The Department performed file reviews on August 4, 2014, August 15, 2014, March 31, 2015, June 6, 2015, and August 5, 2015, and inspected the facility on June 3, 2014. The Individual/Entity has violated the South Carolina Underground Storage Tank Control Regulations as follows: failed to pay annual tank registration fees, failed to provide documents upon request; failed to maintain corrosion protection on a temporarily closed UST system; failed to permanently close an UST system that has been temporarily closed for greater than 12 months; failed to demonstrate financial responsibility; and, failed to provide financial responsibility to the Department upon request.

Action: The Individual/Entity is required to: submit a Certificate of

Financial Responsibility and proof of financial responsibility mechanism; submit a completed Tank and Sludge disposal form, and upon approval, permanently close the USTs by removing them from the ground or filling with inert foam; pay annual tank registration fees and associated late fees for fiscal years 2012, 2013, 2014, 2015, and 2016, in the amount of five thousand, two hundred thirty dollars ($5,230.00); and, pay a civil penalty in the amount of eleven thousand, six hundred fifty dollars ($11,650.00).

On March 24, 2016, the Department issued a Notice of Alleged Violation because the vent pipes were not the correct height and did not have rain caps; there was no A/B operator log available at the time of the inspection; there was no rectifier log available at the time of the inspection; there were broken/exposed wires to the impressed current system in the parking lot; there was no current corrosion protection system test results available; and, the rectifier was not turned on. The Individual/Entity has violated the South Carolina Underground Storage Tank Control Regulation as follows: failed to install tanks and piping in accordance with manufacturer’s instructions; failed to provide records to the Department upon request; failed to validate monthly requirements have been performed; failed to physically visit each assigned facility once a quarter; and, failed to maintain corrosion protection on a temporarily closed UST.

Action: The Individual/Entity is required to submit: proof that vent lines have been repaired; proof that an a/b operator log is being kept; current corrosion protection system test results; proof that exposed/broken wires have been replaced/repaired and that the rectifier is operational; the most current rectifier reading; and, pay a civil penalty in the amount of three thousand, six hundred fifty dollars ($3,650.00). 4) Order Type and Number: Administrative Order 15-0463-UST

On August 14, 2015, the Department conducted an inspection of the Facility and issued a Notice of Alleged Violation because there was no trained A/B Operator and no A/B Operator log available at the time of the inspection; no power going to the Facility and the rectifier was not operational at the time of the inspection; no Certificate of Financial Responsibility at the Facility; and no current registration certificate at the Facility. The Individual/Entity has violated the South Carolina Underground Storage Tank Regulation as follows: failed to provide records to the Department upon request; failure to have a trained A/B operator; failed to validate monthly requirements have been performed; failed to physically visit each assigned facility once a quarter; failed to maintain corrosion protection on a temporarily closed UST system; failed to maintain a Certificate of Financial Responsibility; and, failed to display a current registration certificate at the Facility.

Action: The Individual/Entity is required to: submit proof that electricity is maintained for the corrosion protection system and submit the most current month’s reading on the rectifier, or permanently close the USTs; designate an A/B operator and complete operator training; submit an A/B Operator log; submit a completed Certificate of Financial Responsibility; pay annual UST registration fees for fiscal years 2013 through 2016 and associated late fees in the amount of six thousand, twenty dollars ($6,020.00); and, pay a civil penalty in the amount of three thousand, four hundred fifty dollars ($3,450.00).

On December 11, 2015, the Department conducted a routine inspection of the facility and issued a Notice of Alleged Violation because there was no financial responsibility documentation on file with the Department; there was no trained a/b operator listed with the Department and no a/b operator logs, no release detection records, no current line tightness and line leak detector test results available at the time of the inspections, no current corrosion protection system test results available at the time of the inspection; no Certificate of Financial Responsibility available at the time of the inspection; and, no current registration certificate available at the time of the inspection. The Individual/Entity has violated the South Carolina Underground Storage Tank Control Regulation as follows: failed to monitor secondary containment using interstitial monitoring; failed to have the corrosion protection system inspected by a qualified tester every three years; failed to provide records to the Department upon request; failed to complete a/b operator training; failed to validate monthly requirements have been performed at the facility; failed to physically visit each assigned facility once a quarter; failed to provide adequate release detection methods for an UST system; failed to conduct an annual line tightness test on pressurized lines or have monthly monitoring; failed to conduct annual test of automatic line leak detectors and/or sump sensors; failed to provide financial responsibility for an UST system; failed to demonstrate financial responsibility upon request from the Department; and, failed to pay annual tank registration fees and associated late fees for fiscal years 2015 and 2016.

Action: The Individual/Entity is required to submit: submit proof of interstitial monitoring; current corrosion protection system test results; proof that a/b operator training has been completed; proof that an a/b operator log is being kept; current tank tightness, line tightness, and line leak detector test results and or sump sensor test results; a completed Certificate of Financial Responsibility and proof of financial mechanism; pay annual tank registration fees and associated late fees in the amount of two thousand, one hundred seventy-eight dollars ($2,178.00); and, pay a civil penalty in the amount of nine thousand, eight hundred dollars ($9,800.00). 6) Order Type and Number: Consent Order 16-0045-UST

The Individual/Entity has violated the South Carolina Underground Storage Tank Control Regulations as follows: failed to use overfill prevention equipment that will automatically shut off flow into the tank when the tank is no more than 95 percent full.

Action: The Individual/Entity is required to: pay a civil penalty in the

Summary: eCycling International SC, LLC and eCycling Property

Holdings, LLC (Individual/Entity) are the operators of an unpermitted Class Three Landfill. A Notice of Alleged Violation was issued on November 19, 2015, as a result of a complaint and confirmation of unauthorized disposal of solid waste. The Individual/Entity has violated the South Carolina Solid Waste Policy and Management Act of 1991 and the South Carolina Solid Waste Management: Solid Waste Landfills and Structural Fill Regulation as follows: operated a Class Three Landfill without first obtaining a permit from the Department and failed to recycle at least 75% by weight of materials received during the previous calendar year.

Action: The Individual/Entity is required to: stop receiving recyclable material; submit disposal receipts documenting the removal and disposal of all solid waste and recyclable material placed on the ground and in the building; and, pay a civil penalty of five thousand dollars ($5,000.00).

Mining Enforcement

Summary: Boggs Paving, Inc. (Individual/Entity) operates a mine located

in York County, South Carolina. On November 8, 2014, the Department re-issued, via memorandum, the Mining General Permit (GP1) and Reclamation Plan to all mines operating under the General Permit requiring existing mines to submit

financial assurance in the amount of ten thousand dollars ($10,000.00) for reclamation. The Individual/Entity has violated the South Carolina Mining Act and the South Carolina Mining Regulation as follows: failed to submit financial assurance in the amount of ten thousand dollars ($10,000.00) for reclamation.

Action: The Individual/Entity is required to: submit a Voluntary Termination of Mine Operations and begin reclamation of the mine within one hundred eighty (180) days following termination of mining, or submit a financial assurance mechanism in the amount of ten thousand dollars ($10,000.00); and, pay a civil penalty in the amount of six hundred dollars ($600.00) in accordance with the terms of a promissory note.

Summary: Hilton Hall Mining, LLC (Individual/Entity) owns and operates the Hilton Hall Mine located in Colleton County, South Carolina, which is permitted under the General Permit (GP1-002051). On September 24, 2015, the Department sent a letter to all mines operating under the General Permit extending the deadline for submission of the financial assurance to October 26, 2015, or submit a Voluntary Termination of Mine Operations Form. The Individual/Entity has violated the South Carolina Mining Act and the South Carolina Mining Regulation as follows: failed to submit the required financial assurance or the Voluntary Termination of Mine Operations form.
