to themanner of installation is not practicable, the chiefinspector, upon application therefor in writing, may, inwriting, give permission for such deviation as may benecessary without reducing the standard of safety belowthat provided in this regulation, but no deviation shall bemade until that written permission has been secured.

Recognition of CAN/CSA B139-M91 entitledInstallation Code for Oil Burning Equipment11(1) The standards set forth in CAN/CSAB139-M91 entitled Installation Code for Oil BurningEquipment, as amended from time to time, are adoptedas minimum standards for the installation or alterationof, and for adding to, oil burners, and compliance withthe standards set forth in Code B139-M91 constitutesfulfillment of the requirements of this regulation, exceptthat the chief inspector may, in any specific case, requireadditional equipment to be installed or additionalprecautions to be taken if, in the chief inspector'sopinion, such additional requirements are necessary toensure safety in the operation of the oil burner.

11(2) Where the chief inspector is of the opinionthat additional equipment or additional precautions arenecessary to ensure safety in the operation of an oilburner, the chief inspector shall proceed as prescribed insubsection 9(3).

"code" means

(c) the CAN/CGA Code B149.3-M89 entitled Codefor the Field Approval of Fuel RelatedComponents on Appliances and Equipment,

as the case requires, and as amended from time totime; (« code »)

"gas equipment" means a designated article that is, orforms part of, a gas heating system or a gas cookingsystem, and includes any part of such a designatedarticle, but does not include any part of the systemleading from the pipeline of a gas utility to the pointon the system where the meter of the gas utility isconnected, and does not include the meter; (« appareilà gaz »)

"gas fitting" means the work involved in theinstallation, repair, alteration, or removal of any gasequipment; (« installation du gaz »)

"gas inspector" means an inspector of the Departmentof Labour, or an inspector appointed by amunicipality that has been authorized by the ministerto issue permits under subsection 5(2) of the Act;(« inspecteur du gaz »)

"gas utility" means a person, firm, or corporation theoperations of whom or of which include thedistribution of gas to the consumer, and who or whichoperates under an authorization granted by ThePublic Utilities Board; (« service public de distributionde gaz »)

Classes and scope of licences13 There are the following five classes oflicences for gas fitters, namely:

(a) commercial and industrial gas fitter's licence;

(b) domestic gas fitter's licence;

(c) liquid petroleum gas fitter's licence;

(d) utility gas fitter's licence; and

(e) special gas fitter's licence.

14 No person shall weld or make a weldedconnection to any gas equipment unless the person holdsa subsisting welder's certificate issued under The Steamand Pressure Plants Act, and each weld made by theperson shall be stamped with the number issued to theperson by the minister.

(b) has at least four years of practical experienceunder the direct supervision of a person holding acommercial and industrial gas fitter's licence; or

(c) has a plumber's or steamfitter's certificate ofqualification and has had, in addition, two years ofpractical experience under the direct supervision of aperson holding a commercial and industrial gas fitter'slicence.

(a) who

(i) has at least two years of practical experience asa steamfitter or in related work acceptable to aboard,

(ii) has at least one year of practical experienceunder the direct supervision of a person holdinga gas fitter's licence, and

(iii) has completed a study course acceptable tothe board; or

(b) who

(i) has held, for a period of at least two years, alicence authorizing the person to install andservice oil burning equipment, and

16(3) A liquefied petroleum gas fitter's licence maybe issued to a person who applies therefor, and who hasat least one year of practical experience in a related tradeacceptable to a board, and has, in addition, completed astudy course specifically pertaining to liquefied petroleuminstallation.

16(5) Notwithstanding subsection (4), a utility gasfitter's licence may, on payment of the required fee, beissued without examination to a person who holds asubsisting commercial and industrial gas fitter's licence ora domestic gas fitter's licence.

16(6) A special gas fitter's licence may be issued toa person who applies therefor, and has, to the satisfactionof a board, specialized knowledge of the particular type ofgas equipment that the licence allows the person toinstall, service, and repair.

17 Notwithstanding section 5, the ministermay, on the recommendation of a board, issue a licenceto a person who holds a licence of a similar type issuedby the government of any other province or by any otherlicensing authority.

Examinations for licences18 Every person desiring to take anexamination for a licence shall apply in writing to theMechanical and Engineering Division of the Departmentof Labour, on a form supplied by the minister, and shallpay the prescribed fee.

19 An applicant who fails to pass anexamination may not reapply to write anotherexamination within 60 days after writing the previousexamination.

20 A licence is valid for the period shownthereon, and shall show on the face thereof the date ofexpiry.

21 Where a licensee fails to renew a licence fora period of three or more years, the licensee may berequired to pass a new examination before a licence isissued.

22(1) Subject to subsection (3), where the chiefinspector is satisfied that a licensee has failed

(a) to conform to the provisions of the Act or theregulations;

(b) to comply with the requirements of approved andapplicable codes or rules, subject to any changestherein, deletions therefrom, or additions thereto,made by the minister;

(c) to rectify defective installations of gas burningequipment pursuant to written notification issued byan inspector; or

(d) to pay any fee properly chargeable under theregulations;

the chief inspector may

(e) suspend the licence; or

(f) recommend to the minister that the licence becancelled.

22(2) Where a licence is suspended as provided inclause 1(e), the suspension expires after 30 days haveelapsed, unless the minister, before the end of thatperiod, confirms the suspension or cancels the licence.

22(4) Where the minister receives an appeal undersubsection (3), the minister may confirm the suspensionor cancel the licence, or, in the minister's absolutediscretion, vary the chief inspector's suspension of thelicence, or the chief inspector's recommendation for itscancellation.

23 A person who holds a subsisting third classcertificate, or a certificate of a higher grade, issued underThe Power Engineers Act, may make necessary runningrepairs to gas burning equipment in the plant wherein theperson is employed, but not elsewhere.

(a) the location of the premises;

(b) the location of the gas equipment; and

(c) a complete description of the equipment, includingthe name of the manufacturer, model, and details oflisting or labelling, and showing that the gasequipment, or part thereof, is approved.

29(2) Notwithstanding subsection (1), the chiefinspector may require that work shall be done inconformity with higher standards than those specified inthe regulations if, in the chief inspector's opinion, thehigher standards are necessary in the interests of safety.

30(2) Where a gas-fired residential appliance isinstalled to replace a similar appliance, a licensed gasfitter may ignite the appliance provided that the gas fitternotifies the gas utility forthwith that the appliance isoperating in a safe manner.

31 Where a gas utility makes an inspectionunder section 30, the gas utility shall, within seven daysafter the date of the inspection, report to the chiefinspector, in a form or manner acceptable to the chiefinspector, showing

(a) the street address of the premises where theinstallation is made;

(b) the licence number of the gas fitter who made theinstallation;

(c) the number of the permit issued in respect of theparticular installation;

(d) whether the gas fitter's tag was attached to the gasequipment, as required under section 34;

(e) whether all appliances in the installation carry thenecessary seal of approval;

(f) whether the installation was checked for leaks witha test dial on the meter; and

(g) that the installation complies with therequirements of the regulations and of the code.

32 No person shall connect a vessel containingliquid petroleum gas to new gas equipment being initiallyinstalled unless

(a) an application for a permit is made undersection 24, and

(i) if the gas equipment is not approved, or

(ii) if the hourly input of the gas equipmentexceeds 60,000 British Thermal Units,

the application is approved by the chief inspector anda permit issued to the person; and

(e) whether all appliances in the installation carry therequired seal of approval;

(f) the name of the licensed person who inspected theinstallation; and

(g) that the installation complies with therequirements of the regulations and of the code.

37 Where a hot water or steam boiler that hasbeen fired by another fuel is converted to gas, the gasfitter shall ensure that the boiler is properly equippedwith one or more approved-type safety relief valvesinstalled directly on the boiler and having a dischargecapacity of at least 80% of the actual firing rate of the gasburner, and set at a pressure not to exceed the allowableworking pressure of the boiler.

(b) the owner ensures that the requirements ofsubsections (2) to (5) are met.
