However, subject to the following terms and conditions and in compliance with local law and regulation, you may also be entitled to the following Lim-ited Warranty from Intel in addition to your rights against the Seller. Further detail and local language support regarding Intel’s Limited Warranty can be found at: www.intel.com/support/go/Edison.

This Intel One Year Limited Warranty:

• is a voluntary manufacturer's warranty from Intel. It lasts for one year from the original date of purchase of a new Edison board when that Edison board was purchased in its original sealed packaging (and is what we mean when we use the words a “new Edison board”);

• applies in only those countries in to which Intel has authorized its sale;• gives you extra rights which are separate and in addition to (and not

instead of) your rights against the Seller;• gives you extra rights which are separate and in addition to (and not

instead of) your rights under consumer and consumer protection law.

What does this Intel one-year limited warranty cover? Intel warrants two things. First, we warrant that the new Edison board, as delivered, if properly used and installed, will conform to Intel’s specifications (which can be found at www.intel.com/support/go/Edison) and will be free from manufacturing and material defects that affect performance against the specifications for 1 year from the original date of purchase of the new Edison board. Second, for 1 year from the original date of purchase of the new Edison board, we warrant that the new Edison board itself complies with product regulatory requirements (for example, CE markings in Europe) for those countries in which Edison is authorized for sale. Intel makes no other promises or warran-ties about the Edison board.

What is not covered by this Intel one-year limited warranty? The following are excluded from the warranties above:

• Normal wear and tear and cosmetic damage. This means things like scratches, dents and broken plastic on ports, that don’t result from a default of the Edison board, although it can be other things too;

• Damage caused by use of the Edison board with another product; • Damage from or to, or caused by, any other hardware or software (for

example, the Arduino™ software) used with the Edison board; • Any failures caused by neglect, misuse (for instance, use in contravention

to the user manual or the technical specifications or use of the Edison board in or near water), or modification of the Edison board;

• Any responsibility for regulatory compliance (for example, compliance with CE markings in Europe) of the Edison board when it is combined with other products or software. This is your responsibility, because we don’t know what you will make of the Edison board;

• Any use in applications which are in or related to the following fields: aerospace, medical, military, nuclear or any other mission-critical or safety-critical fields;

• Any damage caused by using the Edison board without a power supply, or with the wrong power supply; and

• Any consequence resulting from accident, earthquake, fire, or other external cause outside of Intel’s control.

What is the practical effect of the Intel One Year Limited Warranty? If during the 1 year from the original date of purchase of the new Edison board the board fails to perform in accordance with the limited warranty, you should contact Intel at www.intel.com/support/go/Edison where you will find the step-by-step process to handle your return. Once we verify that you are enti-tled to take advantage of the warranty process, Intel may in its sole discretion and option: (i) repair the Edison board, which will extend the original warranty period by an additional 90 days; or (ii) replace the Edison board, wherein the original warranty period will apply; or (iii) refund to you your documented costs of purchasing the failed Edison board.

Please note that you may choose not to take advantage of these extra Intel warranty rights. You may choose to use your other rights against whomever sold you the Edison board. The Intel limited warranty rights in this document are in addition to (and not instead of) your contractual rights and your con-sumer law and consumer protection rights.

Disclaimers and limitation of liability

Under the Intel One-Year Limited Warranty, Intel will never be liable for:

(i) any loss or damage that was not caused by Intel’s breach of the Intel One-Year Limited Warranty;

(ii) any loss or damage that was not reasonably foreseeable when you purchased the new Edison board. The sort of thing Intel is not responsible for includes (but is not limited to) loss or damage which is lost profits, loss of opportunity, or loss of data.

本書に記載されているインテルの 1 年限定保証は、

• 該当製品のメーカーであるインテルが自発的に行う保証で、その期間は、最初の購入者が、封印されオリジナル

パッケージに入れられた状態にある Edison 開発ボード ( 弊社では、この状態のボードを「新品の Edison 開発

ボード」と称しています ) を購入した日より 1 年間となります。

• インテルが自社製品の販売権を有する国でのみ適用されます。

• お客様が、責任販売店に対して別途行使できる保証請求権に加えて (「に代えて」ではありません ) インテルに

対して行使できる保証請求権に基づき提供されるものです。

本書に記載されているインテルの 1 年限定保証の対象となる事項。 インテルは、次の 2 つの事項について保証しま

す。 弊社が保証する 1 つ目の事項は、「新品の Edison 開発ボードは、引渡時に示される方法で適切に設置して使用

する限り、最初の購入者が該当ボードを購入した日から 1 年間は、インテルの仕様 (www.intel.com/support/go/

Edison に掲載 ) 通りに作動し、そのような作動に影響を及ぼす製品の材料や製造方法に起因する欠陥が生じないも

のである」という内容です。2 つ目の事項は、「最初の購入者が新品の Edison 開発ボードを購入した日より 1 年間

本書に記載されているインテルの 1 年限定保証の対象とならない事項。 下記の事項は、前述の保証の対象となりません。

• 通常使用に伴う摩耗および裂傷ならびにボード表面の損傷。これには、Edison 開発ボードの欠陥に起因するも

のではない、引掻き傷、へこみ、各ポート上にあるプラスチックの破損、その他の損傷が含まれます。

• Edison 開発ボードを他の製品とともに使用したことに起因する損傷。

• Edison 開発ボードとともに用いた他のハードウェアもしくはソフトウェア (Arduino ™ ソフトウェアなど ) に起

因する損傷、または当該ハードウェアもしくはソフトウェアに対する損傷。

• Edison 開発ボードの乱用、誤用 ( ユーザーマニュアルもしくは技術仕様書の内容に反する方法での使用、また

は水中もしくは水辺でのボードの使用など ) あるいは改造に起因する欠陥。

• Edison 開発ボードを他の製品またはソフトウェアとともに使用する場合に果たすべき、適用される規制 ( 欧州

諸国にて適用される CE マークに関する規制など ) に従って該当ボードを使用する責任。弊社では、お客様によ

る Edison 開発ボードの用法について把握できないため、この責任は、お客様が果たすこととなります。

• 航空宇宙、医療、軍事、原子力、その他のミッション・クリティカルなもしくはセーフティー・クリティカルな

分野における用途、あるいはそれらの分野に関連する用途での使用。

• 電源装置を用意することなく、または問題のある電源装置とともに Edison 開発ボードを使用したことに起因す

るあらゆる損傷。

• 不慮の事故、地震、火災またはインテルが管理できないその他の外的要因に起因するあらゆる影響。

インテルの 1 年限定保証に関する実務での手続など。最初の購入者が新品の Edison 開発ボードを購入した日より

1 年の期間中に、該当ボードが、本限定保証の内容に従って作動しない状態となった場合、お客様は、該当ボードを

返品する際に経るべき段階的手順などについて掲載されている www.intel.com/support/go/Edison に従ってインテ

ルに連絡する必要があります。インテルは、お客様に保証を受ける資格があると判断した場合は、単独かつ自由裁量

で、(i) 該当する Edison 開発ボードを修理して当初の保証期間を 90 日延長すること、(ii) 該当ボードを交換し、

当初の保証期間の範囲内で保証を継続すること、または (iii) 該当ボードの購入費用としてお客様が記録している

額を返金することのいずれかを選択できます。

お客様は、本書に記載されているインテルに対する追加保証請求権を行使せず、Edison 開発ボードをお買上げいた

だいた販売店に対して行使可能な他の権利を行使することも選択できます。本書に記載されているインテルに対する

限定保証請求権は、お客様が、その他の契約ならびに消費者および消費者保護に関する各法に基づき別途行使できる

保証請求権に加えて (「に代えて」ではありません ) 行使できる権利です。
