SAN FRANCISCO— A federal judgein San Francisco issued an order Fri-day that an American Civil Liberties

Union of Northern California’s (ACLU-NC)lawsuit charging unlawful collaboration be-tween the Sonoma County Sheriff’s Depart-ment and the U.S. Bureau of Immigration andCustoms Enforcement (ICE) to unlawfully tar-get, arrest, and detain Latinos in SonomaCounty can move forward.

“As the nation repudiates Arizona’s racialprofiling law, we continue to challenge thesame type of profiling in our own backyard,”said Julia Harumi Mass, ACLU-NC staff attor-ney. “No matter where they happen, violationsof fair and common-sense legal protections likedue process put all U.S. residents at risk – citi-zen and non-citizen alike.”

The lawsuit charges that the Sonoma Sher-iff’s department and its officers have collabo-rated with ICE to stop and search people whoappear to be Latino, interrogate them abouttheir immigration status based on their per-ceived race, and detain them in the county jailwithout lawful authority. The Sheriff’s Depart-ment and ICE have failed to notify individualswho they have targeted of their rights under thelaw and the charges against them, among otherviolations of due process.

The judge considered Sonoma County

Sheriff’s Department and ICE motions for re-consideration of a March 10, 2010 ruling thatallowed the plaintiffs to seek evidence in sup-port of their constitutional and statutory claims.Leaving in place an unchallenged legal rulingthat the Sonoma County Sheriff’s and ICE’s useof immigration detainers was not per se unlaw-ful, this order gives the green light to plaintiffCommittee for Immigrant Rights of SonomaCounty’s claims that the County and ICE areviolating equal protection, due process, searchand seizure, and statutory requirements in theiruse of immigration detainers to arrest personson suspected civil—as opposed to criminal—immigration violations and hold them in thecounty jail without criminal charges.

“Public safety and crime fighting sufferwhen we overburden local and state law en-forcement agencies with federal immigrationauthority,” said Richard Coshnear of the Com-mittee for Immigrant Rights of Sonoma County,a group devoted to educating the public aboutimmigrants’ legal rights under the Fourth, Fifth,and Sixth Amendments of the U.S. Constitu-tion. “Instead of making our communities safer,the Sheriff’s actions distract deputies from theircrime-fighting duties, create a climate of fear,and decrease the willingness of residents to re-port crimes.”

DREAM Act: ¿Cuántos Eric Balderas antes de que el Senado actúe?

WASHINGTON, D.C. –“Tengo la aspiración de en-contrar una cura para el

cáncer… Ojalá algún día pueda lograrloporque de esa manera me gustaría contribuir”.

Esto dijo a America’s Voice EricBalderas, de 19 años de edad, un estudiantede biología celular y molecular en la Univer-sidad de Harvard, detenido por las autoridadesmigratorias el 7 de junio cuando se disponíaa viajar de San Antonio, Texas, a Boston,Massachusetts. Fue a Texas a visitar a su fa-milia. Regresaba a Boston a seguir estu-diando. Perdió su pasaporte mexicano y traíaconsigo la matrícula consular y su identifi-cación de estudiante.

Ahora encara una potencial deportación.Su audiencia ante un juez de inmigración

será el 6 de julio, casi exactamente a un añode la fecha en la cual el gobierno retrasó la de-portación de otro estudiante, Walter Lara,quien como Eric acaparó la atención nacionalcon su lucha para evitar su repatriación a unlugar que no conocía; un año en el cual otrosjóvenes han enfrentado órdenes de de-portación o han vivido con el temor a encararlas; un año en el cual estos jóvenes han de-safiado la deportación para atraer atención asu causa participando en actos de desobediencia civil o caminando 1,500 millas deMiami a Washington, D.C. para que los es-cuchen. Un año en el cual no ha habido ni re-forma migratoria con DREAM Act, niDREAM Act.

Balderas indicó que precisamente esperaque su caso contribuya a ejercer la presiónnecesaria para que el Senado apruebe la me-dida DREAM Act que concedería una vía delegalización a los estudiantes que como élprosigan estudios universitarios, o que se en-listen en el servicio militar.

“Ojalá que la gente que me apoya llamea los senadores y a los representantes parapoder lograr algo porque la DREAM Act eslo que nos salvaría a todos. Lo que pase du-rante mi audiencia, sea bueno o malo, es sólouna solución temporal porque no me permi-tiría obtener mi residencia”, agregó.

Cada año se gradúan de las escuelas se-cundarias del país 65,000 jóvenes sin docu-mentos para seguir estudiando o trabajando.Estos jóvenes no cruzaron la frontera o se

quedaron más allá del tiempo autorizado porsus visas por su propia cuenta. Los trajeronsus padres o familiares.

Balderas fue traído por su mamá desdeMéxico cuando tenía cuatro años de edad. Es-caparon de una situación de violencia domés-tica.

“No tengo ningún recuerdo de México.No recuerdo no hablar el inglés. Todo lo quesé, todo lo que he visto es de Estados Unidos”,señaló.

La medida DREAM Act se presentó originalmente hace casi una década y volvió asometerse en esta sesión del Congreso. En elSenado presentaron el proyecto S. 729 lossenadores Richard Durbin y Richard Lugar,demócrata de Illinois y republicano de Indi-ana, respectivamente. La medida tiene 39coauspiciadores. El proyecto bipartidistaacompañante en la Cámara Baja es el H.R.1751 y cuenta, hasta ahora, con 120 coauspi-ciadores.

El grupo de Facebook que se creó enapoyo a Balderas, ya cuenta con miles deseguidores. Un denominador común de mu-chos de los comentarios es el argumentobásico de que se trata de un joven traído porsu familia a Estados Unidos cuando apenastenía cuatro años; un joven cuya inteligenciay talento lo llevan a ser aceptado con una becatotal por una de las universidades privadasmás prestigiosas del país y del mundo. Comodice su página de Facebook, “su deportaciónnos privará a todos de un potencial ciudadanocuya valentía, compromiso y deseo sincero deayudar a otros a través de la ciencia sólo haráde nuestra nación un mejor lugar”.

La Universidad de Harvard emitió unadeclaración señalando que “Eric Balderas yaha demostrado la disciplina y la ética laboralrequerida para el riguroso trabajo universi-tario y al igual que muchos de nuestros estu-diantes de licenciatura, ha expresado suinterés de marcar una diferencia en elmundo”.

Para citar uno de los comentarios enFacebook: “Eric ha probado ser muy valiosopara este país... y aunque no lo conozco, estoyorgulloso de él y me enorgullecería llamarlocompatriota”. ¿Opinarán igual los senadores?Δ

During the past several decades organ-ized labor (i.e., unions and profes-sional associations) representing

public employees (police, firefighters, socialservice workers, public health workers, teachers,etc.) have experienced the best of times as labornegotiations led to contracts which provided forgenerous hourly wages, health benefits, and re-tirement plans. These union contracts were nego-tiated during very favorable economies plus thesynergistic alignment of both the public’s andunions’ quest for transparency and accountabilityin all governmental affairs.

This situation applies to both the County ofSanta Clara and the City of San Jose. It also ap-plies to many state and federal agencies. Fromthis point on, the focus of these comments appliesto the local county and city jurisdictions. Bothjurisdictions face serious deficits ($250 millionand $120 million respectively).

These deficits, when analyzed categorically,reveal that 70% or more of the deficit is relatedto the cost of employee wage, retirement andhealth care benefits which were negotiated whenthe economy was healthy and robust.

Today that is definitely not the case, and hasbeen so for several years. Management’s ap-proach seems to fall into three actions: 1) Reducethe labor force and therefore the personnel costsincurred. This results in service cuts. 2) Definemore work which can be outsourced to the pri-vate sector using a competitive bid process. Pre-sumably lower costs of services results. And 3)Ask the union leadership to voluntarily agree toa reduction of hourly wages, benefits, and retire-ment programs. Of course, union leadership hasopposed these solutions.

It is essential that public employee unionsfind some way to maximize current employmentlevels without exceeding available funding lev-els. In the past union leadership has used theirclout to have legislation passed which today im-pedes the informed involvement of the public.

Unions have favored keeping contract nego-tiation information away from public scrutinyand inquiry. However, that information has be-come public as a consequence of lawsuits by anonprofit organization called the “First Amend-ment Coalition.” Their website is www.firsta-mendmentcoalition.org. Go there for informationwhich provides an compelling perspective.

An article which provides another perspec-tive is entitled “Stand with the People by Stand-

ing up to Unions” authored by San Jose MayorChuck Reed (San Jose Mercury News, Editorialpage, June 13, 2010). Here we are reminded thatin his 2007 State of the City address, Mayor Reedstated, “We cannot become a great city unless weeliminate our structural budget deficit. This is thegreatest challenge. The budget deficit is publicenemy number one, an enemy that will steal ourhopes and kill our dreams of becoming a greatcity if we ignore it.”

Well, hardly any progress has been made inthe past several years. Nothing will happen untilthe unions step forward with a method of maxi-mizing the number of employees who ‘stay onthe job’. It seems obvious that the union mem-bership must convey to their leadership that shar-ing jobs is preferable to layoffs.

To avoid layoffs, the union membershipmight want to consider sharing the work that canbe paid for by the monies available. It is not anoption to demand full employment when tax rev-enues are not realized in the needed quantity be-cause of a nonperforming economy. Those whopay taxes are experiencing total unemployment(12%+), underemployment, and reduced taxablerevenues. The Mayor makes a good point: voter’sare aware of those elected officials who favor ac-countability and fiscal responsibility. Union-backed candidates did not fare well in the recentprimary election.

If unions representing public employees areto retain their clout, their membership must sup-port their negotiating leadership to fully partici-pate in accepting reduced employment levelsforced on all of us by an economy that is recov-ering from a ‘near collapse’.If your union lead-ership will not provide a formula for sharing thework, then the membership must push their lead-ership towards a viable option.

The outcome is that when all agree to accepta lower income level, more, if not all, unionmembers may remain employed. Job-sharing isa better option than having a few become totallyunemployed. Think about this option. The choiceis yours. If you do not make that choice, then theCity Council will vote to do what it must do toreach a balanced budget. Keep in mind that per-sonnel expenses are 70% of the solution. Unionmembers sharing their jobs are the key to lower-ing personnel expenses.Δ

The Mexican Heritage Corporation invites eligible chil-dren between the ages of 6 and 17 to join the summernutrition, music and dance program at one of the three

camp locations: San Jose State University School of Music and Dance,Mayfair Community Center and the Latino College Prep Academy on thecampus of National Hispanic University.

Participating students will be served breakfast, lunch and two snackseach day. They will also receive lessons in music and dance from

experienced teachers in many styles, attend concerts, meetprofessional musicians from all over the world, and learnto play instruments, sing and perform in ensembles and

choirs. The meals and music camp classes and activities are absolutely freefor all eligible participants.

The camps will run Mondays through Fridays, June 21 - Au-gust 13, from 8 a.m. to 4 p.m. at each of the three locations.

To be eligible, participant families must be on Cal-WORKs, Food Stamps or fall under federal low-income

guidelines. Qualifications require no experience in musicor dance and all levels of experience are welcome.

ANN ARBOR, Michigan.— Un compuestoderivado del brócoli podría ayudar en la pre-vención o el tratamiento del cáncer de mamaenfocándose en las células madre del cáncer,esto es el pequeño número de células que gen-era el crecimiento de un tumor, según un nuevoestudio de investigadores en el Centro Integraldel Cáncer de la Universidad de Michigan.Elestudio probó el sulforafano, un componentedel brócoli y los retoños de brócoli en ratonesy en cultivos de células.Los investigadores en-contraron que el sulforafano ataca y mata alascélulas madre del cáncer e impide que crez-can nuevos tumores.Las quimioterapias ac-tuales no son eficaces contra las células madrede cáncer y por ello es que el cáncer recurre yse propaga. Los investigadores creen que laeliminación de las células madre del cáncer esla clave para controlar el cáncer.

En el estudio actual los investigadorestomaron ratones con cáncer de mama y les in-yectaron diferentes concentraciones de sul-forafano del extracto de brócoli. Losinvestigadores usaron luego varios métodos es-tablecidos para evaluar el número de célulasmadre de cáncer en los tumores. Estas

mediciones mostraron una disminución notablede la población de células madre de cáncer de-spués del tratamiento con el sulforafano, y conpoco efecto sobre las células normales.

Las concentraciones de sulforafano usadasen el estudio fueron más altas que las quepuedan obtenerse comiendo brócoli o retoñosde brócoli. La investigación anterior indica queel cuerpo puede absorber del extracto de brócolilas concentraciones necesarias para tener un im-pacto en el cáncer, pero no se conocen los efec-tos secundarios. ANN ARBOR, Michigan.— Los niñosobesos tienen más probabilidades de ser vícti-mas de prepotencias y abusos, sean cuales seansu género, grupo étnico, situación socioe-conómica, destrezas sociales o logros académi-cos.

Estas son las conclusiones del estudio"Weight status as a predictor of being bullied inthird through sixth grades", (El peso corporalcomo indicador de la vulnerabilidad al abuso yprepotencia del tercer al sexto grado escolar).

La obesidad infantil y el abuso y la prepo-tencia infantiles son ambos problemas muy co-munes de salud pública. La obesidad entre losniños en Estados Unidos ha aumentado a pro-porciones epidémicas y se calcula que el 17 porciento de los niños y niñas de 6 a 11 años deedad eran obesos entre 2003 y 2006. Ademáslos padres y las madres de los niños obesos cal-ifican el abuso y la prepotencia como su prin-cipal preocupación para la salud de sus niños,y estudios anteriores han mostrado que losniños obesos que son objeto de prepotencias y

abusos experimentan más depresión, ansiedady soledad.

El objetivo de este estudio fue determinarla relación entre la obesidad infantil y el serblanco de prepotencias en los grados tercero,quinto y sexto de la escuela. Si bien los estudiossobre abuso y obesidad en la infancia se hanhecho antes, ninguno ha tenido controles porfactores tales como el estatus socioeconómico,el grupo étnico, las destrezas sociales y loslogros académicos.

Además este estudio es único en el sentidode que observó específicamente la gama deedades en la cual el abuso y la prepotencia al-canzan sus mayores proporciones, de los 6 a los9 años.

Los autores llegaron a la conclusión de queel ser obeso, por sí mismo, aumenta la proba-bilidad de ser víctima de la prepotencia. Las in-tervenciones para encarar el abuso y laprepotencia en las escuelas se necesitan ymucho. Δ

OAKLAND, The supply of type Onegative and type B negative bloodat the American Red Cross has

dropped to critically low levels. Type O negative blood is always in high de-

mand because it can be transfused to patientswith any blood type, especially in emergencysituations.

Type O negative and type B negativedonors are needed now to help prevent the typeO negative and type B negative blood supplyfrom declining further.

“The American Red Cross is extendingblood drive hours and reaching out to eligibleblood donors, sponsors and community leadersto ask them to help recruit type O negative andtype B negative blood donations to help makeup for this shortfall,” says Sara O’Brien,spokesperson for the American Red CrossBlood Services – Northern California Region

“While all blood types are needed duringthe summer months, we urge those eligibledonors with O negative or B negative bloodtypes to make and keep appointments to giveblood in the upcoming days to help restore theinventory level,” O’Brien added.

“The Red Cross monitors the blood inven-tory on a daily basis and when we see a trendor shortage emerging, we communicate theneed to our generous blood donors to help usmake up the shortfall,” said O’Brien.

A shortage of type O negative and type Bnegative blood often occurs during the summermonths when fewer donors are giving becauseof summer vacations and schools approachingsummer break are hosting fewer drives.

Every two seconds, someone in the UnitedStates needs blood. The Red Cross NorthernCalifornia Blood Services Region provides life-saving blood to 30 hospitals and must have 300people give blood each weekday to meet hos-pital demand. Accident victims as well as pa-tients with cancer, sickle cell disease, blooddisorders and other illnesses receive lifesavingtransfusions every day. There is no substitutefor blood and volunteer donors are the onlysource.

Individuals who are 17 years of age (16with parental permission in some states), meetweight and height requirements (110 pounds ormore, depending on their height) and are ingenerally good health may be eligible to giveblood. SAN JOSE– Care-givers at HCA, (theworld’s largest pri-

vate for-profit healthcare opera-tor) lead a week of action at thecorporation’s California hospi-tals to protest understaffing andexcessive patient wait times.Picket lines went up at the firstof five hospitals on Monday,June 14.

Caregivers included certi-fied nurse assistants, ER techni-

cians and respiratory care prac-titioners. All of which are mem-bers of Service EmployeesInternational Union-UnitedHealthcare Workers West(SEIU-UHW), the state’s largestunion of healthcare workers. Asfrontline staff, the caregivers arepushing HCA to heed their pro-posals to reduce the harm to pa-tient care caused by chronicunderstaffing.

“We’re committed to mak-

ing sure our patients come firstand we need HCA to invest inquality care. Patients shouldn’thave to wait for care because wedon’t have enough staff,” saidMichelle Parker, a licensed vo-cational nurse at HCA’s River-side Community Hospital.

During the week of action,caregivers revealed survey re-sults that demanded dramaticimprovements in patient safetyand hospital cleanliness.

dos en fuentes de agua e increíbles animaciones a través del agua.“World of Color” es una exhibición de fuentes de agua que sirven de pantalla para

presentar las imágenes de los personajes de Disney. En una exhibición de 25 minutoslos visitantes podrán apreciar el juego de luces, la magia que sale debajo del agua y elimpecable sonido sincronizado con las fuentes y los personajes de Disney.

El reciente lanzamiento en el parque Disney California Adventure cuenta con eseespíritu vanguardista que cada año estrena Disney. "'World of Color' es un testamentoa la creatividad, pasión, innovación y talento de las personas en toda nuestra organi-zación", dijo Iger. Lo cierto es que es cada año el parque de atracciones trae cambios y en esta opor-tunidad la tecnología se suma en esta presentación que sorprenderá a más de uno.Esta zona de casi un acre de extension es propicia para gigantescas proyecciones, efec-tos rayos laser, niebla y hasta el lenguas de fuego que salen desde el lago.

Para hacer realidad esta presentación se trabajó por 5 años y se utilizaron 30proyectores de alta definición, 14 de ellos bajo el agua. Se contó con 1,200 poderosasfuentes que se pueden programar con alturas de 30 a 200 pies. Cada fuente tiene múlti-ples puntos de control para dirigir la luz, intensidad del color, el ángulo y altura delagua.

SANTA CLARA COUNTY, CALIF –Joined by cities and counties from aroundthe nation, the County of Santa Clara, Cal-ifornia filed an amicus curiae brief today inArizona urging a federal district court toblock enforcement of the State of Arizona’snew anti-immigrant law. The brief wasfiled in Friendly House et al. v. Whiting etal., a case brought by labor, business, do-mestic violence, human services, social jus-tice, and religious organizations, as well asa class of individuals who will be subject toharassment or arrest under the law, seekingto have the law invalidated. Santa ClaraCounty and several other local governmentsjoining its brief—the counties of Montereyand Los Angeles and the cities of Balti-more, Berkeley, Los Angeles, Minneapolis,New Haven, Palo Alto, Portland (OR),Saint Paul, San Francisco, San Jose, andSeattle—filed the brief in support the plain-tiffs’ request for an injunction that wouldprevent the law from taking effect while the

court considers its constitutionality. The local governments filing the brief

provide essential services to local residents,including maintaining safe communitiesthrough the funding, operation, and over-sight of local law enforcement agencies.They argue that Arizona’s law “imposesvague and unworkable requirements” onlocal law enforcement officers. Si hay algo que vamos a recordar delmundial en Sudáfrica son las ruidosastrompetas de plástico que ensordece a los

jugadores, a los árbitros, al público asistente y altelevidente. Desde Sudáfrica a San José el sonidoestremecedor de las “vuvuzelas” se escuchan du-rante la transmisión de todos los partidos. Ahora

hasta grupos sindicales están ordenando para protes-tas laborales.

Al parecer la mayoría apoya el sonido que emiteestas “vuvuzelas” sino lea los comentarios y com-pruebe lo que dice nuestra gente.

“No me molesta, al contrario es un ruido espe-cial para todos los encuentros futbolísticos”, dijoCarlos Chuquín residente de Willow Glen.

“A veces me aburro del ruido pero en el fondonos hace sentir como si estuviéramos en el partido”,dijo Cecilia Rosas de Santa Clara.

“Un poco aburrido el ruido, pero qué se le haceun mundial no se ve cada cuatro años y por solo 30días”, dijo Juan Zavaleta.

“No me molesta para nada, de esto se trata unafiesta, ruido, gente, alegría. Tal vez las transmisionestelevisivas podrían regular el sonido pero no es tangrave” dijo Jaime Larios.

On Thursday, June 10, Bay Areasoccer fans had the chance to meetSan Jose Earthquakes midfielder

Arturo Alvarez at the Verizon Wireless store inSan Francisco to help celebrate the kick off ofthe 2010 FIFA World Cup soccer tournament.

“I’m really happy to be here to start off theWorld Cup and I know Verizon is affiliatedwith them in regards to streaming the actuallive game to customers through the v-cast andI think it’s really cool for all the soccer fans outthere,” said Arturo Alvarez, Earthquakes’ mid-fielder.

The soccer fans had the opportunity to getan autographed postcard and a photo with themidfielder. They also learned how to streamUnivision’s live broadcast of the soccermatches from South Africa, exclusively onVCAST from Verizon.

“I want the US to do well,” said Alvarez.“But I think Argentina might be one of thestrong teams to go all the way.”

No matter the home country, customerswill be able to see their favorite teams competein the world’s most important soccer tourna-ment featuring players from 32 nations, the cul-mination of qualifying matches among 208countries.

“I love this game, I think I’m pretty luckyand blessed that I get to do this for a job,” saidAlvarez. “It’s amazing to be playing for yourcountry and knowing that you have a chance toplay in a World Cup, the biggest sporting event

in the world. Hopefully 2014 we (El Salvador)will qualify.”

San Jose hasn’t always been a place to callhome for Alvarez. He has played for FC Dallasand for El Salvador, learning things on and offthe fields since he began his career fresh out ofhigh school.

“Something that I always tell the kids inhigh school is to chase their dream and keepworking hard and listen to your parents andfamily because they want the best for you,”stated Alvarez. “Dreams do come true, I’m liv-ing mine and I’m really happy.”

The city of San Jose has been selected by USAGymnastics and the U.S. Olympic Committeeto host the 2012 U.S. Olympic Team trials for

men and women’s artistic gymnastics. The weeklongevent will turn S an Jose into a primary sports focusand is important to the economic development of thecity.

“Many of the world’s top companies will be look-ing at San as a possible in vestment opportunity be-cause of this event,” said San Jose Mayor, Chuck Reed.“The event will also get kids excited about gymnasticsand other sports and activities.”

The effort to get the Gymnastics Olympic trials toSan Jose was headed by the San Sports Authority andHP Pavilion, including a commitments from the C ityof San Jose, San Jose Hotels, Inc., and the S an JoseConvention and Visitor’s Bureau.

“San Jose is known for its support of USA gym-nastics throughout the years,” said Patricia Ernstrom,executive director of the S an Jose Sports Authority.“It is fitting that the city host the 2012 Olympic Gym-nastics trials.”

Recently, San Jose hosted the 2007 Visa Champi-

onships, the 2008 P acific Rim Gymnastics Champi-onships, the 2009 U.S. Trampoline and Tumbling Jun-ior Olympic Championships and the 2004 U.S. OlympicTeam Trials for rhythmic gymnastics and trampoline.

In addition, the U .S. Olympic Committ eeprocessed the 2008 U.S. Olympic Team in San Jose be-fore heading to Beijing.

Two-time Olympic medalist in gymnastics (1996team gold medal, and silver medalist in the une venbars) and San Jose native Amy Chow said she was veryexcited to see USA Gymnastics hold their trials in SanJose.

“When I was trying to make it on the Olympicteam, I would have to travel to different parts of thecountry to do so,” Chow said. “The Olympic trials iswere dreams come true and San Jose has shown a lotsupport f or Americ an gymnasts throughout theyears.”

The event will be conducted at HP Pavilion in SanJose, June 28 – July 1. The USA Gymnastics NationalCongress and Trade Show will be staged a t the SanJose McEnery Convention Center.
