Special Exception & Variance - Amended Statement In SupportLicensed Premises of Licensed Dispensaries of Medical Cannabis - 7123 East Furnace Branch Road,plen Burnie - Maryland Natural Treatment Solutions, LLC
Maryland Natural Treatment Solutions, LLC ("Applicant") proposes to operate a licensedmedical cannabis dispensary ("Dispensary"), as defined in COMAR § 10. 62. 01. 02(B)(13), at7123 East Furnace Branch Road, Glen Bumie, MD 21060, Tax Map 0010, Parcel 0164,Maryland Senatorial District 31 ("Premises"). The Premises, which is approximately +- 0. 86acres, is zoned C-3 and OS. Licensed Premises of Licensed Dispensaries of Medical Cannabisare allowed in C-3 districts by special exception pursuant to Aime Arundel County Code, Article18 ("Code"), §18-11-132 (as amended by Bill No. 21-17). The Applicant will utilize a portion ofthe existing structure, which is approximately +. 5, 184 square feet, for the Dispensary operation.The interior of the Dispensary, and the day-to-day operation, will comply with all requirementsset forth in COMAR §§ 10. 62.27 - . 33 and the Code.
Code, §18-11-132 sets forth the particular criteria for Licensed Premises of LicensedDispensaries of Medical Cannabis, which are permitted by special exception. The Applicantrequests a variance in regards to the 1,000 foot setback, §18-11-132(1), as detailed below. Aspecial exception with variances may be granted, as stated by the Maryland Court of Appeals inDennis Alviani, et al. v. Phyllis Dixon, et al., 365 Md. 95, 775 A. 2d 1234 (2001), where theCode "does not exclude the section covering the relevant special exception from being modifiedby variances. " The applicable Code section for this application is not excluded from beingmodified by variances. The remaining provisions of the Code have been satisfied or will be metby operation.
The special exception requirements for the Dispensary are as follows:
(1) Premises located north of U. S. Route 50 or premises located north of the northeastshore of the South River may not be located within 1, 000 feet of a dwelling orresidentially zoned property, the lot line of a public or private school, or the lot lineof real property owned by the Board of Education.
a. A variance is requested to Code, 18-11-132 (1). There are several apartmentsat 7125 E. Furnace Branch Road, which is located directly next to thePremises and is also zoned C3. It is our position that, although theseapartments have rental licenses from Anne Amndel County, they are illegallybeing rented in violation of the Anne Amndel County Code §18-10-116. ThisCode section requires that the "development shall include commercial usesthat equal at least 50% of the floor area in a C3 district. " Accordingly, webelieve that 7125 E. Furnace Branch Road fails to meet this requirement andthus fails to qualify as a legal "dwelling" within the meaning of the AnneArundel County Code and may not be considered in evaluating the 1,000 footsetback in Code §18-11-132. The next closest property that qualified withinthe meaning of the Code is located approximately 733 feet from the Premises,measuring door to door from the Premises to dwelling at 1128 GrainHighway, Glen Bumie, MD 21060, which is zoned between C4 ("Residential

Dwelling"). Thus, the Applicant is seeking a 267 foot variance from the 1, 000ft setback. The Premises and Residential Dwelling are separated by the four-way signalized intersection at Furnace Branch Road and Ritchie Highway(nine lanes wide), and the nearly 300 foot extension of Furnace Branch Road,which then intersects with Grain Highway.
b. In the alternative, if it is found that the dwellings within 7125 E. FurnaceBranch Road exist legally within the meaning of the Code, then a variance ofapproximately +- 945 feet is requested to the same section and for all the samereasons as stated in subparagraph (a)above.
c. In accordance with Code, §18-16-305(a)(2), exceptional circumstances, otherthan financial considerations, warrant granting a variance to avoid practicaldifficulties or uimecessary hardship. The availability of property in District31 that complies with the Code, §18-11-132, and is not subject to the 1, 000foot setback of subsection (1) is extremely limited.
d. The requested variance is (i) the minimum variance necessary to afford relief;and the granting of the variance will not (ii) alter the essential character of theneighborhood or district in which it is located, (iii) substantially impair theappropriate use or development of adjacent property; (iv) reduce forest coverin the limited development and resource conservation areas of the criticalarea; (v) be contrary to acceptable clearing and relating practices required fordevelopment in the critical area or a bog protection area; nor (vi) bedetrimental to the public welfare. Code, §18-16-305(c)(l)-(2).
(2) Vehicular Access shall be from an arterial or higher classification road.
Furnace Branch Road, Maryland Route 270, is classified as a Minor ArterialRoadway.
(3) "No loitering" signs shall be conspicuously posted in all parking areas.
The Applicant will meet this requirement by operation.
(4) The premises may not be located within one mile of any other licensed premises of alicensed dispensary of medical cannabis.
No other such facilities exist within one mile of the Premises.
(5) The premises may not have any displays of medical cannabis visible to its customersor the general public.

The Applicant will meet this requirement by operation.
(6) The premises may not have an on-site physician for the purpose of issuing writtencertifications for medical cannabis.

The Applicant's proposal satisfies the general special exception criteria at Code, §18-16-304. The Dispensary will not conflict with an existing or programmed public facility, publicservice, school, or road; will be no more objectionable with regard to noise, fumes, vibration, orlight to nearby properties than other C-3 permitted uses; and will be compatible with theappropriate and orderly development of the area.
The Dispensary will meet the public's need for a secure and efficient licensed medicalcannabis dispensary and will in no way be detrimental to public health, safety, or welfare. TheDispensary will meet the need test set forth in Lucky Stores, Inc. v. Board of Appeals ofMontgomeiy County (270 Md. 513, 312 A.2d 758, 1973) in that it will be "expedient, reasonablyconvenient, and useful to the public."
The Premises is partially located within the critical area. The Applicant simply plans torenovate the existing structure and utilize the existing parking lot as they sit today. There will beno disturbance of the critical area.
