Changes to Legislative Interpretation

On 5 March 2016, significant changes occurred to legislative

interpretation in the Commonwealth as a result of changes brought

about by the Acts and Instruments (Framework Reform) Act 2015

(No. 10). Read more here.

Queensland Practitioner struck off the roll

A Queensland Practitioner has been struck off the roll for

professional misconduct.

Calls for submissions into Town Camps

The Legislative Assembly’s Public Accounts Committee is calling

for submissions to its inquiry into the repair and maintenance of

housing on town camps by 15 March. Further information is

available here.

UK Highest Court again disapproves of decision of High

Court of Australia in Andrews

In its judgment in Cavendish Square Holding BV v Talal El

Makdessi and ParkingEye Limited v Beavis UKSC 67 the UK

Supreme Court considered and disagreed with the High Court's

decision in Andrews v Australia and New Zealand Banking

Group on penalties stating that the decision was a radical

departure from the previous understanding of the law. The Court

also found that the High Court's reasoning was not consistent with

the equitable rule on which it was stated to be based.
