IT’S NOT UNCOMMON at any given time to look at the GNAA job source online and see around a dozen job postings under the maintenance category alone. And unfortunately, it is not isolated to the Nashville market – it’s everywhere. With historic growth in the multifamily sector across the country, hiring managers are finding it increasingly difficult to recruit and keep talented property manage-ment professionals, especially in the maintenance department. According to the National Apartment Association Education Institute (NAAEI), current economic data shows it’s not going to get any easier as the need for maintenance technicians will only increase in the next decade:
• Approximately 35% of U.S. households are renter households, a 4% increase from 2004.
• It is predicted that over the next decade the percentage of renter households is likely to rise by 360,000-470,000 annually.
• The apartment industry employs over 1 million professionals.• The employee turnover rate for apartment maintenance professionals is 35%.• The apartment industry will continue to need new employees for the following reasons: - Replacement of retiring employees - Replacement of employees who leave the industry - Expansion of the number of apartment renters and new apartment development and construc-
tion (after over three years of no new commercial real estate development, currently the only commercial real estate segment significantly involved in new development is the apartment industry)
- Redevelopment of aging apartment communities - Smart growth bringing workers closer to places of employment - Increase in seniors opting for age-restricted retirement or senior communities
February is National Residential Apartment Careers Month, and the National Apartment Asso-ciation’s Education Institute (NAAEI) is working with local industry and affiliates like the GNAA to provide the industry with recruitment resources, and hopefully a new way of looking at the hiring process. They are encouraging managers to evaluate talent more effectively, exploring core compe-tencies and not just looking for previous apartment industry experience. IN OUR LAST ARTICLE, we discussed under what circumstances property management could access the leased premises with the tenant’s consent. In this month’s article, we’ll discuss situations in which a landlord can enter the premises without the tenant’s consent. There are several situations in which the Landlord Tenant Act allows for access by the Landlord, without specifically requiring tenant consent. We will briefly discuss each of them.
1. In case of emergency, which is defined by statute as a sudden, generally unexpected occurrence or set of circumstances demanding immediate action [T.C.A. § 66-28-403(b)]. The words “sudden,” “unexpected,” and “demanding immediate action” must be emphasized. This must be a factual situation that is an actual emergency. The situation should not be based on hearsay, supposi-tion, or any stretch of imagination.
2. If utilities have been turned off through no fault of the landlord, in order to ascertain any damages to the premises and make necessary repairs of damages
resulting from the lack of utilities [T.C.A. § 66-28-403(c)]. This is an entry that limits your actions only to repairs and preventive maintenance, such as frozen pipes and refrigerators and freezers with no power.
3. The law allows access by court order [T.C.A. § 66-28-403(e)(1)]. Court orders such as orders of protection, orders of appointment in probate matters, and search warrants should be and are easily verified with the Clerk of the Court who issued the order. Arrest warrants, as well as after-hours search warrants, generally do not give you the right to grant access to the premises. Warrants for recovery of personal prop-erty, bounty hunters, and investigative probes do not allow us to give access to the unit.
4. If there is noncompliance by the tenant of any of the obligations listed at T.C.A. § 66-28-401 materially affecting health and safety that can be remedied by repair, replacement of a damaged item or cleaning, and the tenant has failed to comply as promptly as conditions require in an emergency, or within fourteen (14) days after written notice by the landlord requesting that the work be done in that time period, the landlord may enter and cause the work to be done in a workmanlike manner and submit an itemized bill to recover the cost of such work (T.C.A. § 66-28-506). Prior to invoking this right of access, remember that the Land-lord Tenant Act allows you to give a fourteen-day, non-curable notice of termination of tenancy as allowed by T.C.A. § 66-28-505. Such a notice of termination of tenancy could offer inspiration enough for the ten-ant to allow access to the premises or, at this point, you may wish for tenancy to be terminated.
5. During any absence of the tenant in excess of seven (7) days, the landlord may enter the dwelling unit at times reasonably necessary [T.C.A. § 66-28-507(b)]. When the Landlord Act was created, this was called the college student “home for Christmas” clause. A good example is a sudden temperature drop that can cause freezing pipes. This clause gives you access to insure that someone has not pulled the circuit breaker for the heat and air unit while away on vacation.
6. If the tenant is deceased, incapacitated, or incarcerated [T.C.A. § 66-28-403(e)(4)]. Remember that this allows you access to the premises. It does not allow you to remove any property from the premises, nor does it allow you to give any third parties access to the premises.
7. Finally, and not frequently used, is the landlord’s right to enter for the purpose of showing the prem-ises to prospective tenants during the last thirty days of a resident’s tenancy [T.C.A. § 403(e)(5)]. Remem-ber, this right must be specifically included in your lease agreement and requires 24-hour advance notice to the tenant.
In all of these situations tenant consent is not specifically required; however, if possible, tenant consent is always the safest way to enter the unit.

THE 109TH GENERAL ASSEMBLY convened on Tuesday, January 13, 2015. Since 1979, the General Assembly has convened on the second Tuesday in January for an organizational session. The organizational session always takes place in an odd-numbered year and cannot last more than fifteen calen-dar days. During the organizational session, the oath of office is administered, rules and schedules are adopted, and the Speakers of the Senate and House are elected.
In ceremonial fashion, the legislature began with the re-election of both Lt. Governor Ron Ramsey and Speaker Beth Harwell to lead their respective chambers. In both legislative bodies, Republicans hold their strongest margins ever with a 73-26 majority in the House and a 28-5 majority in the Senate. In the Senate, three freshman Democrat senators abstained from voting for Lt. Governor Ramsey setting a possible tone of the upcoming Session. Speaker Harwell won unanimously in the House.
Additionally, the House and Senate elected two of the three Constitutional Officers, who stand for election every two years. Comptroller Justin Wilson
and State Treasurer David Lillard were unanimously re-elected for the 109th General Assem-bly. The Secretary of State, the third Constitutional Officer, is elected by the legislature every four years. Currently, Tre Hargett serves as Secretary of State and will be up for re-election in 2017, the first year of the 110th General Assembly.
Following the Governor’s inauguration on Saturday, January 17, Speaker Harwell and Lt. Governor Ramsey announced the new House and Senate committee assignments. In the House, seven new committee chairmen were appointed – four replacing chairmen who served last session, two replacing retired lawmakers, and one to lead a newly created educa-tion panel. In the Senate, the same committee leadership was kept in place as last session. In both chambers, all committee chairmen are Republicans.
The legislature then adjourned until February 2 when Governor Haslam will present his State of the State. Immediately following, the legislature will go into special session for the remainder of the week to debate the merits of the Governor’s proposed Medicaid expansion plan, “Insure Tennessee.” Normal business is expected to resume in regular session on Febru-ary 9 with the bill filing deadline being February 12. The Constitution provides that the leg-islature can meet 90 legislative days in regular session over the two-year assembly period.
Lawmakers are expected to consider several major issues this session. The discussion over business tax revenue shortfalls and high education standards with aligned assessments will both be topics of intense debate. With the passage of Amendment 1 clearing the way for more stringent abortion regulations, legislation has already been introduced to revive and reenact the informed consent statute that was in effect prior to the 2000 Supreme Court ruling. Additionally, Governor Haslam has asked all state agencies to prepare for a 7 per-cent budget cut which could lead to further elimination of state employees and potential fee increases for state services.
