The RFA was posted from November 15, 2017 through November 21, 2017. Pursuant to Section 21.118 of the Broward County Procurement Code, the Protest accompanied by your filing fee was received in a timely and proper manner. For purposes of our response to your protest, the Purchasing Division is only addressing the timely Protest and not the untimely supplemental response from Thyssenkrupp Elevator Corp. submitted on February 21, 2018 at 1:00 p.m. After carefully reviewing the Protest, Broward County's (the "County") responses are as follows: Assertion #1: The County's decision that Eastern Elevator can perform the contract at its unrealistically low prices lacks a rational basis....of counter-evidence. Response #1: The Solicitation contained all general terms and conditions, special instructions, specifications, and requirements to meet the County's needs for elevator and escalator maintenance and repair services. The Solicitation identified the required services for Group 1 and Group 2, and the Solicitation's General Conditions states, "[A]s the best interest of the County may require, the right is reserved to make award(s) by individual commodities/services, group of commodities/services, all or none or any combination thereof (see Solicitation, page 84, #10). On August 9, 2017, the Solicitation opened and all bids were reviewed thereafter based upon all requirements within the Solicitation. The County found Eastern Elevator Service, Inc. ("Eastern") to be the lowest responsive, responsible bidder for Group 1. Upon initial review of the RFA, County's Facilities Management Division's ("FMD") expressed concern about Eastern's ability to perform its services at the offered bid prices and subsequently provided a non-concurrence memorandum as to the RFA. As a follow-up, the Purchasing Division conducted further due diligence by performing a price analysis on several of Eastern's references to determine whether their labor rates for governmental entities were comparable to Eastern's bid for the Solicitation (Exhibit 1). Our price analysis reveals that Eastern's bid submission is within their price range structure offered to Lee County Schools, Hillsborough County, and more recently Miami-Dade County. Eastern's bid prices for the Solicitation fall between Lee County, which has lower prices, and Hillsborough and Miami-Dade counties, which have higher prices. Dear Mr. Goldstein:

The Broward County Purchasing Division (the "Purchasing Division") is in receipt of your protestletter dated November 21, 2017 (the "Protest"), on behalf of your client Thyssenkrupp ElevatorCorp., contesting the Recommendation for Award ("RFA") for Solicitation No. D2114263B1,Elevator and Escalator Maintenance and Repair (the "Solicitation"). The RFA was posted fromNovember 15, 2017 through November 21, 2017. Pursuant to Section 21.118 of the BrowardCounty Procurement Code, the Protest accompanied by your filing fee was received in a timelyand proper manner. After carefully reviewing the Protest, Broward County's (the "County") responses are as follows:
