Notice Inviting E-Tender for Hiring Vehicles for Examination Conducted by WBSCTE

(Through Pre-qualification) (Online submission of Bids)

West Bengal State Council of Technical Education is a Statutory Body under Government of West Bengal Act

XXI of 1995 under the Department of Technical Education & Training, Govt. of West Bengal. WBSCTE has been

entrusted under the Act to regulate academic monitoring activities of the technical education at diploma level within

the state on behalf of the Government of West Bengal. The activities of the Council include, inter alia i) Conduct of

examination for admission in different Diploma in Engg./Tech. & other courses in the polytechnics in the state b)

Conduct of examinations for different affiliated courses under this Council etc.

The Secretary , on behalf of the West Bengal State Council of Technical Education [for the sake of brevity

hereinafter referred to as WBSCTE ] invites offer from the competent authority for distribution and Collection of

examination related Confidential Materials as detailed in the section ‘Job Description’ respectively in Route Chart as

Annexure from experienced Transporters /Transport service providers running different types of vehicles in reputed

Industrial Establishment(s)/Educational Institution(s ) / Public Transport System (s).

The tentative requirements of vehicles are as follows:

http://wbtenders.gov.in directly with the help of Digital Signature Certificate. Earnest money to be deposited

physically to the office of the West Bengal State Council of Technical Education, Kolkata Karigori Bhavan, 110 S.N.

Banerjee Road, Kolkata–700013 through demand draft/pay order drawn from any nationalized bank payable at

Kolkata drawn in favour of “West Bengal State Council of Technical Education”. Scanned copy of the Bank Draft/

EMD to be uploaded along with the other documents.

Job description:

To provide transport service as per the actually Route Chart provided by this Council respectively The job consists

of :

a) Picking up of examination related confidential packets along with escorting team and security personnel .

b) Delivery of the confidential packets at the scheduled destinations, as indicated in the respective Route Chart .

c) Collection of the confidential packets at the scheduled destinations, as indicated in the respective Route Chart .

d) If required, temporary arrangement of displacement / relocation of seats for providing additional spaces may

be needed.

e) The bidder has to provide Vehicles for all the routes, partly for some selected routes only will not be accepted

in any condition.

General conditions :

Bidder should have ~

i) Experience of at least 2 ( Two) years in providing similar service to state govt. /Central Govt. / PSUs /any

other public institution like school/college for similar nature of job.

ii) Registration with R.T.A. for at least 15 Commercial vehicle (s) of which the company has the authorization

to use.

iii) Valid Trade License.

iv) PAN card of the Company.

v) Professional Tax Clearance certificate.

vi) Income Tax return for last three years.

vii) Audited Balance Sheet of the company for last three years. Annual turnover of the company should not be

less than Rs.25 Lakhs.

viii) Vehicles should not be older than the year 2010 and in good condition . Registration number of vehicles

with currency of Insurance, Road Tax and Pollution under control certificate etc.

ix) The tender Application form and all Non Statutory Documents (NSD) attachments thereto shall be

submitted along with the bid with each page being consecutively numbered and duly signed by the bidder

along with the seal of the Contractor through online bidding.

x) This tender document is not transferable. The work, if awarded, is not transferable.

Necessary supporting documents required for General conditions must be enclosed with the bids at the time of

applying through On-line.

Special conditions of contract : 1. In the event of any mechanical failure/breakdown of vehicle after its reporting duty, the contractor / service

provider shall arrange for replacement by another commercial vehicle within one hour. Non-compliance

will attract a penalty in the form of rescinding of the contract agreement and in the form of claims related to

the costs incurred in the form of partial performance of the job by the selected bidder shall stand invalid.

2. In case of any accident resulting in loss or damage to property or life, the sole responsibility, either legal or

financial would vest with the contractor / service provider. WBSCTE shall have no liability, whatsoever.

3. The contractor / service provider is/shall be liable for any legal disputes/cases/claims that have arisen or

may arise during the currency of the job contract in respect of vehicle provided for transport. The WBSCTE

shall not be liable for any loss, damage, etc suffered/to be suffered by the contractor / service provider or

third party as the case may be.

4. The contractor / service provider shall also be liable for all fines, penalties, and the like of parking, traffic

and other criminal offences arising out of or concerning the use of the vehicle during the period of transport

and any toll charges or entry taxes payable locally and the contractor / service provider accordingly

indemnifies the WBSCTE against all such liability.

5. The contractor / service provider is/shall be responsible for compliance of all the laws/ rules regulations

and Government instructions that are / will be applicable to and aimed to protect the interest of the

employees/ workers engaged by it and shall ensure payment of all the statutory dues/ liabilities as may

have arisen during the past or may arise during the course of performance of this contract.

Arbitration:

In the event of any question, dispute or difference arising under the agreement or in connection there with

(except as to the matters, the decision to which is specifically provided under this agreement), the same shall be

referred to the sole arbitration of the SECRETARY, WBSCTE or any other person appointed by him. In case his

designation is changed or his office is abolished then in such case to the sole arbitration of the officer for the time

being entrusted whether in addition to the function of the SECRETARY, WBSCTE or by whatever designation

such officers may be called (hereinafter referred to as the said officer). In the event of such arbitrator to whom

the matter is originally referred to vacates his office on resignation or otherwise or refuses to do work or

neglecting his work or being unable to act as Arbitrator for any reasons whatsoever, the SECRETARY, WBSCTE

shall appoint another person to act as Arbitrator in the place of outgoing arbitrator and the person so appointed

shall be entitled to proceed further with the reference from the stage at which it was left by the predecessor and

that the award of the Arbitrator shall be final and binding on both the parties. Contractor will have no objection

in any such appointment that the arbitrator so appointed is an employee of WBSCTE or a government servant or

that he has to deal with the matter to which the agreement relates or that in the course of his duties as a WBSCTE

employee he has expressed his views on all or any of the matters in dispute. The adjudication of such Arbitrator

shall be governed by the provisions of the arbitration and Conciliation Act 1996, or any statutory modification or

re-enactment thereof or any rules made thereof.

The venue of arbitration proceeding shall be office of the SECRETARY, WBSCTE, Kolkata or such other place as

the arbitrator may decide.

If the contractor institutes any legal proceedings against the WBSCTE to enforce any of its rights under this

agreement it shall be in the legal jurisdiction of WBSCTE at Kolkata.

Submission of the tenders:

All tenders must be submitted online as provided in Table below in compliance with Annexure detailing the

scopes of work. Tenders will be opened in presence of such tenderers or their authorized representatives.

The tender is to be submitted in a Two Bid System.

a) “BID A”:

One folder for “Essential Requirements of the Tendering Firm for participation” shall contain all papers related to

the essential requirements of the Tenderer for participation in the tender viz.

1. Prequalification doc/ Statutory Documents :

1 Demand Draft/Pay Order of Rs.50,000/- (Rupees Fifty Thousand only) favouring “West Bengal State Council of Technical Education“ payable at KOLKATA as Earnest Money for the whole tender . Scanned copy of the Draft/EMD for Rs. 50,000/- should be uploaded.

2. NIT Digitally Signed and Uploaded (Scanned copy of Tender document signed each pages indicated acceptance of all terms & Conditions)

3 Application form ( Signed Application form in company letter head). ** A folder will contain only one file. A file may contain multiple pages.

Non statutory documents/my documents to be attached with the Technical Bid:

Authorization to use at least 15 passenger vehicles like luxury buses and contact carriage buses with not later than the year 2010. For such vehicles copy of registration certificate , Tax clearance, Pollution under control certificates etc. to be scanned and uploaded.

** The above Statutory Documents as well as the NSD (Non Statutory Documents) are Compulsory for qualification under Technical BID.

b) “BID B”:

Another folder as “Financial Bid” shall contain the financial bids (BOQ) with the base rate in rupees for per hour

use of vehicle inclusive of all applicable Taxes and any other charges to be quoted.

1. During the tender evaluation process, the “Bid A” will be opened first. Those tenderers having qualified for

the essential requirements will be identified on the basis of the supplied documents. The Tender Selection

Committee / Purchase Committee will assess the capability of the bidders for executing the deliverable service

of the council during the tender period and then only in respect of those bidders who shall qualify in the opinion

of the Tender Selection Committee , the “Bid B” will be opened. The “Bid B” of those Tenderers, failing to meet

the essential requirements of participating in the tender and subsequently failing to qualify in the opinion of the

Tender Selection Committee after the presentation, will not be opened and be rejected.

2. The Tenderers quoting the Comparative lowest rate in “Bid B” will be considered as empanelled as

successful if otherwise eligible.

Rate to be quoted for :

(i) Rate of Hiring vehicle should be quoted per hour of use of vehicles .

(ii) Rate is inclusive of the wages of driver and helper and all other charges etc.

(iii) The fuel charges will be reimbursed by this Council at rate of 6 K.M. per Litre.(Ordinary crude fuel)

Earnest Money:

(a) Each tenderer must deposit Earnest Money in the form of Demand Draft/Pay Order for Rs 50,000/- (Rupees

Twenty Thousand) only in favour of “West Bengal State Council of Technical Education”, before opening of Bid

–‘A’. The Earnest Money is to be deposited once for participation in the whole tender. A copy of the Demand

Draft/Pay Order of the Earnest Money deposited should be included with the documents submitted in “Bid A”.

(b) The earnest money of the Tenderer is liable for forfeiture in case the Tenderer withdraws the tender as a

whole or for any particular item at any stage after the opening of the tender, or fails/refuses to enter into written

agreement for any or all of the items of its accepted tender within the time specified when requested to do

so/fails to furnish Performance Bank Guarantee within the stipulated time.

(c) The Earnest Money will be refunded after finalization of the tender or within 3 (three) months from the date

of opening of tender whichever is later against the specific prayer from the Tenderer.

(d) The EMD may be converted into security Deposit at the request of the selected agency, if considered by

competent authority of this Council.

Performance bank guarantee/ Security Bid :

i) Security Deposit : 10% of the bid value will have to be deposited as security deposit for the fulfillment of the

terms and conditions of the contract and is liable to be forfeited for non fulfillment of the obligations under

the contract. The same will be paid to the transport contractor / service provider with the final bill after the

successful completion of transport services under the contract.

ii) The performance bank guarantee will be mandatory for all suppliers and will not be waived in any case.

iii) The successful tenderers shall be required to furnish the ‘Performance Bank Guarantee’ equal to 10% of the

value of the estimated cost i.e. 1 lakh which may be considered to be adjusted with EMD if WBSCTE feels if

necessary as Performance Bank guarantee.

iv) ‘Performance Bank Guarantee’ should be submitted within three working days from the date of issue of

empanelment order.

Iv) The Performance Bank Guarantee will be liable to forfeiture as enumerated in penalty Clauses above.

Payment terms and conditions :

Payment: Payment will be made within 30 working days of placement of the bill, after successful completion of

assignment, under the contract .

Termination of contract: The contract may be terminated without prejudice to any other remedy for breach of

contract if the contractor fails to arrange transport as per the timings set out or if he fails to perform any other

obligation under the contract. The WBSCTE may without prejudice to other rights, may arrange for transport

services at the risk and cost of the contractor, in the above circumstances.

General guidance for e-Tendering

Instructions/ Guidelines for tenders for electronic submission of the tenders online have been annexed for assisting

the prospective Bidders to participate in e-Tendering.

1. Registration of Bidders:

Any Bidder willing to take part in the process of e-Tendering will have to be enrolled & registered with the

Government e-Procurement system, through logging on to https://etender.wb.nic.in. The prospective Bidder is

to click on the link for e-Tendering site as given on the web portal.

2. Digital Signature certificate (DSC)

Each Bidder is required to obtain a class-II or Class-III Digital Signature Certificate (DSC) from NIC for

submission of tenders, from the approved service provider of the National Information’s Centre(NIC) on

payment of requisite amount details are available at the Web Site Stated in Clause-2 of Guideline to Bidder DSC

is given as a USB e-Token.

3. The Bidder can search & download NIT & Tender Documents electronically from computer once he logs on to

the website mentioned in Clause 2 using the Digital Signature Certificate. This is the only mode of collection of

Tender Documents.

4. Participation: A prospective bidder shall have to offer rate for all items subject to fulfillment of conditions laid down

hereinabove and conforming to production capacity to be laid down in the tender paper.

5. Submission of Tenders.

Tenders are to be submitted through online to the website in two folders at a time for each work, one in

Technical Proposal & the other is Financial Proposal before the prescribed date &time using the Digital

Signature Certificate (DSC). The documents are to be uploaded virus scanned copy duly Digitally Signed. The

documents will get encrypted (transformed into non readable formats).

6. Technical proposal

The Technical proposal should contain scanned copies of the following in two covers (folders) contining

Statutory Documents (SD) & Non statutory Documents (NSD).

7. Financial proposal

Another folder as “Financial Bid” shall contain the financial bids (BOQ) with the base rate in rupees for per hour
