Growing oranges, grapes, peaches or any other crop isn’t just a matter of putting seeds in the ground and watching plants grow.

Beyond the work, water and other resources that go into suc-cessfully raising crops, an enor-mous amount of science goes into ensuring fruits and vege-

tables grow to marketable sizes, avoid diseases, fend off invasive insects and survive rough weath-er conditions, to name a few.

But once crops are harvested, packed and sent off to market, the need for science to protect them doesn’t end. A company called AgroFresh has come to Fresno to help with that.

Plans to relocate Club One Casino to another Downtown Fresno location suffered a major blow when one of the businesses involved pulled out of the deal with the city last week.

But that doesn’t mean the deal is dead, as Kyle Kirkland, the casino’s owner and CEO, said in a recent interview it’s his intention to “regroup, meet with the city some time in the next couple of weeks and figure out if we can continue with that.”

In December 2018,  the Fresno City Council agreed to sell to Club One and its development partner, Brixton Capi-tal for $1.7 million, what is commonly referred to as the “Spiral Garage,” at 830 Fulton St., along with 50,040 square feet of former retail and office space — for-merly part of the downtown Gottschalks department store.

The office and retail space has been vacant since 1988, when the depart-ment store pulled up.

The two properties are also located a couple of blocks south of Club One, which had planned to move into the former Gottschalks property and con-vert it into a larger casino and enter-tainment center.

Kirkland clarified that Brixton was going into this as a development part-ner, meaning it would have bought the buildings and Club One would have leased it, so Brixton wouldn’t have been a financial partner with stakes in the ca-sino and parking operations.

No money had changed hands yet, and the city and the partners had only a disposition and development agree-ment (DDA), with the purchase of the buildings’ at their combined assessed values coming later.

That came to an end July 15, when Brixton sent an email to the city stating that it “is not going to be proceeding on the acquisition of this property.”

While Brixton expressed confidence that Club One could make a successful go of the move, the email didn’t’ express the company’s reason for pulling out of the venture, and a Brixton official con-tacted declined to disclose it.

For his part, Kirkland speculated that development of a card casino may have been too outside the Solana Beach real estate investment firm’s development experience.

Still, he said, he’s going forward with plans to get into a larger space, so Club One could offer more bar and restau-rant space, along with more space to hold special events that could include seminars, conventions, concerts and other large gatherings.

The new casino would be off Ful-ton Street, allowing it to be part of the growing restaurant and nightlife scene,

as well as being an attraction drawing customers to the area, which Kirkland said would benefit all businesses on the block.

Kirkland acknowledged that the es-timate for converting the building and reworking the parking garage to hold more cars could end up costing up to $3 million more than the $13-$15 estimate Kirkland had last year.

He said the estimate change isn’t the result of structural problems, as initial inspections indicate the buildings are in good shape. The problem is that con-struction costs have risen considerably over the last several months, jacking up the cost.

“There’s no real change in our vision for it. It’s probably a little more compli-cated, expensive than we’d hoped.”

But what comes next may end up be-ing more complicated. Kirkland and Brixton approached the city about buy-ing the downtown buildings, so the city didn’t request other bids on it.

Whether the city would require bids or stick with its development agree-ment is unclear, and it’s also unclear if Club One and a new development part-ner would have to start the process over from square one or not, as city officials couldn’t provide that information by press time.

“I think the city needs to do what it thinks is best for its process and the area,” Kirkland said. “ It’s my sense that … we’d have to renegotiate or have an-other agreement with the city to do that.”

Even with the cost to renovate the buildings now estimated at nearly $18 million, he said he still wants to go for-ward with the deal.

“I think the idea is we have to come back with another partner and say, ‘Hey, listen, this is what we think it looks like. There’s no real change in our vision for it. It’s probably a little more compli-cated, expensive than we’d hoped.

Kirkland believes city leaders will continue seeing this as a good deal.

“Knowing what I know about the building and our plans for it, I think what we were proposing is a very excit-ing, transformative project that has real value in terms of employment, local taxes, traffic in the area, and entertain-ment. I’m comfortable that we would still be a very viable competitor for that property.

“We have been downtown 24 years, we have a real use for it, and — as I have said repeatedly — we’re willing to work with the other people in the neighbor-hood to make sure it works for every-body,” Kirkland added."

A Fresno law firm will see its list of services expand with the addition of three new attorneys — two of whom have joined as partners.

The firm, Whitney, Thompson & Jeff-coach (WTJ), brought on Carl R. Refuer-zo, Courtney McKeever and Anna Bar-cus Allen last week, with Refuerzo and McKeever receiving partnership status.

According to Tim Thompson, partner for Whitney, Thompson & Jeffcoach, the firm had been in talks with them for the past few months. Primarily dealing in business litigation, Thomp-son explained that the three attorneys (coming from Baker, Manock & Jensen) add their expertise in business transac-tional work to the WTJ portfolio. This means a broader scope of service for clients.

“What adding Carl, Courtney and Anna does for us is it gives us a trans-actional practice, as well as helping our existing clients,” Thompson said. “And also, they’ve brought in clients that they’ll continue to service on transac-tional business matters.”

The firm was founded in February 2018 by Thompson, Marshall Whitney, Mandy Jeffcoach and Niki Cunning-ham, all four of whom where previ-ously partners at McCormick Barstow. Their clients include family-owned businesses, Fortune 500 companies, accountants, lawyers, physicians, land-owners and other professionals.

DeYoung Properties is rallying for supplies and donations as it gears up for show time next week.

For the second time in 10 years, De Young has been selected to build a home for “Extreme Makeover: Home Edition.” At the Centennial Plaza in Old Town Clovis, the homebuilder held a pep rally during last Friday’s farmers market. While there, they raised funds and help with the 2,000-plus meals that will be served on the job site.

So far, volunteers from Pardini’s Catering, Valley Wide Beverage, Westwoods BBQ, Guadalajara Mexican Restaurant, Riley’s Brew Pub, Chick-Fil-A, DiCicco’s Restaurant, Sam’s Italian Deli, Heirloom, Me ‘n Ed’s and Dog House Grill have already

committed to help feed the volunteer work force, but 400 meals are still needed. Saladino’s Foodservice also made a donation at the rally for food and cold storage.

“We are in need of food and donations,” said Brandon DeYoung, executive vice president of DeYoung Properties. “The army of volunteers needs over 2,000 meals on the job site.”

Candidates for the home are currently being vetted for selection, and the lucky family will be revealed on July 30 when the show’s new host, Jesse Tyler Ferguson of “Modern Family,” knocks on their door. The goal is to have a new house built within a week of the knock.

When it comes to finances, the difference between success and failure is often the ability to main-tain a positive cash flow. We have this goal in our everyday lives: we seek to earn enough to pay the bills each month while saving strategi-cally for long-term investments that will fuel future growth. The same is true for a business. If you are thinking about becoming a small business owner, know going in that your cash flow needs to be a top priority. Here are a few simple steps you can take to help maintain a positive cash flow:

•Invoice on a timely basis. It isn’t unusual for some business owners to take their time sending invoices, which can seriously hamper cash flow. You might want to specify a certain day of the week or a couple of days during the month as your days to issue invoices. Or commit to taking care of it immediately af-

ter a sale is made or work is com-pleted. You can even ask for a down payment up front, a particularly important practice if you incur out-of-pocket expenses to com-plete the job. If sending invoices and following up is taking up too much of your time, consider hiring an accountant or implementing an online service or mobile app.

•Set clear terms for payment. There is no hard and fast rule for what your terms must be. Many small business owners request pay-ment upon receipt of an invoice, or within a specified number of days. The important point is to find what works for your business model and clearly communicate it to clients (ideally in writing). Also, create a repeatable system for following up if payments are not received on time.

•Track expenses. The downfall for many businesses, particularly in the early months of operation,

is a failure to keep spending in check. While it may be necessary to spend to get your business off the ground, create the habit of record-ing all expenses and keep an eye on your overall spending pattern. And, keep your business accounts separate from your personal ones so that you have a clearer line of sight into your cash flow.

•Be cautious with debt. Many startups or smaller businesses fi-nance activities through bank loans or by building up credit card debt. The latter, in particular, is an expensive form of financing that could impact your personal finances fairly quickly if not used responsibly. If you’re unsure about how to finance or move forward with your business, consider con-sulting a business coach or finan-cial advisor.

•Minimize credit to customers. Depending on your business, some customers may seek to make their

purchases on credit. If you deter-mine that this is workable for your business model, be diligent in as-sessing the customer’s ability to repay you on a timely basis and fol-lowing the terms you set up in step #2 above.

NONPROFITSPINC gifts record amount to Fres-no organization

Philanthropy Inspired by the Needs of the Community (PINC) has set a new orga-nizational record for fundraising.

On Tuesday afternoon, PINC surprised Debra Rush, founder of Breaking the Chains, with a total donation of $150,000, which will go towards supporting the re-maining construction of a new 24-hour Rescue Center project, and assist in pro-viding food, shelter, education, readiness and preparation, job placement, com-prehensive case management, addiction counseling, and numerous forms of ther-apy.

Breaking the Chains is a local nonprofit dedicated to helping juvenile and adult survivors of human trafficking. Rush her-self is also a survivor.

“We all have heard about human traf-ficking, but to know and understand this is happening in our own backyard here is terrifying,” said Ashley Webster, president of PINC. “Girls just like me at the age of 33 and as young as 5 years old are get-ting kidnapped and forced into this night-mare.”

Funds were raised through PINC’s June 22 fundraising event, “PINC-Royale,” which was held at Holy Trinity Armenian Church in Downtown Fresno. This was the 11th event done by this non-profit organization that serves other non-profits. Last year, the organization raised $120,000 for the Valley Children’s Healthcare Oncology/So-cial Services Family Help Fund. This years it was Breaking the Chains’ turn. Present guests included Fresno Police Chief Jerry Dyer and Fresno County District Attorney Lisa Smittcamp.

Webster attributed much of the event’s success to strong sponsor support from local businesses, signature live auction items like trips New Orleans and New York, and support from the community and the hard work of the PINC members. Items up for bid also included “Pinky,” a 10-week-old black Labradoodle who went for $5,500.

“The monies raised by PINC will make so much more than a ripple in the fight to combat human trafficking,” Rush said. “It will make an impact that will be felt for de-cades to come.”

DISTRIBUTIONAmazon hosts ribbon cutting

Something made of paper is the tradi-tional gift on a first anniversary, but what do you give for a 13-month anniversary?

Whatever it is, there’s a good chance you can order it from the Amazon Fulfillment

Center, which celebrated its 13-month an-niversary Wednesday.

Technically, the event is a ribbon-cutting ceremony to celebrate the opening of the 855,000-square-foot fulfillment center that opened in June 2018.

Fresno Mayor Lee Brand, who frequently notes the substantial benefits of having Amazon here as a key factor in getting to his goal of bringing 10,000 new jobs to the city during his term, will be among the dig-nitaries expected to attend.

The number of year-round and sea-sonal employees at the fulfillment center currently is more than 2,500, about 1,000 more than anticipated during the plan-ning process for the massive facility at 3575 S. Orange Ave.

Plans are to convert a few hundred seasonal workers — most brought on dur-ing the Christmas period and other times when online orders get heavy — to full-time status, said Ankush Pole, general manager for the site.

The Fresno facility is one of 110 Amazon fulfillment centers in the U.S. While the one here is among the largest, 20 are a 1 million to 1.2 million square feet in size, such as the one in Tracy.

The Fresno center opened with just 75 people, and in a few months ramped up to the original hiring goal of about 1,500, and now has more than 2,500, which is pretty much Amazon’s hiring capacity there.

If there is a need to increase Amazon’s local distribution services, Pole said that may lead to building a second facility, though he wouldn’t speculate if or when that could happen.

ENVIRONMENTNewsom signs water bill

State Sen. Melissa Hurtado’s first major piece of legislation was signed into law Wednesday.

Gov. Gavin Newsom is visiting the Cen-tral Valley this week to sign SB 200, which guarantees funds up to $130 million to communities to provide clean water — a cause Hurtado championed throughout her campaign.

“Today’s signing of SB 200 marks a significant milestone for California,” said Hurtado in a press release. “Growing up in the City of Sanger, I, along with my fam-ily and friends, encountered firsthand the challenges of limited availability to clean and affordable drinking water. Unfor-tunately, nearly one million-plus people continue to share that experience includ-ing our most vulnerable rural communities throughout the Southern Central Valley.”

Newsom signed the bill in the Sanger area, visiting with families afterward.

RETAILNewsom stops at the Cosmo

The Cosmopolitan Tavern in Downtown Fresno hosted Gov. Gavin Newsom Tues-day night during his trip to sign new water legislation near Sanger.

According to a Facebook post Wednes-day morning that appears to have been removed, Newsom took a picture with Cosmo Executive Chef and Owner Joe Lan-franco.

The Lanfrancos have had an at-times contentious relationship with state bu-reaucracy. In 2016, the original Cosmo location had to move to its current home near Selland Arena due to the high-speed rail project.

That wasn’t lost on some people leav-ing Facebook comments, ranging from congratulations to disdain for some of the governor’s policies.

“Our feeling is no matter which party you belong to, having the governor of the state choose to come to your restaurant in downtown Fresno of all places is kind of an accomplishment,” Lanfranco said in the post.

Lanfranco had noted for a previous story about dinner service in Downtown Fresno that the move had actually been good for business, placing the restaurant in a more prime location.

‘Tween’ retailer coming to Fashion Fair

Tenant improvement work has begun on the latest Five Below store in the Cen-tral Valley — this one at Fashion Fair Mall in Fresno.

The store will be located in the former Charming Charlie space, reported The Fresno Bee.

The tenant improvement is valued at $166,880, according to a construction per-mit from the City of Fresno.

Five Below specializes in selling items $5 and under and is billed as a “tween and tween value retailer.” Bolstered by strong sales, Five Below is on a building spree, with plans to open up to 150 new stores in fiscal 2019. It opened 125 new locations last year, and currently has about 750 stores in

33 states.The Valley’s first Five Below store opened

in March in Visalia. The Business Journal has also reported on additional locations planned for the Marketplace at El Paseo and River Park shopping center in Fresno.

TRANSPORTATIONClovis Transit offering free rides

Clovis Transit will be offering free rides for the month of August on its Stageline and Round Up bus services for the first time in its 40-year history.

Stageline is a traditional bus service that runs on set routes. Round Up is a point-to-point service transporting riders with dis-abilities from home or work to a location of their choice and back again.

Registered Round Up customers simply must make an appointment to receive their free ride.

Clovis Transit hopes to expose more potential customers to its service, which it bills as featuring “vehicles [that] are clean, well maintained and air conditioned,” driv-en by “experienced, friendly drivers whose priority is to get you to your next stop safe-ly and on time.”

“We are excited about offering rides with no fares during the month of August,” said Bethany Berube, Clovis Transit super-visor. “This opportunity not only provides a considerable financial savings to our regular customers, but it is also a great in-centive to those who have not yet tried our services.”

The month of free rides is possible thanks to a $50,000 California Climate Investments grant, as part of the Low Carbon Transit Operations Program. The grant was established in 2014 by the California Legislature in efforts to reduce greenhouse gas emissions and improve mobility.

Any remaining funds at the end of Au-gust will be used for free ride days in the fall.

Typical Stageline and Round Up fares are $1.25 one-way. Round Up trips to Fres-no range from $2 to $2.75.

The free rides begin Aug. 1.

focused on the quality of fruits and veg-etables and some ornamentals from the point of harvesting to the time it makes it to retailers,” said Dan MacLean, global innovation research and development director for AgroFresh, which in April leased office space at 4140 N. Brawley Ave., turning 5,600 square feet into a lab and office space where field repre-sentatives and researchers study local crops and develop ways to better get them to market fresh and extend their shelf lives.

When successfully done, packers, shippers and grocers have less wasted food that has to be thrown away due to mold, rot, etc., while the fruit and veg-etables consumers buy stays fresh a day or few days longer, MacLean explained.

There are a lot of factors working to damage those commodities, from natu-

ral deterioration to the effects of weath-er to exposure to fungi.

“When you pick a product — a fruit or vegetable — it’s got a finite lifespan. It’s not going to last forever,” MacLean said. “We have a challenge to cool it and get it to the market — from here to Sacra-mento, or if it is from here to Philadel-phia, or if it’s from here to China — so it doesn’t show up brown or mushy or fuzzy.”

As for solutions, they can range from applying waxes and other coatings to gaseous treatment to using antimicro-bials, to designing or chemically coating packaging that can slow the deteriora-tion process or protect the commodi-ties from fungi.

Such solutions aren’t one size fits all, said MacLean, noting that a solution to extend the freshness of blueberries probably will not work for lettuce. Ge-ography may also affect potential solu-tions, even on the same crops, so treat-

ments for oranges grown here may not work for oranges from dryer or more humid parts of the country.

So AgroFresh, which began opera-tions here about a month ago with a limited staff, is working directly with client growers, packers, shippers and retailers to research the longevity issues affecting their specific crops, develop-ing solutions and selling them to the clients.

“We can tailor those technologies to the unique needs of the customers,” MacLean noted.

“The core of our business and what we were founded on is an ethylene management tool,” he said, explaining that ethylene is a hormone-based gas naturally produced by plants that rip-ens them but also adds to their rate of decay.

“And we have a technology that con-trols that rate of ripening and greatly controls the shelf life,” he added.

Solutions include a gas to which harvested fruits and vegetables are exposed to, and another using chemical box coat-ings to counter the ethyl-ene.

The Philadelphia-area company started about two decades ago and has grown to include three U.S. research-and-devel-opment facilities in Fres-no; Yakima, Washington; and Springhouse, Penn-sylvania, along with ad-ditional ones in Spain, Italy, Chile and Australia. AgroFresh also contracts with labs in other parts of the world.

Since its start, Agro-Fresh also has increased the scope of its work, expanding beyond eth-ylene to address other issues affecting freshness and longevity.

MacLean said all of AgroFresh’s facilities are located in agricultural regions, which is why the company opened one here.

And while it isn’t fully staffed yet, the plan is to have enough researchers and field representatives so that all of California’s farming regions can be served.

“We want to be able to connect with them, understand their needs in the post-harvest quality challenges, and we can draw on our portfolio of solutions and make recommendations,” MacLean said.

AgroFresh had operated a lab in Davis but decided to relocate it to Fresno.

Its central location in the state was a big part of the reason.

“It’s really in the heart of all of the production. You know, within two to three hours you can get to everything from avocados to stone fruit and berries and cold crops on the coast,” MacLean said.

“It was important at this time in our company’s growth to be closer to the in-dustry.”

(AP) — Insurance companies contending that Pacific Gas & Electric owes them more than $20 billion from wildfire claims want to take over the California utility and pull it out of bank-ruptcy.

The insurers filed court doc-uments Tuesday to end PG&E’s exclusive right to file a reorga-nization plan. They want the right to submit their own plan to wildfire victims and other PG&E creditors.

Their request came ahead of a Wednesday hearing at which a bankruptcy judge granted a two-week period for California officials to develop a way to evaluate competing bids to re-structure the utility.

PG&E filed for bankruptcy in January to deal with an esti-mated $30 billion in liabilities from wildfires its equipment may have ignited in 2017 and 2018, including the wildfire that largely destroyed the Northern California town of Paradise and killed 85 people.

The insurers have said the utility owes them about $20 billion in reimbursements for wildfire claims. Under their plan, many of their claims

They are seeking to invest more than $30 billion, which would give them a major-ity stake in the company. The bondholders said they would set aside at least $16 billion of their investment into a trust to pay claims arising from the 2017 and 2018 wildfires.

The stakes surrounding PG&E’s bankruptcy exit plan intensified after Democratic Gov. Gavin Newsom signed a

law on July 12 requiring major utilities to spend at least $5 bil-lion on safety improvements and creating a fund of up to $21 billion to help pay out future wildfire victims.

The fund is aimed at finan-cially stabilizing the state’s three largest investor-owned utilities: PG&E, Southern Cali-fornia Edison and San Diego Gas & Electric.

The law says PG&E can’t ac-cess the financing mechanism unless it gets out of bankruptcy by the end of June 2020.

with state utility regulators, said they will ask the judge Wednesday to establish a time-line and process for the bid-ders to submit their proposal.

Legal advisers for Newsom and the California Public Utili-ties Commission said they want to encourage an organized, competitive process to achieve the best results for the state.

“All offers out there should to be brought to the table, and given a fair and transparent opportunity to compete,” said Nancy Mitchell, an attorney ad-vising for Newsom’s office.

The insurers said their plan provides “a viable path” toward PG&E emerging from bank-ruptcy. They argued the util-ity has made little progress in settling claims and that other stakeholders should be allowed to present their own.

PG&E has until Sept. 26 to submit its plan and is resisting insurers’ attempt to present their own.

In a statement Tuesday, the utility said it has made “signifi-cant progress in developing a viable, fair and comprehensive plan of reorganization that will compensate wildfire victims, protect customer rates, and put PG&E on a path to be the en-ergy company our customers need and deserve.”

Allowing the insurers to sub-mit their plan ahead of PG&E’s proposal “would increase the potential for a long, drawn-out bankruptcy process and create unnecessary delay,” the com-pany added.

Work on old oil well may have caused Kern County spill

(AP) — Chevron says a 974,400-gallon oil spill in Central California may have started when crews tried to recap an abandoned well.

KQED News says the company held a briefing Friday about the seepage that began in May in a Kern County oil field west of Bakersfield.

Chevron says it believes the spill stemmed from efforts to remove aging cement plugs from its non-producing wells and replace them.

The company says that the initial flows came from a previously damaged well that was be-ing re-entered. Chevron says more oil spilled in June when crews did pressure tests and later tried to complete the job of replacing cement in the well.

Chevron says the oil has only fouled about an acre of land and most of the spilled material has been recaptured.

How did you come to work at Richard Heath & Associates?

I applied for a director role at RHA through a posting on monster.com. The job interested me and seemed as though it was tailored for my skills and experience. Interestingly, the role RHA hired me for ultimately was not the job I applied for, but rather a di�erent director role. I accepted and was grateful for the opportunity to lead the RHA team in supporting Covered California in standing up the A�ordable Care Act health insurance marketplace. After serving in that role for 18 months, I was o�ered the CEO role and have served in that capacity for more than six years. I am honored and humbled to work with a wonderful team of intelligent, diverse, committed and fun colleagues.

RHA has been doing energy consultations since 1979. How has that changed over four decades?

Like most industries, energy e�iciency is ever evolving. We see this evolution primarily through the type and number of energy saving measures available in the program. Increasingly we are seeing smart technology, such as smart thermostats and communicating appliances, play a role. Some measures that exist as program o�erings currently were not contemplated when we started in this industry — the ideas for them didn’t exist yet, not to mention the technology to support them.

How have concerns regarding a�ordable housing and climate change a�ected your industry?

A�ordable housing has been a driver for RHA to continue providing services to low-income and hard-to-reach customers. Energy e�iciency is an often-overlooked strategy to help families pay their bills. The energy e�iciency savings — sometimes as much as 20 to 30 percent bill reduction per home — helps to maintain and preserve a�ordable housing for low-income homeowners and renters in California.An additional positive benefit of making homes more energy e�icient is the reduction in emissions and the carbon footprint to fight against climate change.

Describe your new initiative to help seniors stay in their homes:

Through our Remodeling for Healthy Aging program we work to enable seniors to remain in their homes, or “age in place,” as long as possible. Following an initial assessment, we install appropriate fixtures and equipment to foster independence, safety and mobility. Examples of program o�erings include measures designed to facilitate physical well being such as grab bars, bathroom fixtures and door hardware that are easier to use, and improved and safer lighting. In addition, we o�er smart technology designed to monitor a senior’s activities in the home and provide electronic notifications to adult children supporting their parents’ independence when their normal routine is o�. We o�er these services both to seniors with existing needs and those planning for the future.

What was the best advice you ever received?

I’m fortunate to have received wonderful mentoring over the years, with some of my favorites being “ugly, but it still counts (a tennis reference),” “don’t jump over dollars to pick up dimes,” and “always leave people with their dignity.” The best advice I ever received, however, was from my mom who reinforced “Do Whatever It Takes” to take care of both the people depending on me and the responsibilities I have accepted. Although we have adopted this as our RHA motto,

very few of my teammates know that

my mom is the one behind it. Thanks Mom!

What was your first job and what did you learn from it:

Like most of us, I held part-time jobs during summer breaks and periods during college and law school, but my first professional job was serving as a naval o�icer in the Judge Advocate General’s (JAG) Corps (think Demi Moore in “A Few Good Men”). In that role, I served on active duty for more than five years during which I learned much about responsibility, commitment and leadership. I also learned how to perform consistently with the Navy’s creed to Improvise, Adapt and Overcome. Life rarely goes as planned and it is critical to have the skills to pivot quickly in order to stay on track and achieve success. This has proven invaluable throughout my career.

What are your roots in the Central Valley?

My dad was raised in Fresno, and my family has deep roots in the construction industry dating back to my grandfather’s company, Bruno Electric. My parents are both graduates of Fresno State, where they met. Following my dad’s resignation from Marine Corps active duty, we relocated to Fresno just before my first birthday. I attended K – 12 in Fresno, at Slater Elementary (K-2), Fort Washington (3rd – 6th), Kastner and finally Clovis West. I left Fresno in 1989 to obtain my BA at UC Irvine and Juris Doctorate from the UCLA School of Law. Subsequently, I joined the Navy and spent 8 years on the East Coast, first in the Navy then as a civilian working in national defense. I returned to Fresno in 2004, with an appreciation for the proximity to family, sense of community, minimal commute and a�ordable housing. I’m thankful for the ability to work and raise my children in Fresno surrounded by my supportive village.

What do you like to do in your free time?

In my free time I like to hang out with my husband and my children. I am a dedicated fitness enthusiast, avid reader and have yet to meet an adventure I didn’t like.

From cars to computers, smartphones to spaceships, California manufac-turers are innovating and mak-ing products that will pull our country into the future — doing so with technology that already exists. Our state’s manufactur-ing industry is poised to grow and thrive as long as lawmakers provide pro-growth policies to enable it — which is exactly why manufacturers here in Califor-nia and across the nation are calling on Congress to support the United States-Mexico-Cana-da-Agreement (USMCA) when it

A trial court judge delivered a blow to tax-payers July 5 with a decision allowing San Francisco officials to impose special taxes with a simple majority vote of the public, rather than the two-thirds vote required by the state constitution. The litigation now heads to the Court of Appeal.

An appellant in another upcoming case also is challenging San Francisco’s vote threshold requirement for tax increases. That case, City and County of San Francisco v. Wayne Nowak, is scheduled to be heard Aug. 21 in San Francisco Superior Court. Nowak is challenging Proposition G, a June 2018 measure imposing a parcel tax of $298 per parcel to fund increases in teacher sala-ries for San Francisco Unified School District.

The cases decided July 5 sought to keep San Francisco from validat-ing two measures:

Proposition C of June 2018, taxing the lease of commercial prop-erty for landlords with annual gross receipts of more than $1 million, at the rate of 1% of gross receipts for warehouse space and 3.5 percent of gross receipts for other commer-cial properties. The revenue is earmarked for the special purpose of funding childcare and early education programs. The measure received 51% of the vote.

Proposition C of November 2018: A gross receipts tax imposed on businesses with more than $50 million in gross an-nual receipts within the city and county of San Francisco, with revenue dedicated to programs relating to homelessness. The measure received 61% of the vote.

While neither measure reached the two-thirds vote threshold, San Francisco certi-fied both, relying on City Attorney Dennis

Herrera’s interpretation of the 2017 Califor-nia Supreme Court decision in California Cannabis Coalition v. City of Upland to say that a ballot measure initiated by the public is not subject to the vote requirements im-posed by Proposition 218.

San Francisco Superior Court Judge Ethan Schulman sided with the city attorney, rul-ing that the Upland decision allows cities to impose a tax with a simple-majority vote if the measure is placed on the ballot via a citizens’ initiative rather than by an elected body.

Taxpayers argued that elected officials already are abusing the process by leading initiative campaigns to place taxes on the

ballot, instead of act-ing in their official ca-pacities, as an end-run around the two-thirds vote requirement. This practice will explode if Schulman’s rulings are not reversed by the

appellate courts, taxpayers said.The San Francisco Chronicle reported

that the rulings “could reshape the ways lo-cal governments pass new taxes in Califor-nia.”

The two-thirds vote requirement — a safeguard that requires communitywide consensus for tax increases that will impact the cost of living and economic competi-tiveness — has been upheld repeatedly by statewide voters, most recently via passage of Proposition 26, the Stop Hidden Taxes Act of 2010 cosponsored by CalTax.

Founded in 1926, the California Taxpayers Association is the state’s largest and oldest organization representing taxpayers. Estab-lished as a nonpartisan, non-profit research and advocacy association, CalTax has a dual mission to guard against unnecessary taxa-tion and to promote government efficiency.

United States, Canada, and Mexico came together to update the 25-year-old North American Free Trade Agreement (NAFTA). NAFTA, while forward-thinking for its time, has become increas-ingly outdated as our technol-ogy and modern economy con-tinue to outpace our economic policy. Our countries’ leaders recognized this and signed the USMCA in November 2018. The next step is for Congress to rat-ify it expeditiously once the ad-ministration formally submits it for approval — which we expect to happen soon.

This new deal not only pro-tects free trade throughout North America, it provides a

number of long-awaited im-provements that will help to shepherd our economy and our manufacturing industry for-ward for decades to come.

First, the new agreement includes best-in-class rules that would strengthen United States intellectual property (IP) protection and enforcement. Being in such a technology-driven and innovative state, IP rights are critical to a number of sectors and businesses. With even better IP standards that reflect the modern economy, California manufacturers will be emboldened to create new, environmentally friendly and economical ways to put food on tables across the United States or even to find the next discov-ery in outer space.

The USMCA would also im-prove digital rules to ensure companies in the United States using online storefronts have safe and unfettered access to consumers across Mexico and Canada that would help their businesses grow. And let’s not forget about the ways it lev-els the playing field for many

American businesses by im-proving the way anti-compet-itive behaviors by state-owned enterprises are addressed and by expanding access into both Canada and Mexico by remov-ing unfair trade barriers. This agreement is undoubtedly ben-eficial to each North American nation.

To date, Mexico is the only country that has ratified the USMCA. And with data from the National Association of Manufacturers (NAM) showing the positive economic impact the USMCA would have, it is surprising that some in Con-gress have not shown the same sense of urgency.

California has more than 25,000 manufacturing firms, 93 percent of which are small- and medium-sized, that de-pend on free trade throughout North America. And these jobs can be found across our state and throughout many differ-ent industries, creating well-paying, career-track jobs. In fact, the jobs in our state that are supported by North Ameri-can trade pay an average of

$100,060 in wages and benefits in comparison to an average $54,329 in nonfarm industries.

According to the same NAM study, California’s economy would suffer without the pas-sage of a strong North Ameri-can trade agreement, with the state’s manufactured goods ex-ported to Canada and Mexico potentially facing between $1.2 billion and $10.1 billion in extra taxes. That’s in comparison to zero tariffs today and it’s com-pletely unacceptable.

Each day that the USMCA is not approved is another day that goes by without certainty for manufacturers. It’s another day that manufacturers could be creating more well-paying, stable jobs for the middle class. As is so often the case, manufac-turers are looking to California to lead, to show what is possible and to pull our country into the future by signing the USMCA. We are up to the task, and let’s get to work!

Solar installers are taking a mixed view of a planned 30-percent tariff on foreign-made solar panels announced this week by President Donald Trump.

For some local installers it was an expected move from a president who warned of protectionist policies since his campaign began in 2016. In fact, it provided some much-needed certainty.

Others feel it could stunt their business,

leading to higher prices and layoffs.“So I can tell you I come at a different

viewpoint than about 99 percent of my constituents,” said Glenn Siemens, president of the local chapter of the California Solar Energy Industries Association. “So I don’t necessarily follow the belief that this is a bad thing.”

Siemens, who is also the CEO of Arise Solar, hosted a press conference Wednesday at his Fresno headquarters to point out that while prices in solar will go up, the industry is prepared. This is largely because the solar

Proposition would give tax breaks to older homeowners

California home prices have risen, prompting more owners to put their properties on the market.

But the market still remains tight, with many homes for sale in the Valley getting five offers, which extends the search period of would-be buyers, said Don Scordino, a Fresno Realtor and member of the board of directors of the California Association of Realtors.

Over the past couple of months, he and other association members across the state have been working to collect voter signatures from clients, friends and others in order to get a proposition developed by CAR onto California’s November ballot. It would provide the incentive that many older homeowners may need to get them to buy homes that better suit them and in turn put their current, long-time homes on the market, which CAR officials believe would boost the state’s inventory.

“This bill, what it will do is allow people 55 or older to keep their tax base,” the amount they pay in property taxes every year, as determined by Prop. 13, which California voters passed in 1978, said Brett Taylor, CEO of the Tulare County Association of Realtors, which is supporting CAR’s efforts.

By most accounts, 2017 was a red-letter year for Salter’s Distribut-ing, Inc. The wholesale distribution company saw a 20 percent growth in business and moved to a new 10-acre site in Chowchilla in October.

With the growth of the business, however, came an increased tax bur-den. In particular, the owners were hit with a federal unemployment (FUTA) tax bill that set them back more than $8,700 — compared to their usual payment of around $600. Cheryl Salter, the office manager for Salter’s Distributing, stated that the FUTA tax hike came out of nowhere.

“This was just a shocker from Cali-fornia. I just felt it was so unfair to not give me notice, and I feel like

Salter added that the company could have purchased a new ve-hicle with the amount they paid in FUTA expenses. This, coupled with gas taxes, has been a burden on the company.

“It seems to be a climate of dis-respect to small businesses,” Salter said. “Again, the verbiage is the ‘rich people need to pay’ somehow, and I feel like they are not paying atten-tion to how much small businesses are struggling to be financially strong in this state.”

Salter’s Distributing is by no means alone. Manny Perales, owner of Yosemite Falls Café and High Sierra Grill House, said that while he was given some notification, his business was hit with a $60,000
