    I am honoured o presen he 2009-10 FOIP annual repor.

    Rapidly evolving echnology is changing he way governmen and oher public bodies work. Te worldhas changed so much in recen years wih he Inerne, ideniy hef and he abiliy o ransmi inormaiona he push o a buton. Social media in paricular has dramaically alered how ciizens obain inormaionand orm opinions. Te need or making sure personal and privae inormaion is proeced has neverbeen greaer.

    As well, here are increasing expecaions or public bodies o share inormaion wih openness andransparency, while also proecing personal and privae inormaion. Achieving ha balance is he key. Herein Albera, our access and privacy legislaion seeks o achieve ha balance. I ensures public access, bu i alsoproecs Alberans personal inormaion.

    Service Albera provides advice and assisance o public bodies on access o inormaion and proecion oprivacy maters and ensures ha personal inormaion o Alberans held by he Governmen o Albera is

    appropriaely secured.

    Provincial governmen bodies have responded o nearly 35,000 requess or inormaion since he Freedomof Information and Protection of Privacy Act(he FOIP Ac) came ino effec and local public bodies haveresponded o over 12,000 requess.

    Significan accomplishmens or he 2009-10 fiscal year include:

    Commenced planning and research activities to support the 2010 review of the FOIP Act.

    Established a new training delivery contract that makes FOIP training more accessible and aordableo public bodies hroughou he province.

    Added a new course to the FOIP training program to assist public body sta with ensuring contractsare complian wih he FOIP Ac.

    Supported the selection of soware to enable government departments to review and releaserecords elecronically.

    Redesigned the FOIP website to provide public bodies and the public with improved access to theFOIP legislaion, publicaions and oher inormaion resources.

    Continued to advise ministries on new legislative initiatives to promote a consistent approach to accessand privacy adminisraion across he governmen.

    In 2010, he Legislaive Assembly appoined an all-pary special commitee o conduc he hird review othe FOIP Act. Te commiee is comprised of members from the Standing Commiee on Health. I lookorward o he commitees recommendaions on improvemens o he Ac.

    As public bodies embrace new echnologies o engage ciizens in meaningul dialogue and o make

    inormaion more accessible, we mus all srive o say a he oreron o he laes developmens and puino place policies and pracices o deal effecively wih access and privacy issues ha arise.     Albertas FOIP Program

    Service Albera provides leadership, sraegicdirecion and suppor o public bodies subjeco he Freedom of Information and Protection of

    Privacy Act(he FOIP Ac). Tese bodies includeprovincial governmen deparmens, agencies,

    boards and commissions, as well as a diverse range

    o local public bodies operaing across Albera.Te role o Service Albera is o ensure haAlberans are able o exercise heir righ underhe FOIP Ac o reques access o records andha hey can rely on public bodies o proecheir personal inormaion.

    Te deparmen provides raining, inormaionresources and proessional developmen or saff inpublic bodies who are responsible or he day-o-day adminisraion o he Ac. Tis ensures heyhave he suppor hey need o run an effeciveFOIP program. Service Albera also keeps aheado new issues and rends, and ensures ha helegislaion keeps pace wih he changing world.

    Effective Legislative Framework

    Te FOIP Ac requires a periodic reviewo he legislaion o deermine wheher anyimprovemens are needed. Service Alberas rolein his process includes providing advisory andechnical suppor o he all-pary commitee o heLegislaive Assembly ha will be reviewing he Acin 2010. Te commitee is mandaed o seek public

    inpu and o make recommendaions or changesrequired o he legislaion.

    A process was esablished a ew years ago o reviewand commen on any access or privacy implicaionsin new legislaive iniiaives. Tis process promoesa consisen approach o access and privacy inlegislaion across he governmen. Te deparmenconsuled wih minisries on 16 pieces o legislaionin 2009-10.

    Learning Opportunities

    Access and privacy is an evolving field and saff areencouraged o paricipae in aciviies ha exposehem o he laes developmens in he field. Regularinormaion sessions were held wih governmen,school board, pos-secondary and municipal FOIPsaff. Tese meeings provide an opporuniy or hedeparmen o convey inormaion abou aciviies

    and or public bodies o share inormaion andsraegies o address common issues. For example,inormaion abou he 2009 amendmens o he

    Personal Information Protection Actwere providedto FOIP Coordinators to heighten their awarenesso he privacy concerns o sakeholders andconracors o public bodies subjec o hePersonal

    Information Protection Act.

    MAKING FOIP

    WORK FOR ALBERTA

    FOIP Quick Facts

    In 2009-10, the Government of Albertaresponded to 96 per cent of access

    requests within 60 days.

    The government has responded to more

    than 34,600 access requests since the

    FOIP Act came into effect.

    Local public bodies have responded to

    nearly 12,500 access requests.

    Expers were invied o give special presenaions

    to FOIP Coordinators on new developments ona range o opics. Albera Jusice and AtorneyGeneral saff provided an updae on issuesand aciviies relaing o he preservaion oinormaion and records or liigaion ande-discovery purposes.

    Te Assisan Inormaion and PrivacyCommissioner gave a presentation on changes tothat oces inquiry procedures that are intended

    Publications and Resources

    Service Albera has over 50 publicaions andresources available o help FOIP saff undersandand apply he FOIP Ac. Tese publicaionsare reviewed and updaed as needed o refleclegislaive amendmens, decisions o heInformation and Privacy Commissioner, and

    policy or procedural changes. For example,several publicaions were reviewed in 2009-10o reflec changes in inquiry procedures a heCommissioners oce.

    wo issues o FOIP News, an elecronic newsleteror local public bodies, were published. Tenewsleter keeps he lines o communicaion openwih all local public bodies, no jus hose able oparicipae in nework meeings. Te newsleterypically highlighs decisions o he Inormaionand Privacy Commissioner that are particularly

    significan or local public bodies. Te newsleteralso includes announcemens abou new andrevised publicaions and upcoming courses,meeings and evens. Te newsleters are availableon he FOIP websie or easy reerence.

    Supporting FOIP Staff

    One of the challenges facing FOIP oces is thegrowing volume o records ha are available inelecronic orma only. Prining hese documenso prepare hem or release o he public is imeconsuming and cosly. In recen years several

    Training Program

    Service Albera offers sandard raining courseson a regular schedule so ha public bodies cansend new saff or FOIP raining. In 2009-10,a new raining delivery conrac was esablishedhrough a compeiive process. Te conracincludes both Edmonton and Calgary-basedinsrucors which makes FOIP raining moreaccessible and affordable o public bodieshroughou he province.

    Te insrucor-led raining program includeshree one-day courses or employees who are

    responsible or FOIP and hal-day courses oremployees who require an overview o he basicconceps o proecion o privacy and access oinormaion. A new course on managingconracs under he FOIP Ac was added ohe program his year.

    Te deparmen also offers an online privacycourse o mee he need or flexible, imelyraining. A new eaure is being added o hecourse o enable public bodies o be noified whenheir saff have compleed a course. Paricipans

    will also receive a cerificae o compleion.

    Te groundwork was laid or a new onlinecourse or public bodies and heir conracors.Once compleed, he course will provide a basicoverview o he conceps o privacy and access oinormaion, wha is expeced o he conracorand is employees, and wha a prospeciveconracor needs o consider when bidding on aconrac wih a public body.

    Cross-Ministry Initiatives

    Service Albera paricipaed in a number o cross-minisry iniiaives involving access o inormaionand proecion o privacy. One o hese was heChild and Youth Data Laboratory, an innovativeresearch iniiaive ha sudies how provincialgovernmen programs can work ogeher oachieve posiive oucomes or children andyouh. A procuremen process was developed orsofware ha will enable improved analysis andreporing o provincial minisry daa.

    Te deparmen also paricipaed in he AlberaChildren and Youth Initiative by reviewingraining maerials and provided inpu on heProvincial Approach o Suden Inormaion(PASI) projec led by Albera Educaion.

    National Initiatives

    Albera coninued o paricipae in a naionalcommitee o ederal, provincial and erriorialgovernmens o promoe he harmonizaion oaccess and privacy legislaion. Te commiteeswork ofen leads o sharing o educaional andoher resources.
