Solicitors for shoe shop owner win radio royalty fees case against PPI F For many years, members have been faced with "Hobsons' Choice" when it came to paying royalties to IMRO (performers) and PPI (record companies) for the privilege of playing a transistor radio in their shops.

The CSNA was therefore surprised and excited to learn that a firm of solicitors had successfully argued against a prosecution by

PPI of a PPI of an owner of

two shoe

shops. PPI had claimed that the presence of the radio being played in the shops was sufficient to warrant a payment to the group of royalty fees, set on a square metre basis. The amount being claimed was in excess of €2,045, with a further €6,348 being claimed for aggravated damages.

The argument, accepted by Judge Mary Collins, was that PPI was not entitled to collect royalties, relying upon two European Court of Justice (ECJ) cases that dealt with key terms in the law such as "communicated to the public" and whether the music was being played for profit.

In one of the ECJ cases, the Italian equivalent of PPI had sought payment from a dentist in Turin. The ECJ had ruled that as there were only a small number of people in the reception area at any one time, it was

improper for the Italian PPI to seek a payment. It was also accepted by the judge that the

shops were not playing the radio for profit and it was not a factor in influencing whether or not people entered the stores in the first place.

Judge Collins dismissed the PPI's claim and ordered it to pay the company's costs. PPI is not appealing the ruling.

Following this, the CSNA has had discussions with the firm of solicitors and has decided to submit a number of test cases to the courts for rulings.

PPI and IMRO both charge royalties based upon the area of the shop (square metres) but makes no reference to the number (if any) of customers per hour that are on the premises, whether they make purchases or otherwise, or whether it is fair to charge the same fee to a retail outlet in Temple Bar and Templeglantine!

Ten-year-old Tubridy steps up career with video release

Mullingar's latest singer-songwriting sensation, 10year-old Ashley Tubridy.

Mullingar's Ashley Tubridy continues her ascent in the music business with the news this week that her latest song has been chosen for release on Aertv as its video of the week.

"Ashley performs her track 'Light My Sun' with incredible conviction and passion that you wouldn't expect to come from someone so young," said Karen Howley of Aertv.

Ms Tubridy - who lives with her parents in Greenpark, and won't be 11 until later this summer - came to national notice in 2011 when she performed her own track 'Friends Forever' on The Late Late Toy Show, which subsequently reached No2 on the iTunes Ireland download charts.

Ashley has already played numerous gigs throughout Ireland, including a special event that was put on for One Direction star Niall Horan's charity birthday bash last year, and has also busked with the other local star, Bressie.

"The song 'Light My Sun' is about a relationship between Ashley and her friend and how she thought that she was a true friend but it turns out that she wasn't so nice after all," Samantha Tubridy, Ashley's mum explains.

"This person let her down quite badly and she was very hurt by what this friend had done to her. So an evening not too long after the event, Ashley composed this song using the anger, hurt and pain that she was experiencing to explain how she was feeling inside as a result of that day!"

Fans can look forward to Ashley playing lots of festivals and gigs over the summer months once school is out. Details of upcoming gigs as well as news of her EP due to be released in June will be released on her Facebook page.

Ashley started picking up the guitar at around four-and-a-half years old, and at about five would sit in her room and create music despite there being noone else in the household able to sing a note between them. In 2011 at the age of eight she became the youngest member of IMRO.

Certainly, the appointment of

Dan Healy as the new station

boss came as a bit of a surprise.

Healy has worked with Newstalk

and g8fm in the past and was one

of the consortium that put the

successful iRadio bid together.

Latterly he has been CEO of

Independent Radio Sales, so there

are few people in the business

who know as much as Dan does

about how and where the money

is currently being spent - and

what kind of deals are being

done. "That knowledge could be

invaluable," one media buyer told

The Phantom. "It indicates that

RTfi are putting business first."

Another advertising mogul was

in agreement. "In the past," she

said, "the head of 2fm tended

to come from a programming

background but Dan Healy is a

man who's steeped in sales. I

imagine some of the guys in the

independent stations are having

the odd sleepless night because

Dan knows their business insideout

- and now he's working for the

opposition." Interesting times...

Bressie was among those

who last week completed the

1,400km Cycle Against Suicide,

which stopped off in 28 schools

nationwide. There was lots of

positive media feedback, though

strangely little of it from the

journalists who'd demonised Mr.

B a few weeks ago for daring to

challenge Ireland's failed drugs

laws in Hot Press...

Six of Ireland's greatest

songwriters and composers were

inducted into the IMRO Academy

last week (see panel) at a ceremony

in the Conrad Hotel. The induction

ceremony coincided with the

IMRO sponsored Independent

Broadcasters of Ireland (IBI) annual

conference dinner. Following the

ceremony, all six performed a

selection of their iconic hit songs

live. The most poignant moment

came with the rendition by Shay

Healy of his Eurovision winning

'What's Another Year?' - a song he

has seldom played in public before.

Shay recently celebrated his 70th

birthday, and his performance

was rendered all the more moving

by the knowledge that he has

been battling for some time now

with what he calls the TV Show

- Parkinson's disease. All told, the

occasion was a big success...

20 years after its release as part

of their Casual Sex In The Cineplex

opus, The Sultans Of Ping FC

are back in the Irish chart with

'Cive Him A Ball (And A Yard Of

Grass)'. The paen to Roy Keane is

soundtracking the new Vodafone

The Phantom enjoyed a bite of lunch last week with Hot Press' long-standing chum Kevin Rowland, in advance of his Olympia show, in the vegetarian hangout, Cornucopia in Wicklow St. The Dexys frontman was in fine fettle and later provided a fantastic night's entertainment,

which featured the new album, One Day I'm Going To Soar played in its

entirety, followed by a selection of Dexys classics. Afterwards we adjourned to Maureen's Bar, where

a gathering of friends and family convened to wish the band well. Raising their glasses to Kevin & Co. were Jim Sheridan and his wife

Fran, Frank Murray, former Pogue Cait O Riordan, Roisin Dwyer and Anne Sexton of this parish,

as well as a posse of Kevin's Mayo relations and DJ Dandelion to name but a few. We look forward to Kevin's next visit...

Hot Press' Duan Stokes was one of the judges in the annual Dare 2 Be Drinkaware film competition,

which saw college students around the country submit their threeminute

take on 'Pacing Yourself' — drinkaware.ie's current campaign, which is based around

the need for people to take their tipple of choice at the speed that

suits them, and not anyone else's! With the shortlist encompassing submissions from throughout Ireland, the judging debate was

long and fierce, but the eventual winners were a team from the ITTralee (David Lyons, Nicky O'Donnell, Peter O'Callaghan, Jane Callahan and Cer Roche) with The Pace Setter. Joining Duan on the judging panel were USI's Denise McCarthy, RTE's Stephen Byrne (fresh from Voice Of Ireland

duties!), Daragh Doyle and Chair of the panel Fionnuala Sheehan, Chief Executive of drinkaware.ie.

Also at the prize-giving ceremony were actor Emmet Kirwan, Nicky Cogan (founder of the Darklight Film Festival, and Director and Producer with Still Films), 2fm's

Paddy McKenna, and 3e presenter Caroline Twohig...

Lived in previously by John Martyn who hung out there with Snow Patrol, Thomastown further enhanced its rock 'n' roll credentials last week when it hosted the first live collaboration in the Red Door between Jerry Fish and drummer extraordinaire Jeremy Hickey, aka RSAC. With

Crum Gallagher (guitar), Bill Blackmore (trumpet) and John Colbert (bass) completing the lineup,

it was a gloriously in-yer-face

affair, which culminated in a guest appearance by Liz Aspden,

an English singer who moved to

Thomastown a few years ago and trades as Tit Modern. The Phantom

was delighted to catch up with Red Door proprietor Barry Reilly, local artist Ramie Leahy and Luke Cahill who was serving delicious locally-sourced sushi...

Billy Connolly caused consternation in Killarney last week when he verbally abused INEC house photographer Valerie O'Sullivan from the stage. "Get the fuck out of here... Will someone come here and see to this fucking cunt?" he said to the snapper, who had the permission of both the venue

and Connolly's management to take shots. Cathy Scannell was one of the numerous gig-goers who jumped to her defence on

the INEC Facebook page. "Billy, the way you spoke to the woman in the audience was absolutely awful. So very disappointed in

you. Way over the top to the point of being embarrassing both for the woman and a high percentage of the audience I would say. I do not

go to any performance to watch members of the audience being humiliated like that and I will not be going to any of your shows again." Connolly is, of course, no stranger to controversy. Back in 2004, he made a joke about Iraqi hostage Ken Bigley's plight and

THE TOP BANKERS A shrinking pool of banks for corporates to chose from means

more clients for those that do remain. FIONA REDDAN reports.

It should come as no surprise that, given

the events of the past few years, banking

options for TOP 1000 companies have shrunk

considerably. According to a survey of

this year's TOP 1000, the two pillar banks,

AIB and Bank of Ireland, have a combined

share of more than 80 per cent of all those

companies whose accounts reveal who they

bank with. When Ulster Bank is factored in,

the total exceeds 100 per cent.

Bank of Ireland's client base reads like

a who's who of corporate Ireland: DCC,

Microsoft; Musgraves, and Johnson & Johnson,

as does AIB's, which includes: C&C, SAP,

Google and GSK.

Despite the predominance of the

aforementioned three names however, other

banks that still have a corporate presence on

the ground in Ireland also feature strongly,

given the fact that most larger corporates will

opt for a multi-bank approach.

Foreign banks with Irish operations, such as

Bank of America, Danske Bank, Citibank and

HSBC, all feature in the survey. Unsurprisingly,

Bank of America is banker of choice to a host

of US multinationals, ranging from Adobe to

Boston Scientific to Facebook, with Citibank

similarly employed. Its clients include Allergan,

Dell, Hasbro and HP.

Although global investment banks such

as JP Morgan are less common, larger

corporates frequently have between four and

eight banks servicing them. But while there

is a shrinking pool of banks for corporates to

choose from, the situation is also influenced

by the willingness of the various banks to

lend and engage in refinancings. It's not just

small and medium-sized businesses that

struggle to get credit, given the performance

of some loans to larger corporates, which

have had to be written down. Most recently

for example, media group Independent News

& Media announced that it had agreed a debt

restructuring deal with its eight bankers,

which include AIB, BOI, Barclays Bank and

BNP Paribas, effectively writing down some

€140 million in debt.

While Anglo Irish Bank or its successor

Irish Bank Resolution Corp (IBRC) no longer

features in the survey, it's likely that many

of its former clients are still dealing with the

fallout arising from its abrupt liquidation

earlier this year. Corporate clients of the

bank include Hickey's Pharmacies, Jury's Inn,

Fields Jewellers and Sherry Fitzgerald and

it's understood that where such clients have

outstanding loans with the liquidated bank, the

onus is on them to refinance or repay the loan.

Failing that, the loans will be sold onto a third

party, which could include the National Asset

Management Agency (NAMA).

NAMA itself features in this survey on the

companies providing advisory services, and is

listed as a banker for a number of companies in

the survey, including Harcourt Developments

and Toji Holdings. This is the holding company

for the O'Dwyer hotel and pub group, which

operates Break for the Border, the Dragon Bar,

and the Grafton Capital and Trinity Capital

hotels in Dublin.

Of course, the asset management agency

also needs a banker itself, and has hired

Citibank in this regard.

When it comes to financial institutions,

unsurprisingly both AIB and BOI are again

dominant, boasting a combined market

share of just over 50 per cent, with Citibank,

Ulster Bank and HSBC bringing up the rear.

Unsurprisingly, many international financial

institutions based in Ireland opt to keep their

banking services in house - Dublin-based life

company Monte Paschi Ireland, for example,

utilises banking services of its parent, Banca

Monte dei Paschi di Siena.

Foster and Allen in the outfits that caught the imagination, on the BBC in 1982.

IT'S one of the great mysteries of our time: why did Mick Foster and Tony Allen wear Leprechaun outfits when they appeared on Top of the Pops

back in 1982? Well firstly, laughs Mick Foster, they

weren't leprechaun outfits: they were modelled on the 18th century outfits from the hit film Barry Lyndon.

And they just happened to be green. Secondly, they'd been wearing them

for years before going on Top of the Pops.

More than 30 years on, Mick is still bemused by the furore.

"When we did our first record, Jimmy Magee of RTE and Mick O'Riordan of IMRO said to us: 'it doesn't matter how good you are: you need something for people to remember ye'."

That was 1975: the film Barry Lyndon had just come out, and O'Riordan came up with the suggestion that they dress up in the sort of outfits worn by the actors

in that film. Seven years on, in 1982, preparing for

their, by then, annual tour of America, the two men decided they needed new suits for their performances.

"And in our wisdom, we got them in green," recalls Mick.

Bunch of Thyme got into the British Top 20, and Foster and Allen found themselves invited to go on Top of the Pops. They decided to go in their normal

stage suits. "We could see no reason to change,

and the media latched on to it. "But they weren't leprechaun outfits,

but as it turned out, the green suits were worth more to us than anything else: people are still talking about them!"

'Foster and Allen' started as a group in, above all places, Kilburn in London in 1975, and the creation of the duo represented

the fulfilment of an ambition formed in Mick's mind after seeing the success of The Alexander Brothers from Scotland.

He identified Tony Allen as someone with a rare combination in the music world: talent and reliability.

After a tour in the UK with The Nightrunners, there was a lull, "and this fellow

had a pub beside Kilburn Station, and he said: 'would you and Tony stay and play for a week?', and it went down well, so we actually started over there."

'Three strikes' rule challenged THE use of a 'three strikes and you're out' rule to combat illegal music sharing online should be subject to appeal, the Data Protection Commissioner has argued before the Supreme Court.

In appealing a 2009 High Court ruling that led to internet provider Eircom implementing the system, counsel for the Commissioner asked for a ruling on whether it is a breach of privacy and data rights.

Record companies EMI, Sony, Warner and Universal say privacy is not an issue where someone is making their computer a repository for copyrighted material.

Judgment was reserved.

WHAT a wonderful tribute to the legendary Shay Healy, inset, on the Marian Finucane show on RTE Radio 1 last weekend.

To hear Billy Connolly, Paul Brady, Maura O'Connell and Phil Coulter all talk to Shay about his induction into the IMRO Academy, and also regale listeners with stories about their times together, was very moving.
