EN BANC RESOLUTIONNo.19 -11(Series of 201.1.)
WHEREAS, on February 01,2007, the Commission passed En Bane Resolution No. 08-07,Series of 2008 amending En Bane Resolution No. 01-05, Series of 2005, which provides for theschedule of fees and charges to be collected for certain services;
WHEREAS, Executive Order Nos. 292 (1987), 159 (1994), 197 (2000), and otherissuances enjoin all government agencies to adjust fees and charges by just and reasonablerates sufficient to cover the full cost of services rendered;
WHEREAS, there is a need to amend the aforesaid En Bane Resolution to conform withthe amendment of the Rules of Procedure of this Commission and in line with the concerns ofstakeholders;
WHEREFORE, RESOLVED as it is hereby RESOLVED to amend the Schedule of Feesprovided under En Bane Resolution No. 08-07, Series of 2008 amending En Bane Resolution No.01-05, Series of 2005, as follows:

*Walk-in settlements refer to amicable settlements entered into between/among parties without a pending case orbefore the filing of position paper.
Unless otherwise provided by law, rules or regulation, litigants (a) whose gross incomeand that of the members of their family do not exceed an amount double the monthly minimumwage for an employee and (b) who do not own real property with a fair value as stated in thecurrent tax declaration of more than Three Hundred Thousand (P300,000.00) pesos, shall beconsidered indigent litigants and shall be exempted from immediate payment of fees/charges,upon execution of an affidavit to that effect.
In such case, the fees/charges shall be a lien on any judgment rendered in the casefavorable to the indigent litigant unless it is otherwise provided in the decision.
Any insufficiency in the amount paid by reason of the imposition of new fees shall allowthe concerned party five (5) days within which to pay the deficiency. The grace period shall beapplicable only during the transitory period of six (6) months.
This resolution shall take effect after fifteen (15) days from publication in newspapers ofgeneral circulation.
