I. GENERAL INTRODUCTION

The Quy Nhon city - Binh Dinh Province is surrounded by the Sea in the East, and it

is bounded by Tuy Phuoc district in the West, by Phu Cat and Tuy Phuoc districts in the

North, by Song Cau District - Phu Yen province in the South, with the area of 284.28 km2.

Quy Nhon is one of the six first class urban centers directly under the province of Vietnam

and the centre of economy, politics, culture and tourism of Binh Dinh province. Quy Nhon

city has 21 administrative units comprising 16 precincts and five communes. Nhon Hoi

Economic Zone – the key one of Binh Dinh province is invested to be constructed on the

territory of Nhon Hoi commune belonging to Quy Nhon City. Nhon Hoi Economic Zone with

the area of 12,000 ha will have Quy Nhon city enlarged to be the center of industry, port

service, commerce, tourism, education and training of the Central coastline area.

Currently, Nhon Hoi economic zone, the load in area of Nhon Hoi commune and

part of the load of Quy Nhon city is received electricity from Quy Nhon 2

110kV substation with a capacity of about 8MW. Based on analysis of existing sources and

the power grid there should not meet the load demand during the time when non-tariff zone

(capacity of about 7MW), Nhon Hoi container port (capacity about 6MW) came into

operation and the development of other services in synchronisation with Nhon Hoi economic

Zone in the future. Therefore, the need to invest some 110 kV substation to the local load

must be considered, in which, it is necessary to build Nhon Hoi 110kV substation and branch

line to provide load for investors in Nhon Hoi Economic Zone. Aware of the need

to implement of this project construction investment, Binh Dinh Province has asked the

World Bank (WB) for sub-project financing. Sub-project "Nhon Hoi 110

kV Substation and branch line" that is one of the sub-projects will be implemented in Phase

I of distribution efficiency project (DEP) under the Electricity of Vietnam by World Bank

loans. Sub-projects will be implemented in Tuy Phuoc district and Quy Nhon city, Binh Dinh

Province.

The subproject activities include: i) Construction of an 110/22KV substation; ii)

construction of the control house, distribution system, and the shifting house of the

substation; and iii) newly built 110KV branch line of 26.33km long, in which in which there

are 2.46km to be gone together with the power line to An Nhon. These activities can

cause negative impacts on the environment and local communities during pre-construction,

construction and operation.

In order to ensure that potential negative impacts can be identified and during the

preparation and mitigated during the subproject implementation process and that the

subproject complies with the Environmental Assessment Policy OP / BP 4:01) of the World

Bank, an Environmental Management Plan (EMP) of the sub-project has been prepared that

follows the guidance provided in the Environmental Management Framework (EMF) of the

DEP project. This EMP includes: the sub-project description, policy framework, applied

environmental technological standards and regulation, potential negative impacts, proposed

mitigation measures implemented during pre-construction, construction

and operation, implementation arrangement of EMP and budget. The EMP will be

incorporated into tender documents and contracts, along with environmental monitoring and

supervision.

According to the EIA regulations of the Government, the subproject is subject to the

preparation of an Environmental Impact Assessment Report (EIA). This report was prepared

and approved by Binh Dinh Provincial People Committee under Decision No No 544/QĐ-

CTUBND dated 23 March 2012.

2.2. World Bank Environmental Safeguard Policies

Environmental Screening in accordance with the criteria provided in the EMF of the

DEP has been performed and the results shown that this subproject has to apply

Environmental Assessment Policy (OP 4.01), Involuntary Resettlement Policy (OP 4.12) and

Information Disclosure Policy of the WB. The safeguard document related to OP 4.12 will be

presented in a separate report. The subproject will also meet the WB’s requirements on

public consultation and information disclosure.

III. SUBPROJECT DESCRIPTION AND SCOPE OF WORK

3.1 Subproject Objectives:

Investment in construction of Nhon Hoi 110kV substation and branch line to:

- Enlarge the market and increase consumption output.

- Improve the reliability and safety in electrical supply for customers; ensure operational

safety.

- Provide sufficient power for Silicon Industrial Plant and Industrial Zone - Area A of Nhon

Hoi Economic Zone and the adjacent load, contributing to local economic development.

Sub-project "Nhon Hoi 110 kV Substation and branch line" will be implemented to aim at: (i)

Ensure power supply capability for Nhon Hoi Economic Zone and the loads in the area of

Quy Nhon city and Tuy Phuoc district - Binh Dinh Province; (ii) enhance the safety in power

supply due to fault reduction; (iii) reduce electric energy loss.

3.2. Subproject Location:

- Location of Nhon Hoi 110kV substation: Located in area A belonging to Nhon Hoi

Economic Zone, Nhon Hoi commune, Qui Nhon city, Binh Dinh Province.

- 110kV line passes through the territory of Tran Quang Dieu precinct, Nhon Hoi commune

belonging to Qui Nhon city and the townlets of Dieu Tri, Tuy Phuoc, the communes of Phuoc

An, Phuoc Loc, Phuoc Hiep, Phuoc Nghia, Phuoc Son, Phuoc Hoa belonging to Tuy Phuoc

district, Binh Dinh Province.

3.3. Subproject Management Organizations:

3.4. Subproject Components:

3.4.1 110kV Branch Line:

The whole branch line and Nhon Hoi 110kV Substation are built in the territory of Tran

Quang Dieu precinct, Nhon Hoi commune belonging to Qui Nhon city and the townlets of

Dieu Tri, Tuy Phuoc, the communes of Phuoc An, Phuoc Loc, Phuoc Hiep, Phuoc Nghia,

Phuoc Son, Phuoc Hoa belonging to Tuy Phuoc district, Binh Dinh Province. The location of

the project is as follows:

- Branch Line: newly built 110KV branch line of 26.330km long (in which, upgraded 110kV

branch line of 2,455m long and newly built 110KV branch line of 23,085m long), the starting

point of newly built 110KV branch line is at 110kV busbar (line bay E13) of Quy Nhon

220kV Substation and the ending point is at the gantry of Nhon Hoi newly built 110KV

substation.

The topography that the line passes through is complex, the elevation changes

abundantly, as the terrain is mainly mountainous with bowl shape at the start route section as

well as at the end route section, the middle route section is located in the coastal plain,

geographical location are mainly of eucalyptus, acacia, rice fields and shrimp ponds. The

route section to Nhon Hoi Industrial and Economic Zone passing through the sand dunes

planted willows.

The line almost goes over the hill slope to avoid residential areas, sometimes there are route

sections crossing through the area with sparse houses.

In ROW there are some cross-lines such as Highway No.1A, Highway No.19, provincial road

638, 639, 640, inter-communal, inter-village, productive road, planning road in Industrial

Zone…, so that the transportation of construction apparatus is rather favorable.

substation, the route section goes through the newly built

tower next to tower No 02 (of Quy Nhon – An Nhon

110kV line) up to Dieu Tri river bank it goes inside Phu

Tai Industrial Zone.

- In the ROW, 15 meters (from the heart line on both

sides) cut asphalt road with R = 5m in Industrial Zone 02

times.

II Tuy Phuoc district

1 Phuoc An commune 1,801

- The route section goes on the territory of Phuoc An

commune, Tuy Phuoc district. From Dieu Tri river bank

it crosses over the river and goes along with the Quy

Nhon – An Nhon existing 110kV line, it goes next to

tower No 06 creating the right rudder angle to cross over

the provincial road 638, up to tower No 07 it creates the

left rudder angle and passes through residential area.

From tower No 08 it crosses over the railway and passes

through the rice field towards tower No 10, from tower

No 10 it goes through residential area, passing through

the rice field up to Ho Den mountain and reaching to

tower No 11.

- In the ROW, 15 meters (from the heart line on both

sides) there are 03 four-grade houses under the existing

ROW, cutting asphalt roads with R = 5m in Industrial

Zone (04 roads), cutting provincial road 638 with R =

5m.

2 Dieu Tri townlet 836+662 - The route section goes through the territory of Dieu Tri

townlet, at G1 it creates the left rudder angle and then

hilltop. From G2 it skirts the hillside on the right side of

existing line up to G3. The terrain in this section is

relatively complex, high mountains, steep slopes,

geographical location are mostly of wild trees intermixed

with eucalyptus.

3 Tuy Phuoc towlet 2,484

- The route section goes on the territory of Tuy Phuoc

townlet, from G3 it turns right to go slowly down the

hillside of eucalyptus with many small stagnant pools and

cliffs so it creates more rudder angles then goes down the

hill base and create G6, From G6 it crosses over the

railway, over the Highway No 1A and over 22kV line

creating G7, then it then cut through brick-kiln to avoid

planning plot of Quy Nhon city to go to G8.

- The terrain in this section is relatively complex, high

mountains, steep slopes, geographical location are mostly

of wild trees mixed with eucalyptus. Brick kiln that was

cut through by the route section to be dismantled by

mutual agreement.

4 Phuoc Loc commune 2,658

- The route section goes on the territory of Phuoc Loc

commune, Tuy Phuoc district. From G8 it turns right,

going through the rice field, coming near Mr. Mit bridge

to create G9, from G9 it crosses over the Highway No 19

that is 10m far from Mr. Mit bridge then passes through

the rice field to G10, from G10 it crosses over the river

going up the rich soil area to create G11 right after the

concrete road.

- The terrain in this section is relatively flat; the route

section mainly goes through the rice fields.

5 Phuoc Hoa

commune 1,025

- The route section goes on the territory of Phuoc Hoa

commune, from G11, the route section goes through the

rice field, then crosses over concrete intervillage going up

the rice field to G12. The terrain in this section is

relatively flat; the route section mainly goes through the

rice fields.

- Not affected households within 15 meters (from the

heart line on both sides).

6 Phuoc Nghia

commune 1,177

- The route section goes on the territory of Phuoc Nghia

commune, from G12, the route section goes through the

rice field, then goes up Kim Son mountain to G13. - The

terrain in this section is relatively complex; the route

section mainly goes on the hills and mountains.

7 Phuoc Son commune 7,709 - The route section goes on the territory of Phuoc Son

commune. At G13 it turns right going down Kim Son hill

base, crossing over provincial road 640 to goes in the

middle of Mr Phat and Mr Long’s houses, then creates

G14 right on the field that is 20m far from 22kV line

(planning area of Phuoc Son commune), from G14 it

goes on the rice field to avoid residential area, it create

angles 15, 16, 17 coming to G18 that is nearby the saline

dam base of hamlet Vinh Quang 2. From G18, it crosses

over Thi Nai river > 500m then goes on shrimp pond and

Thi Nai lagoon to Piket (186 +44). The terrain in this

section is relatively flat; the route section mainly goes

through the rice fields and shrimp pond.

- There are two affected households within 15 meters

(from the heart line on both sides).

8 Phuoc Hoa

commune 334

- The route section goes through the territory of Phuoc

Hoa commune, Phuoc Son district, this route

section mainly goes through the shrimp pond (alluvial

mound between the rivers).

- The route section goes through the territory of Nhon

Hoi commune belonging to Quy Nhon city, from Piket

(186 +78), it continuously goes through the shrimp pond,

crosses over saline dam, passes through the rice field,

crosses over 0.4kV line and provincial road 639, passes

through residential area up to sand dune to create G19.

From G19 to G22 it goes in Nhon Hoi Economic Zone

and mainly on sand dune with willows. From G22 it goes

up Phuong Mai mountain side, skirting the hillside of

wild trees that intermixed with eucalyptus to the end

point of Nhon Hoi substation. The terrain in this

section is bumpy (sand dunes), from G22 to the ending

point the terrain changes much, and geographical location

is mainly of willow trees, eucalyptus and wild plants. .

Total 26,330 The transmission line does not go through the

conservation areas and other sensitive areas.

3.4.2. Nhon Hoi 110kV Substation:

Substation location: The newly built 110/22kV substation with the anticipated capacity of

2x40MVA (At the early stage install one transformer with the capacity of 1x40MVA) is built

on the planning area of Nhon Hoi Economic Zone, Nhon Hoi commune, Quy Nhon city, Binh

Dinh province, as follows:

The North: is bounded by Phuong Mai mountain.

The South: is bounded by Phuong Mai mountain.

The West: is bounded by ring road (opposite Lot B5, area A of Nhon Hoi Economic Zone

through ring road).

The East: is bounded by Phuong Mai mountain.

The area of Nhon Hoi 110kV substation is about 50m far from the ring road of Nhon Hoi

Economic Zone. The terrain is relatively flat. It is very convenient for the connection of

110kV outgoing and incoming feeders as well as 22kV outgoing feeders. Due to the

substation location is adjacent to planning road so it should be very convenient for

the transportation of equipment as well as operation and management of substation later.

3.4.3. Scope of the Subproject:

a/ Nhon Hoi 110kV Substation:

- Newly built one substation: Capacity of 2x40MVA

- Voltage level: 110/22kV.

- The substation is designed to be semi-outdoor.

- Substation operation to be in the regulations concerning regular watch of the staff.

- Substation location: Nhon Hoi commune – Quy Nhon city – Binh Dinh province.

- Expected area of substation construction: 5,461m2 including outdoor distribution systems,

shift dorm, control house, yard, substation gate and substation fence, access road to

substation.

b/ The connection part of 110kV outgoing feeder bay at Quy Nhon 220kV substation:

- Install one the 110kV line bay E13.

- Install one control cubicle, two protection cubicles for 110kV line bay.

- Build the control system, supervision from Load Dispatch Centre of the Central Power

System (A3).

c. 110kV Branch Line.

- Starting point: the 110kV busbar (line bay E21) of Quy Nhon 220kV substation.

- Ending point: Gantry of Nhon Hoi 110kV substation.

- Voltage level: 110kV.

- Number of circuits: 02 circuits, at this stage only build one circuit.

- Length of the 110kV branch line: 26.330km, in which. There are 2.455km to be gone

together with the power line to An Nhon.

- The ROW: 7.5 m from the heart to each side (total 15m).

- Construction location: Tuy Phuoc district – Quy Nhon city – Binh Dinh province.

- Conductor: ACSR-300/39.

- Lightning wire: GW-50.

- Optical cable: OPGW-50.

from position 01 to position 12 goes together with the power line to An Nhon.

d/ Upgraded line to Don Pho:

- Starting point: tower No 01 (tower for 02 circuits) goes to both An Nhon and Don Pho.

3.5.2. Means for Transportation of Construction Materials and Equipment

- Materials and equipment will be transported from freight yards and storehouses of investors

to temporary storehouses of the project by specific trucks suitable with packaged format.

After that, they will be transported to project’s site by trucks with load capacity of 5 – 7.5

tons. Roads that are used to transport materials to substation site and some tower locations are

Highway No1A, Highway No19, provincial road and other inter hamlet, inter-village roads.

The load capacity of the trucks has to be suitable with traffic load in the area. After

temporarily loaded near the roads, materials and equipment will be manually carried to

construction site. The substation construction site is near the roads, the manually carried

distance is inconsiderable. For the line construction site, there are many positions far away

from the roads or located on hill slopes so the manual transportation is

relatively expensive, the weighted average of manual transportation distance is of about 350-

400 m. These roads do not cross residential areas, schools, hospitals and medical stations.

- Building materials such as: sand, grit, cement will be supplied by suppliers who have got

business license in locality within the radius of 10 – 30 km.

3.6. Subproject Implementation Schedule and Total Investment Capital

IV. SUMMARY OF SOCIO–ENVIRONMENTAL BACKGROUND IN THE

SUBPROJECT AREA

4.1. Geographical Area

Binh Dinh is located on the coast of Central Vietnam, the

province's territory stretches 110km along the north – south with the

average narrow width of 55km (narrowest place is 50km, maximum width is 60 km). It is

surrounded by Quang Ngai in the north with the common border of 63km, the South China

Sea in the east with the coastline of 134km, Phu Yen in the south with the common border of

50km Gia Lai in the west with the common border of 130km. Binh Dinh is considered

a gateway to the sea of the Central Highlands provinces and southern Laos.

The total natural land area of Binh Dinh province is 6,039.56 km2, the province's

population is 1,489,900 people, a population density of 247 people per km2 (2009 data). On

the administrative organization, Binh Dinh has 11administrative units, Qui Nhon city is the

provincial capital that is first grade city and10 districts are: An Lao, Van Canh and Vinh

Thanh (mountainous districts), Hoai An, Tay Son (Midland districts), Hoai Nhon, Phu Cat,

Phu My, Tuy Phuoc, An Nhon, (deltaic districts), the whole province has 159 communes,

precincts and townlets (of which: 129 communes, 14 townlets, 16 precincts). Currently, Qui

Nhon city is the center of politics, culture of Binh Dinh.

4.2. Climate, Topography and Pedology

a) Climate

The climate of Binh Dinh Province in general, Qui Nhon and Tuy Phuoc in particular

have humid tropical monsoon climate, due to the complex topography when the monsoon got

into the mainland, its direction and intensity has changed quite a lot. The annual average air

temperature: in the mountainous area varies from 20.1 to 26.1ºC, the highest one is 31.7ºC

and the lowest one is 16.5ºC. In coastal area the annual average air temperature is 27ºC, the

highest one is 39.9ºC and the lowest one is 15.8ºC.

- Monthly average absolute humidity in the year: in the mountainous area varies from

22.5 to 27.9ºC and the relative humidity is 79.92% , and in coastal area average absolute

humidity is 27.9% and the average relative humidity is 79%.

- Precipitation: Rainy season starts from August to December, sunny season from

January to July. Particularly, mountainous areas have one more aid rainy season lasting from

May to August under the influence of Highland’s rainy season. The dry season lasts from

January to August. For the mountainous districts, the average rainfall during the year from

2,000 to 2,400mm. For coastal areas, the total rainfall is 1,751mm. The total rainfall tends

to decrease from the mountainous area to coastal one and from the Northwest to Southeast.

- About storm: Binh Dinh is located on the coast of Central Vietnam, so the storms

are often landed the mainland. Annually in the coast from Quang Nam-DaNang to Khanh

Hoa there is the average of 1.04 hurricane landfall, frequency of typhoons’ appearance

from September to November.

b) Topography:

The line goes through Tran Quang Dieu precinct, Phuoc Hoi commune belonging to Quy

Nhon city and towlets of Dieu Tri, Tuy Phuoc, communes of Phuoc An, Phuoc Loc, Phuoc

Nghia, Phuoc Son, Phuoc Hiep, Phuoc Hoa belonging to Tuy Phuoc district, Binh Dinh

province, it almost goes on the hillsides, there are several sections running through sparsely

populated areas and Industrial Zones in relatively flat terrain, in ROW there are some cross-

lines such as Highway No1A, Highway No19, provincial road 638, 639, 640, inter-

communal, inter-village, productive road, planning road in Industrial Zone…, so that the

transportation of equipment, materials and construction apparatus is rather favorable.

Particularly, the terrain at the start route section as well as at the end route section is rather

complicated, the elevation changes constantly, most line route goes on the high hills and

mountains so it ‘s very difficult in execution latter.

c) Pedology:

Geology here is mostly land of gray, gray brown, clay, loam of the yellow, lemon

yellow, medium grained quartz sand – coarse medium light gray, pale yellow and quite a lot

of shells, livid and dark blue clay. Heterogeneous structure and content of rock chips and

pebbles stone is quite large, 5.0 meters thick.

4.3. Natural Resources

Soil resources: The natural area of Binh Dinh province is 6.039km ² , there are11

groups of land with 30 different kinds, of which, the alluvial land accounts for 71,000

hectares. Currently there are approximately 136,350 hectares of agricultural land,

249,310 hectares of forestry land, and 62,870 hectares of non-agricultural land, over

150,000 hectares of unused land that can be exploited to develop agriculture, forestry

and other uses (2009 data)

Rivers and streams: Binh Dinh river system mostly stems from the high mountains of

Truong son Mountain range to the east side, the rivers are not large, high slope, short, low in

silt content, The total water volume is 5.2 billion m3, hydropower potential is

182.4 million kw. There are four major rivers in the province, they are Con river, Lai Giang

river, La Tinh river, Ha Thanh river and small rivers as Chau Truc or Tam Quan ones. The

province has about 15 artificial lakes and 03 fresh water lagoons that are favorable for the

development of agriculture and aquaculture. Especially the big Thi Nai

lagoon is favorable for the development of national-caliber port and contributes to the

development of Nhon Hoi Economic Zone, Thi Nai lagoon has the largest over sea bridge

in Vietnam today.

Mineral resources: Binh Dinh has many kinds of minerals such as bauxite, gold,

titanium, ilmenite placer ... and some non-metallic minerals such as kaolin, white sand,

granite ...In the whole province there are 5 points of mineral springs: Hoi Van, Chanh Thang,

Dinh Quang, Vinh Thinh, Long My. Especially hot mineral water quality of Long

My reaches international standards, it can be exploited 50 million liters / year. The project

did not go through the area with the resources listed above.

Marine and coastal resources:Binh Dinh has a coastline of 134

km with three large bays: Qui Nhon, De Gi and Tam Quan, has Thi Nai Lagoon and more

than 7600 hectares of water surface capable of aquaculture and marine products. Binh

Dinh marine ecosystem is suitable for many types of seafood that are of high value and

preferred by domestic market as well as foreign one. The coast has many beautiful

landscapes. However, the project is not located in this area.

Flora and fauna resources: With hot and humid climatic conditions, rainfall,

diversified topography and land, vegetation in Binh Dinh is abundant in genders

and species, there are 66 classes, 175 groups, 1,848 species. Wildlife in Binh Dinh forest are

associated with animal systems of Kong Ha Nung (Gia Lai), Ba To, Tra Bong (Quang

Ngai),Tra My and Phuoc Son (Quang Nam) includes seven classes with 19 groups,

38 species and 13 classes of birds with 37 groups, 77 species. However, the project area is

located away from these areas; flora in this area are mostly rice and crops and some fruit

trees, common timber; animals are mainly domestic ones as the special

livestock, poultry, wildlife mainly birds, bats, squirrels ...

4.4. Traffic system

The transportation system in Binh Dinh province is rather synchronous. Highway

No.1A (runs through the province from north to south with a length of 118 km), national

railway (150 km through the province) runs through the province from north to south along

with Highway No.14D (34km long); Highway No19 (70km through the province) that

connects Qui Nhon port to the outside is very convenient, Phu Cat airport that is 30km far

from Qui Nhon city to the north has been opened more flights to welcome passengers to and

from Binh Dinh. Notably, the coastal road connection from Nhon Hoi to Tam Quan

facilitates socio-economic development and exploits the potential of the province’s hills and

mountains.

The traffic conditions in the project area is relatively favorable, construction site position is

about 300 meters far from Highway No.1A, in the substation location there ‘s the planning

road in the Industrial Zone so it is very convenient for the transportation of materials and

equipment

Yes - Materials and equipment are transported in long

distance from the yard and storehouse of Investors

by specific trucks with suitable form of packaging

goods and equipment to the temporary project

storage. After that, they are transported to the

construction sites by 5 tons to 7.5 tons trucks.

Building materials such as: sand, grits, stones,

cement will be supplied by suppliers who have got

business license in locality and transported directly

to the construction sites.

- With the average frequency of transporting as

above (item 9) and constructing activities such as:

soil excavating and conductor stretching, local

traffic obstruction will happen. However, the time

for loading materials and equipment is short

(about 1 hour), building materials (sand, grits,

stones, soil, etc) is loaded by dumper trucks so the

level of traffic jam is not high.

investors and always be expressed in the bidding

documents, contract terms, therefore there are

during construction such as installing septic tanks,

create drainage channels, installing manholes

septic, etc in compliance with the regulations of

the local area. Hence, the impact on environment

by workers is not considerable. The appropriate

mitigation measures specified in Item 6.1 of this

EMP will be implemented to minimize impacts to

the environment from workers.

Yes - There are differences between the workers and

local people in income, lifestyle and custom.

However, there is no deep conflict between them

because they all use Vietnamese as a means of

communication. The workers have to follow

project uses some local labors in manual work. So,

there is no big conflict between workers and local

people.

take-off and landing outside the airport.

and does not use the equipment that contains PCB

Transformer oil may be leaked in case of failure.

However, this is rarely occurred and there is

already the tank for containing this oil. Leakage

pollution caused by oil sewage.

at sites identified and approved by the Construction Supervision Consultant and

14. Chance find procedures

on historical, cultural

and religious relics

If the Contractor discovers archeological sites, historical sites, remains and objects,

including graveyards and/or individual graves during excavation or construction, the

Contractor shall:

- Stop the construction activities in the area of the chance find.

- Zone off and secure the site to prevent any damage or loss of removable objects. In

cases of removable antiquities or sensitive remains, a night guard shall be arranged

until the responsible local authorities or the Department of Culture and Information

takes over.

- Notify the Construction Supervision Consultant who in turn will notify responsible

local or national authorities in charge of the Cultural Property of Viet Nam (within

24 hours or less).

- Relevant local or national authorities would be in charge of protecting and

preserving the site before deciding on subsequent appropriate procedures.

- Decisions on how to handle the finding shall be taken by the responsible

authorities. This could include changes in the layout (such as when finding an

irremovable remain of cultural or archeological importance) conservation,

preservation, restoration and salvage.

- If the cultural sites and/or relics are of high value and site preservation is

recommended by the professionals and required by the cultural relics authority, the

Project’s Owner will need to make necessary design changes to accommodate the

request and preserve the site.

VII. INSTITUTIONAL ARRANGEMENT FOR EMP IMPLEMENTATION

7.1. Responsibility for implementing the Environmental Management Plan

To ensure effective implementation of the EMP, the following actions will be carried out

during the implementation of the subproject:

a) During the detailed design and tender documentation making

- During the detailed design of technical specifications and preparation of bidding

contract documents for each contract, the technical design consultant will incorporate

into these bidding and contractual documents the parts of the EMP specific to that

contract, as well as the specific measures identified in the EMP.

- In preparing the bidding and contract documents, make an effort to ensure that the

contractors are aware of the safeguard obligation and commit to comply.

b) During the course of construction

PPMU will assign the Construction Supervising Consultant (CSC) and/or field engineer to be

responsible for supervision of safeguard performance of contractor on a daily basis. A generic

Terms of Reference (TOR) is provided in Annex 1. CSC and/or field engineers will carry out,

but not limited to, the following tasks:

- Before the commencement of the construction, confirm that all compensation for land

and facilities are provided and relocation and/or land acquisition/donation has been

completed.

- Closely supervise the implementation of the EMP throughout the construction period.

- Confirm the compliance with the agreed environmental plan and inspect any damages

incurred by the contractor. If necessary, prepare an order to compensate/restore the

construction sites as specified in the contracts. Contractor safeguard performance will

be included in the subproject progress report.

8. Phuoc Hoa Commune People's Committee:

During the consultation process PMU has been conducting the following activities:

- Activity number 1: Information supply and discussion with Local Authorities about

line route direction;

- Activity number 2: Check and make inventory of the impact and number of affected

households;

- Activity number 3: Contact with project affected households.

When the investigation is completed, the NPMU will cooperate with the representatives of

the districts, town and villages (in project areas) to hold meeting with households whose

assets are affected by the project. During these meetings, the NPMU’s staff will present these

following contents: Summary of the project, draft of RP (plan of compensation and

resettlement) and (EMP (Environmental management Plan), site maps, statistics, forms and

other related documents.

The NPMU’s staff announces the project objectives, land and crop impact by project,

compensative regulations and policies to PAHs and recommends the local people do not

build new houses or structures in the ROWs. PAHs are consulted about compensation

policies and value. PAHs’ questions are answered appropriately; the interest / request of

PAHs are recorded.

Some key comments and recommendations from public consultation meetings as

follows:

- Carry out construction after the harvest;

- Mitigate impacts on scenery and environment;

- Guide power safety methods to people under the project area.

- Activity number 4: Continue to get feedback from PAHs.

- Activity number 5: Publicize information;

The project will get the decision of investment and approval of design- total cost estimate,

design of construction engineering drawings after appropriate adjustment of project location,

design document, capacity and/or project technologies in order to meet the demand of

environmental protection and resettlement. In order to meet the demand of OP 4.01 on

information announcement, the NPMU will be:

- Disclose the Vietnamese version of the EMP and summary of the subproject at the

offices of People’s Committees of Districts and communes in subproject areas.

- Put up and announce on famous newspaper of the province in 2 months. The

announce will inform that resettlement plan, environmental management plan and the project

summary will be publicized in two months and in office hours at (1) District-level People's

Committees, and (2) Commune townlet-level People's Committees.

The Construction Supervision Consultant is to provide professional technical services (“the

Services”) to help ensure effective implementation of subproject EMPs.

Scope of Services:

The general services to be provided by the CSC are to inspect, monitor the construction

activities to ensure that mitigation measures adopted in the subproject EMPs are properly

implemented, and that the negative environmental impacts of the project are minimized.

On behalf of the PMU, the CSC will conduct the following tasks:

- Conduct regular site inspections;

- Review the status of implementation of environmental protection measures against the

EMP and contract documents;

- Review the effectiveness of environmental mitigation measures and project

environmental performance;

- As needed, review the environmental acceptability of the construction methodology

(both temporary and permanent works), relevant design plans and submissions. Where

necessary, the CSC shall seek and recommend the least environmental impact alternative

in consultation with the designer, the Contractor(s), and PMU;

- Verify the investigation results of any non-compliance of the environmental quality

performance and the effectiveness of corrective measures; and

- Provide regular feedback audit results to the contractor’s Chief Engineer according to

the procedures of non-compliance in the EMP;

- Instruct the Contractor(s) to take remedial actions within a specified timeframe, and

carry out additional monitoring, if required, according to the contractual requirements and

procedures in the event of non-compliances or complaints;

- Instruct the Contractor(s) to take actions to reduce impacts and follow the required EMP

procedures in case of non-compliance / discrepancies identified;

- Instruct the Contractor(s) to stop activities which generate adverse impacts, and/or when the

Contractor(s) fails to implement the EMP requirements / remedial actions.

- For contracts that Site Environmental Management Plan (SEMP) are required, the CSC shall provide the final review and recommend clearance of all Site

Environmental plans which may affect the environment. These include, but are not

limited to: dredging areas, borrow pits and disposal sites, worker’s camp plans. The CSC

will review and approve the SEMP presented by the Contractors. Where these plans are

found not to comply with the EMP, EIA or RAP, the CSC shall work with the PMU and

Contractor to establish a suitable solution.

- Addressing Complaints: Complaints will be received by the Contractor’s Site Office

from local residents with regard to environmental infractions such as noise, dust, traffic

safety, etc. The Contractor’s Chief Engineer or his deputy, and the CSC shall be

responsible for processing, addressing or reaching solutions for complaints brought to

them. The CSC shall be provided with a copy of these complaints and shall confirm that

they are properly addressed by the Contractors in the same manner as incidents identified

during site inspections.

- Certification for Monthly Payments: The CSC shall confirm the monthly payments

for environmentally related activities implemented by the Contractor.

- Reporting: the CSC shall prepare the following written reports:

o Bi-weekly report of non-compliance issues

o Summary monthly report covering key issues and findings from

reviewing and supervision activities

o At the end of the project the CSC shall prepare a final report

summarizing the key findings from their work, the number of infringements,

resolutions, etc. as well as advice and guidance for how such assignments

should be conducted in the future.
