Inquadramento. Il 21 novembre p.v. entrerà in vigore l'Accordo Commerciale fra Unione Europea e Singapore. L’ufficializzazione è avvenuta con la pronuncia del Consiglio Europeo riunitosi lo scorso 8 novembre, che fa seguito all’approvazione da parte del Parlamento del 13 febbraio di quest’anno. I negoziati fra UE e Singapore presero il via nel 2010 per essere conclusi appena due anni dopo. L’entrata in vigore dell’Accordo fu tuttavia sospesa in attesa della definizione della nuova politica europea in tema di protezione degli investimenti e della pronuncia della Corte Europea di Giustizia che, nel maggio 2017, dispose la divisione dell’intesa originaria in due accordi separati: l’FTA vero e proprio e l’IPA – Investment Protection Agreement, anch’esso già approvato dal Parlamento ma per la cui entrata in vigore dovrà attendersi il completamento della procedura di ratifica da parte dei singoli Stati membri. L'Accordo di Libero Scambio rappresenta l’ultimo successo in ordine di tempo della politica commerciale europea e si caratterizza per alcuni aspetti peculiari.

Si tratta innanzitutto di uno dei primi accordi di nuova generazione negoziati dall’Unione. Oltre all’eliminazione dei dazi doganali e degli ostacoli non tariffari agli scambi di beni e servizi, contiene infatti disposizioni importanti su questioni come tutela della proprietà intellettuale, liberalizzazione degli investimenti, appalti pubblici, concorrenza e sviluppo sostenibile.

E’ inoltre il primo accordo commerciale sottoscritto dall’UE con un paese dell’Asean (l’Associazione delle nazioni dell'Asia sudorientale), una regione destinata ad assumere in futuro un ruolo sempre più centrale nelle catene globali del valore. Obiettivo originario dell’Unione era giungere ad un accordo bi-regionale; a tal fine nel 2007 furono avviati negoziati con il Segretariato dell’Associazione, abbandonati tuttavia appena due anni dopo a favore di un approccio bilaterale.

Definisce degli standard elevati su aspetti quali accesso al mercato, servizi, public procurement, indicazioni geografiche o proprietà intellettuale che fungeranno da benchmark per i negoziati in corso con gli altri paesi dell’area (in particolare Malesia, Tailandia e Indonesia).

Si inserisce in una strategia più ampia che, attraverso la convergenza regolamentare, tende a rafforzare la presenza delle imprese europee in una regione a tradizionale influenza cinese. In quest’ottica l’FTA con Singapore si pone in continuità con quelli già in vigore con Corea del Sud e Giappone e quello firmato a giugno di quest’anno con il Vietnam.

Da ultimo, riguarda un mercato tradizionalmente al centro delle strategie di internazionalizzazione delle imprese italiane nel sudest asiatico. Singapore rappresenta infatti di gran lunga la destinazione più importante per il nostro export fra i paesi Asean,

per un valore che nel 2018 ha superato i 2,1 miliardi di € e un saldo positivo di 1,7 mld1. Sono inoltre 250 le imprese italiane stabilmente presenti a Singapore e circa 8.200 quelle che esportano nella Città Stato, l’83% delle quali di piccola e media dimensione.

Profilo Tariffario di Singapore. La sua natura di hub logistico fra i più importanti dell’Asia e di centro d’affari fra i più competitivi al mondo, ha resto storicamente Singapore uno dei paesi più aperti al commercio internazionale. Il livello di protezione tariffaria medio applicato sui prodotti importati dall’estero è infatti sostanzialmente pari a zero. L’unica categoria di prodotti sui quali è applicato un dazio all’import sono le bevande e il tabacco, su cui è prevista una tariffa media di appena l’1,7%. Il livello consolidato dei dazi al 2018 è invece stato pari al 9,5% (6,2% per i prodotti industriali e 23% per quelli agricoli). E’ da sottolineare tuttavia come Singapore abbia consolidato appena il 72% delle proprie linee tariffarie, percentuale che scende al 67% nel caso dei prodotti NAMA. Fra essi i livelli più elevati riguardano il comparto tessile, abbigliamento e calzature (10%), seguito dalle macchine elettriche (6%) e mezzi di trasporto (5,3%). Nell’ambito invece degli AMA, le categorie per i quali sarebbero applicabili i dazi maggiori sono le bevande (fino al 210%), cereali (11%), olii e grassi e dolciumi (10%)2. Impatto dei dazi applicati da Singapore sull’export dell’Italia. Le considerazioni espresse in precedenza sul livello di protezione tariffaria applicato da Singapore si riflettono integralmente sull’export dell’Italia. Da un’analisi delle nostre vendite verso la Città Stato effettuata prendendo in considerazione le prime 200 linee tariffarie a 4 digit (che rappresentano oltre il 95% del totale) emerge infatti come pressoché tutti i prodotti made in Italy possano già accedere a Singapore in esenzione di dazio. Gli unici codici gravati da tariffe sono il 2203 (birre di malto – dazio applicato: 70%) e 2208 (Alcol etilico non denaturato – dazio applicato: 1%). Il dettaglio completo dell’analisi è disponibile nell’Allegato in calce. Principali punti dell’Accordo Accesso al mercato. In virtù dell’Accordo di libero scambio, Singapore eliminerà i dazi doganali sui rimanenti prodotti europei ancora sottoposti a tariffe (bevande alcoliche e tabacco) e manterrà invariato l'attuale livello di accesso duty free per tutte le categorie merceologiche già di fatto liberalizzate (cd. standstill). Sul fronte europeo, al momento dell’entrata in vigore dell'FTA circa l'84% delle importazioni da Singapore avranno accesso al mercato comune a dazio zero. Le tariffe rimanenti saranno eliminate nell'arco di 3 anni (quando si raggiungerà il 90% dell’export singaporiano) o 5, a seconda della tipologia di prodotto. Le categorie che beneficeranno della liberalizzazione immediata riguardano principalmente i prodotti elettronici, farmaceutici, petrolchimici e i prodotti agricoli trasformati. I dazi su alcune tipologie di prodotti tessili e tappeti o carne di anatra saranno eliminati entro 3 anni, mentre quelli su biciclette, frutta, cereali e calzature nell'arco di 5.

Per alcune tipologie di prodotti alimentari originari di Singapore e rientranti nella categoria del cd. cibo asiatico (quali ad esempio dumpling cinesi, samosa, salsa sambal) è previsto un contingente annuo a dazio zero di 1.250 tonnellate. Regole di Origine e Catene regionali del valore. Data la natura fortemente integrata del sistema economico singaporiano con le catene regionali del valore, le norme in tema di regole di origine contenute nell’Accordo mirano a raggiungere un equilibrio tra due diverse esigenze: il riconoscimento alle imprese di una certa flessibilità per l'acquisto di componenti da altri paesi Asean e la fissazione di requisiti minimi per il riconoscimento del trattamento preferenziale. In termini generali, per l’ottenimento di tale status, i prodotti europei o singaporiani devo potersi considerare “wholly obtained” (nel caso di risorse naturali, piante e vegetali) o “sufficientemente lavorati o processati” in base alle disposizioni vigenti e alle norme contenute negli allegati tecnici. Per alcune categorie di prodotti (fra essi: derivati dal petrolio, cinghie di trasmissione e riduttori, batterie o microscopi) è previsto il cd. "cumulo ASEAN" che permette di considerare originari di Singapore alcuni componenti acquisiti da altri membri dell'Associazione. L'accordo prevede inoltre ulteriori agevolazioni in tema di cumulo regionale una volta che l'UE avrà concluso nuovi accordi commerciali con altri membri ASEAN. Dichiarazione di Origine. Per usufruire delle agevolazioni previste nell’ambito dell’Accordo, è necessario che le imprese europee utilizzino un’apposita “Dichiarazione di Origine”3. Essa può essere rilasciata su fattura o su qualsiasi altro documento commerciale (riferibile alla spedizione in oggetto) da tutti gli operatori per spedizioni di beni fino a 6.000 €, e da Esportatore Autorizzato per quelle di valore superiore. Dall’entrata in vigore dell’Accordo, le aziende dovranno quindi richiedere lo status di Esportatore Autorizzato, mentre quelle che ne sono già in possesso potranno richiedere l’estensione a Singapore. Standard tecnici e misure fitosanitarie. Come per gli altri accordi preferenziali sottoscritti dall’UE, anche l’FTA con Singapore garantisce il mantenimento degli standard europei in tema di salute, sicurezza e ambiente. Vengono tuttavia affrontate alcune divergenze normative che si traducono in barriere tecniche al commercio su alcuni settori specifici. In tema ad esempio di prodotti elettronici, apparecchiature per la generazione di energia rinnovabile e autoveicoli, UE e Singapore convengono di basare le proprie norme, prescrizioni tecniche e procedure di valutazione della conformità, sui principi riconosciuti a livello internazionale. Ciò consentirà di evitare la doppia procedura di valutazione e i conseguenti costi per le imprese. Per i prodotti farmaceutici e i dispositivi medici, l'accordo promuove inoltre procedure trasparenti e non discriminatorie per l'iscrizione di un prodotto nei rispettivi elenchi dei farmaci, per la fissazione dei relativi prezzi e per il loro rimborso.

Con riferimento alle misure sanitarie e fitosanitarie applicate ai prodotti animali e vegetali, fermo restando il rispetto delle normative vigenti, l'FTA prevede la valutazione dell’efficacia dei sistemi di ispezione e di certificazione delle due parti e non dei singoli prodotti. Collaborazione doganale. L'UE e Singapore si impegnano a migliorare la collaborazione doganale per semplificare, armonizzare e standardizzare le procedure, riducendo così tempistica e burocrazia. L'accordo permetterà di rafforzare la sicurezza della catena di approvvigionamento grazie anche al graduale riconoscimento reciproco di programmi di partenariato commerciale, quali l’AEO europeo. Servizi e Investimenti. Grazie all'Accordo di Libero Scambio, Singapore agevolerà l'attività delle imprese europee che operano nei settori delle telecomunicazioni, servizi ambientali, ingegneria, informatica e trasporto marittimo. Per quanto riguarda i servizi finanziari, le banche commerciali europee potranno aumentare il numero di sportelli presenti a Singapore. In termini generali, UE e Singapore manterranno tuttavia il diritto a stabilire standard di qualità e sicurezza o ad introdurre nuove norme per perseguire obiettivi quali la sicurezza nazionale o la salute e la sicurezza pubblica. L'accordo tutela inoltre alcuni settori considerati sensibili che rimarranno esclusi dal perimetro dell’FTA come TV, radio e cinema, salute pubblica e istruzione, servizi sociali e di distribuzione dell'acqua. Public Procurement. Essendo già membri dell’Agreement on Government Procurement del WTO, UE e Singapore hanno già assunto impegni concreti in materia di appalti pubblici e dispongono di regimi normativi moderni ed elevati standard di trasparenza. Grazie all’FTA le parti convengono di migliorare e semplificare le procedure di appalto e si impegnano ad aumentare il numero di evidenze pubbliche, per quanto riguarda Singapore in particolare nel settore ferroviario e in quello ambientale. Ciò determinerà per le imprese europee un accesso preferenziale ad un mercato del valore di oltre 20 miliardi di €. Tutela dei diritti di proprietà intellettuale. In tema di IPR, l'accordo UE-Singapore consolida i sistemi normativi di cui le parti già dispongono, rafforzandone i meccanismi di controllo alla frontiera. I titolari dei diritti di proprietà intellettuale potranno infatti ricevere assistenza dalle autorità doganali per bloccare merci oggetto di contraffazione di marchi o Indicazioni geografiche, come pure contenuti coperti dal diritto d'autore e disegni registrati piratati. Indicazioni Geografiche. In base all'Accordo, Singapore ha accettato di rafforzare il proprio regime delle indicazioni geografiche creando un sistema di registrazione ad hoc. Una volta registrate, 190 IIGG europee godranno pertanto di livelli di protezione pari a quelli in vigore nell'UE. 48 di esse sono italiane, fra cui: Aceto balsamico Tradizionale di Modena, Bresaola della Valtellina, Prosciutto di Parma e San Daniele, Asiago, Gorgonzola, Mozzarella di Bufala Campana, Parmigiano Reggiano, Grana Padano e Chianti. Sviluppo sostenibile. Così come per gli ultimi accordi di seconda generazione sottoscritti dall’UE, anche quello con Singapore comprende un capitolo dedicato al tema della tutela ambientale e dello sviluppo sociale.

L'FTA prevede ad esempio impegni vincolanti per garantire che i livelli di tutela ambientale e del lavoro delle parti siano in linea con le principali norme e i principali accordi internazionali. L'UE e Singapore convengono inoltre di impedire la corsa al ribasso delle normative in materia di lavoro e ambiente per attrarre maggiori investimenti e si impegnano a promuovere aspetti legati alla responsabilità sociale di impresa, sistemi di garanzia della sostenibilità (marchi di qualità ecologica, commercio equo e solidale) e alla conservazione e gestione sostenibile delle risorse naturali. A tal fine è previsto che anche le parti sociali e le società civili siano coinvolte nell’attuazione dell’Accordo e nel suo monitoraggio.
