Bonne soiree les amis,

Once again, the Webster family has come together for a social

gathering of fun with a purpose Ð an evening dedicated to raising

money to provide our children with the best educational

opportunities possible. We invite you to share in the laughter,

delectable dinner and friendly competition of the evening as we

renew our commitment to the children of Webster.

David Legaspi III custom 7Õ4Ó surfboard featuring the Malibu Pier

Sunset exclusively for our Live Auction Local Artist and Webster

muralist, David Legaspi III has painted a professional surfboard

featuring the iconic Malibu Pier Sunset exclusively for our Live

Auction.

The paint process is unique, using mainly airbrush. The final

polished glassing gives the board an awesome coat of

protection. It is completely surfable, but you may choose to

display this beautiful piece of art.

David has been doing murals now (hundreds) for more than a

decade. His first major school mural is at our very own Webster

school. Back in 1999, Phil Cott gave him the first challenging wall

of his muralist career, the inclined retaining wall behind the

school cafeteria.

AUCTION RULES

1. ALL SALES ARE FINAL, merchandise is sold Òas isÓ and no exchanges or refunds are possible. Webster neither

warrants nor represents, and shall in no event be responsible for the accuracy of the description, authorship, or

condition of the property. Stated values of auction goods and services are appraisals, provided by the donor only, and

are not warranted for tax purposes or for general value. Webster School cannot provide any servicing or guarantee with

the items. Items purchased are tax deductible to the full extend provided by law.

2. All vacation homes, condominiums, resorts and special visits are subject to availability. Reservations must be made

with the donor unless otherwise specified.

3. All transportation and vacation packages are non-transferrable (i.e. to other carriers or hotels), non-redeemable for cash

and non-negotiable for upgrades or substitutions unless otherwise noted. Webster School is not responsible for

increases in transportation, tariffs, fares, room rates or taxes. The successful bidder of a privately owned

condominium/vacation home is responsible for any damage as a result of their stay.

4. Value indicated on restaurant gift certificates excludes tax, service charge, gratuity, wine or beverages, unless

otherwise stated.

5. All Auction items are donations from friends of Webster School and are not returnable. Webster School is not

responsible for the quality of goods or services of the donor.

6. Any inquiries regarding an item are to be directed to the Auction Co-Chairs and NOT the donor of the item.

SILENT AUCTION BIDDING INSTRUCTIONS

1. The Silent Auction bidding will begin at 6:00 pm and close between 8:30 and 9:00 pm.

2. All items in the Silent Auction have bid sheets affixed nearby. Each successful bid must equal or exceed the minimum

increase figure stated on the bid sheet in order to constitute a valid bid.

3. To bid, place your sticker provided with your bid number and the amount of your bid on the uppermost blank line

available on the bid sheet. Bidders must be 18 years of age or older.

4. The last bid entered on the bid sheet before the bid sheet is declared closed constitutes the winning bid and will be

marked by the Silent Auction Official. At closeout time, the Silent Auction Committee reserves the right to place in

live auction or to requested sealed bids on, any item, depending upon the volume of bidding on that item. In any event,

the decision of the Silent Auction Officials will be final.

5. Reserve Items: The Auction Committee reserves the right to withdraw an item from the auction if bids do not meet or

exceed a designated amount (the ÒReserve AmountÓ). Items for which a Reserve Amount (minimum bid) has been

established will be noted on the bid sheets or announced prior to bidding.

PAYMENT PROCEDURE

1. Payment by the successful bidder is due immediately following the announcements of the winners. Payment in full is

mandatory.

2. Payment may be made with CASH, CHECK, AMEX, MATERCARD, or VISA. Checks should be made payable to

Webster School PTA.

3. All sales are final. There will be no exchanges or refunds.

4. All auction items must be removed at the close of the evening. The Silent Auction officials assume no responsibility for

any items left beyond that time.

FINALLY, PLEASE REMEMBER

A bid sheet is not to be removed from its affixed location. Instructions on the bid sheet are final and binding and supersede the

data in the Auction Catalog.

Unless otherwise stated, all auction goods and services must be used or redeemed before the expiration date.

Initial contact is the responsibility of the bidder and should be made within 30 days of the auction. Reservations must be

arranged between the successful bidder(s) and the donor(s) unless otherwise specified.

FULL RELEASE OF RESONSIBLITY: Webster Elementary School, a recipient of the item from its donor, disclaims any

knowledge of or familiarity with the item, except as set forth in the donorÕs description. Purchaser bears responsibility and

fully releases Webster Elementary School from any and all responsibility including, but not limited to negligence, and for all

damages, injury and /or consequences flowing from use of or participation in the item. It is the responsibility of the purchaser

to investigate any and all potential risks of any item or service purchased. Webster Elementary School makes no representation

or warranty regarding any use of the item, not with respect to availability or sufficiency of any insurance coverage in

connection with such use. Purchaser releases and holds Webster Elementary School harmless from such damage and liability.
