    FIRE PROTECTION, FIRE PREVENTION & FIRE/EMERGENCY CONTROL

    REGULATIONS(Preamble)

    A)These regulations supersede and repeal the ones embodied in Planning &Construction Regulations for Control of Commercial Developments in Jebel

    Ali Free Zone Building And General Civil Work Construction Regulations

    Third Edition 2003 (Chapter 11). They are now published separately as

    part of Health, Safety and Fire Regulations; and hence shall be read in

    conjunction with all relevant provisions [concerning overall authority of

    Trakhees/EHS Division, sanctions & penalties and enforcement etc] of the

    latter.

    B)These regulations provide fire protection planning, design, construction,sustainment, restoration and modernization criteria. They will be

    periodically reviewed, updated and made available to users as part of EHS-

    Fire Depts responsibility for providing fire protection criteria &

    requirements to developers / lessees / licencees.

    C)These regulations are distributed electronically through websites:www.trakhees.ae; www.ehss.ae

    D)These regulations, having the force of law, are effective from the date ofissuance of their current (2010) electronic version / edition; and all

    stakeholders are obligated to comply with them strictly.

    E)Currency of hard/paper copies of these regulations shall be ensured by wayof doing minute checks against their current electronic version.

    Part1

    -Sections

    1

    to

    27

    (Scope)

    1. Theprovisionsoftheseregulationsestablishminimum fireprotectionrequirements/prescriptivecriteria for

    buildings,facilitiesorstructureswithinTrakhees/Ports,Customs&FreeZoneCorporation(PCFC)jurisdiction.

    Therequirements/criteriareflecttheneedfortheprotectionoflifeandpropertywhiletakingintoaccountthe

    assessed risksassociatedwith thebuildings, facilitiesor structures, theircontentsand*permittedactivities.

    (*Refer to Appendix1) and quality assurance includingmanagement of changes (refer to guideline notes

    followedbysection27)andsafeguardsbefore,duringandafterconstruction.

    2. Theprovisionsshallbeapplicabletoallnewandalltypesofexistingbuildings,facilitiesorstructuresandtheircontents and permitted activities whether considered permanent or temporary, mobile & stationary

    equipment,waterfrontfacilitiesandshoreprotectionforshipswithinTrakhees/PCFCjurisdiction.

    3. The provisions shall also be applicable to construction, alteration, repair, equipment, use and occupancy,

    maintenance,relocation&demolitionofanybuilding,facilityorstructureoranyappurtenancesconnectedor

    attachedtosuchbuildings,facilitiesorstructureswithinTrakhees/PCFCjurisdiction.

    4. Theprovisionsprimarilyaddressthoseconstruction,protectionandoccupancyfeaturesnecessarytominimize

    dangertolife&property.

    5. Allprovisionsarebasedalmoston functional requirementsanddonotencompassdetaileddimensionaland

    technicalspecifications.

    6. Theprovisionsaremandatory.Also,allrequirementsplacedhereunderateveryGuidelineNotesandtheones

    containedinAppendicestotheseregulationsaremandatorywithrelationtotheprincipalmattertowhichthey

    standasrequirements.

    7. Theprovisionsshallbeusedconsistentlyasamandatoryreferencedocumentforthedevelopmentofdetaileddocuments (including scope,basisofdesign, technical requirements,plans,designdrawings&specifications

    etc.)bytheconsultingservices,includingthatoffireprotectionexperts/specialists,hiredbythestakeholders.

    Theprovisionsshallnotbeusedinlieuofdetaileddocumentsthatarerequiredtobesodeveloped.

    8. Trakhees/PCFChasadoptedbyreferenceNationalFireProtectionAssociation(NFPA)USAanditscompanion

    Codes,standardsandpublicationsincludingtheirofficialdefinitions,forapplicationoftheirprescriptivedesign

    criteria / requirementswithin Trakhees / PCFCjurisdiction. Accordingly, relevant provisions of themost

    currentNFPAcodes&standardsshallapplynormallytotheextentasprescribed.

    9. AHJ: (a) The term AuthorityHaving Jurisdiction (AHJ) as used inNFPA codes, standards and publications

    referenced intheseregulations indicatestheofficeofresponsibility i.e.EHSFireDepartment,asrepresented

    by itsofficers includingVicePresident/ChiefFireOfficerandhisdeputy forenforcing (i)therequirementsof

    NFPAanditscompanioncodes,standardsandpublications(ii)provisionsoftheseregulations(iii)requirements

    of EHSFireDepartment and (iv) applicable statutes and regulations ofUAE /DubaiGovernment; andVice

    President / Chief Fire Officer of EHSFire Dept is the person who is ultimately responsible to Trakhees /

    PCFC/EHSmanagementfortheenforcementoftheforegoingrequirements,statutes,rules&regulationsand

    forthedeliveryof fire,nonfireandemergencymedicalservices(i.e.ambulanceservices inaccordancewith

    DubaiGovernmentprotocol)withintheoptimumcapabilitiesofavailable resources. (b)VicePresident/Chief

    FireOfficer,cantherefore,reverse,rescindormodifyanyapproval(s)/decision(s)takenandcommunicatedbyanyofficerbelowhisrankincasesuchapprovalordecisionissubsequentlyfoundtobeerroneousontheface

    oftherecord. Nopartyshallbeentitledtothebenefitsofanysucherroneousapprovalordecision&(c)Inthe

    event that a conflict arises on a code application, Vice President / Chief Fire Officer shall make the

    determinationsonequivalencies,variancesandwaiversasapartofhiscodeinterpretation/administration/

    enforcement responsibilities. All such decisionsmade by him shall be final and binding for the concerned

    stakeholders.

    10.Certainrequirementsandrecommendations[thatmaynotbecovered inNFPAcodes/publications/standards]

    thatarenecessarilyrecommendedbytheEHS FireDepartmentonacasebycasebasisshallbecompliedwith

    notwithstandingmerecompliancewithNFPAcodes/publications/standards.

    11.Inthe

    event

    of

    any

    conflict

    between

    the

    text

    of

    the

    references

    cited

    herein

    in

    regard

    to

    NFPA

    and

    its

    companion codes, standards andpublications, the textof the relevantandapplicable codes, standards and

    publicationsshalltakeprecedence.

    12.Omission of any specific references or cross references, in regard to any NFPA and its companion codes,

    standardsandpublications,shallnotrelievethestakeholdersoftheirobligationtocomplyingwithsuchcodes,

    standardsandpublicationshavingregulatoryjurisdictioneffectandforce.

    13.Wherethesituationandthecontextwarrants,thestakeholders,includingtheconsultants,shallbeobligatedto

    gathertheexplicitinterpretationofthewordsofanyprovisionsoftheseregulationsfromEHSFireDept/AHJ

    andnot fromwhat theyprofess it tobewhen theyhave translated their selfassumptionor intention into

    requirements.

    14.Where appropriate relevant and current statutes and regulations of UAE/Dubai Governments shall be

    applicable.

    15.Equivalencies: (a) Equivalencies to any established prescriptive criteria of NFPA and its companion codes,

    standardsandpublications,theprovisionsoftheseregulationsmaybeapprovedbytheEHSFireDept/AHJ,if

    thealternativefireprotectionengineeringdesignprovidesanequivalentleveloffireprotectionandlifesafety.

    Writtenrequestsforapprovalshallincludejustification,hazardanalysis,criteriausedandotherpertinentdata

    (b)Lackof fundsand timedeadlinesofprojects shallnotbeconsidered sufficientjustification fordeviation

    fromtheestablishedcriteriarequirementsandprovisions& (c)Approvedequivalenciesandalternativesshall

    only apply to the specific building, facility or structure involved in extraordinary case where no technical

    alternativesexist;andshallnotconstituteblanketapprovalforsimilarcases.

    16.AbsenceofCriteria: (a)Whena specificapplication isnotcoveredby thecriteriaor theprovisionsofNFPA

    codes, standards & publications; other international building codes, recognized industry standards and

    standardengineeringpracticesshallbefollowedwithpriorandexpressapprovalofEHSFireDepartment/AHJ.

    (b)WhereappropriatetheprovisionofSection 15(Equivalencies)shallapply.

    17.Waivers: (a)Written request forwaiver to any established prescriptive criteria ofNFPA and its companioncodes,standardsandpublicationsorprovisionsoftheseregulationsshallbesubmittedtoEHSFireDept/AHJ

    fordeterminationprior to commencementofbuilding constructions. The same shalldemonstrate that the

    provisions,criteriaorrequirementscannotbetechnicallyexecuted,ortheirexecutionwillincreaseahazardor

    createanewhazardandnotechnicalalternativesexist. Writtenrequestforwaiversshallincludejustification,

    hazard analysis, alternatives considered and other pertinent data (b) Lack of funds and time deadlines of

    projectsshallnotbeconsideredsufficientjustificationfordeviationfromtheestablishedcriteria,requirements

    orprovisions&(c)Waivers,ifgivenexpresslybyEHSFireDept/AHJ,shallonlyapplytothespecificbuilding,

    structure,facilityorprojectinvolvedandshallnotconstituteblanketapprovalforsimilarcases.

    18.Insurance:Thestakeholdersarerequiredtohavetheir landsandpremises insuredagainstFire,ExplosionandPerils.

    19.Existing buildings, facilities or structures: (a) Existing buildings, facilities or structures that meet therequirementsofNFPA101 forexistingoccupanciesdonothavetobemodified tocomplywithprovisionsof

    these regulations, (b) Buildings, facilitiesor structures thatdonotmeet the requirementsofNFPA 101 forexisting facilitiesshallbebroughtup to,at least, theminimumrequirements, includingsprinklerretrofit, for

    existing occupancies, (c) If the facility cannot be brought up to the minimum requirements for existing

    occupanciesandarenovation,modernizationorrehabilitationproject isrequired,thatprojectshallmeetthe

    requirements fornew construction as stipulated in these regulations.& (d) any changes inoccupancy shall

    requirethebuilding,facilityorstructuretomeettherequirementsfornewconstructionforthenewoccupancy

    asstipulatedintheseregulations.

    20.SustainmentandRestoration:(a)Newworkaccomplishedinexistingbuildings,facilitiesorstructuresaspartof

    repair, restoration and sustainment actions /projects shallmeet the requirements fornew constructionas

    stipulated intheseregulations. Sustainmentandrestorationeffortsshall lookbeyondthescopeofworkto

    ensurethatthefireprotection,including lifesafety,featuresarenotbeingcompromisedordesignedonlyfor

    theportion

    of

    the

    building,

    facilities

    or

    structure

    that

    is

    being

    repaired

    &

    (b)

    The

    repair

    project,

    ifpossible,

    shall

    include a basis to support the entire building, facility or structure i.e. if considering providing a fire alarm

    extenderpanel to theexistingantiquated firealarmcontrolpanel,ensure thepanelbeingprovidedhas the

    capabilitytosupporttheentirebuildingfacilityorstructuresothatanyadditionalprojectscanutilizethenew

    panelwithouthavingtoremovewhatwasjustinstalled.

    21.Conversionofuse/changeofoccupancy:(a)Whenanyportionofabuilding,facilityorstructure ismodifiedfrom its current use to thatof an inhabited building, facility, structure forone year ormore, the building,

    facility or structure shall meet the requirements for new construction as stipulated in these regulations.

    Exampleswould include a warehouse (uninhabited) being converted to administrative (inhabited) use; an

    inhabitedadministrativebuildingbeingconvertedto uninhabitedbuilding, facilityorstructure;or inhabited

    building,facilityorstructurebeingaltered,modernized,modified,rehabilitatedorrenovatedandconvertedto

    uninhabitedbuilding,

    facility

    or

    structure

    or

    vice

    versa

    &

    (b)

    When

    any

    portion

    of

    abuilding,

    facility

    or

    structure

    ismodified from its currentuse toanyotheroccupancyuse for two yearsormore, thebuilding, facilityor

    structureshallmeettherequirementsofnewconstructionasstipulatedintheseregulations. Changinggroups

    of occupantswithin the occupancy classification does not constitute an occupancy change. An example of

    modifying from one occupancy to another would include an office building converted tomercantile. An

    exampleofchanginggroupsofoccupantswouldincludeaninstallationpersonnelfunctionoccupyingtheoffice

    spaceformallyusedbyaninstallationcontractingfunction.

    22.DurationofvalidityofFireDeptNOCforbuildingpermit: Iftheconstructionworkdoesnotcommencewithinsixmonthsof issueofNOC forbuildingpermit,a freshNOC is required tobeobtained;and theconcerned

    stakeholdersshallbeobligatedtocomplywithnewrequirements, ifany,asmayberequiredbythecurrent

    changesincodes/regulations.Suchnewrequirementsshallbeincorporated/stipulatedinthefreshNOC.

    23.Offences: Appendix 53 contains the list of offences againstwhich appropriate financial penalties shall be

    imposed.

    24.Accreditation: Accreditationoftheconsultants,contractors,designteammembersand installersofactive&passivefireprotectionsystems,equipment,materialsorproductsthroughcompetentthirdpartyismandatory.

    25.Fakeandcounterfeitmaterials/products/equipment

    (a) Theconsultantsandcontractors shallbesubject to the lawsofUAE& relevantTrakhees regulations for

    supplyandinstallation ofthematerials/products/equipmentandcomponentsorpartsthereofthatare

    not genuine, original or not suitable for the intended purpose. This includes but not limited to the

    materials/ products/equipment that are defective, suspect or fake/counterfeit,

    materials/products/equipmentthathavebeenprovidedunderfalsepretensesandmaterials/products/

    equipmentthataremateriallyaltered,damaged,deteriorated&degraded.

    (b) Fire Dept reserves the right to rejectmultiple /cross listed and private labeledmaterials / products /equipment.

    26.Precedence:Theseregulationsshalltakeprecedenceoveranyconflictingsituation.

    27.If any section, subsection, sentence, clause of phrase of these regulations is, for any reasons, held to beunenforceableforanyreasonwhatsoever,itshallnotaffecttheremainingportionsoftheseregulations.

    GuidelineNotes:

    ChangeManagement

    Efficiency,effectivenessorsatisfactoryperformancesofanyfireprotectionsystemorequipmentondemand

    primarilydependuponadherencetotheirdesigncriteriaandtimelymaintenancethroughoutthelifecycleof

    building/facility. This life cyclemay involve changes in individual stakeholders including owners, tenants,

    management, maintenance staff and designed facility configuration and occupancy. It is, therefore,

    imperative that these changes bemanaged through recognition and adherence to (i) established change

    managementpolicies&proceduresand(ii)buildingfacilitymaintenancemanualsandestablishedprocedures

    fortheapprovalanddocumentationofbuilding/facilityusageandconfirmationattention.

    prevention checklist,method of implementing such fire preventionmeasures (Refer to Part 7 of these

    14. BuildingsServiceandFireProtectioninstallations/fireextinguishingSystemsandEquipment:

    a) Design of new, andmodifications to existing buildings and facilities shall be in accordancewith the

    requirementsof these regulationswhichdescribe specific fireprotectiondesign criteria. Design is to

    incorporateredundantfireprotectionconcepts,employingactivefireprotectionthroughautomaticfire

    suppression and detection systems, passive fire barrier features, and limiting combustible fuel load

    withinthebuildingsinordertocontrolandminimizepotentiallosses.

    Completeautomatic firesuppressionsystemsare tobeprovidedand installed inaccordancewiththe

    applicable NFPAcodes/standards forallprojects (regardlessof fundingsources)where themaximum

    credible fire loss (MCFL)withoutautomatic fire suppressionwould result in the lossofuseofa vital

    structureor

    equipment.

    Inaddition to theabove requirement, fireextinguishingsystemsshallbeprovidedwhere requiredby

    applicableNFPAcodes/standards.

    When the criteria above does not apply, automatic fire suppression and/or detection may still be

    underground main and at the pressure necessary to produce the required sprinkler density over the

    Waterdemandforspecialfacilities,familyhousing,piledorrackstorage,rubbertirestorage,flammable&

    combustibleliquidstorageshallbedeterminedonthebasisofrelevantNFPAcodes.

    v.Water supplypressure requirements: Pressure required for sprinkleredbuildings, facilitiesor structuresshall be themost demanding pressure of the domestic / industrial demand, sprinkler demand or hose

    streamdemandandshallbedeterminedbyhydrauliccalculations.

    vi.Quantities of water required: Requirements for fire protection water storage shall be based on theassumptionthattherewillbeonlyonefireatatime. Thequantityofwaterrequiredshallbeequaltothe

    product of the fire protectionwater demand and the required duration. This quantity represents fire

    protectionrequirementsonlyandshallbeavailableatalltimes. Watersupplyfordomestic,industrialand

    other

    demands

    shall

    be

    added

    to

    these

    requirements

    to

    determine

    the

    total

    amount

    of

    water

    that

    is

    necessaryatthebuilding,facilityorstructure. Thewaterstorageshallbeselfreplenishing. Itshallreach

    vii. Thepumps:Pumpsshallhaveadequatecapacitywithreliablepowerandwatersupply.Theyshallconform

    shall be listed byUL, approved by FM or listed or classified byNRTL. Fire pumps shall be located in a

    detached,noncombustiblepumphouseorlocatedina2hoursfireratedroomwithdirectaccessfromthe

    exterior. A secondary fire pump shall be providedwhen thewater supply cannot support 25% of the

    sprinklersinthehydraulicallymostremotedesignareawiththeprimaryfirepumpoutofservice.

    viii.FireMains: Useof firemains for the services like irrigation,process&domesticpurposes shallnotbe

    permitted.

    PressureRegulating Valves (PRVs): PRVs are restricted in use on fire protectionwater systems.Where

    essential,PRVsshallbeinstalledonindividualserviceratherthanonmainpiping.WherePRVsareprovided

    in distributionmains supplying systems or portions of systems with fire hydrants, automatic sprinkler

    systemsorother installed fireprotection, the following features shallbeprovided to safeguard against

    failuresandtofacilitatemaintenance:

    of

    egress

    kinds, numbers, locations and capacities appropriate to the individual building or structurewith due

    regard to type of occupancy, the capabilities of the occupants, number of persons exposed, the fire

    22.Laboratoriesa) Designoflaboratories shallbeinaccordancewiththerequirementsoftheIBC,NFPA45.

    b) All designs for laboratory spaces shall follow the lab unit approach as defined in NFPA 45. Wherequantitiesofhazardousmaterialsstoredwithin labunitscanbeshowntoalsocomplywiththecontrol

    arearequirementsofNFPA45shallapply.

    c) Wherethequantitiesofhazardousmaterialsand/orthenumberoflabunitsonagivenlevelofabuildingexceedthelimitationsestablished,therequirementsofNFPA45shallgovernthedesign.

    d) InallcasesthesprinklersystemrequirementsofNFPA45shallbefollowedforlaboratories.

    e) Limitationson allowablequantitiesof corrosives, toxic chemicals, andotherhazardous materials,not

    b) AFireProtection/Life SafetyBasisofDesignnarrative shallbeprepared foreach renovationandnewconstructionprojectthataffectsanimalhousingfacilities. Thisnarrativeshalldescribehowthefireand

    lifesafetysystemscomplywithNFPA150.

    c) Means of egress shall be designed to meet the special requirements of animals and/or equipment

    necessaryforegress.

    d) All fire protection designs shall take into consideration the animals ability to reach the equipment,

    potentiallyharmingtheanimalortheanimaldamagingtheequipment.

    e) All fire alarm systems shall take into account theneed for apushbutton that silences the fire alarmnotificationappliancesintheanimalareasonly,butthatactivatesasilentredbeacontoindicatethatthe

    system

    f) Smokeexhaustsystemsshallbeperformancebasedandshalltake intoconsiderationtoxicitylevels,thetemperature,thesmokelayerheightbasedontheanimalbreathingzone,and the risks of exposure to
