Gang Member Definition

Texas Code of Criminal Procedures 61.02

“Criminal street gang,” “gang organization,” or “gang” means three or more individuals, having a common identifying sign or symbol or an identifiable leadership who continuously or regularly associate in the commission of criminal activities.

Gang Documentation

Meet two of the criteria as set by CCP 61

Documented and stored in an electronic database as gang members

TxGang

Juveniles – 2 years

Adults – 5 years

Expiration can be extended

New arrest above Class C Misdemeanor

New intelligence (clothing, interview, informant, etc.)

Criteria

Self admission

Identified by a RELIABLE person.

Corroborated info from someone of unknown reliability.

Clothing, Tattoos, marks, signs, symbols, or hand signs that are consistent with gang affiliation.

Subject arrested with gang members while exhibiting conduct consistent with gang activity.

The subject has used technological methods to recruit.

Judge determines membership - or - an admission in front of a judge in court.

Subject frequents and ear where gang members are found and associates with them. Needs 3rd criteria if used with jail visit.

Leadership is determined by democratic vote, requiring unanimity. Recruitment is achieved by demonstrating a "homeboy connection," passing a background check to make sure the prospect is not an informer, and receiving a unanimous vote

Bandidos

Bandidos

Bandidos were started in San Leon, Texas in March 1966 by Donald Chambers.

Their colors are red letter on a gold background. Support clubs use opposite color schemes.

Center patch on their “colors” is the Fat Mexican which was copied from the Frito Lay Corp. that was used to advertise Fritos corn chips.

The bottom rocker on the “colors” represent what State the Bandido member is from. Other outlaw motorcycle gangs do not allow other gangs to use the State name forcing them to use city or county.

Bandidos is an all Harley club

Bandidos By-Laws

REQUIREMENTS FOR A CHAPTER

Five members minimum

Pictures and information kept on all members

Weekly meetings held (church)

Probationary chapters pay one time fee of $1,000, then $25.00 per month, per member to National Chapter.
