Dear Ms. Seay,On behalf of our client, Utz Enterprises, Inc., developer of the above property, and Frank A. Ruff, owner,and in accordance with the attached grading permit comment letter dated July 3, 2019, we are seeking aVariance to Article 17-8-20 1 (a) of the Anne Arundel County Code.

The subject property is known as Lots 6-8 & 23-25, Block C, in the subdivision ofSouthaven, inAnnapolis Maryland 21401, the plat for which is recorded among the land records ofAnneArundelCounty in plat book 10 at page 24 The lot is zoned R2, and is located within a Chesapeake Bay CriticalArea with a designation ofLDA The lot abuts Southaven Drive (an existing 60' unproved public right-of-way) on its southern side, and an un-named, uumproved 20' County right-of-way to the north. In itscurrent state the site is vacant and fully forested, with an isolated pocket of steep slopes along SouthhavenDrive. Per the environmental consultant, See Environmental Services, there are no rare, threatened, orendangered species or non-tidal wetlands present at the site. The site is located in flood area "X" (an areaof minimal flood hazard) as shown on FIRM map number 24003C0229F, dated Febmary 18, 2015.

As shown on the attached Variance & Grading Plan, since steep slopes are located within the southernportion of the site, all proposed development is to occur on the northem/rear portion of the lot. However,given that the existing 20' right-of-way at the northern end of the site is currently unimproved, the use ofthe imimproved right-of-way would require considerable clearing and disturbance, and result in asignificant amount of new lot coverage within the Critical Area. To avoid the additional clearing,disturbance and additional lot coverage within the Critical Area for improvement of the existing 20' right-of-way, the site has been designed to derive access via the currently improved Southaven Drive.

Therefore, we are respectfully requesting a Variance toArticle 17-8-201(a) of the County Code, to allowthe disturbance of 500 square feet of 15% steep slopes associated with construction of the proposeddriveway, as shown on the attached Variance Site Plan. Additionally, all required building setbacks andCritical Area limitations regarding lot coverage and clearing have been maintainetd with the currentproposal. Therefore, it is our professional opinion that the relief requested herein is the minimumrequired for the subject lot, and it is in conformance with the spirit and intent of the County Code.We appreciate your attention in this matter.
