COMMUNITY RELATIONS PLANMAYWOOD CHEMICAL COMPANY

AND VICINITY PROPERTIES SITEMAYWOOD, BERGEN COUNTY, NEW JERSEY

This draft community relations plan describes issues of communityconcern related to the Maywood Chemical Company and VicinityProperties site (Maywood Chemical Company site) in Maywood,Bergen County, New Jersey, and describes community relationsactivities to be conducted by the U.S. Environmental ProtectionAgency (EPA) as part of their oversight responsibilities underthe Comprehensive Environmental Response, Compensation, andLiability Act (CERCLA), better known as Superfund. Theseresponsibilities include overseeing the investigatory activitiesof the U.S. Department of Energy (DOE), and their subcontractors(Bechtel National Inc., and Eberline) under DOE's FormerlyUtilized Sites Remedial Action Program (FUSRAP), and the RemedialInvestigation and Feasibility Study (RI/FS) being conducted bythe Stepan Company (successor to the Maywood Chemical Company)along with their contractor (CH2M Hill). The latters1 activitiesat the site are in accordance with a consent agreement enteredinto by the Stepan Company and EPA in September 1987. Theobjective of both DOE and Stepan Company's investigations is tocharacterize the nature and extent of chemical, non-radiologicalcontamination as defined in the consent agreement at the site andto explore potential remedies for cleanup of this contamination.The community relations program outlined in this plan focuses onactivities designed to provide interested citizens and localofficials with ongoing information about site activities and toaddress specific areas of community concern.

This plan is based on community interviews conducted in theSummer of 1988 with residents and local officials in Maywood, NewJersey. This plan is divided into the following sections:

Site Background;

Community Background and Key Issues;

Objectives of the Community Relations Program at theMaywood Chemical Company Site;

Suggested Community Relations Activities; and

Preliminary Schedule and Staffing Plan.

In addition, Appendix A identifies suggested locations for site-specific information repositories and public meetings conductedby EPA near the Maywood Chemical Company site. Appendix Bincludes a contact list of key federal, state, and localofficials, area businesses and members of the local news media.

I. SITE BACKGROUND

A. Site Description

The Maywood Chemical Company Superfund site consists of severalparcels of land in a mostly residential area of Maywood near NewJersey Highway 17, Maywood Avenue, and the New York, Susquehanna& Western Railroad (see Exhibits 1 and 2). The Borough ofMaywood lies between the Hackensack and Passaic rivers, about 15miles west of New York City. The site, Maywood Chemical Company,is occupied by a number of commercial and light industrialbusinesses.

Most of the approximately 90-acre site is bounded by the above-mentioned road and railroad. The site includes several adjacentproperties, in addition to Sears and the Stepan Company property,along Route 17 and Maywood Avenue, and identified as Gulf Oil,Sunoco Oil, Federal Express, Hunter Douglas, AMF Voit, and DeSaussure (see Exhibit 2). Also included in the central portionand lying along the northern boundary of the Stepan Companyproperty is the Maywood Interim Storage Site, a secured interimradioactive waste storage facility. As the RemedialInvestigation of the site progresses and the nature and extent ofpotentially site-related chemical contamination is determined,the exact boundaries of the site study area will be moreaccurately defined.

The site is near the communities of Rochelle Park and Lodi whichform the western boundary of Maywood. Natural land features inthe area include two brooks, Westerly Brook and Lodi Brook, eachflowing southward through the site and into Rochelle Park andLodi, respectively. The brooks eventually discharge to theSaddle River, west of Main Street, Maywood.

B. Site History

The Maywood Chemical Company was founded in 1895. In the yearsbetween 1916 and 1957, the company's operations involvedextracting thorium1 from monazite and manufacturing of mantles(such as those used in lanterns). Waste products generatedthrough the extraction process included clay-like dirt thatcontained natural radioactive materials. Other non-radioactivewaste products were also generated by the company. The company

stored the waste in piles on the site and periodically used thewaste to fill in nearby swampy land.

The predecessor of the federal Nuclear Regulatory Commission(NRC), the Atomic Energy Commission (AEC), issued a license toMaywood Chemical Company in 1954 authorizing storage of thoriumwaste on the company's property. In 1959, the Stepan ChemicalCompany (later renamed the Stepan Company) purchased the MaywoodChemical Company. The Stepan Company produces various non-radioactive chemical products for sale to industry. The StepanCompany renewed the AEC license for possession of radioactivematerial, and in 1963 received permission from the AEC to cleanup and bury piles of thorium waste on the property. By 1968 whenthe cleanup was complete, 20,000 cubic yards of thorium waste hadbeen consolidated and stored on the southern portion of thecompany's property.

c. Investigations conducted to Date

DOE and EPA, as well as the New Jersey Department ofEnvironmental Protection (NJDEP), are jointly involved ininvestigative and remedial activities at the Maywood ChemicalCompany site. DOE's activities, in compliance with FUSRAP, focuson addressing site-related radiation contamination problems. EPAis acting under the federal Superfund program, and is providingoversight both to DOE, and to the Stepan Company in theirinvestigation of site-related chemical non-radiologicalcontamination problems. EPA also consults with NJDEP with regardto all remedial activities taken at the site.

Contamination problems were first suspected at the site inSeptember 1980 when a local resident discovered the presence ofradioactive contamination on an area property in Maywood. Afterthe discovery of radiological contamination was reported to stateofficials, NJDEP inspected the area and collected on-site soilsamples. The results of the soil testing indicated the presenceof radioactive contamination on the property. NJDEP reported thefindings of the soil testing to the NRC. An aerial survey wasconducted in 1981 over a four-square-mile area near the site todetermine the extent of possible off-site radiologicalcontamination. The survey detected radiological contamination oncommercial and residential properties in Maywood, Rochelle Park,and Lodi.

The findings prompted EPA to evaluate whether the sitequalified for the Superfund National Priorities List (NPL), EPA'sroster of uncontrolled hazardous waste sites nationwide that areeligible for investigation and possible cleanup under the federalSuperfund program. Following on-site inspections and preliminaryinvestigations, EPA placed the Maywood Chemical Company site onthe NPL in December 1982.

As a result of a characterization study of chemicalpollutants subsequently performed by Ebasco Services Inc.(Ebasco) for EPA and EPA's evaluation of all existing relevantinformation, a Special Notice for conduct of a RemedialInvestigation/Feasibility Study (RI/FS) at the site was issued toStepan Company and all owners of contaminated property. Afterseveral negotiations meetings with the responsible parties,Stepan Company offered a good faith proposal to conduct theRI/FS. As a result of further negotiations between EPA andStepan Company, an Administrative Order of Consent was developedand agreed upon.

While an RI/FS Work Plan was subsequently being developed toaddress the Sears and adjacent properties, EPA conducted testingon the Stepan Company property between August and October, 1987,and March and April, 1988. EPA's contractor, Ebasco, collectedsamples of soil and groundwater on-site together with DOE'sconsultant Bechtel National Inc. Soil sample analyses detectedvolatile and semi-volatile organic compounds, pesticides, andmetal contaminants. The groundwater sample analyses alsodetected many volatile and semi-volatile organic compounds,pesticides, and metal contaminants. These hazardous substanceswere found in the soil and groundwater at levels which EPAdetermined sufficient to warrant further investigation.

Because of the soil and groundwater contamination found on theStepan Company property, the investigation of the Stepan Companyproperty will now be undertaken as part of the original RI/FS ofthe Sears and adjacent properties. EPA expects the RI to beginduring the fall of 1989.

DOE's involvement with the site was mandated through anAppropriations Bill, Congressional Act PL98-50, which directedDOE to investigate and clean up radioactive contamination at foursites, including the former Maywood Chemical Company property.In 1984 and 1985, DOE removed contaminated soil from the BailedCompany property, and from 25 residential properties in Maywood,Rochelle Park, and Lodi. After removal, the contaminated soilwas transported to the Maywood Interim Storage Site (MISS) forinterim storage. DOE continued to assess potential off-siteradioactive contamination following these initial removals, andsubsequently removed contaminated soil from 10 additional Maywoodand Rochelle Park properties.

DOE's remedial activities related to radioactive contamination atthe site and area properties is continuing. If it is determinedthat additional properties are contaminated with radioactivewaste, the contaminated soil will be removed and stored in theMISS. DOE also currently conducts quarterly monitoringactivities at the MISS to ensure compliance with radiationstandards, and is assessing options for permanent remediation ofexcavated soil.

II. COMMUNITY BACKGROUND AND KEY ISSUES

A. Community Profile

The Maywood Chemical Company site is located in a denselydeveloped area in Maywood, Bergen County, New Jersey. TheMaywood governing body consists of an elected Mayor and sixelected council members. Maywood has a population ofapproximately 10,000 residents.

Residents of Maywood have a strong sense of community pride andidentity. Many of the town's families have lived in Maywood forgenerations, relying on local industries, including the MaywoodChemical Company and later the Stepan Company, for employment.

According to public officials interviewed, residents of Maywoodare aware of the potential environmental problems in their town.As a means of monitoring the environmental concerns of thecommunity, the mayor has established a Mayor's Advisory Councilto keep the governing body informed of any developments regardinggeneral problems, and problems specific to the Maywood ChemicalCompany site.

Congressional representatives to the area have exhibited interestin the Maywood Chemical Company site, and the Lodi Municipal Wellsite, another Superfund site located in the adjacent municipalityof Lodi, New Jersey. However, residents are critical of therepresentatives, expressing concern over their effectiveness inexpediting possible cleanup of the sites.

Although Maywood residents are served by the municipal watersupply rather than individual wells, members of the community areconcerned that area groundwater supplies are contaminated. Inaddition, concern has been expressed regarding the quality ofwater in several small streams running through the community.Residents interviewed emphasized the importance of keeping localgroundwater free of contamination and expressed their concernregarding the possible effect that site-related contaminationcould have on the lifestyles and health of future generations.

B. History of Community InvolvementCommunity concern over the Maywood Chemical Company site hasremained relatively high over the last decade, and particularlyover the last four years. Area newspapers have regularlypublished articles regarding the site, many of which concern thepolitical aspects of the proposed cleanup.

The residents have established a group known as the Coalition ofConcerned Citizens, which launched an intensive letter-writingcampaign in 1984. A petition circulated by the Coalition of

Concerned Citizens regarding the cleanup of the Maywood ChemicalCompany site collected more than 2,750 signatures. This numberrepresents more than 25 percent of Maywood's population. TheCoalition of Concerned Citizens has continued to contact federal,state, county and local officials regarding the remediation ofthe site, and in 1987 several members of the group were appointedto the Mayor's Advisory Council.

In recent years, concern has increased regarding the previouslymentioned Lodi Municipal Well site. Speculation exists that manyyears ago contaminated soil from the Maywood Chemical Companysite may have been transported to Lodi for use as fill. However,Maywood residents are reluctant to acknowledge the possibleconnection between the two sites, and maintain that these areseparate sites and separate issues. A major concern of Maywoodresidents is that officials may propose any movement of thecontaminated soil from Lodi to Maywood.

C. Key Community Concerns

For years, there has been active, organized interest in the site.Community interviews identified several major concerns that wereconsistently expressed by the residents and officialsinterviewed. Many of these concerns are not new, have not beenresolved and will continue to be addressed throughout the courseof remedial activities at the site.

Specific issues provided by residents and local officials duringthe community interviews are described below.

1. Health and Safety

Several residents expressed an interest in an epidemiologicalstudy to determine if there is a link between the possiblegroundwater contamination and a number of cancer-relatedillnesses in the area. Residents also expressed concernregarding potential negative health effects that site-relatedcontamination could have on the lifestyle and health of futuregenerations.

2. Storage of Thorium-Contaminated Soil

A current major issue to Maywood residents is the possibility ofthorium-contaminated soil from remediations in Lodi being removedand deposited at the Maywood site. Residents and officialsrepeatedly voiced concern over the possibility that the Lodisoils would be transferred to Maywood.

3. Groundwater Contamination

Residents are very aware and concerned about the potential forgroundwater contamination migrating from the Maywood Chemical

Company site. Residents interviewed expressed general concernabout protecting area groundwater from site-relatedcontamination. Several residents interviewed specifically statedthat all contaminated waste should be removed from the site.

4. Technical Assistance Grants

Residents specifically asked for additional information on EPA'sTechnical Assistance Grant (TAG) Program, through which citizengroups can receive up to $50,000 per Superfund hazardous wastesite to allow them to hire an independent consultant to reviewand interpret documents relating to site remediation efforts.The residents expressed satisfaction with EPA's efforts to informthem of the TAG program and stated they were appreciative of theopportunity to apply for such funds.

5. Coordination with Local Officials and Civic Leaders

Local officials and residents requested that EPA keep themapprised of planned activities at the site. Officials andresidents interviewed stated that, in addition to electedofficials, it would be beneficial for civic leaders to benotified in advance of EPA meetings and major site activities.

III. OBJECTIVES OF THE COMMUNITY RELATIONS PROGRAM AT THE MAYWOODCHEMICAL COMPANY AND VICINITY PROPERTIES SITE

By providing the community with an opportunity to learn about andparticipate in the Superfund remedial process, the communityrelations program for the Maywood Chemical Company and VicinityProperties site will address concerns expressed by citizens andlocal officials gathered during community interviews. EPA'scommunity relations effort will focus on providing residents andlocal officials with accurate and timely information aboutfindings and developments at the site and ensuring effectivecoordination with local elected officials and civic leaders.Information, such as updates, should be published at regularlyscheduled intervals throughout the work at the site. Recommendedapproaches for this and community relations activities arediscussed in detail below.

1. Ensure active and regular coordination of activities withlocal officials and civic leaders.

Effective coordination with the citizen groups in the Maywoodarea will require routine contact with municipal, county, andstate officials. Leaders of local civic groups, representativesof key community and environmental associations, and school boardmembers also should be kept informed of site activities. In thisway, site-related information will reach a broader audience.Regular contact with community leaders will ensure that accurate

information about the site reaches community members throughvarious civic organizations. This will also enable EPA toestablish good relationships with these groups, giving residentsadded confidence in EPA. In addition, direct contact can, inturn, encourage community leaders to contact EPA directly withquestions or concerns that arise, thereby allowing EPA communityrelations staff to be aware of any shifts in the level or type ofpublic concern regarding the site.

2. Maintain a central contact at EPA.

Identification of a central EPA contact can ensure that timely,understandable, and consistent responses are provided to anyquestions raised by local officials, civic leaders, residents,and the news media concerning the site.

3. Educate area residents about the procedures, policies, andrequirements of the Superfund program.

EPA community relations staff should familiarize the communitywith the sequence of events that take place during a Superfundcleanup and explain the importance of each event. Thisinformation will help residents understand the time framerequired for adequate remedial efforts. Additionally, thecommunity will become better acquainted with opportunities forpublic involvement during the various phases of the Superfundprocess. An important part of this educational process shouldinclude providing residents with more information regarding theTAG program.

4. Provide Maywood residents with opportunities to askquestions about site activities.

Residents and officials interviewed stressed that Maywoodresidents are likely to have many questions about siteactivities. Residents suggested that any public meetings held byEPA about the Maywood Chemical Company and vicinity propertiessite should allow adequate opportunity for a question and answerperiod. In addition, residents requested that information aboutother Superfund sites in the area be made available. Also,residents who have questions or comments during the time betweenpublic meetings should be encouraged to call EPA and voice theirconcerns.

5. Provide timely and accurate information about any sitedevelopments, sampling results, and proposed remedialaction(s) to residents and local businesses.

In addition to coordinating activities with local officials andcivic leaders, EPA should provide Maywood residents withaccurate, detailed information on site sampling activities,findings, and proposed remedial actions. Information

disseminated through mailings, updates, news releases, and publicmeetings will ensure that residents receive accurate informationabout progress at the site. Residents and businesses inproximity to areas in which sampling will occur should bepromptly notified to avoid raising undue concern about thepurpose of this activity.

IV. SUGGESTED AND REQUIRED COMMUNITY RELATIONS ACTIVITIES

To accomplish the objectives of the community relations programfor the Maywood Chemical Company site, the following communityrelations activities are suggested during the RI/FS:

1. Establish and maintain information repositories.

Purpose; To ensure that all technical documents, factsheets, and other site-related information are available tointerested citizens, local officials, and the news media.

Technique: Possible locations for the informationrepositories include the Maywood Public Library and theMaywood Borough Hall. Copying facilities are available atthe library. Appendix A lists the addresses, phone numbers,and contact people for these locations. It will beimportant for these repositories to contain all relevant andappropriate documents about the Maywood Chemical Companysite. This will ensure that residents are provided with theinformation available about the site.

Timing; Information repositories should be established assoon as possible to provide residents with information oncurrent and upcoming site-related activities.

2. Identify and publicize EPA information contact.

Purpose; To provide accurate and timely responses toquestions from citizens, civic leaders, local officials, andnews media throughout the RI/FS and site cleanup, and toensure that EPA's statements to these groups are coordinatedand consistent. This will better enable EPA to monitor anyshifts in concern about the site.

Technique; The designated EPA Region II community relationscontact will respond directly to public inquiries regardingsite activities, and maintain the information repositories.A toll free number should be made available to localofficials and civic leaders, and should be included in theinformation repositories. This designated contact personwill play a significant role in establishing EPA'scredibility.

Timing; An EPA-designated point of contact should beestablished as soon as possible to provide residents andlocal officials with coordinated, consistent responses toinquiries.

3. Conduct routine and periodic phone contact with localofficials.

Purpose; To inform local officials of the schedule of siteactivities, any schedule changes, major findings during siteinvestigations, and unforeseen site developments.

Technique; EPA should provide information on siteactivities and progress at various technical milestones.Local officials should be kept apprised of any samplingactivities that take place, particularly in residentialneighborhoods, as well as any change in schedule.

Timing; Telephone contact is necessary to inform localofficials about upcoming site activities and should be doneat appropriate points throughout the site investigations.Telephone contact should also be used to announce projectmilestones. If EPA becomes aware of an increase inconcerns, more frequent telephone contact may be needed.

4. Prepare and distribute fact sheets.

Purpose; To inform residents about the Superfund process,and any current and upcoming site-related activities.

Technigue; EPA should distribute an update providingbackground information on the Superfund process as well asplanned community relations and technical activities at thesite. This update would also notify residents of the dateand time for the public information meeting.

Another fact sheet or update should be released at thecompletion of the investigatory phase. This fact sheetwould describe the nature and extent of contamination at thesite, and in particular, the potential for groundwatercontamination.

A third fact sheet, the Proposed Remedial Action Plan(PRAP)i, describing the cleanup alternatives, must bedistributed prior to, and during the public comment period.

All fact sheets on site activities should be made availableat public meetings and should be placed in the informationrepositories.

Timing; In sufficient time to ensure that the publicreceives adequate notice of site-related events.

Purpose; To explain plans and activities underconsideration to interested community members and provide anopportunity for EPA to answer residents' questions.

Technique; EPA should hold a public information meetingconcerning site activities and EPA oversightresponsibilities. A meeting summary should be preparedfollowing the meeting and placed in the informationrepositories.

A second meeting must be held during the public commentperiod on the draft FS report to allow the public anopportunity to provide comments on the proposed remedialalternatives. A court stenographer will be required toprovide a transcript of this meeting. Appendix A providespossible locations for public meetings held in Maywood.

Timing; At significant project milestones and during thepublic comment period on the draft FS report.

6. Conduct informal meetings with local officials, keycommunity members and civic leaders.

Purpose; To monitor and assess citizen concern, explainupcoming activities, and provide opportunities forofficials, civic leaders and key community members to askquestions.

Technique: EPA should consider providing an opportunity forsmall group meetings with civic leaders and local officialsprior to the public meetings to discuss specific concernsthese officials and civic leaders may have about the site.

Timing; Prior to, and on the same day as, the publicmeetings.

7. Conduct public comment period on draft FS report.

Purpose; As required by law, to allow the general publicthe opportunity to provide comments on the draft FS reporton the Maywood Chemical Company site.

Technique; EPA must hold a 30-day public comment periodfollowing the release of the draft FS report. To furtherencourage comments, EPA should publicize the comment periodby publishing the information in a local newspaper ormunicipal newsletter, and providing the deadlines andaddress for submitting comments.

Timing; Required following release of the draft FS report.8. Obtain access to private properties and describe sampling

procedures and results.

Purpose; To obtain permission for EPA technical staff to dosampling on private property in proximity to the MaywoodChemical Company site if necessary.

Technique; If necessary, EPA community relations staffshould mail or hand-deliver a letter seeking permission tosample from nearby privately-owned properties surroundingthe Maywood Chemical Company site. If sampling inresidential areas near the site becomes necessary, a similarletter would be hand-delivered or mailed to nearbyhomeowners. Hand delivery may be appropriate to callattention to the letter and to encourage a prompt responsefrom residents and businesses. After residents havereceived the letter, EPA should follow up to obtainpermission and schedule sampling.

Timing; If needed, letters should be distributed at leasttwo weeks prior to the start of any sampling to allowresidents time to review and respond to the information andcontact EPA with questions.

9. News releases to local newspapers.

Purpose; To ensure that the general public receivesnotification of upcoming meetings and accurate informationon the results of EPA oversight activities.

Technique; News releases should be prepared and released byEPA to announce upcoming public meetings and any significantfindings during the remedial investigation. Residentsinterviewed indicated that brief newspaper articles in thelocal daily and weekly newspapers would be the mosteffective method of notifying Maywood residents aboutupcoming meetings. In addition, EPA should issue newsreleases at the completion of significant technicalmilestones. To ensure that the widest audience is reached,news releases should be sent to all individuals and membersof the news media included on the site mailing list. A listof media contacts is included in Appendix B.

Timing; Prior to public meetings, upon release of the draftFS report, after release of the final FS report, and uponapproval of the Record of Decision.
