    RE: Form 11 Training - Deadlines for Submittal to County Counsel

    Per Board of Supervisors Policy A-5:

    All agenda items involving contracts, agreements, resolutions, or any legal matter must be

    approved by County Counsel prior to submittal to the County Executive Office.

    o This includes County Counsel signature in the margin of the Form 11.o County Counsel signature on any other legal document attached to the Form 11.o Memos from counsel confirming review and approval are not sufficient. Counsel

    signature must be on the actual documents.

    All agenda items needing review and approval by County Counsel must be submitted ten days

    prior to the Executive Office deadline. This means the agenda items must be submitted tenworking days prior to the Executive Office Thursday deadline. However, any accompanying

    Form 11 may be submitted for review and approval five days prior to the Executive Office

    deadline. It is County Counsels preference that the Form 11 be submitted for review at the same

    ti me the underlying agenda item is submitted so as to ensure that the documents are consistent

    with each other. Please see the attached schedule for the remainder of the County Counsel

    deadline dates for 2013.

    When submitting agenda items to County Counsel, please include all attachments and exhibits tothe Form 11. Failure to include al l attachments and exhibits to the Form 11 could delay review

    by our office.

    The deadlines given above are for standard, routine agenda items. Certain items may require

    more detailed analysis, review, research, and/or conferring with multiple departments and

    outside agencies. County Counsel review and approval of those items will necessarily take more

    ti me. Examples include, but are not limited to, EI R resolutions, ordinances or ordinance

    amendments, contracts with other jurisdictions, and complex lease or real property agreements.

    Departments should generally be able to recognize which items potentially require this level of

    review. In these instances, it is best to bring County Counsel into the process early and

    communicate with County Counsel often. I have attached the County Counsel assignment list so

    that you can contact the appropriate attorney with any questions.
