End of the 3.5 Tonne DerogationTheforthcomingendtothederogationfordriversofvehiclesoflessthan3.5tonnesmaximumpermissiblemassnottoholdavocationaltrainingcertificate(ADRcertifi-cate)massmaymeanthatcarriersofdangerousgoodswilllookforotheravenuesforrelieffromthefullburdenoftheADR.Manycarriersaffectedbythischangetendtobesmallbusinessessothatreleasingdriversforlengthydangerousgoodstrainingimposesasignificantfinancialburden.TherehasbeenapowerfuloutcryfromLPGindustryrepresentativesattheADRcommitteeandattheUNinGenevaabouttheeffectoftheendofthederogationonthemultitudeofsmalldistributorsacrossEurope,whichhassofargoneunheeded. Changes to the Rule for Training of Drivers of Vehicles carrying Dangerous Goods.Currentlydriversofvehicleswithapermissiblemaximummassexceeding3.5
tonneshavetopossesanADRtrainingcertificate.From1
stJanuary2007theexemptionfordriversofvehicleslessthan3.5tonnesex-
pires.Fromthatdatedriversofallvehiclesthatcarrydangerousgoodswillbere-quiredtoholdavocationaltrainingcertificate(ADR).General Training RequirementsSince1999allpersons(notonlydrivers)suchasconsignors,carriers,packersandcontaineroperators,whosedutiesconcernthecarriageofdangerousgoodsrequiresomeformoftraining.Theyhavetoreceivetrainingappropriatetotheirresponsibili-
tiesandduties.Thistrainingisusuallyanawarenesscourse.Theawarenesscoursemustcoverthefollowingsubjects:GeneralAwarenessTrainingFunction-specificTraining&SafetyTrainingDriver Training from 1

Alldriversofvehiclesthatcarrydangerousgoods(wherenoexemptionscanbe
claimed(seepage6foralistofexemptions))mustbeinpossessionofaVocationalTraining(ADR)Certificate.TheADRcertificateisgainedbyattendingapprovedclassroomsessionsandsittingexaminations.

Otherdelegationsstressedthattrainingrequirementshadcausedasignificantin-
creaseintheproductioncostofthetransportofdangerousgoods,andthatinorder
toavoidit,theindustrywasmoreandmoreresortingtousingvehiclesnotexceed-
ing3.5tonnes,whichwereincreasinglyeffectiveinpowerandspeedbutfellshort
ofnumeroussafetyrequirements.
TherepresentativeofItalyproposedthatthedecisiononthisproposalshouldbe
deferred;soastogiveGovernmentstimetocollectaccidentstatisticsandassess
safetyadvantagesinrelationtocost.Afteravoteresultinginequalnumbersfor
andagainst,theproposalwasbyItalywasnotaccepted.
TheWorkingPartyfinallydecidedtoadopttheproposalbyLiechtensteintothe
effectthatalldriversofvehiclescarryingdangerousgoods,irrespectiveoftheper-
missiblemaximummassofthevehicle,subjecttotheexemptionssetoutin1.1.3,
mustbetrainedinaccordancewith8.2.1.Thismeasurewouldtakeeffecton1
January2007atthelatest.
Sowhatexemptionscanbeclaimed,thisisthepurposeofthisbooklet.

Carriage by Private Individuals.
Lookingattheexistingderogationsin1.1.3.1,thefirst[(a)]exemptsthecarriageof
dangerousgoodsbyprivateindividualsprovidedthegoodsarepackagedforretail
sale andthegoodsare:
♦ intendedfortheirpersonal,domestic,leisureorsportingactivities; and
♦ providedthatmeasureshavebeentakentopreventanyleakage.
Withthisexemptionthereisadutyimposedonthegeneralpublictotakemeasures
topreventleakageinnormalconditionsoftransport.
Isitatallreasonabletoexpectthe60millionsubjectsorsooftheQueenintheUnitedKingdomtohavereadtheADRandtobefamiliarwiththisrequirement?
SupposingI,asason-in-law,needtoapartusedcanofflammablepaintthinners
roundtomymother-in-law’shouseforabitofDIYinthebootofmycar.
IsitreasonablethatIshouldbeawarethatIcouldbecommittinganoffenceifthe
topwasnotisnotfullyclosed?I’dbecommittingsomekindofoffence,too,ifI
tooksomeliquidBBQfueldowntotheschoolsummerfêtewithoutthetopon,
perhapsbecauseithadbeenlost,andinsteadtheopeningstuffedwithapieceof
rag(whichcouldproduceacapillaryeffect).
Yes,weallknowthatignoranceofthelawisnoexcusebutreally–toexpectevery-
oneinsuchcircumstancestoreadthe1400pagesofADRand(currently)two
StatutoryInstrumentsontopordinarilymustinfringesomesortofhumanright?
MightIbeinmoredangerfromthewrathofmymother-in-lawifIdon’tdothatbitof
paintinganddecorating?
Whathappenswhensomeonehasahobbyofrenovatingoldvehiclesandcarries
weldinggascylinders.Couldthisbealeisureactivitytowhichderogation(a)
applies?
Anyonecould,intheory,goalongtoacuttingandweldinggasdepotandpickup
somecylindersforprivateuse.Couldonesaythatthegascylinderswere
packagedforretailsaleinthiscaseoristhisstretchingthederogationtoofar?

TheUNModelRegulationsprovideUN3363fordangerousgoodsinmachineryor
apparatus.SuchgoodsarerecommendedforClass9withaspecialprovision
limitingthequantityofdangerousgoodstotheinnerpackagelimitforlimitedquantities.However,theRID/ADRauthoritiesaremindedtoallowamuchmore
generousderogation.IfyouconsulttheRID/ADRdangerousgoodslistyouwill
findthatUN3363goodsarenotconsidereddangerousforrailandroadtransport
inanyquantity,itseems.Thisisfurtherconfirmedbythethirdofthederogations
in1.1.3.1at(c).Anymachineryorequipmentnotspecificallymentionedinthe
ADRwhichcontainsdangerousgoodsmaybetransportedwithoutbeingsubject
toitsprovisionsinanywaysolongasmeasureshavebeentakentopreventany
leakageofcontents.
So,thefirstthingtocheckiswhetherthemachineryorequipmentisspecifically
mentionedintheADR.Ifitis,therulesapplicabletoitstransportwouldapplyas
normal.
Examplesofgoodsforwhichthisderogationcannotbeclaimedcouldincludee.g.
life-savingappliances(UN2990,UN3072),airbaginflatorsorairbagmodules
(UN3268),chemicalorfirstaidkits(UN3316),articles,pressurizedpneumaticor
hydraulic(UN3164)andothers.
ThedecisionoftheDfTin2004tofollowtheADRinregulatingflammableliquid
hydrocarbonfuelsofUN1202upto100oCflashpointhastriggeredaparticular
issuewithrespecttotheuseofthisexemption.
TherearemanymobileelectricpowergeneratorsinservicethroughouttheUK.
Theymaybeneededastemporarypowersuppliesforhospitals,buildingsites,en-
tertainmentvenuesetc.
Theyaredieselpowered,usuallyandhaveafueltank.Thisistypicallylocatedas
abox-shapedtankunderneaththedieselengine.Priortothechangeintheregu-
lationstheirtransportwasoflittleconsequencefordangerousgoods.However
allthatchangedon10thMay2004.

Thefuel,whichcouldbeasmuchas1500litresormorerepresentsasignificant
quantityandpossiblynotthesortofquantitythattheRID/ADRauthoritieshadin
mindtoexemptwhen(c)of1.1.3.6wasdrawnup.
Realisingthis,theDfThasplacedapaperontheagendaoftheJointRID/ADR
meetingaskingforacommoninterpretationastohowfarthederogationcanbe
taken.MyowntakeonthesituationisthattheDfTwouldbeuncomfortableifthe
derogationwereextendedtosuchaquantityofdieselfuelcontainedinthese
mobilegenerators
WhiletheRID/ADRcommitteedeliberatesonthematter,theDfThasissued
guidanceonhowtheexemptionistobeappliedseepage19&20.
Manysuppliersofmobilegeneratorsneedtoprovideanadditionalandseparate
fueltank.Thisleadstothequestionastohowthatfueltankshouldberegarded
fortransport,especiallycoulditstransportbeexemptedinanyway.
Thisquestionleadsnicelyintothenewexemptionwhichwillbeaddedto1.1.3.1
in2007(see(f)onpage13).
White lining and other road construction vehicles
Dedicatedroadconstructionmachineryshouldberegardedasexempt.
Thusvehiclesusedbywhiteliningcontractorsareexemptaslongastheyare
dedicatedforthetaskandnotsimply,forexample,flatbedlorriesthathappento
havetheequipmentonboard.
Similarprincipleswouldapplytomachinerysuchasroadplaningmachines,black
topmachinesetc.

Carriage Ancillary to Main Activity.
Thethirdexemptionin1.1.3.1at(c).
Thisexemptioncoverscarriagebythosethatisancillarytotheirmainactivity,suchasdeliveriesorreturnsfrombuildingorcivilengineeringsites,orinrelationto
surveying,repairsandmaintenanceinquantitiesnotmorethan450litresper
packageandthetotalquantitypervehiclelimitedtotheloadlimitsof1.1.3.6.
Thisisausefullittleexemptiontocoversmallamountsofdangerousgoodstobe
takene.g.fromoneclosingbuildingsitetoanother.
TheexamplesofancillarycarriagegivenintheADRarebriefandcouldbeextended
toincludemanymorebusinessandprofessionsthatleadmetowonderhowfarthis
exemptionmaybetaken.Whataboutadoctororavetonhisrounds?Ifthey
takeanydangerousgoodswiththemcouldthisbe“ancillarycarriage”?
Useofthisexemptionfortradesmensuchasroofers,plumbers,painters&decora-
torswouldseemtobealegitimateuseoftheexemption.ButiftheycarriedButane
asanexamplehowaretheytoknowthatshouldtheyeverattempttocarrymore
thananetmassofmorethan333kg(seePage15onexemptionpertransportunit).
Ihaveseenpick-upvansbelongingtorooferswherethenumberofLPGlarge
bottlesmusthaveperilouslyclosetothislimit.
Iwonderiftheywereawareoftheconsequencesofexceedingthe333kglimit?
Thereisaridertothisderogationwhichisaimedatreducingitsabuse.
Thecarriagemustnotbefortheactualsupplyofthegoodstoausernortointernal
orexternaldistribution.
So,forexample,ifLPGbottleswerebeingsuppliedbyanemployertoplumbersworkingonvarioussites,thederogationcouldnotbeclaimed,onlybytheplumbers
themselvesaspartoftheirtoolsandequipmentforthejob.

Breakdowns
Thefourthderogation[(d)]of1.1.3.1addresses,inparticular,carriageofdanger-
ous goodsbybreakdown vehiclescarryingor towing vehicleswhichhave been
involvedinanaccidentorwherethevehicleshavebrokendown.
Itisimportanttonotethattoclaimthisexemption,thecarriagehastobeperformed
bytheemergencyservicesor,ifnotdirectlyperformedbythem,undertheirsuper-
vision, presumably meaning under escort (or could carriage supervised by
continuousCCTVcameracoveronamotorwaybesufficient“supervision”required
bythisderogation?).
Thisderogationhasbeenrevisedandextendedforthe2007ADRandwillread:
(d) the carriage undertaken by or under the supervision of the emergency
services,insofarassuchcarriageisnecessaryinrelationtotheemergency
response,inparticularcarriageundertaken:
♦ bybreakdownvehiclescarryingvehicleswhichhavebeeninvolvedin
accidentsorhavebrokendownandcontaindangerousgoods;or
♦ tocontainandrecoverthedangerousgoodsinvolvedinanincidentor
accidentandmovethemtoasafeplace ;".
ThesecondindentwhichIhaveputinitalicsshouldbenotedasnewtextallowing
dangerousgoodse.g.whichhasbeenlostfromaloadtoberecoveredseparately
from theoriginalcarryingvehiclebutnonetheless, the “supervision” requirement
mustbecompliedwith.
Saving Human Life or Protecting the Environment.
The fifth derogation [(e)] of 1.1.3.1 dealswith emergency transport intended to
savehumanlivesortoprotecttheenvironmentprovidedallmeasuresaretakento
ensurethatsuchtransportiscarriedoutincompletesafety.Thisisanextremely
importantderogation,ofcourse,butwhatis“completesafety”?Howarecourts
tointerpretthisgiventhedictumthatthereisnosuchthingascompletesafety?

Carriage of Uncleaned, Empty Static or Storage Vessels.
A new sixth derogation*will be introduced into 1.1.3.1 in 2007 as (f) whichwill
read:
"(f) thecarriageofuncleanedemptystaticstoragevesselswhichhavecon-tained gases of Class 2, groups A, O or F, substances of Class 3 or Class 9
belongingtopackinggroupIIorIIIorpesticidesofClass6.1belongingtopacking
groupIIorIII,subjecttothefollowingconditions:
- Allopeningswiththeexceptionofpressurereliefdevices(whenfitted)are
hermeticallyclosed;
-Measureshavebeentakentopreventanyleakageofcontentsinnormal
conditionsofcarriage;and
- Theloadis fixedincradlesorcratesorotherhandlingdevicesor to the
vehicleorcontainerinsuchawaythattheywillnotbecomelooseorshiftdur-
ingnormalconditionsofcarriage.
This exemption does not apply to static storage vessels and tankswhich have
containeddesensitizedexplosivesorsubstances thecarriageofwhich isprohib-
itedbyADR.".
*Therewere two lastminute amendmentsmade tonew (f)at theADRmeeting
May9-12th2006whichhasbeenincluded.
Asyoucansee it isanewandmorecomprehensiveexemptionthan thecurrent
derogationwhichisonlyforgasstatictanksonly. Ifastaticorstoragevesselis
tobetransportednominallyemptywithresiduesofanyoftheclasses,groupsand
packinggroupslisted,providedthecarriageconditionsareobserved,suchstaticor
storage vessels may be transported without the application of the relevantprovisionsofADR.Notethattherearenocapacitylimitssetforthestaticorstor-
agetankssothattheycanbeaslargeasyoulike.

This derogation opens up the possibility of the fuel tanks for generators to be
transportedseparatelyoralongsidethemobilegeneratorstoandfromsites.
Itopensupthepossibility,too,fortheDfTtoabandonthemoreterseexemptionfor
storagetanksatregulation5(14)ofSI568/04.However,thereisasting-in-the-tail.
At its most recent session the WP.15 ADR committee decided that a static or
storage tank is one whichwasoriginally designed for the storage of dangerous
goodsratherthanfortheirtransport. Theydecided,therefore,thatthederogation
cannot apply to the carriage of transport equipment such as IBC’s or tank-
containers,which,notfulfillingtheprovisionsofADR,aresubsequentlyintendedfor
storagepurposes.
GiventhisinterpretationhandeddownbyADRitseemstomethattankswhichare
usedfortemporarystorageoffuelse.g.formobilegeneratorscouldnotbeconsid-
eredtobestaticorstoragetanksandwouldeitherhavetobefullycleanedofall
residuesfortransportorbesubjectedtothefullweightofthetankdesign,construc-
tion,inspection,testingandcertificationrequirementsoftheADRif(1)“newtanks”
or(2) transportedunder theprovisionsofSchedule1ofSI568/04 or, (3) ifsmall
enough,betransportedundertheAuthorisationsforexistingBowsers.
Tobeastorageorstatictanktowhichnew(f)couldapplytherewouldneedtobe
somemoredefinite signsofpermanence ofdesign such asa clearly observable
baseandmaybeconnectionsandpipeworkofamorepermanentkind,Isuggest.

Limited Quantity
LimitedQuantities(LQ)referstosmallreceptacles(typicallyofthesortthatgointo
theretaildistributionchain)whicharepackedinboxesoronshrink-wrappedtrays.
TheprinciplebehindLQisthatanacceptablelevelofsafetyisassuredproviding
thereceptaclesareinaboxorshrink-wrappedtray.Individualreceptaclesdonot
comeintotheLQcategory.Regulation7(4)(asamendedin2005)allowsretaildis-
tributionofLQpackagesthathavebeen"brokendown",subjecttocertain
conditions.
Forlimitedquantityexemptions,thegeneralrequirementsforpackaging(tobeof
goodqualityandsuitableetc)apply,butthepackagingdoesnothavetobe"UN
approved".EachLQcategoryhassomepackagingconstraints(ADR3.4.3to
3.4.5)andthereareparticularlabelingrequirements(seeADR3.4.4(c)).Within
theseconstraints,ADRdoesnotapplyto"limitedquantities".

underADR).Theyconsiderthistobeusefultotheemergencyservices.
Ambulances,mobileworkshops,engineer'svansandroadconstructionvehicles
areexampleswherehazarddiamondsareoftendisplayed.

DFT DANGEROUS GOODS GUIDANCE NOTE 11: DANGEROUS GOODS IN
MACHINERY OR EQUIPMENT - MEASURES TO PREVENT LEAKAGE
NOTE: This Guidance Note is only intended to give helpful advice. It should not be inter-
preted as a substitute for reading the Regulations.
Background
Regulation 3(6) of the Carriage Regulations applies the RID and ADR exemptions of sec-
tion 1.1.3 to domestic carriage. Sub-section 1.1.3.1(b) exempts –
“the carriage of machinery or equipment not specified in this Annex and which happen to
contain dangerous goods in their internal or operational equipment, provided that meas-
ures have been taken to prevent any leakage of contents in normal conditions of carriage;”
Measures to prevent leakage
This exemption covers a wide range of machinery, some of which may only be moved
very occasionally. The following guidance on measures to prevent leakage also in-
cludes a number of mandatory requirements from the Management of Health and
Safety at Work Regulations 1999 (MHSWR).
Risk assessment
Regulation 3 of the MHSWR requires all work activities to be risk assessed. The assess-ment should be suitable and sufficient and be carried out by a competent person who has

Design of machinery and equipment
The machinery and equipment should be robust enough to hold dangerous goods during
the normal conditions of carriage. The manufacturer should be able to provide advice.
Quantity of dangerous goods
Keep the quantity of dangerous goods as low as practicable.
Preventing leaks
All openings, with the exception of pressure relief devices (if fitted), should be properly
closed and secured to prevent opening and leakage during carriage.
