Whereas:

(1) On 16 February 1996 the Commission gave the European Parliament and the Council its

Report on the state of application of the general system for the recognition of

higher-education diplomas made in accordance with Article 13 of Council

Directive 89/48/EEC of 21 December 1988 on a general system for the recognition of

higher-education diplomas awarded on completion of professional education and training of at

least three years' duration 1; in this Report the Commission undertook to examine the

possibility of incorporating into that Directive the obligation to take into consideration, when

examining applications for recognition, experience gained following the award of the

qualification in question, the possibility of introducing the concept of "regulated education

and training"; the Commission also undertook to examine the arrangements whereby the role

of the Coordinating Group set up by Article 9(2) of Directive 89/48/EEC could be developed

in order to ensure more uniform application and interpretation of the Directive.

(2) The concept of regulated education and training, introduced by Council Directive 92/51/EEC

of 18 June 1992 on a second general system for the recognition of professional education and

training to supplement Directive 89/48/EEC 2 (both Directives being hereinafter referred to as

the "general system Directives"), should be extended to the initial general system and should

be based on the same principles by applying to it the same rules; it should be left to the

individual Member States to choose the means of defining professions covered by regulated

education and training.

1 OJ L 19, 24.1.1989, p. 16.2 OJ L 209, 24.7.1992, p. 25. Directive as last amended by Commission Directive 97/38/EC

(OJ L 184, 12.7.1997, p. 31).

(3) The general system Directives permit the host Member State to require, subject to certain

conditions, the applicant to take compensation steps, notably where substantial differences

exist between the theoretical and/or practical education and training undergone and that

covered by the qualification required in the host Member State; under Articles 39 and 43 of

the Treaty, as interpreted by the Court of Justice of the European Communities 1, the host

Member State must assess whether professional experience is sufficient in order to prove

possession of the knowledge which is lacking; in the interests of clarity and legal certainty for

individuals wishing to practise their profession in another Member State, it is desirable to

incorporate into the general system Directives the requirement that the host Member State has

to examine whether the professional experience gained by the applicant since obtaining his

qualification(s) covers the subjects referred to above.

(4) The coordination procedure provided for by the general system Directives should be

improved and simplified by enabling the Coordinating Group to adopt and publish opinions

on questions referred to it by the Commission that relate to the practical application of the

general system.

(5) In its Communication to the European Parliament and the Council on the SLIM initiative, the

Commission undertook to present proposals aimed at simplifying the updating of the lists of

qualifications eligible for automatic recognition; Council Directive 93/16/EEC of

5 April 1993 to facilitate the free movement of doctors and the mutual recognition of their

diplomas, certificates and other evidence of formal qualifications 1 provides for a simple

procedure in the case of general practitioners' qualifications; experience has shown that the

procedure affords sufficient legal certainty; it is desirable to extend it to qualifications held by

nurses responsible for general care, dental practitioners, veterinary surgeons, midwives,

pharmacists and doctors as referred to in Council Directives 77/452/EEC 2, 77/453/EEC 3

78/686/EEC 4, 78/687/EEC 5, 78/1026/EEC 6, 78/1027/EEC 7, 80/154/EEC 8, 80/155/EEC 9,

85/432/EEC 10, 85/433/EEC 11 and 93/16/EEC (hereinafter referred to as the "sectoral

Directives") respectively.

(6) According to the case-law of the Court of Justice of the European Communities,

Member States are not required to recognise diplomas, certificates and other evidence of

formal qualifications which do not testify to training acquired in one of the Member States of

the Community 1; however, Member States should take into account professional experience

gained by the person concerned in another Member State 2; that being so, it should be

stipulated in the sectoral Directives that recognition by a Member State of a diploma,

certificate or other evidence of formal qualification awarded to a nurse responsible for general

care, dental practitioner, veterinary surgeon, midwife, architect, pharmacist or doctor on

completion of education and training in a third country and professional experience gained by

the person concerned in a Member State constitute Community elements which the other

Member States should examine.

(7) The period within which Member States are to reach a decision on applications for

recognition of diplomas, certificates and other evidence of formal qualifications obtained by

nurses responsible for general care, dental practitioners, veterinary surgeons, midwives,

architects, pharmacists or doctors in a third country should be stipulated.

5103/3/00 REV 3 6DG C II EN

(8) The applicant must have right of appeal under national law if his application is rejected or if a

decision is not reached within the stipulated period; Member States are to state their reasons

for such decisions taken regarding the recognition of diplomas, certificates and other evidence

of formal qualifications held by nurses responsible for general care, dental practitioners,

veterinary surgeons, midwives, architects, pharmacists or doctors; where a Member State

decides to recognise a diploma, certificate or other evidence of formal qualifications, it should

be free to choose whether or not to state the reasons.

(9) For reasons of fairness, transitional measures should be taken in respect of certain dental

practitioners in Italy who hold diplomas, certificates or other evidence of formal qualifications

in medicine awarded in Italy but on completion of medical training begun after the deadline

stipulated in Article 19 of Directive 78/686/EEC.

(10) Article 15 of Directive 85/384/EEC 1 provides for a derogation during a transitional period

that has now expired; that provision should be deleted.

(11) There should be a clear distinction in Article 24 of Directive 85/384/EEC between the

formalities to be completed in the case of establishment and those to be completed in the case

of provision of services, thereby rendering more effective the exercise of the freedom to

provide services as an architect.

5103/3/00 REV 3 7DG C II EN

(12) According to the case-law of the Court of Justice of the European Communities 1, for reasons

of fairness, transitional measures should be applied in Italy in respect of certain holders of

diplomas, certificates and other evidence of formal qualifications in pharmacy awarded, on

completion of training that does not fully comply with Directive 85/432/EEC.

(13) It is desirable to extend the scope of mutual recognition of diplomas, certificates and other

evidence of formal qualifications in pharmacy in order to facilitate effective exercise of the

right of establishment between Greece and the other Member States; therefore, the derogation

provided for in Article 3 of Directive 85/433/EEC should be deleted.

(14) In its Report on specific training in general medical practice provided for by Title IV of

Directive 93/16/EEC, the Commission recommended that the requirements applying to

part-time training in general medical practice should be brought into line with those applying

to other medical specialisms.

(15) The general system Directives and the sectoral Directives, should be amended,

HAVE ADOPTED THIS DIRECTIVE:

STATEMENT OF THE COUNCIL'S REASONS

I. INTRODUCTION

1. The Commission submitted to the Council, on 3 December 1997, a proposal for a

Directive amending Directives 89/48/EEC1 and 92/51/EEC2 on the general system for

the recognition of professional qualifications and supplementing Directives

77/452/EEC, 77/453/EEC, 78/686/EEC, 78/687/EEC, 78/1026/EEC, 78/1027/EEC,

80/154/EEC, 80/155/EEC, 85/384/EEC, 85/432/EEC, 85/433/EEC and 93/16/EEC

concerning the professions of nurse responsible for general care, dental practitioner,

veterinary surgeon, midwife, architect, pharmacist and doctor.

This proposal is based on Articles 40 and 47(1), the first and third sentences of

Article 47(2) and Article 55.

2. The European Parliament adopted its first-reading Opinion at its sitting on 1 and

2 July 1998.

The Economic and Social Committee delivered its Opinion on 27 May 1998.

The Commission decided not to submit an amended proposal.

3. The Council adopted its Common Position on 20 March 2000, in accordance with

Article 251 of the Treaty.

II. OBJECTIVES

The proposed Directive incorporates into the general system the legal requirement to take into

account, when examining an application for recognition, experience gained after obtaining the

qualification in question. It introduces the concept of regulated education and training

contained in the second general system Directive and is designed to achieve more uniform

application and interpretation of the two general system Directives in the Member States.

1 Hereinafter the "first general system Directive".2 Hereinafter the "second general system Directive".

Page 79: EUROPEAN PARLIAMENT … · Directives 89/48/EEC and 92/51/EEC on the general system for the recognition of professional qualifications and Council Directives 77/452/EEC, 77/453/EEC,

5103/3/00 REV 3 ADD 1 ENDG C II 3

As regards the sectoral Directives, it will (among other things) facilitate efficient updating of

the technical provisions concerning the titles of qualifications eligible for automatic

recognition in the Member States. It will also help to ensure legal certainty as regards the

examination of education and training undergone in third countries by Community nationals.

III. THE COMMON POSITION

1. General remarks

The Council's Common Position follows the objectives set out in the Commission's

proposals, as indicated in section II supra. The Council has nevertheless introduced a

number of technical modifications in the proposal, in particular with the aim of

reinforcing the free movement of persons.

The Council has adopted the Common Position by unanimity.

The Council has not been in a position to accept the amendments proposed by the

European Parliament in the first reading. It should be taken into account that the

Commission did not accept the amendments either.

2. Specific remarks

The modifications introduced in the Commission's proposal are summarised below:

i) More specific description of "course of study" in the framework of the definition

of "regulated education and training" (Article 1(1), second tiret)

For the sake of consistency within the first general system Directive, the concept

"course of study" used in the Commission's proposal has been replaced with a

definition taken from Article 1(a), second tiret of the first general system

Directive. In particular, it has been made clear that the duration of the study must

be at least three years.

Page 80: EUROPEAN PARLIAMENT … · Directives 89/48/EEC and 92/51/EEC on the general system for the recognition of professional qualifications and Council Directives 77/452/EEC, 77/453/EEC,

5103/3/00 REV 3 ADD 1 ENDG C II 4

ii) Mutual recognition of proof of financial standing and of insurance cover

(Articles 1(4) and 2(4))

These provisions extend to the two general system Directives the provisions

contained in certain "transitional measures" Directives regarding mutual

recognition of proof of financial standing and of insurance cover against the

financial consequences of professional liability.

iii) Substantial difference to be covered by experience also at certificate level

(Article 2(2)and (3))

The provision contained in Article 2(1) for the diploma level has been extended to

cover recognition of certificate level. Therefore, the knowledge acquired by the

applicant in the course of his professional experience can cover the substantial

difference between his certificate and the diploma required by the host Member

State.

iv) Direct effect of amendments to Annexes C and D (Article 2(6))

In order to avoid lengthy implementation procedures in Member States,

Article 2(6) sets out an immediate application of any amendments made by the

Commission to Annexes C and D of the second general system Directive.

v) Insertion of Articles 3 to 6 of the Commission's proposal in the sectoral Directives

(Articles 3(4), 5(9), 7(4), 9(5), 11(1), 13(5) and 14(12))

For reasons of legal certainty, the contents of Articles 3 to 6 of the Commission's

proposal have been incorporated into each one of the sectoral Directives. This

change is purely technical.

Page 81: EUROPEAN PARLIAMENT … · Directives 89/48/EEC and 92/51/EEC on the general system for the recognition of professional qualifications and Council Directives 77/452/EEC, 77/453/EEC,

5103/3/00 REV 3 ADD 1 ENDG C II 5

vi) Examination of third-country diplomas (ancient Article 5 of the Commission's

proposal, now integrated in Articles 3(4), 5(9), 7(4), 9(5), 11(1), 13(5) and 14(12))

For a better protection of the holder of a third-country diploma, the Council has

decided to replace the words "Member States shall take account of diplomas" with

"Member States shall examine the diplomas…". This implies a more active

implication of the host Member State. Moreover, the examination deadline has

been reduced from four to three months.

vii) No need to state the reasons of a positive decision on the recognition of a diploma

(last sentence of Recital 8, to be read in conjunction with Articles 3(4), 5(9), 7(4),

9(5), 11(1), 13(5) and 14(12) (ancient Article 6 of the Commission's proposal))

In order to provide for a faster recognition procedure, Member States will not be

obliged to justify positive decisions recognising diplomas.

viii) Inclusion of certain Spanish specialised doctors ("MESTOS") in the scope of

Directive 93/16/EEC (Article 14(8))

This provision aims at taking into account the specific situation of certain Spanish

specialist doctors without official qualifications who received an unofficial form

of training which was nevertheless similar in quantity and quality to that obtained

by those who followed the official residence-based system.

ix) Revision clause (Article 15)

The Council has included a revision clause concerning Article 1(2) and (2), which

system Directive.

IV. EUROPEAN PARLIAMENT'S AMENDMENTS

The Council felt that amendments 1, 4, 6, 7, 8, 9 and 11, which were designed to oblige

Member States to inform the Commission if they intended to impose compensation measures

in each of the sectors, were not consistent with the SLIM initiative, as they would lengthen

the recognition procedures and, therefore, be detrimental to migrants. These amendments

would not be consistent with the general system either, as the latter foresees a case-by-case

treatment of applications for recognition.

Amendments 5 and 10, which were designed to ensure that the Coordinators Group's

deliberations were widely publicised, are not in line with SLIM. Indeed, the publicity

proposed in these amendments would lengthen the Commission's works and would endanger

the quality of the debates, which are mainly technical. In any case, the final result of the

works of the Group is published in the Code of Conduct.

Amendment 12, which would lengthen the procedure proposed by the Commission for

updating lists of qualifications and delay its application, does not follow the principles in

SLIM and could create some legal uncertainty.

Amendments 3 and 13 are designed to introduce automatic recognition of qualifications

obtained in a third country if the qualifications are already recognised by the first host

Member State. The Council considered it wiser to defer examination of this issue until the

Commission's report, due in 2000, on the general system for the recognition of qualifications

had been published. The same was true of amendments 15 to 21, which concerned general

practitioners.

Amendments 2 and 14 related to the Directive on architects. The rapporteur specified that

amendment 14 would bring all Irish architects within the scope of the Directive, which was

not currently the case. As this matter is currently under study in the Commission, the Council

preferred to await the completion of the Commission's works.

V. CONCLUSION

The Council considers that all the modifications made to the Commission proposal meet the

objectives of the proposed Directive, in particular the simplification objective of the SLIM

initiative and the facilitation of free movement.

The Council adopted a Common Position on 20 March 2000.

2. SUBJECT OF THE COMMISSION PROPOSAL

The proposal for a Directive is intended to:

- implement the recommendations of the SLIM team on the "recognition ofdiplomas" by facilitating the updating of the lists of diplomas, certificates and otherevidence of formal qualifications eligible for automatic recognition.

- introduce other - often technical - amendments intended to improve the legalcertainty or to make it easier to interpret the Directives in question and improve theirfunctioning.

3. COMMENTS ON THE COMMON POSITION

3.1. General remarks

The Council unanimously adopted the Commission proposal after incorporatingseveral amendments intended to reinforce the freedom of movement of persons. After resuming its examination of the situation of specialised nurses, which it hadembarked upon when examining the transitional Directives on the mutual recognitionof professional qualifications, it decided not to include any special provision in thecurrent proposal for a Directive presented by the Commission.

3.2. The European Parliament's amendments adopted on first reading

The Council did not accept any of the amendments adopted by the EuropeanParliament on first reading. The Commission had not amended its initial proposal.

3.3. Amendments introduced in discussions with the Council

3.3.1. General system for the recognition of professional qualifications

The Council made a number of clarifications intended to make Directives 89/48/EECand 92/51/EEC clearer, improve their legal certainty and strengthen theireffectiveness.

It clarified several elements of the definition of regulated training. Amongst these, itspecified that the course of studies referred to in that definition must last at leastthree years, and it extended to Directives 89/48/EEC and 92/51/EEC provisionscontained in other Directives on the mutual recognition of professionalqualifications, with a view to making it easier to prove financial capacity where thisis required for access to a regulated profession.

It also reinforced the obligation on the competent authorities to take account ofknowledge acquired by the migrant in the course of his professional experience. Themigrant may, for instance, show that the knowledge acquired in the course of hisprofessional experience is such as to compensate, either partly or wholly, forsubstantial differences between the diploma and the qualification obtained.

Finally, the Council proposed speeding up the implementation of the amendments toAnnexes C and D of Directive 92/51/EEC.

3.3.2. Sectoral Directives on the mutual recognition of diplomas

The Council improved the protection of the holder of a diploma acquired outside theEuropean Union by stipulating that that diploma must be examined within threemonths.

It also speeded up the procedure for recognising all diplomas by dispensing with theobligation to justify decisions in favour of the applicant.

In addition, in the case of medical or dental specialisations which are subject not toautomatic recognition but to individual recognition, the Council has obliged thecompetent authorities to take account not only of the specialised training acquired, as

Page 88: EUROPEAN PARLIAMENT … · Directives 89/48/EEC and 92/51/EEC on the general system for the recognition of professional qualifications and Council Directives 77/452/EEC, 77/453/EEC,

already laid down in the Directives, but also of the ongoing training which may havebeen acquired by the applicant.

Finally, as proposed by the Commission with a view to regularising the situation ofcertain dentists and pharmacists, it introduced a provision allowing the situation ofcertain specialised doctors and of psychiatric nurses to be regularised, provided thattheir level of training corresponds to the requirements of the relevant sectoralDirective.

3.4. Position of the Commission on the amendments introduced in the Council

The Commission accepts the amendments made as a result of the Council's work.

4. CONCLUSIONS

The Commission considers that the common position is an appropriate addition tothe proposal for a Directive presented by the Commission.
