NANCE. AN ORDINANCE TO LICENSE PUB­

LIC CARRIAGES, OMNIBUSES. HACKS, CABS, AUTOMOBILES, TAXICABS. AND TO P R E S C R I B E T H E RIGHTS AND DUTIES OF THE OW^NERS AND DRIVERS T H E R E O F . The Common Council of the City

of Ann Arbor ordain: Section 1. Every public carriage,

cab, hack, hackney, coach, omnibus, automobile or taxicab kept, used. driven or employed within the City of Ann Arbor for the transfer of per­sons or passengers from place to place for hire shall be deemed a public ve­hicle within the meaning of this ordi­nance, and no person, persons, firm or corporation shall keep, operate or use any such public vehicle without having first obtained a license there­for fi-om the clerk of the City of Ann Arbor, as hereinafter provided.

Section 2. Any person, persons, firm or corporation of good moral character mny obtain a license for op-orating such public vehicle by mak­ing application in writ ing to the City Clerk, conforming to the hereinafter named requirements, and by paying the hereinafter named fees, and by tiling ix good cind satisfactory bond as hereinafter set forth. Such applica­tion shall be made upon blanks fur­nished by the City Clerk and shall contain the name of the person, per­sons, firm or corporation desiring to operate such vehicle, the location of the place of business of such person, persons, firm or corporation, a de­scription of the public vehicle so in­

tended to be opera ted—that is, whether it be a one or two-horse ve­hicle, or n vehicle driven by othe*' power, and the size and kind of ve­hicle. Such application shall contain the date of the expiration of the li­cense, which shall be upon the first day of May following, except in cases of short te rm licenses, and such appli­cation shall be signed by the owner or owners of such public vehicle.

Section 3. The application set forth in the preceding section shall be ac­companied by a license fee as follows: For any person, persons, firm or cor­poration having a bona fide residence \»'ithin the City of Ann Arbor, five dol­lars ($5.00) each for the first five hacks, omnibuses or other vehicles drawn by two horses, to be used by such person, persons, firm or corpo­rat ion in the conveying of passengers within the City of Ann Arbor for hire, and one dollar ($1.00) for each of said hacks, omnibuses or other vehicles over five owned by the same person, persons, firm or corporation. Fou r dollars ($4.00) each for the first five hacks, omnibuses or other vehicles drawn by one horse, to be used by such person, persons, firm or corpora­tion in conveying passengers within the limits of the said city <for hire, and one dollar ($1.00) for each of said nacks, omnibuses or other ve­hicles over five owned by the same person, persons, firm or corporation. Eight dollars $8.00) each for the first ^en automobiles, taxicabs or vehicles driven by motor power and having a s tandard rated carrying capacity of five people or less, and to be used by such person, persons, firm or corpo­ration for conveying passengers with­in the limits of the said city for hire; and two dollars ($2.00) for each of said auton.obiles or motor vehicles over ten owned by the same person, persons, firm or corporation. Fifteen .-'.oUars ($15.00) for each and every automobile, taxicab or other vehicle driven by motor power, having a s tan­dard rated carrying capacity of not more than ten or less than five peo­ple, to be used by such person, per­sons, firm or corporation in conveying passengers within the limits of the *.aid .city for hire. Twenty dollars ($20 00) for each and every au tomo­bile, taxicab or other vehicle driven by motor power, havint? a s tandard rated carrying capacity to exceed ten people, used by such person, persons, firm or corpoi-ation in conveying pas-.^engers within the limits of said city for hire. The license fee for all such

public vehicles owned by any such person, persons, firm or corporat ion not residing in the City of Ann Arbor shall be double those charged to resi­dent owners. Said license fee shall be for a period of one year, to and in­cluding the first day of May following +he grant ing of said license. P ro ­vided, however, in case said appl icant shall desire only to operate said pub­lic vehicle or public vehicles for a short time, the license fee shall be a s follows: The sum of two dollars per day for each and every hack, omni­bus or other vehicle drawn by one horse; three dollars per day for each and every hack, omnibus or other ve­hicle drawn by two horses or more; five dollars per day for each and every automobile, taxicab or other vehicle driven by motor power, hs.ving a stan­dard rated carrying capacity of five people or less, and seven dollars per day for each and every automobile, taxicab or other vehicle driven by mo­tor power, having a s tandard rated carrying capacity of not to exceed ten or less than five people. Eight dol­lars per day for each and every auto­mobile, lOxicab or other vehicle driven by motor power, having a s tandard ra ted carrying capacity of not to ex-coed ton people. Provided, further, tha t any person, persons, firm or cor­porat ion desiring to tak3 out a license as aforesaia, shall file with said appli­cation a bond in the penal sum of one tl;ousand dollars ($1,000.00), condi­tioned upon the faithful performance of the duties of a common carrier, and of each and every one of the pro­visions of this ordinance, and tha t he, she or they will not run or allow any other persons to run any public ve­hicle not owned by thoni under the license issued on account of this ap­plication, and that said licensee shall pay all fines and penalties which may be imposed upon him for violation of nny of the provisions of t he ordi­nances of the City of Ann Arbor, said bond to be a surety company bond and to be approved by the Common Council of the City of Ann Arbor.

Section 4. Each license issued in pursuance of section two of this ordi­nance shall bear a certain nuniber, and the City Clerk shall deliver to each applicant a plate of a size to be determined by the mayor of the City of Ann Arbor, said "plates to have printed tliereon in legible figures a number, wh>uh said number shall cor­respond with the nuiiibei of the li­cense issued, and said plates to be in duplicate, and said licensee shall

place one of said plates upon each side of c>aic public vehicle in a con­spicuous place. In case such vehicl-3 is sold cr t ransferred, such license shall renrain in force until the expira­tion date thereof; provided, the pur­chaser or subsequent owner thereof shall present said license and the evi­dence of said ownership to the City Clerk within twenty-four hours after said transfer, and permit the City Clerk to note such transfer on the city records, and to endorse the same upon said license, and said purchaser or subsequent owner shall at the same t ime file with the said City Clerk a oond as hereinbefore described, said bond to be approved by the Common Council of the City of Ann Ai-bor, othervv^ise, said license when t rans­ferred shall be null and void.

Section 5 It shall be the duty of every ov/ner or owners of such public vehicle to have none but competent persons not less than eighteen years of age drive any such public vehicle, and such owner or owners shall be held liable and responsible for all acts and doings of such drivers, and for all negligence of such drivers, and for all violations of this ordinance by s a i l drivere, :'.nd no person shall be per­mit ; ed to drive or operate any such vehicle when such person shall be or is in a state of intoxication or under the infiuence of intoxicating liquors.

Section 6. Every public vehicle li­censed under this ordinance, when used at night, shall be provided with a lamp on each side of th^ front there­of, with plain glass fronts and sides, and so placed that it may be seen by any person who may be in front of such vehicle; and such public vehicle shall ei ther have a lamp in the rea / thereof, v/ith a red glass front, so placed tha t it may be seen by any per­son who may be in the rear thereof, or such vehicle shall be provided with said front lamps with a red glass in the rear, and so placed tha t said lamps I'.iay bo seen by one in the rear of such vehicle. Such lamps shall be lighted ai all t imes when said vehicle is upon the streets of the City of Ann Arbor from one hour after sundown until one hour before sunup. ' All vehicles and l:orses used in such busi­ness shall be good ones, and properly suitable and fitted for such business, and when any public vehicle drawn by one or moi-e horses is le.^t s tanding on any day vrhen the t empera ture shall be below forty degrees a b o \ e zero, Fahrenhei t , the said horses shaM be properly blanketed, and no such

public vehicle shall be permit ted to remain upon the street or any public place in said City of Ann Arbor for an unreasonable length of time, nor shall any public vehicle or a horse be permit ted to obst ruct the travel Df any street, avenue or sidewalk, nor shall any public vehicle b^ permit ted to stop fv;r a discharge of passengers so as to interfere in any way with r^arties crossing a public street in the City of / n n Arbor in the paved dis­t r ict a t the usual crossing places.

S-ection 7. No owner or driver of any such public vehicle, while wait ing for employment, shall refuse or neglect, when application is made to him, to convey any person or persons to any place or places within the City of Ann Arbor, and when any person or persons shall be seated in any such conveyance the same shall be driven by the most direct route to the plac^j to which such person or persons wish to go, and not elsewhere, and at a reasonable ra te of ppeed, and no owner or driver of such licensed ve­hicle shall permit any number of per­sons to vide upon such vehicle in excess of two more than the s tandard ra ' ed ca'-rying capacity of such ve­hicle. Temporary or folding seats shall not be permit ted in any public conveyance licensed under this ordi­nance.

Section 8. No owner or driver of any licensed vehicle shall suffer the same to remain in any street, park, alley or other public place without some proper person being present and in ac tual and constant cha^rge thereof; nnd no such person, while wait ing for or t rying to obtain employment, shall snap or flourish his whip or toot h ' s horn, or s tar t up his engines with hw muftler open, or call loudly for pas­sengers, or misrepresent or misstate the owner of any licensed vehicle, or in an> wise purposely deceive anv cus tomer or person asking for infor-ir.ation, or make any solicitation fO'* t r ade a t any other place than imme­diately a t the door or o ther place of en t rance in such vehicle; nor shall he or they be guilty of rudely tak ing hold of any person, or the baggage of an\^ person; nor shall he be guilty of any boisterous, disorderly, improper or un­civil conduct, nor the use of any im­proper language to or in the presence of any person or persons whoinsoever. No person ov persons, unless operat ing or driving a licensed vehicle as heie in provided, shall procure passengers nor chai'ge nor receive any fare for any public corA'eyance. The driver or

owner of any public conveyance, li­censed as aforesaid, may demand and receive for carrying passengers from any place within the city of Ann Ar­bor to any place within the City of Ann Arbor the following prices, and no more, viz.; F r o m five o'clock a. m, to eleven o'clock p. m., thirty-flv© cents; between the hours of eleven o'clock p. m. and five o'clock a. m., fifty cents. Provided, no charge shall be made for carrying chil­dren under s;x years of age when accompanied by a paying passenger, and tha t between the ages of six and twelve years only half fare shall be collected for children accom­panied by a paying passenger. P ro ­vided, tha t for every stop made a t the request of the passenger the own­er or driver may charge the sum of fifteen cents. Each paying passenger shall be entitled to have carried by such conveyance, without charge, any baggage not exceeding fifty pounds in weight, and for each piece of baggage weighing over fifty pounds twenty-five cents may be charged and collected. The time specified in this ordinance is central s tandard t ime.

The owner or owners of every pub-I'c vehicle licensed under this ordi­nance shall post a copy of this section in a conspicuous place in said public conveyance. Copies will be furnished upon appl 'cat ion to the City Clerk.

Section 9. Any license issued pur­suant to the provisions of this ordi­nance may bo revoked and annulled by the mayor or by a majori ty vote of the Common Council of the said City of Ann Arbor at any time for a vio'ation of any of the provisions of this ordinance or a refusal or neglect of the licensee or anyone under his control t( comply with any of the provisions of this ordinance; but such revocation and annul l ing shall not en­title such offender to receive back any portion of the sum paid for such li­cense.

Section 10. Any person or persons, firm or corporation violating any of the te rms of this ordinance shall, upon conviction thereof, be punished by a fine of not to exceed one hundred dol­lars or by imprisonment in the county jail of Wasli tenaw county for a poriOvi of not exceeding ninety days, or by both fine and imprisonment , in the discretion of the court.

Section 11. All ordinances or par t s of ordinances conflicting with this or­dinance are hereby repealed.

Section 12. This ordinance shall take effect and be in force on and

Reports of City Treasurer, Clerk, Engineer and Street Commissioner, for nionth of July, received and order­ed to take usual course.

City Attorney F rank B. DeVine pre­sented permits recei\ ed from the own­ers of land adjoining highway, grant ­ing right of way to city for the purpose of constructing a pipe line for the wa­ter works depar tment from the city to the so-called "Steere Fa rm." The per­mits being received from the follow­ing: Olney J. Belknap and Catherine Belknap, Charles E. Bowling and Esther Bowling, D. C. Chipman and Jane t M. Chipman, Ann East, Richard D. T. Hollister and Jessie Holmes Hol-lister, Ber tha S. Ohlinger, E r n e s t J. Reimold and Hermine A. Reimold, Gustave A. Schenk, Henry Schwab and Anna Magdalena Schwab, James A. Steere, Josephine E. Stimeon, Jul ia A. Thomas and James A. Thompson.

The City Attorney also presented agreements with property owners immediately adjoining the Steere Fa rm, viz.: Anna East, William and Thomas East, Samuel Canby, Gustave A. Schenk, J ames A. Steere; wherein said property owners agreed not to a p ­ply to the courts for an injunction to restrain the city from taking water from the Steere Farm, upon condition tha t the city would furnish them with water in case the pumping by the city damaged their water supply.

Moved by Aid. Lutz, tha t the per­mits and agreements be accepted and tha t the City Clerk be authorized to certify the acceptance on said permits, and that the Mayor and City Clerk sign the agreements on behalf of the city.

sum of one hundred fifty dollars be and the same is hereby transferred from the contingent fund to the park found, for the purpose of repair ing the log cabin at Burns park, in ac ­cordance with Council action August 5, 1918.
