SUMMARY: This contract is seeking from qualified and experienced contractors to provide various heating, ventilation and airconditioning (HVAC) maintenances emergency repairs to County operated facilities. This is a one year contract with mutualoptions to extend for 2 additional one year contracts, if both parties agreed upon.

Mechanical Inc. was the lowest responsible bidder, based on 100 hours of labor rate at $89.95 per hour for a Journeymen,and $62.00 for an Apprentice.

Based on recommendation from the Purchasing Department and Building Management, both parties recommendMechanical Inc. as the HVAC repair and Maintenance Services Contractor.

AUTHORIZING A CONTRACT FOR HVAC REPAIR AND MAINTENANCE SERVICE

WHEREAS, bids have been solicited and received for HVAC Repair and Maintenance Service,for all Government facilities ; and

WHEREAS, the lowest responsible bidder as per specifications was Mechanical Inc. 2279Yellow Creek Road, Freeport IL includes the following complexes: Government Center, Courthouse 6thStreet Center, Circuit Clerk, Judicial Center, Juvenile Justice Center, Sheriff's Corrections, AuroraHealth Department, Court Services and Animal Control, based on the sum of a Journeymen's rate of($89.95) per hour, Apprentice rate of ( $62.00) per hour, plus a (15.00%) markup in materials; and

WHEREAS, Mechanical Inc. of Freeport, IL was the lowest responsive bidder chosen by theKane County Purchasing Department and Building Management for a one-year contract with a mutualoption to extend for an additional two (2) one year renewal periods, if agreed upon by both parties.

NOW, THEREFORE, BE IT RESOLVED by the Kane county Board that the Chairman is herebyauthorized to execute a contract for the HVAC Repair and Maintenance Service for the followingcomplexes Government Center, Courthouse, 6th Street Center, Circuit Clerk, Judicial Center, JuvenileJustice Center, Sheriffs Corrections, Aurora Health Department, Court Services and Animal Control forthe sum of Journeymen's rate of ($89.95) per hour, Apprentice rate of ($62.00) per hour, plus a(15.00%) markup in materials.

SUMMARY: Each year the U.S. Census Bureau conducts the Boundary and Annexation Survey (BAS) to update information about thelegal boundaries, names, governmental status, and types of municipalities in each county. This voluntary survey ensures theCensus Bureau has the correct boundary and legal name for each county, as well as for the governmental units within eachj urisdiction. The Census Bureau uses the boundary information to report data from various programs and surveys, such asthe Population Estimates Program and the American Community Survey.

To reduce the burden on local governments and avoid duplication of effort, the Census Bureau offers consolidationagreements to counties that might be interested in submitting to the Census Bureau all boundary changes for the legalgovernments (incorporated places and minor civil divisions) within their jurisdiction. A county does not need participationby all of its entities to establish a consolidation agreement.

The Kane County Board authorizes GIS-Technologies to participate as the county contact for the Census Bureau'sConsolidated Boundary and Annexation Survey Program. There is no agreement to sign, just survey each BAS governmententity in the county to determine if they are interested in taking part in the program. Their responses are then added to theCBAS Form with either a YES or NO and then returned to the Census Bureau.

WHEREAS, To reduce the burden on local governments and avoid duplication of effort, theCensus Bureau offers consolidation agreements to counties that might be interested in submitting tothe Census Bureau all boundary changes for the legal governments (incorporated places and minorcivil divisions) within their jurisdiction. A county does not need participation by all of its entities toestablish a consolidation agreement; and

NOW, THEREFORE, BE IT RESOLVED the Kane County Board authorizes GIS-Technologiesto participate as the county contact for the Census Bureau's Consolidated Boundary and AnnexationSurvey Program. There is no agreement to sign, just survey each BAS government entity in the countyto determine if they are interested in taking part in the program. Their responses are then added to theCBAS Form with either a YES or NO and then returned to the Census Bureau.

SUMMARY: Authorizes the County to execute restated cell tower lease agreements for the Stearns Road cell tower site and the cell towersite located at the former Sheriff's Office/County Jail site, and a lease agreement for the cell tower at the Big Rock.

Agreement for the Stearns Cell Tower near IL Route 31 has a 4 year term with additional 5 renewal terms of 5 years each(total of 29 years, or until 2043). The agreement can be terminated by Lesee for any reason 90 days prior to end of each 5year term. This agreement increases the rent paid to the County from $1,749/month (with a 15% increase at the beginningof each 5 year renewal) to $2,500/month with a 3.5% increase on the yearly anniversary date of the lease. Total ProjectedRevenue $1,467,323, plus a $10,000.00 signing bonus. The original lease agreement for the Geneva Site 900 (Sheriffs site)expired on June 30, 2013. The initial term will be from 06/01/14 to 06/30/19. There are three additional five year terms atthe option of the Lessee. Rent paid to the County will be $1,402.50 per month with a 3% annual increase and a $5,000.00signing bonus. Projected revenues for 20 years $459,761. The lessee agrees to allow County to install and maintainwireless radio equipment (existing) at one additional attachment location on this tower.

The lease agreement for the cell tower at the Big Rock site allows the County to install and maintain emergency 911 wirelessradio equipment at one attachment location on the tower.

WITH PINNACLE TOWERS LLC, STC II LLC, CROWN COMMUNICATION LLC

WHEREAS, the County of Kane is authorized by law, pursuant to the Illinois Compiled Statutes,605 ILCS 5/9-113 et seq., to grant use of highway right of way for public utility purposes; and

WHEREAS, the County of Kane is also authorized by law, pursuant to the Illinois CompiledStatutes, 50 ILCS 751/5 et seq. to cooperate with wireless telecommunications carriers to provideemergency wireless communication services to its citizens; and

WHEREAS, the County of Kane owns a cell tower that is located on a site on County HighwayNo.37 also known as Stearns Road; said cell tower is currently leased from the County by CrownCastle or one of its subsidiaries for wireless communication purposes; and

WHEREAS, the County of Kane also owns a cell tower that is located at the former Sheriff'sOffice/County Jail site on Kane County Highway No. 8, also known as Fabyan Parkway; said cell toweris also being currently leased by Crown Castle or one of its subsidiaries; and

WHEREAS, the County of Kane desires to use a cell tower site that is owned or otherwiseunder the control of Crown Castle or one of its subsidiaries, for emergency communication purposes,which cell tower is located in the vicinity of Big Rock, Illinois

WHEREAS, the County and Crown Castle desire to restate and extend their existing cell towerlease agreements and also desire to enter into a lease agreement for the use by the County of the CellTower site near Big Rock, Illinois and toward that end have developed three cell tower leaseagreements (copies of which are on file in the office of the Kane County Clerk).

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the County of Kane authorizeand direct the County Board Chairman to execute the restated cell tower lease agreements for theStearns Road cell tower site and the cell tower site located at the former Sheriff's Office/County Jailsite.

BE IT FURTHER RESOLVED by the Kane County Board that the County of Kane authorize anddirect the County Board Chairman to execute the lease agreement for the cell tower at the Big Rock,Illinois site.

SUMMARY: The attached Text Amendments to the Kane County Zoning Ordinance where reviewed at Development Committee on May14, 2014, and sent on the the Zoning Board of Appeals. AMENDMENT TO THE KANE COUNTY CODE, APPENDIX B, ZONING ORDINANCE

WHEREAS, the Kane County Board has adopted a Zoning Ordinance dividing theunincorporated areas of the County into zoning districts for the purpose of regulating land use; and

WHEREAS, said ordinance is adopted for the purpose of promoting the public health, safety,morals, comfort, and general welfare; conserving the values of property throughout the County; andreducing or avoiding congestion in the public streets and highways; and

WHEREAS, it is necessary from time to time to amend the ordinance to continue to provideeffective enforcement of the Kane County Zoning Ordinance; and.

NOW, THEREFORE, BE IT ORDAINED by the Kane County Board that various sections of theKane County Code, Appendix B, Zoning Ordinance, be amended to read as follows:

ARTICLE Ill. RULES AND DEFINITIONS

Section 3.1. Established.

Use, interim special: A special use that may be granted on zoning lots in the F and F-2 Districts whichmight remain unused or unoccupied by uses otherwise permitted in the district. An "interim specialuse" may be granted for only a limited period of time, not to exceed (5) years.

Use, interim for cultivation of controlled substances licensed b y the State of Illinois: An interim use thatmay be granted on zoning lots in the F, F-2, B-3, LI and I specifically for the cultivation of controlledsubstances licensed by the State of Illinois. An "interim special use" may be granted for only a limitedperiod of time, not to exceed (5) years.

In addition to thestandards set forth in Section 4.8-2 (a) throu g h (f), the interim special use must be compatiblewith the character and intensity of other structures and uses permitted in this District. In itsrecommendation to the County Board, in addition to the standards set forth in Section 4.8-2 (a)through (f), the Zoning Board of Appeals shall also find that the proposed interim special usewould be compatible with other uses permitted in this District. An interim special use shall beauthorized for a limited period of time only, not to exceed five (5) years.

ii. Interim use for a limited period of not more than five (5) years specifically for the cultivation ofcontrolled substances licensed by the State of Illinois.

Sec. 8.3. F2 District - Agricultural related sales, service, processing, research, warehouseand marketing: Special uses.

The purpose and intent of this district is to provide for the proper location and regulation ofagriculturally related sales, services, processing, research, warehousing and marketing activities andother related uses that are dependent upon, or closely allied to, the agricultural industry.

Any use established in the F2 District hereafter shall be operated in such a manner as to comply withthe applicable performance standards as set forth in Article XI, Section 11.1-5 of this ordinance.

8.3-1 Permitted Uses.

All uses in this district are special uses and must be approved in accordance with procedures andrequirements of Section 4.8, Special Uses, of this ordinance.

8.3-2 Special Uses.

The following special uses may be allowed in the F2 District:

a.Agriculturally related research and facilities;

b.Contract sorting and grading services for grains, fruits, vegetables and other agricultural products;

c. Shelling, drying, baling and threshing of agricultural crops;

d.Horticultural services;

e. Preparation of feeds for animals and fowl;

f. Livestock sales facilities, including auctions;

g.Grain elevators and bulk storage of feed grains;

h.Fertilizer production, sales, storage, mixing and distribution;

i. Transportation related activities primarily serving the basic agricultural industry;

j. Repair of farm machinery, implements and related farming equipment.

ORDINANCE NO. 14-

ESTABLISHING THE TAMARA-DITTMAN SPECIAL SERVICE AREA (OR SPECIAL SERVICEAREA NO. SW-50) OF KANE COUNTY, ILLINOIS AND THE LEVY OF TAXES FOR THE PURPOSE

OF PAYING THE COST OF PROVIDING SPECIAL SERVICES IN AND FOR SUCH AREA

WHEREAS, a Final Flat of subdivision was approved by the County of Kane, Illinois (the"County"), for Unit 2 of Tamara Heights Subdivision and was recorded on November 20, 1996(Document No. 96K082181) in addition to an unincorporated lot along Dittman Road; and

WHEREAS, a mutual subsurface drainage system, which conveys flows from an uplandwatershed west of Dittman, was deemed an integral part of the stormwater improvements for TamaraUnit 2 in that the subsurface system regains storage within the stormwater detention facility after rainevents and in accordance with the plat of subdivision each and every lot of owner within Tamara Unit 2is responsible for the maintenance of the stormwater infrastructure; and

WHEREAS, the subsurface drainage system continues upstream of the Tamara Unit 2detention facility and under Illinois Drainage Law, individual property owners are obligated to maintainmutual drainage systems with their property; and

WHEREAS, Kane County has been working with the property owners to develop a plan toreplace the failed portion of the mutual subsurface drainage system to restore storage within localdepressions in the watershed and decrease flow downstream. Through a series of meetings with theresidents, it has been determined that it is in the best interest of the residents to move forward with thedrainage improvement plan and finance the residents' portion of the construction; and

WHEREAS, pursuant to the provisions of Article VII, Section 7, Part (6) of the 1970 Constitutionof the State of Illinois (the "Constitution"), the County of Kane is authorized to create special serviceareas in and for the unincorporated areas of the County; and

WHEREAS, pursuant to the "Special Service Area Tax Law", 35ILCS 200/27-5, et seq. (2003),the County is authorized to levy and impose taxes upon property within special service areas for theprovision of special services to those areas and for the payment of debt incurred in order to providethose services; and

WHEREAS, it is in the public interest that the establishment of the area hereinafter described asa special service area for the purposes set forth herein and to be designated as the Tamara-DittmanSpecial Service Area (or Special Service Area No. SW-50), of the County; and

WHEREAS, the Area is contiguous and totally within the boundaries of the unincorporated areaof the County; and

WHEREAS, the purpose of establishing the Area is to provide certain special governmentalservices (the "Services"), to the Area, which are unique and in addition to the services generallyprovided to the County as a whole. The Long Term Maintenance Services to be provided may include,but are not limited to the following: the operation, maintenance, repair, rehabilitation, replacement andreconstruction of any storm water detention and/or retention area, drainageway, ditch swale, stormsewer or other stormwater facility; costs of design, engineering and other consulting services, surveyingand permits, public liability insurance, and all administrative, legal and other costs or expenses incurredin connection therewith and with the administration of the Area, including the repayment of any loan ordebt incurred for the provision of any such Services. The maximum long term maintenance levyamount shall increase each year the Special Service Area is active by 1% to account for inflation andshall be available indefinitely; and

WHEREAS, a Construction Project is to be built through the County's cost-Share Drainageprogram. The loan program outlines a ten (10) year term at a zero (0) percent interest rate. Part A ofthe Construction Project is defined as the replacement of the subsurface drainage system through Lots17, 18 and 19 of Tamara Heights Unit 2 following the route, as closely as possible, to the existingsubsurface drainage system. The Tamara Heights Unit 2 property owner's share of the constructioncost is a maximum of $10,000 and will be reduced if bid prices are less than the estimate based onactual bid numbers for the work on Lots 17, 18 and 19 with a 60% homeowner share and 40% Countyshare. Lot owners on whose property the construction occurs will be responsible for 100% of the costof fine grading, topsoil spreading (if required), seeding and watering. The cost of establishing the non-ad valorem special service area fee per Resolution 09-232 of $400 will be paid by the Kane CountyCost-Share program. The Tamara Unit 2 loan amount shall be collected over a 10 year period afterwhich time the Construction Project levy shall expire. Payments shall be made each year inaccordance with the repayment schedule by the property owners in the maximum amount as shown onExhibit A for the 10 year period. The 60%/40% cost-sharing arrangement outlined above for thisproject is subject to approval by the Development Committee. If the Cost-Share percentage is deniedor funding sources are unavailable for any other reasons, the passage of the SSA by the County Boarddoes not obligate Kane County to move forward with the project; and

WHEREAS, Part B of the Construction Project is defined as the replacement of the subsurfacedrainage system through PIN 05-27-300-044 following a route, as closely as possible, to the existingsubsurface drainage system. The property owner's share of the construction cost is a maximum of$5,400 and will be reduced if bid prices are less than the estimate based on actual bid numbers for thework on PIN 05-27-300-044 with a 60% homeowner share and 40% County share. The property ownerreserves the option to solicit prices independently for the work on PIN 05-27-300-044 and contractdirectly with a contractor to complete the work. If the property owner contracts independently for thework, Kane County field staff will make site visits during construction to verify the quality andworkmanship. Once approved by field staff, the property owner will provide an invoice to the Countywith supporting documentation for reimbursement. The property owner will be responsible for 100% ofthe cost of fine grading, topsoil spreading (if required), seeding and watering. The property owner loan

amount shall be collected over a 10 year period after which time the Construction Project levy shallexpire. Payments shall be made each year in accordance with the repayment schedule by the propertyowner in the maximum amount as shown on Exhibit A for the 10 year period. The 60%140% cost-sharing arrangement outlined above for this project is subject to approval by the DevelopmentCommittee. If the Cost-Share percentage is denied or funding sources are unavailable for any otherreasons, the passage of the SSA by the County Board does not obligate Kane County to move forwardwith the project; and

WHEREAS, it is in the public interest that the levy of a non-ad valorem annual tax upon alltaxable property within the Area be considered for the purpose of paying the cost of providing theServices; and

WHEREAS, the revenue form such tax shall be used solely for Services for which the County isauthorized under law to levy taxes or special assessments or to appropriate funds of the County, all ofthe Services to be in and for the Area; and

WHEREAS, said tax for Long Term Maintenance Services shall be available for an indefiniteperiod of time in an amount sufficient to produce revenues required to provide the Services, and suchamount shall not exceed the amount as shown on Exhibit A plus 1% for each year the SSA is activeand shall be in addition to all other taxes permitted by law. The Long Term Maintenance Services levywill only be activated if the majority of the property owners in the SSA provide a written request to KaneCounty specifying the project, project cost and duration for which they are requesting that the LongTerm Maintenance Services levy be activated. The Long Term Maintenance Services levy request willbe subject to County Board approval; and

WHEREAS, said tax shall be levied upon all taxable property within the Area for theConstruction Project for 10 years beginning for the tax year that coincides with the first loan payment, inan amount sufficient to produce revenues required to provide the Services, and such amount shall notexceed the amount as shown on Exhibit A and shall be in addition to all other taxes permitted by law;and

WHEREAS, the establishment of the Area was proposed by the Board of the County of Kane(the "County Board" pursuant to Ordinance No. 14-09, entitled: AN ORDINANCE PROPOSING THEESTABLISHMENT OF THE TAMARA-DITTMAN SPECIAL SERVICE AREA (OR SPECIAL SERVICEAREA NO. SW-50) OF KANE COUNTY, ILLINOIS AND THE LEVY OF TAXES FOR THE PURPOSEOF PAYING THE COST OF PROVIDING SPECIAL SERVICES IN AND FOR SUCH AREA (the"Proposing Ordinance"), duly adopted on January 14, 2014 and was considered at a public hearing (the"Hearing") held by the County Board on April 8, 2014; and

WHEREAS, notice of the Hearing was given by publication at least once not less than 15 daysprior to the Hearing in the Kane County Chronicle, the same being a newspaper of general circulationwithin the County (a copy of the notice and affidavit of publication is on file with the County Clerk asExhibit B and is incorporated herein); and

WHEREAS, mailed notice of the Hearing was given by depositing notice in the United StatesMail, not less than 10 days prior to the time set for the Hearing, addressed to the person or persons inwhose name the general taxes for the last preceding year were paid on each lot, block, tract, or parcelof land lying within the Area, and in the event taxes for the last preceding year were not paid, the noticewas sent to the person or persons last listed on the tax rolls prior to that year as the owner or owners ofsaid property (a copy of the notice and the affidavit of mailing is on file with the County Clerk as ExhibitC and is incorporated herein); and

WHEREAS, at the Hearing, all interested persons, including persons owning taxable realproperty located within the Area, were given the opportunity to be heard regarding any issuesembodied within the notice, including the establishment of the Area and the levy of taxes, and to filewith the County Clerk written objections to the same (a copy of the transcript of the hearing and thewritten objections, if any, are on file with the County Clerk as Exhibit D); and

WHEREAS, the County Board does hereby determine that it is in the public interest and in theinterest of the County and the Area that the Area be established and the taxes described herein belevied;

NOW, THEREFORE, BE IT ORDAINED by the County Board of the County of Kane, Illinois, asfollows:

§1.Incorporation of preamblesThe preambles of this Ordinance are hereby incorporated into this text as if set out herein infull as the findings of the County Board.

§2.Final adjournment of HearingThe Hearing was adjourned on April 8, 2014

§3.Establishment of AreaThe Tamara Dittman Special Service Area (or Special Service Area No. SW-48) of KaneCounty, Illinois is hereby established in and for the County and shall consist of the territorylegally described in Exhibit E on file with the County Clerk and made a part hereof.

§4.Purpose of establishing the AreaThe purpose of establishing the Area is to provide the Services to the Area, which Services areunique and in addition to the services generally provided to the County as a whole. TheServices to be provided may include, but are not limited to, the following: the operation,maintenance, repair, rehabilitation, replacement and reconstruction of any storm waterdetention and/or retention area, drainageway, ditch, swale, storm sewer or other stormwaterfacility; costs of design, engineering and other consulting services, survey and permits, publicliability insurance, and all administrative, legal and other costs or expenses incurred inconnection therewith and with the administration of the Area, including the repayment of anyloan or debt incurred for the provision of any of such Services, all of the Services to be in andfor the Area.

§5. Tax LevyThe cost of the Services shall be paid by the revenue from the levy of a direct annual tax uponall taxable property within the Area for an indefinite period of time beginning for the 2014 taxbill (payable in 2015) and shall be as described in the SSA document, and shall be in additionto all other taxes permitted by law.

§6. FilingThe Water Resources Division is hereby directed to file a recorded, certified copy of thisOrdinance, including a legal description of the territory and an accurate map of the Area and allexhibits, with the Kane County Clerk's Tax Extension Department within 60 days after itsadoption and approval.

§7. RepealerAll Ordinances, Orders, and Resolutions and parts thereof in conflict herewith be and the sameare hereby repealed, and this Ordinance be in full force and effect forthwith upon its adoption.

SUMMARY: It is the desire of the County Board to utilize the Video Gaming Tax revenue to fund capital projects. However the revenuecollected from the Video Gaming Tax is currently being directed into the General Fund for operations.

This resolution authorizes the reclassification of the Video Gaming Tax Revenue account from the General Fund to theCapital Fund beginning in fiscal year 2014. Consequently any Video Gaming Tax revenue collected to date (which as of thedate of the drafting of this resolution is $54,445.93) will be transferred from the General Fund to the Capital Fund.

Since the General Fund operations budget was dependent on this revenue, it must be replaced with $65,000 fromContingency.

OPPOSING SENATE BILL 1739(Chicago Casino Gambling Expansion Bill)

WHEREAS, Senate Bill 1739, the Chicago Casino Gambling Expansion Bill, is not in the bestinterest of Kane County and her cities and villages within; and

WHEREAS, Senate Bill 1739 will call for Illinois taxpayers to risk as much as $900 million inborrowing to construct the Chicago casino at a time when finances are low and the backlog of billsowed and deficits are high; and

WHEREAS, Senate Bill 1739 allows five new casinos to be built, at least three of which willcompete for customers with the already long established Hollywood Casino in Aurora and/or GrandVictoria Casino in Elgin; and

WHEREAS, Senate Bill 1739 creates a bureaucracy called the Chicago Casino DevelopmentAuthority that will have unfettered rights to use eminent domain, condemnation, and unlimited bondingpowers to the detriment of local governments, business, and resident taxpayers.

NOW, THEREFORE, BE IT RESOLVED that for the aforesaid and other reasons the KaneCounty Board strongly advises our local elected state representatives and senators to oppose SenateBill 1739 and ensure that this bill, and bills similar to it, does not pass in order to protect our sharedconstituents.

APPROVING CREATION OF CAPITAL PROJECT FUND 5312 - TAMARA DITTMAN SBA SW 50

WHEREAS, Kane County Water Resources Division has been working with the Tamara Unit 2residents and a property owner on Dittman Road to fund a drainage improvement project through theCost-Share program and in accordance with the plat of subdivision, the lot owners within the TamaraUnit 2 subdivision are equally responsible for the maintenance of the drainage facilities; and

WHEREAS, Tamara Unit 2 does not have an organized Homeowners' Association grantingthem authority to collect funds for the purpose of maintaining the stormwater infrastructure within theSubdivision; and

WHEREAS, it is appropriate and in the best interest of the subdivision to provide a means bywhich the residents are able to collect funds for the above described purpose for both current andfuture projects that may arise.

NOW, THEREFORE, BE IT RESOLVED that Fund 5312 Tamara Dittman SBA SW 50 beestablished to receive revenue and expend applicable project expenses.

SUMMARY: The Kane County Board adopted Resolution 13-126, Amending Res. No. 08-278 Implementation of County Financial Policiesregarding Personnel Hiring and Replacement. Section 5 of Res. SUMMARY: Kane County Animal Control Department is staffed with 12 full-time employees consisting of the following positions: anAdministrator, one Administrative Assistant, three Kennel Staff, three Data Entry staff and three Animal Control Wardens.Kennel Assistants are scheduled to rotate each weekend to clean the kennel, which results in one day off during the week.When there is absenteeism on the weekends it results in paying another employee overtime.

Converting a full-time kennel assistant position into a three part-time kennel assistant positions would create anopportunity to have staff scheduled to work in the shelter each weekend, which would reduce scheduling conflicts andminimize the impact of having staff shortages due to call-ins and to reduce the impact of the increased overtime costs.

The annual budget for a full time kennel assistant with benefits is $22,701, whereas three part time employee's averaging 8hours per week would have an annual budget of $17,175.

SUMMARY: This is a supplemental budget request for fiscal year 2014 in the net amount of $3,238 for the Office of the Kane CountyAuditor. The 2014 budget included an Accounting Assistant and a Deputy Auditor. The Accounting Assistant took apromotion within the County, and the Deputy Auditor retired. The position of Accounting Assistant was upgraded to that ofa Staff Auditor. The Staff Auditor position requires a degreed accountant. The annual difference in base salary wasincreased from $34,000 to $42,000 in order to attract a qualified professional. The Deputy Auditor was replaced with aninternal promotion, which resulted in a salary that was virtually unchanged. There were additional unbudgeted expensesrelated to salaries as a result of the changes. The previous Deputy Auditor had unused sick and vacation pay which theOffice incurred. The Office also incurred additional salary expenses for the overlap of personnel for a week (in bothinstances) to provide training by the outgoing personnel. The increased salary expenses were largely offset by the netreduction in healthcare and dental contributions due to the difference in actual compared to budgeted levels of coverage.

There is also an additional cost to the County for IMRF and FICA related to the increased pay rate, the additional trainingsalaries, and the one time payout of retirement related expenses. Combined these amount to $2,050 for fiscal 2014.

WHEREAS, the Office of the Kane County Auditor is committed to provide high quality, costefficient financial information which accurately represents the operations of Kane County government inaccordance with professional standards; and

WHEREAS, the Accounting Assistant transferred to another position in the County and theDeputy Auditor retired; and

WHEREAS, the Accounting Assistant position was upgraded to a Staff Accountant; and

WHEREAS, the retirement of the Deputy Auditor caused the Office to incur additionalunbudgeted salary expenses related to unused sick pay and retirement pay; and

WHEREAS, the process to replace each position required a one week overlap of personnel fortraining purposes and caused the Office to incur additional unbudgeted salaries; and

SUMMARY: The adopted budget for Fiscal Year 2014 Back Taxes Interest and Penalties revenue was $2,075,000. The current projection is$1,600,000 which will result in a $475,000 budget shortfall.

At the same time we are projecting a $595,000 overage in Probation Salary Reimbursement revenue.

Since a budget adjustment is being made to recognize the $595,000 increase in Probation Salary Reimbursement revenue, itis prudent to recognize this $475,000 decrease in Back Taxes Interest and Penalties revenue at the same time, so as tominimize the impact on the General Fund Contingency.

WHEREAS, the adopted budget for Fiscal Year 2014 back taxes interest and penalties revenueis $2,075,000; and

WHEREAS, the projection for Fiscal Year 2014 back taxes interest and penalties revenue iscurrently $1,600,000; and

WHEREAS, it is prudent to recognize this $475,000 reduction in back taxes interest andpenalties revenue at the same time the $595,000 increase to probation salary reimbursement revenueis being recognized in order to minimize the impact on the General Fund budget.

ADJUSTING COURT SERVICES REVENUE FOR FY 2014

WHEREAS, at its September 2013 Term, the Supreme Court approved the State Fiscal Year(SFY) 2014 probation funding formula and $63.6 million was appropriated to the Supreme Court forprobation salary reimbursements statewide; and

WHEREAS, the Chief Circuit Judge of the 16th Judicial Circuit (Court Services) has beennotified by the Administrative Office of the Illinois Courts that the SFY 2014 allocation included a 5%increase for all probation departments from their SFY201 3 funding level; and

WHEREAS, these amounts need to be reflected in Kane County FY2014 budgeted revenue.The receipt of said additional funds will require an amendment to Court Services fiscal year 2014budget.

WHEREAS, the parties have reached an agreement concerning wages, hours and other termsand conditions of employment which include certain step adjustments and wage increases which werenot budgeted in the Court Services budgets; and

WHEREAS, the cost for these adjustments are addressed by the increases in revenuegenerated by the Kane County Court Services Departments as highlighted in another Kane CountyBoard Resolution; and

WHEREAS, these wage and salary increases are deemed reasonable and modest incomparison to salaries paid to counterparts in surrounding counties with the general intent of reducingthe 19.75% turnover in employees for each of the last four years; and

WHEREAS, non-union employees have not received a wage increase during the pendency ofthe negotiations; and

WHEREAS, upon finalization of the CBA's, the Chief Judge has determined to establish newequitable salary ranges for non-union employees as well as for those under the CBA's.

SUMMARY: In July 2013, the Illinois legislature adopted the Firearm Concealed Carry Act. The Act allows the carrying of firearms inpublic. The Act contains a variety of places where carrying a concealed weapon is prohibited, including governmentbuildings; however, a parking areas are considered "safe harbors" where an individual with an appropriate concealed carrylicense may lock the firearm in a locked case within his or her vehicle.

The proposed policy takes a risk management perspective by prohibiting employees from carrying a firearm in theirpersonal vehicle while on County business, even if the vehicle is parked.

The amended policy was drafted by Joseph Lulves of the State's Attorneys Office.

AMENDING THE PERSONNAL POLICY HANDBOOK(CONCEALED CARRY)

WHEREAS, from time to time, the Human Services Committee recommends that policiesaffecting employee conduct, behavior and adherence to certain rules are promulgated and published inthe Kane County Personnel Policy Handbook; and

WHEREAS, the Human Services Committee recommends the Employee Concealed Carrypolicy be adopted in light of the passage of Public Act 98-0063, the Firearm Concealed Carry Act.

NOW, THEREFORE, BE IT FURTHER RESOLVED, by the Kane County Board that theConcealed Carry policy be approved and published in the Kane County Personnel Policy Handbook asset forth below.

Concealed Carry Policy

Kane County employees may not carry a concealed firearm in any County building or vehicle.Employees are also prohibited from carrying a concealed firearm in their private vehicle, while in thecourse of their employment with the County. This policy applies to those employees who are licensedunder the Illinois Firearm Concealed Carry Act, 430 ILCS 66/65, which specifically prohibits carryingconcealed firearms in any building designated for matters before a circuit court, any building or portionof a building under the control of a local government, or any building, real property, and parking areaunder the control of an adult or juvenile detention or correctional institution, prison or jail. This policydoes not apply to any Kane County employee who is authorized to carry a concealed firearm by anyother State statute.

SUMMARY: The attached resolution authorizes the County Board Chairman to accept federal Workforce Investment Act and TradeAdjustment Act funds awarded during Program Year 2014 (July 1, 2014 to June 30, 2015), and to enter into agreements withsubrecipient organizations to carry out workforce development activities for either the full program year or, in the case ofyouth services, part of the program year. AUTHORIZING AGREEMENTS FOR WORKFORCE INVESTMENT ACT AND TRADEADJUSTMENT ACT FUNDING FOR PROGRAM YEAR 2014

WHEREAS, Kane County administers Federal funding provided by the Illinois Department ofCommerce and Economic Opportunity for a three-county area, including Kane, DeKaib, and KendallCounties; and

WHEREAS, said funding supports training and job readiness services for adults, dislocatedworkers, and youth; and

WHEREAS, the county has been notified that it will receive a formula allocation under theWorkforce Investment Act for Program Year 2014 in the amount of $5,777,074 and that it can expectallocations of Trade Adjustment Act funds to serve impacted workers during the year; and

WHEREAS, the local Workforce Investment Board has authorized several subrecipientorganizations to provide services to adults and dislocated workers in DeKaIb County, and youththroughout the three-county area.

NOW, THEREFORE, BE IT RESOLVED that the Chairman of the Kane County Board isauthorized to accept Workforce Investment Act and Trade Adjustment Act funds awarded duringProgram Year 2014 and to sign grant agreements, certifications and other documents required by theIllinois Department of Commerce and Economic Opportunity to accept said awards.

SUMMARY: This Resolution is for Food Providers for the Juvenile Justice Center. There is a need for adequate food supplies and propernutritional values for all residents in the facility. A bid was put out and was awarded to four (4) vendors in 2013. By choosingvarious items from the four (4) vendors, we can order the least expensive items of the four (4). This is a one year contractwith two (2) one (1) year options to extend. This Resolution is to authorize entering into the first one (1) year option toextend the contract dated July 30, 2013. AUTHORIZING THE CHAIRMAN TO APPOINTADDITIONAL MEMBERS OF THE BOARD OF REVIEW

WHEREAS, the Illinois Property Tax Code requires that the Board of Review in every Countyunder township organization consist of three members, regardless of parcel county or workload (35ILCS 200/6-5, et seq.); and

WHEREAS, the Kane County Board of Review holds numerous hearings on assessmentcomplaints each year and must complete its work in a timely manner so that real estate tax bills can bemailed on time; and

WHEREAS, the Kane County Treasurer reports that cost of late real estate tax bills can exceed$10,000 per day; and

WHEREAS, the Illinois Property Tax Code provides that in such circumstances, a County Boardmay declare by resolution that the number of complaints filed with a Board of Review creates an"emergency situation" and causes the need for additional members of the Board of Review so that itmay complete its work in a timely manner; and

WHEREAS, the Illinois Property Tax Code provides when the County Board adopts such aresolution, the Chairman of the County Board may appoint additional qualified members to the board ofreview to hold separate hearings on complaints.

NOW, THEREFORE, BE IT RESOLVED that an emergency situation, as defined by the IllinoisProperty Tax Code, exists for 2014 and Chairman of the County Board may appoint additional qualifiedmembers to the Board of Review to hold separate hearings on complaints so that the Board of Reviewmay complete its work in a timely manner.

APPROVING ADOPT-A-HIGHWAY PROGRAM PARTICIPATION APPLICANTS

WHEREAS, the Illinois Highway Code of the Illinois Compiled Statutes (605 ILCS 120/1 et seq.)

provides for the establishment of Adopt a Highway Programs by Counties and various units of governmentthroughout the State of Illinois to support anti-litter efforts by allowing groups of private citizens to adopt asegment of highway for the purpose of litter and refuse collection; and

WHEREAS, the County has enacted and otherwise established pursuant to Kane County BoardOrdinance No. 13-267, the Kane County Adopt-A-Highway Program in conformance with the IllinoisHighway Code, which program is intended to assist the County in its efforts to remove refuse and litter fromCounty highway right of way and otherwise beautify the County Highway System; and

WHEREAS, those groups whose names are set forth in the exhibit attached hereto (a copy of whichis on file in the office of the Kane County Clerk) have submitted applications for participation in the KaneCounty Adopt-A-Highway Program; and

WHEREAS, each of the groups' applications have been reviewed and approved by the CountyEngineer of Kane County and have subsequently been approved by the Transportation Committee of theKane County Board; and

WHEREAS, the approval of the applicants for participation in the Kane County Adopt-A-HighwayProgram will facilitate the County's litter collection efforts on County highways and will aid in thebeautification of all County highways whether in urban or rural areas of the County.

NOW, THEREFORE, BE IT RESOLVED by the County Board of Kane County that each applicantfor participation in the Kane County Adopt-A-Highway Program that is set forth on the exhibit attached to thisResolution is hereby approved.

SUMMARY: The following proposed speed limit alteration has been determined in accordance with Kane County Resolution No. 01-419(Policy for the Establishment and Posting of Altered Speed Limits on County and Township Roads) and is being submittedfor approval in accordance with 625 5/11-604 of the Illinois Compiled Statutes.

ORDINANCE NO. 1.4

APPROVING ALTERATION OF SPEED LIMITBATAViA TOWNSHIP

WHEREAS, County of Kane through its Division of Transportation has caused an engineering andtraffic investigation to be conducted on various streets in Batavia Township, which are highways not otherwiseunder the jurisdiction of the Illinois Department of Transportation; and

WHEREAS, the Transportation Committee of the Kane County Board has reviewed the results of saidinvestigation and has recommended the alteration of the existing maximum speed limit of fifty five (55) miles perhour as set forth in the Illinois Vehicle Code, (625 ILCS 5/11-604), so as to be both reasonable, safe and proper.

NOW, THEREFORE, BE IT ORDAINED by the Kane County Board, that pursuant to the IllinoisVehicle Code, (625 ILCS 5/11-604), the maximum speed limit on the street in Batavia Township as describedhereunder shall be thirty five (35) miles per hour as indicated in the schedule as set forth below.

APPROVING AN INTERGOVERNMENTAL AGREEMENT BETWEENTHE COUNTY OF KANE AND THE CITY OF AURORA FOR

JERICHO ROAD OVER BLACKBERRY CREEKKANE COUNTY SECTION NO. 04-00329-00-BR

WHEREAS, the Illinois Constitution of 1970, Article VII, Section 10 and 5 ILCS 220/1 et seq.

authorizes the County of Kane (hereinafter "Kane") and the City of Aurora (hereinafter "Aurora") to cooperatein the performance of their respective duties and responsibilities by contract and other agreements; and

WHEREAS, Kane and Aurora desire to cooperate among themselves to accomplish a water mainrelocation on Kane County Highway No. 24 (Jericho Road), a highway under the jurisdiction of the County ofKane (hereinafter referred to as the "Improvement"); and

WHEREAS, Aurora has agreed to reimburse Kane for water main relocation for the Improvement atan estimated cost of Two Hundred Fifty Thousand Dollars ($250,000.00); and

WHEREAS, the Improvement is deemed by Kane and Aurora to be of immediate benefit to theresidents of the County of Kane, the City of Aurora and the State of Illinois in that it shall facilitate the safeand efficient movement of traffic and shall provide for the safety of the motoring public; and

WHEREAS, Kane and Aurora have determined a mutually satisfactory allocation of responsibilitiesand costs for said Improvement as set forth in the intergovernmental agreement (a copy of which is on filewith the County Clerk's Office.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman thereof ishereby authorized to execute an intergovernmental agreement with the City of Aurora for reimbursable watermain relocation on Jericho Road.

SUMMARY: On May 28th, construction bids were opened at the Division of Transportation office for the Plank Road Realignment andBurlington Road Intersection Improvement Project which will realign and reconstruct Plank Road from an existingoffset alignment interrupted by two stop controlled "1" intersections at Burlington Road, to a proposed uninterruptedalignment with a new signalized intersection at Burlington Road. The section of proposed Plank Road near the BurlingtonRoad intersection shall be an urban section with new storm sewer and combination concrete curb and gutter. The section ofproposed Plank Road away from the Burlington Road intersection shall be a rural section with ditches and shoulders. Therealigned section of Plank Road shall require significant earthwork in both the undercutting of unsuitable soils within theroadway alignment and the building of high embankments. Improvements on Burlington Road shall include full-depthpavement widening and resurfacing with new storm sewer and combination concrete curb and gutter along the east side ofthe roadway.

The apparent low bidder for this project is Martam Construction, Inc. of Elgin, Illinois with a proposed contract amount of$4,631,358.17, which is approximately 3.99% above the engineer's estimate of $4,453,762.05.

SUMMARY: On May 28th, construction bids were opened at the Division of Transportation office for the Tanner Road over Lake RunBridge Replacement Project which is located between Healy Road and Deerpath Road. The scope of work involves removalof the existing structure and replacement with a reinforced concrete slab structure. Additional work includes bridgeapproach and connector pavement, HMA pavement and shoulders, embankment grading, guardrail removal andreplacement, pavement marking and other misc. work.

The apparent low bidder for this project is Illinois Constructors Corp. of Elburn, Illinois with a proposed contract amount of$1,572,800.00, which is approximately 8.45% below the engineer's estimate of $1,717,953.00.

APPROVING AN INTERGOVERNMENTAL AGREEMENT BETWEENTHE COUNTY OF KANE, THE ST. CHARLES TOWNSHIP ROAD DISTRICT, AND

THE SUGAR GROVE TOWNSHIP ROAD DISTRICT

WHEREAS, the Illinois Constitution of 1970, Article VII, Section 10 and 5 ILCS 220/1 et seq.authorizes the County of Kane (hereinafter "Kane"), the St. Charles Township Road District (hereinafter"St. Charles"), and the Sugar Grove Township Road District (hereinafter "Sugar Grove") to cooperate in theperformance of their respective duties and responsibilities by contract and other agreements; and

WHEREAS, Kane, St. Charles, and Sugar Grove desire to cooperate among themselves toaccomplish the cold-in-place recycling improvement of Harter Road, Dean Street, and Prairie Street,highways under the jurisdiction of Kane, St. Charles, and Sugar Grove, respectively (hereinafterreferred to as the "Improvement"); and

WHEREAS, Kane, St. Charles, and Sugar Grove desire to undertake construction for theImprovement at an estimated cost of Eight Hundred Seventy Thousand Two Hundred Thirty Five and16/100 Dollars ($870,235.16); and

WHEREAS, the Improvement is deemed by Kane, St. Charles, and Sugar Grove to be ofimmediate benefit to the residents of the County of Kane, St. Charles Township, Sugar GroveTownship, and the State of Illinois in that it shall facilitate the safe and efficient movement of traffic andshall provide for the safety of the motoring public; and

WHEREAS, Kane and St. Charles have determined a mutually satisfactory allocation ofresponsibilities and costs for said Improvement as set forth in the intergovernmental agreement (a copy ofwhich is on file with the County Clerk's Office) with the St. Charles share of the construction of theImprovement estimated to be $238,000.00; and

WHEREAS, Kane and Sugar Grove have determined a mutually satisfactory allocation ofresponsibilities and costs for said Improvement as set forth in the intergovernmental agreement (a copy ofwhich is on file with the County Clerk's Office) with the Sugar Grove share of the construction of theImprovement estimated to be $442,000.00.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman thereof ishereby authorized to execute an intergovernmental agreement with the St. Charles Township RoadDistrict and the Sugar Grove Township Road District for the improvement of Dean Street and PrairieStreet.

SUMMARY: On May 28th, construction bids were opened at the Division of Transportation office for the 2014 Kane County Cold-in-PlaceRecycling Project which will involve portions of Dean Street, Harter Road and Prairie Road. We have coordinated thiscontract and executed Letters of Intent with the St. Charles Township Highway Commissioner for the improvement of DeanStreet (estimated at $238K) and Sugar Grove Township for the improvement of Prairie Road (estimated at $442K).

The scope of work involves surface course removal and treatment with an emulsified asphalt to restore stability to the base,followed by a hot-mix asphalt wearing surface or cape seal. Additional work includes aggregate shoulder placement, inletadjustments, combination curb and gutter removal and replacement, pavement marking and other misc. work.

The apparent low bidder for this project is Dunn Company of Decatur, Illinois with an as-read contract amount of$886,439.00. As allowed by contract standard specifications, quantities for two pay items were reduced by the St. CharlesTownship Highway Commissioner, resulting in a final contract amount of $870,235.16, which is 2.9% above the engineer'sestimate of $845,870.00.

WHEREAS, the County of Kane is authorized by law, pursuant to the Illinois Compiled Statutes,605 ILCS 5/5-801 (2014), to acquire real property for highway purposes by negotiated purchase oreminent domain proceedings; and

WHEREAS, the County of Kane has developed right of way plans for the Longmeadow ParkwayBridge Corridor, Kane County Sec. No. 94-00215-01-BR; and

WHEREAS, L & H Farm Limited Partnership, an Illinois limited partnership, the property ownerof Longmeadow Parkway Bridge Corridor Parcel Nos.1LN0070, 1LN0070TE-A, 1LN0070TE-B and1 LNOO7OTE-C which are legally described in Exhibit "A" attached hereto (a copy of which is on file inthe office of the Kane County Clerk), have offered to sell said described property (Parcel No. 1 LN0070),and grant temporary easements upon the property described as 1LN0070TE-A, 1LN0070TE-B and1 LN0070TE-C to the County of Kane for the amount of Eight Hundred Sixty Seven Thousand ThreeHundred Fifty Dollars ($867,350.00).

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the County of Kaneaccept the offer of L & H Farm Limited Partnership, the property owner of Longmeadow ParkwayBridge Corridor Parcel No.1LN0070, 1LN0070TE-A, 1LN0070TE-B and 1LN0070TE-C to sell saiddescribed property and grant temporary easements upon said described property to the County ofKane for the total amount of Four Hundred Sixty Seven Thousand Three Hundred Fifty Dollars($467,350.00) to be paid from the Transportation Sales Tax Fund #305, Line Item #74010 (HighwayRight-of-Way) and Four Hundred Thousand Dollars ($400,000.00) to be paid from the Upper FoxImpact Fee Fund #556, Line Item #74010 (Highway Right-of-Way) for a total of Eight Hundred SixtySeven Thousand Three Hundred Fifty Dollars ($867,350.00)and the Chairman of the Kane CountyBoard is hereby authorized and directed to execute a contract, real estate agreements and closingdocuments therefor.
