The undersigned is directed to invite reference to this Ministry’s OfficeMemoranda of even number dated the 7th February, 2008 and 27th March, 2008, onthe above subject vide which the setting up of Hindlabs, a state of the art diagnosticlaboratory by M/s Hindustan Latex Limited was conveyed. The decision of theMinistry of Health & Family Welfare was also conveyed that all CGHS beneficiaries(registered with CGHS dispensaries in Ramakrishna Puram Sectors II, III, IV, VI, VIIand XII; Jawaharlal Nehru University; Moti Bagh; Nanak Pura; three dispensaries inSarojini Nagar; Netaji Nagar; Nauroji Nagar and Laxmibai Nagar) shall have to bereferred only to that laboratory. As there were some initial teething problems in theHindlabs, it was decided to keep in abeyance the implementation of the instructionscontained in the Office Memorandum of 7th February, 2008, referred to above untilfurther orders.

2. It has been brought to the notice of the Ministry of Health & Family Welfarethat Hindlabs has now overcome the problems faced by it initially and is in a positionprovide one window quality diagnostic services to the beneficiaries. Theundersigned is, therefore, directed to convey the following decisions of the Ministry ofHealth & Family Welfare:

(i) As Hindlab has been set up by the CGHS in collaboration with M/s. HindustanLatex Limited, it will be deemed to be empanelled under CGHS, and beneficiariesfrom any dispensary in Delhi may also get tests done at Hindlabs for diagnosticpurposes;

(ii) Hindlabs will not charge any money from pensioner CGHS beneficiaries forthe diagnostic tests to be carried out by it and raise bills on Additional Director(Hqrs), CGHS, Bikaner House, Shahjahan Road, New Delhi 110 011, in a periodicalcycle; and

(iii) A CGHS beneficiary can directly go to Hindlab for diagnostic tests, if he / shehas been prescribed the same by a Government specialist. For this, the beneficiaryhas to submit a copy of the prescription by the specialist and a copy of his / her validCGHS card.

Subject: Revision of income limit for dependency for the purpose ofproviding Central Government Health Scheme (CGHS) coverage tofamily members of the CGHS covered employees subsequent toimplementation of recommendations of the sixth Central PayCommission – regarding

The undersigned is directed to say that subsequent to the implementation ofthe recommendations of the 5th CPC the income limit for dependency for thepurpose of extending CGHS coverage to “family” members of the CGHS coveredCentral Government employees was enhanced to Rs. 1500/- per month.

2. With the implementation of the recommendations of the 6th Central PayCommission, the issue of revision of income limit for dependency for the purpose ofproviding CGHS coverage to family members of the CGHS covered CentralGovernment employees and pensioner CGHS beneficiaries was underconsideration keeping in view the amount of minimum pension/ family pension fixedby the 6 th Central Pay Commission.

3. On the basis of the recommendations of the 6th CPC, the Department ofPension and Pensioners’ Welfare under para 5.5 of their OM No. 38/37/08-P&PW(A) dated 2.9.2008, has fixed the amount of minimum pension as Rs. 3500/- permonth and under para 8.1of this OM the amount of family pension has been fixedas 30% of the basic pay in all cases shall be subject to a minimum of Rs.3500/- permonth and maximum of 30% of the highest pay in the Government. The DoP&PWat para 8.5 of the same OM has decided that dependency criteria for the purpose offamily pension shall be the minimum family pension along with dearness reliefthereon.

4. It has been decided, in consultation with the Department of Expenditure, torevise the income limit for the purpose of providing CGHS coverage to the familymembers of the CGHS covered Central Government employees to “Rs.3500/- plusthe amount of dearness relief on basic pension of Rs.3500/- as on the date ofconsideration”.

5. As such, all the orders related to the CGHS Rules stands amended to theextent that the income limit for Rs.1500/- per month from all sources includingpension/ and family pension stands amended to an income of Rs. 3500/- plusamount of the dearness relief on the basic pension of Rs.3500/- as on the date ofconsideration. The amount of dearness relief, as indicated in the income limitstands for the amount of dearness relief drawn by a pensioner/ family pensioner onthe date of consideration and not the amount of dearness relief due on the date ofconsideration.

6. The income limit for dependency of “Rs. 3500/- plus amount of the dearnessrelief on the basic pension of Rs.3500/- as on the date of consideration”, shall alsobe applicable for the cases covered under CS (MA) Rules, 1944 for the purpose ofexamining eligibility of family members of the Central Government employee formedical facilities under the Rules.

7. The order shall be effective from 1st January, 2009.

8. This issues with the concurrence of the Department of Expenditure vide theirI.D. No. 566/EV/2008 dated 4.11.2008.

The undersigned is directed to state that the age limit for dependent sons anddaughters was earlier fixed vide Office Memorandum, No: B – 12014/7/92-CGHS (P) datedthe 31st December, 1993, issued by the Ministry of Health & Family Welfare, according towhich for sons to be dependent on his father / mother, he had to be less than 25 years ofage or till he started earning, whichever was earlier. As a result of stay granted by theHon’ble High Court of Delhi in Civil Miscellaneous Petition, No: 115/97 in Civil Writ Petition,No: 2542 of 1996 in Shri Madan Mohan Sharma Vs Union of India, the Ministry of Health &Family Welfare issued an Office Memorandum, No: 4-24/96-C&P/CGHS/CGHS(P) on 17th

September, 1999, upper age limit for sons was removed subject to fulfilling otherconditions regarding dependency and normally staying with the Government servant /pensioner. The Hon’ble High Court of Delhi has dismissed the petition by its order on 29th

November, 2006.

2. In view of the dismissal of the Writ Petition, it has been decided to re-fix the agelimit for dependents, as indicated below:

(i) Son Till he starts earning or attains the age of 25years, whichever is earlier.

(ii) Daughter Till she starts earning or gets married,irrespective of the age limit, whichever isearlier.

(iii) Son suffering from any permanentdisability of any kind (physical ormental)

Irrespective of age limit.

(iv) Dependent divorced / abandoned orseparated from their husband /widowed daughters and dependentunmarried / divorced / abandoned orseparated from their husband /widowed sisters

Irrespective of age limit.

(v) Minor brother(s) Upto the age of becoming a major.

3. The other conditions of dependency and normally residing with theGovernment servant / pensioner will remain the same.

4. This order will take effect from the date of issue of the Office Memorandum.

5. This order would also be applicable to Central Government employees coveredunder Central Services (Medical Attendance) Rules, 1944.

The undersigned is directed to refer to this Ministry’s Office Memorandum, of evennumber dated the 30 th May, 2007, vide which age limit for dependent sons and daughterswere refixed by the Ministry of Health & Family Welfare, after the Delhi High Courtdismissed Civil Miscellaneous Petition, No: 115/97 in Civil Writ Petition, No: 2542 of 1996 inShri Madan Mohan Sharma Vs Union of India, by its order on 29th November, 2006. Interms of the Office Memorandum of 30th May, 2007, referred to above, a son who isdependent on his father / mother can avail CGHS facilities upto the time he attains the ageof 25 years or till he starts earning, whichever is earlier. The age limit of 25 years would notbe applicable in respect of the son of a CGHS beneficiary, in case he was suffering fromany permanent disability of any kind (physical or mental).

2. Subsequent to the issuing of the Office Memorandum of 30 th May, 2007, referred toabove, the Ministry of Health & Family Welfare has been receiving requests for clarificationfrom, many sources, as to whether renal failure constitutes a permanent disability. Afterexamination of the matter in the Ministry of Health & Family Welfare, it is hereby clarifiedthat disability that are covered by the above mentioned Office Memorandum of 30 th May,2007, are “disability” as defined in Section 2(i) of ‘THE PERSONS WITH DISABILITIES(EQUAL OPPORTUNITIES, PROTECTION OF RIGHTS AND FULL PARTICIPATION)ACT, 1995 (No: 1 of 1996)”, which is reproduced below:

The process empanelment of private hospitals and diagnostic centres inDelhi, on the basis of quotations received during 2004 has been completed. The listof empanelled hospitals, however, does not include a single hospital for treatment ofcancer patients. Earlier there were four hospitals, viz. Rajiv Gandhi Cancer &Research Institute; Dharmshila Cancer Hospital & Research Centre; Batra Hospital& Medical Research Centre and Indraprastha Apollo Hospital. The situation in otherCGHS cities is almost the same.

2. As the list of empanelled hospitals under CGHS, Delhi, did not have anyhospital providing treatment for cancer patients, it was decided as on ad-hocmeasure, the permit CGHS beneficiaries to get themselves at these four hospitalssubject to the condition that they would have to initially pay for the treatment andclaim reimbursement later. The reimbursement will be limited to the rates notified in2001. The ad-hoc arrangement is currently valid upto 31st December, 2008.

3. 4. The Ministry of Health & Family Welfare has been receiving representationsabout non-availability of adequate hospitals providing treatment to beneficiariesunder CGHS / CS (MA) Rules, 1944, who are cancer patients, as the list of hospitalswhere the treatment can be taken is limited to around thirty hospitals in the country.After careful examination of the representations received, it has been decided withthe approval of the competent authority that CGHS / CS (MA) Rules, 1944,beneficiaries, who are cancer patients (both old and new) may be permitted to taketreatment in any multi-speciality general purpose hospital that provides treatment tocancer patients, subject to the condition that reimbursement will be limited to actualexpenditure or the rates notified in 2001, whichever is lower.

5. As the private hospitals are not on the list of CGHS empanelled hospitals,these hospitals will not extend credit facilities to pensioners and hence thebeneficiaries under CGHS will have to claim reimbursement, at the rates notified in2001 or actuals whichever is lower, after getting themselves treated at the hospitals.Similarly, serving employees and their family members, who are beneficiaries under

CGHS / CS(MA) Rules, 1944, may be reimbursed as per the rates notified in 2001or actuals whichever is lower.

6. In so far treatment taken in Regional Cancer Centres is concerned, theposition will remain the same in so far as reimbursement is concerned, as has beenmentioned in para 3 of this Office Memorandum.

7. These orders will be in force until further orders.

8. This issues with the concurrence of Integrated Finance Division in the Ministryof Health & Family Welfare, vide Dy. No: 5034-IFD/08 dated the 14th August, 2008.

CEILING RATES FOR INTRA-OCULAR LENSES

It has decided to revise the rates for IOL, as followed by the All India Instituteof Medical Sciences, and to circulate the guidelines to be followed for various types ofIOL for reimbursement to beneficiaries under CGHS / CS (MA) Rules, 1944, with regardto the purchase of IOL:

(1) Hydrophobic Foldable IOL ……… Rs. 5,000/-(2) Silicon Foldable IOL ……… Rs. 3,600/-(3) Hydrophilic Acrylic Lens ……… Rs. 5,800/-(4) PMMA IOL ……… Rs. 490/-

2. The ceiling rates, mentioned above for the different types of IOL implantsto be used will be as per actual expenditure or the rates mentioned, whichever is less,and will be reimbursable in addition to the package rates for cataract surgery procedure.

3. The reimbursement at the above mentioned ceiling rates will be done asper the rates fixed for the various IOL mentioned above and the IOL actually used in thesurgery. It is mandatory for the operating surgeon of all private empanelled hospitals /CGHS and CS (MA) beneficiaries to attach the empty IOL sticker, bearing the signatureand stamp of the operating surgeon on it, alongwith the bill in support of the type of IOLused, containing its’ batch number. In the event of the private empanelled hospital notgiving the batch number and / or empty IOL sticker then the beneficiary will be requiredto obtained the same from the hospital before the CGHS / concerned Department /Ministry finally settles the claim for reimbursement.

Subject: Payment / Reimbursement of medical expenses to beneficiariesunder CGHS and Central Services (Medical Attendance) Rules,1944 from two sources – From insurance agencies and from theCGHS or from the Ministry / Department.

The undersigned is directed to invite reference to the Office Memoranda,of even number dated the 8th January, 2004, and 27th February, 2004, vide whichbeneficiaries under CGHS and Central Services (Medical Attendance) Rules, 1944(who have subscribed to mediclaim policy from an insurance agency) were permitted toclaim reimbursement of the medical expenditure from both the sources viz. theinsurance agency and CGHS and Ministries / Departments (as the case may be). Thisbenefit was subject to the condition that the beneficiary will first claim reimbursementfrom the insurance agency and then from the CGHS or Ministry / Departmentconcerned. The reimbursement from the two sources was, however, not to exced thepackage rates prescribed under the CGHS for the particular treatment.

2. This Ministry had received representations from beneficiaries requestingfor the removal of the monetary ‘cap’ mentioned above. The main argument advancedin the representation was that this offered the beneficiary no incentive to subscribe tothe mediclaim policy for reimbursement only upto the package rates as it did not providethem with any additional benefit because they would in any case get the same amountfrom the CGHS without subscribing to mediclaim policy. Chairman InsuranceRegulatory & Development Authority (IRDA) also wrote to Secretary (H & FWrequesting appropriate revisions in CGHS Rules so that any expenditure incurred bypolicyholders which was inadmissible as per the CGHS rules but admissible mediclaiminsurance policies could be suitably claimed from the insurer. 3. The above have been carefully considered in this Ministry and it has beendecided, with the approval of the Competent Authority that beneficiaries who havesubscribed to Medical Insurance Policies in addition to availing CGHS facilities / CentralServices (Medical Attendance) Rules, 1944, may be allowed to claim reimbursementfrom both the sources subject to the condition that the reimbursement from suchsources should not exceed the total expenditure incurred by the beneficiary on thetreatment. The beneficiary will make the first claim to the insurance company and thesecond claim to the CGHS or the Ministry / Department concerned. The medical claimagainst the original vouchers / bills would be raised by the beneficiary first on theinsurance company, which would issue a certificate indicating the amount reimbursedto the Director, CGHS or Head of Department of the Ministry / Departmentconcerned.

The insurance company concerned will retain the original vouchers / bills in such cases.The beneficiary would then prefer his / her medical claim alongwith photocopies ofvouchers / bills duly certified, in ink, alongwith stamp of the insurance company on thereverse of the vouchers / bills to the concerned organisation. Reimbursement fromCGHS or other departmental source will be restricted only to the admissible amount asper approved package rates subject to the condition that the total amount reimbursedby the two organisations does not exceed the total expenditure incurred by thebeneficiary.

4. These instructions take effect from the date of issue and past cases arenot to be re-opened, and supercede earlier instructions on the subject (cited above).

Subject: Relaxation of procedures to be followed in considering requestsfor medical reimbursement.

The undersigned is directed to state that under the extant instructions, a CGHS cardholder, who wishes to apply for reimbursement of the expenditure incurred by him / her onmedical treatment of either self or his / her dependent family members, the presentreimbursement procedure needs verification of bills and issue of essentiality certificate bythe treating doctor, and the Medical Superintendent of the hospital. The process ofverification of bills and issue of essentiality certificates are time consuming with the doctor attimes being busy or being away from office for whatever reason. This necessitatesrepeated visits to the hospital for getting the verification done and essentiality certificateobtained. Representations have been received in the Ministry of Health & Family Welfarerequesting for doing away with the two requirements and for the Ministries / authoritiesconcerned to verify and check the authenticity of the claims on the basis of the prescriptionslip and the diagnostic report submitted by the Government servant / pensioner. In theevent of any doubt, the concerned Ministry / Authority can always get verification done fromthe hospital concerned.

2. The undersigned is also directed to state that CGHS guidelines currently provide forrelaxation of guidelines to cover full reimbursement in individual cases depending uponmerits of each case. In the case of Hon’ble Members of Parliament, the powers to relax theguidelines have been delegated to the Lok Sabha Secretariat and Rajya Sabha Secretariatrespectively and in the case of Hon’ble Chief Justice of Supreme Court and Judges of theSupreme Court to the Secretary General of the Supreme Court.

3. In order to reduce the burden on the specialists in individual cases of medicalreimbursement claim, it has been decided with the approval of heads of the hospitals torevise the guidelines for reimbursement by the competent authority, as follows:

(1) It has now been decided to do away with the procedure for verification of bills andissue of essentiality certificate by the treating doctor, and the Medical Superintendent of thehospital. Ministries / authorities concerned may verify and check the authenticity of theclaims on the basis of the prescription slip and the diagnostic report submitted by theGovernment servant / pensioner. In the event of any doubt, the concerned Ministry /Authority can always get verification done from the hospital concerned. Modifiedreimbursement claim form, alongwith checklist is annexed.

(2) All cases involving requests for relaxation of rules for reimbursement of fullexpenditure will henceforth be referred to a Technical Standing Committee, to be chaired bythe DGHS / Addl.DGHS and consist of Director (CGHS) and subject matter specialists. Ifthe Technical Standing Committee recommends the relaxation of rules for permitting fullreimbursement of expenditure incurred by the beneficiary, the full reimbursement may be

allowed by the Secretary (Health & Family Welfare) in consultation with IFD. A check list forconsideration of requests for reimbursements in excess of approved rates may include:(a) The treatment was obtained in a private non-empanelled hospital under emergencyand the patient was admitted by others when the beneficiary was unconscious or severelyincapacitated and was hospitalised for a prolonged period;

(b) The treatment was obtained in a private non-empanelled hospital under emergencyand was admitted for prolonged period for treatment of Head Injury, Coma, Septicemia,Multi-organ failure, etc.;

(c) The treatment was obtained in a private non-empanelled hospital under emergencyfor treatment of advanced malignancy;

(d) The treatment was taken under emergency in higher type of accommodation asrooms as per his / her entitlement are not available during that period;

(e) The treatment was taken in higher type of accommodation under specific conditionsfor isolation of patients to avoid contacting infections;

(f) The treatment was obtained in a private non-empanelled hospital under emergencywhen there is a strike in Government hospitals;

(g) The treatment was obtained in a private non-empanelled hospital under emergency,while on official tour to non-CGHS covered area;

(h) Approval for air-fare with or without attendant on the advice of treating doctor fortreatment in another city even though he is not eligible for air travel / treatment facilities areavailable in city of residence and

(i) Any other special circumstances.

4. The Office Memorandum is issued with the concurrence of IFD vide Dy. No: 908/AS&FA/2009 dated the 20th February, 2009.

INTERIM ARRANGEMENT FOR MUMBAI AND THIRUVANANTHAPURAM

It has been brought to the notice of the Ministry of Health & Family Welfare thathospitals and diagnostic centres empanelled under CGHS, Mumbai and Thiruvananthapuramhave been showing lack of interest in continuing with CGHS due to their perceived grievance ofhigh amount of performance bank guarantee and the rates that were being offered. This hasresulted in the ailing CGHS beneficiaries not being able to get treatment in private hospitals anddiagnostic centres.

The matter has been examined in the Ministry of Health & Family Welfare and, asan interim arrangement, it has been decided that CGHS beneficiaries in Mumbai andThiruvananthapuram may be allowed to get their treatment / tests, etc., in any private hospital /diagnostic centre in their respective cities and claim reimbursement from their respectiveDepartments / Ministries / CGHS, as the case may be, subject to the condition that thereimbursement would be limited to the CGHS rates that have been fixed for the city. There will beno change in the procedure for claiming of reimbursement of expenses.

The hospitals, not being in the list empanelled hospitals under the CGHS, may notprovide treatment under CGHS package rates for the city and may charge their own prevailingrates. The hospitals will also not be extending credit facilities to pensioner CGHS beneficiaries.Hence the beneficiaries may have to spend for their treatment from their own resources and claimreimbursement from their respective Ministries / Departments / CGHS. Before they proceed to gettreatment in a hospital, the beneficiaries are requested to get the permission from the concernedauthorities.

INTERIM ARRANGEMENT FOR MUMBAI AND THIRUVANANTHAPURAM

It has been brought to the notice of the Ministry of Health & Family Welfare thathospitals and diagnostic centres empanelled under CGHS, Mumbai and Thiruvananthapuramhave been showing lack of interest in continuing with CGHS due to their perceived grievance ofhigh amount of performance bank guarantee and the rates that were being offered. This hasresulted in the ailing CGHS beneficiaries not being able to get treatment in private hospitals anddiagnostic centres.

The matter has been examined in the Ministry of Health & Family Welfare and, asan interim arrangement, it has been decided that CGHS beneficiaries in Mumbai andThiruvananthapuram may be allowed to get their treatment / tests, etc., in any private hospital /diagnostic centre in their respective cities and claim reimbursement from their respectiveDepartments / Ministries / CGHS, as the case may be, subject to the condition that thereimbursement would be limited to the CGHS rates that have been fixed for the city. There will beno change in the procedure for claiming of reimbursement of expenses.

The hospitals, not being in the list empanelled hospitals under the CGHS, may notprovide treatment under CGHS package rates for the city and may charge their own prevailingrates. The hospitals will also not be extending credit facilities to pensioner CGHS beneficiaries.Hence the beneficiaries may have to spend for their treatment from their own resources and claimreimbursement from their respective Ministries / Departments / CGHS. Before they proceed to gettreatment in a hospital, the beneficiaries are requested to get the permission from the concernedauthorities.

SHILLONG: NIL (as hospitals have refused to sign MOA with CGHS)

INTERIM ARRANGEMENT FOR SHILLONG

At present there is no private hospital or diagnostic centre that has beenempanelled under CGHS, Shillong.

2. The matter has been examined in the Ministry of Health & FamilyWelfare and, as an interim arrangement, it has been decided that CGHSbeneficiaries in Shillong may be allowed to get their treatment / tests, etc., in anyprivate hospital / diagnostic centre in Shillong and claim reimbursement from theirrespective Departments / Ministries / CGHS, as the case may be, subject to thecondition that the reimbursement would be limited to the CGHS rates that have beenfixed for the city. There will be no change in the procedure for claiming ofreimbursement of expenses.
