O que é a ELSA?

A ELSA é a “The European Law Students’ Association” – Associação Europeia de Estudantes de Direito, uma associação

internacional, independente, apolitica e de escopo não lucrativo gerida por e para estudantes de direito e jovens juristas.

Fundada em 1981 por estudantes de Direito da Áustria, Hungria, Polónia e República Federal Alemã, a ELSA é hoje a maior

organização de estudantes de direito .

Nossa Filosofia

Visão A just world in which there is respect for human dignity and cultural diversity.

Propósito To contribute to legal education, to foster mutual understanding and to promote social responsibility of

law students and young lawyers.

Meios To provide opportunities for law students and young lawyers to learn more about other cultures and legal

noutros sistemas jurídicos internacionais e adquirem uma

maior e mais ampla experiência jurídica. A ELSA prepara

os estudantes de Direito para um ambiente mais

internacional e para os novos desafios do actual mercado

de trabalho.

O nosso Estatuto Especial

A ELSA através das suas actividades e dedicação demonstradas na comunidade internacional adquiriu um estatuo especial

em diversas instituições internacionais. Em 2000, foi atribuído à ELSA o “Participatory Status” com o Conselho da Europa.

Além disso, a ELSA tem “Consultative Status” em vários órgãos das Nações Unidas; em 1997 a ELSA adquiriu o “Special

Consultative Status” na UN ECOSOC, UNCITRAL e em 1994 foi atribuído à ELSA o “Consultive Statuts” na Categirua C

na UNESCO. A ELSA também tem o estatuto de Observador na WIPO e um acordo de cooperação com a UN Human

Rights Council e coopera com o ICRC e todas as Instituições Europeias.

Escolas de Direito da ELSA:

As Escolas de Direito da ELSA têm o objectivo de fornecer de fornecer aos estudantes de

Direito e jovens juristas dos diferentes países da rede ELSA oportunidades para aprender e discutir

temas jurídicos que habitualmente não são abordados nos planos de estudos das Universidades,

contribuindo desta forma para uma melhor educação jurídica, cultural e social.

A escola de Direito é um evento que tem a duração de pelo menos uma semana com um

mínimo de 20 horas de programa académico e são organizadas em parceria com um Parceiro

Académico ou Institucional (Centro de Estudos, Universidade, Observatório).

FEES e Preços diários:

As Escola de Direito da ELSA e os Eventos Internacionais têm preços máximos diários fixados

internacionalmente que os grupos organizadores não podem ultrapassar. Dependendo do país em

questão, os fees poderão ser diferentes. Há duas categorias diferentes – Favoured Countries e Non-

Favoured Countries.

Actualmente, de acordo com as mais recentes resoluções, a ELSA Portugal é considerado um Non

Favoured Country que usufrui do preço diário de 33€ (que inclui estadia, programa académico, todas as

refeições e programa social). Outros fees extras poderão existir (Gala Ball, transporte aeroporto-hotel e

outros à descrição da organização) que previamente o participante terá de declarar que pretende

usufruir desses mesmos.

The Erasmus Observatory on Health Law / Institute of Health Policy & Management (Erasmus

University Rotterdam) announces the annual Summer school programme on Health law, providing

health professionals and practitioners, with an opportunity for intensive training in various aspects

of health law and ethics over a two-weeks period, while absorbing the sights, sounds and culture unique

to Rotterdam and the Netherlands. The Summer school offers a custom-developed course taught by leading

academics in their field.

The course is designed to enhance the preparation of health professionals confronted with legal and ethical issues.

The course focuses on both theoretical and practical aspects of health law and ethics.

A Certificate of Attendance will be presented to participants who wish to take the course for academic credit.

Direito da Saúde: enquadramento jurídico do erro médico

“Health law is the branch of law which concerns the prerogatives and responsibilities of medical professionals and the rights of the patient. We focused on this topic, because it is a big issue in the post soviet countries as well as throughout the world. The proposed topic is extremely important nowadays because the studding of human rights in the field of Medical Law in Universities of Eastern Europe do not get enough of attention.

As a heritage, we have a bureaucracy in medical field which is extremely unacceptable, because we are talking about human lives. In our opinion it’s should be a duty of today's leaders to not only bui the structure and establish the procedures that will constitute the health law and legal medicine of tomorrow, but remember that a patient is a goal to the doctors and not the methods

However, this issue is urgent and requires formal legislative consolidation in the relevant legal act. In addition, it needs to be discussed in wider circles.

The main issue that arises towards the medical error – either it was intentionally or it’s only a medical negligence. During our seminar we will discuss all those problems and also will try to

answer the next question - what is causing the commission of medical errors?”

9th Aniversary celebrating M&A por Işıl Ergeç (VP S&C ELSA Turquia) Probably you heard of ELSA Summer Law Schools. If so, we bet that it is ELSA Istanbul’s Summer Law School on Mergers and Acquisitions! Given that it is acknowledged as a brand throughout the network! And that it is a nine-year-old already! Then, why miss the celebrations for its 9th birthday? It was a dream. They had a dream. They heard of ELSA Summer Law Schools. They thought “Why not us? Why not in Istanbul?” So, they started working hard. Not all the time they were motivated. There were times where so many things went bad and discouraged they were. However, they never

gave up. Thus, ELSA Istanbul’s Annual Summer Law School was born in 2005. They wished to accomplish the first example of a Law School in Turkey. Not only they could do that, but also they bequeathed us a tradition. Us, we are trying to do better every year, carry forward every time the previous edition. A week of lectures on Mergers and Acquisitions given by the partners of top law firms

in Istanbul and professors of well-known Faculties of Law of Istanbul... A week of

ELSA Bucareste pioneira na abordagem do Construcion Law!

Porquê Construction Law? por Catalina Apostu, Responsável pela Organização

For the first time ELSA Bucharest is proud to present to you “Construction Law” International Summer School. Due to the fact that Construction Law is still an unexplored area, we want to offer you the opportunity to get to know this field. This matter covers a wide range of legal issues including contract law, bonds and bonding, guarantees and sureties, liens and other security interests, tendering, construction claims, and related consultancy contracts.

The main purpose of our summer school is to provide information and to share some of the experience gained by those who work in this particular field, beginning with the fundamental notions and ending with practical aspects. The lectures present a balanced view upon Romanian and English legislation, offering the point of view the contractors. Also, the summer law school aims at an overall understanding of the field before excusevly examining successful contract management techniques, the art of negotiation, the role of the engenieer etc. To provide a very good academic program for our participants, our summer school aims to collaborate with: Freshfields Bruckhaus Deringer, NNDKP, CBRE, Coldwell Banker, Jones Lang LaSalle.

This edition is about promoting Construction Law through a series of lectures, seminars and workshops, case studies and moot court competitions. We plan to provide 30 motivated students with lecturers from Romania and foreign top universities and celebrated guests. The summer schools take place simultaneously at the same resort,in Bucharest, the difference being the well planned academic program for each event. The free-time program includes social events during evenings and study visits which allow you to discover the traditions and realities of a great country together. “Banking & Finance Law”, one of the most appreciated projects of ELSA Bucharest, has now reached its 5th edition. Due to the approached subjects

and due to the involvement showed by both students and professionals, “Banking and Finance Law” has risen each and every year, fact that was reflected in the number of participants and also in the importance of the speakers that held the lectures. The purpose of this summer school is to show to those who are interested what involves working in this area and also sharing the experience gained by those who are already working in this particular field. Sea, sun and learning with fun! A 14ª Edição da Escola de Verão Direitos Humanos e Globalização

Last week in July, in a beautiful town of Zadar on the Adriatic coast, will be placed a law school about an important subject- human rights and globalization. Including sun, sea and good fun, in a city of rich architectural. Because human rights are the basic rights to which all human beings are entitled, participants can take part and learn something more from experiences of native and foreign experts in human rights law.

Ana Teixeira, ELSA UCP Porto, participante na International SLS Human Rights & Globalization 2012 Uma semana na Croácia No verão do ano passado tive a oportunidade de ver aquele que Ernest Hemingway considerou ser o melhor pôr-do-sol do mundo: o pôr-do-sol da ilha de Zadar, na Croácia. Entre debates e palestras sobre os Direitos Humanos (tema que passou a ser um dos meus favoritos), passeios, gelados, uma viagem de barco, mergulhos no mar Adriático e (claro!) muitas festas, o que mais

me marcou foram as pessoas, os risos, as conversas…e as histórias que ficaram. Diana Roque, ELSA Faculade Direito Universidade do Porto, participante na International SLS Human Rights & Globalization 2012 Antes de mais, penso que qualquer experiência internacional nos enriquece enquanto pessoas e enquanto juristas. A Croácia foi escolhida devido à diferença cultural, o que obviamente transparece para o direito, mas também porque o plano da SLS me pareceu particularmente interessante. Foi sem dúvida uma experiência única conhecer um pouco sobre o direito croata e também, pelo contacto com os outros estudantes, saber o tratamento dado aos direitos humanos naquela parte da Europa. Foi sem dúvida um dos pontos altos do meu Verão.

A ELSA UCP Lisboa organiza pelo quarto ano consecutive a sua famosa e conceituada Escola de Verão, este ano subordina-da ao tema de “Media Law”. Aberta também a participantes portugueses, é uma excelente forma de experimentares um evento internacional da ELSA em Portugal!

Nowadays the world is like a global village: we are able to experi-ence an event happening in that precise moment across the

world or even to meet someone a thousand miles away without leaving our home. Everything and everyone is only a click away. This became possible due to media developments and tools: the press, social networks,

telecommunications, the internet itself, it all makes it easier for us. But how does it work? Is there any limitation to the power of the media? Should there be any? How can human rights be violated in the process? On the other hand, how can they be protected? Maybe you want answers for these ques-

tions or even have questions of your own you need to clarify – if so, we are waiting for you this summer!

Our goal this year is to focus on a more practical approach of the legal issues at stake and for that

we are counting with the honorable presence of the most reputed lawyers in the field, as Anthony Hudson

(Media Law specialized Lawyer and Winner of the Chambers Bar awards in 2012) and Gavin Millar Q (Media Law specialized Lawyer, Winner of the Chambers Bar awards in 2012 and co-author of “Media Law and Human Rights” and “Equality and Discrimination Law”), as well as excellent professors and experts in these subject

matters, such as Ian Cram (Head of School and Professor of Comparative Constitutional Law in the University of Leeds, currently advising the Law Commission in England as it reviews the operation of contempt of court laws) and Miguel Gomes (currently responsible for YDreams' Intellectual Property Management and that has served in the Portuguese IP Commission of the International Chamber of Commerce), among others.

So be prepared to discuss topics such as Freedom of Expression, Defamation and Protecting Reputa-tion, Contempt of Court Laws, Human rights and Entertainment, Non-disclosure agreements and other media related issues, as well as to enjoy one of the most beautiful capitals in Europe through an unbelieva-

ELSA Rotterdam organizes its third Summer Law School this year, with the topic: ‘Legal Aspects of Terrorism’. It will take place from the 21st until the 27th of July and the number of participants is limited to only 24.

Although the main topic suggests that the lectures will be focused on the legal aspects of terrorism, we still strive to offer you some interdisciplinary topics as well. Most lectures will have a combination of an expert speaking to you and of you all working

actively with the topic.

Since we are in The Netherlands, we do not want to rob you of the opportunity to visit The Hague’s international organizations. Also, you will have enough time to explore our capital city of Amsterdam. An ELSA Summer Law School would not be complete without your local drinks and some crazy parties. We have a spectacular social program planned for you!

Escola de Verão ELSA Roterdão “Primavera Árabe” em 2012

Joana Pratas, ELSA Universidade Católica de Lisboa No verão passado tive a oportunidade de participar na Summer School subordinada ao tema “O Direito Internacional e a Primavera Árabe”, organizada pela ELSA Roterdão. Para além das vantagens incontornáveis que se relacionam com a possibilidade de visitar um país estrangeiro e privar com estudantes oriundos de toda a Europa, que no meu caso se vieram a revelar uma fonte de momentos muito bem passados, os efeitos desta Summer School reflectiram-se também nos meus conhecimentos e formação jurídica. Passado quase um ano considero que estou bastante mais

dispersa para aquilo que é o direito num contexto global e para as subtilezas trazidas pelo contexto social e cultural em que estudamos para o modo como encaramos o direito em geral. Frequentar uma summer school é a maneira ideal de aumentar conhecimentos jurídicos e alargar horizontes e por isso não posso fazer mais do que recomendar vivamente a experiência!

Bem-Vindos a Odessa! Welcome to Odessa, the administrative center of the Odessa Oblast (province) located in Southern Ukraine. The city is a major seaport located on the north-west shore of the Black Sea and the fourth largest city in Ukraine with a population of 1,029,000. The city of Odessa was founded by a decree of the Empress Catherine the Great in 1794.In the 19th century it was the fourth largest city of Imperial Russia, after Moscow, Saint Petersburg and Warsaw. Its historical architecture has a style more Mediterranean than Russian, having been heavily influenced by French and Italian styles. Some buildings are built in a mixture of different styles, including Art Nouveau, Renaissance and Classicist.

Nowadays world’s merchant fleet from within 46 000 vessels operated by 1,5 million seamen which supply with freight in 380 billions of dollars.

As the “sea lawyers” said that in order to be fluent in maritime law you need to forget all that you were taught on the shore because reverse rules are in action.The participants will learn from leading maritime lawyers and scholars in the field about general issues of maritime law and dispute resolution practices in public and private spheres. Participants receive hands-on insider information about maritime commercial arbitration, adjustments of disputes between ship-owners and seamen. The course will also cover current trends and situation in dispute resolution in the sea law sphere between the states, as the continental shelf disputes as well as the recent practice of the International Court of Justice. Also in the end of the law school a moot court on maritime arbitration will be held among the participants. Alongside with the strong academic program, a social part will be reach in events, e.g. attendance of Odessa sea port administration, visiting the Opera, barbecue at the countryside and of course resting on the beach on the shore of the Black Sea.

Summer Seminar

ELSA Copenhagen is delighted to inform, that we will hold our annual summer seminar with the title “Design Protection and Piracy Prevention”. The seminar also offers an outstanding opportunity to network with other law students from all over Europe.

The seminar will focus on intellectual property law with the title, ”Design Protection and Piracy Prevention”. Today, design, and especially the right design has a tremendous

meaning to consumers worldwide, and companies are spending great amounts on designs that appeals to the consumer. It is therefore of utmost importance that there are international, as well as national law regulations that protects the designs and prevents business competitors in copying them from one another. It is a wide reaching discipline, which includes everything from textile to electronic products.

Furthermore, intellectual property law is a relatively new discipline when it comes to law regulation, and we therefore believe that the subject is of high relevance to upcoming lawyers. Intellectual property law is also very international orientated, due to the international conventions that exist on the area, which therefore also makes the seminar interesting for European participants. We are hoping provide the participants with an academic ballast, which they can hopefully bring to use in their future careers. We also wish to point focus towards the development and progress of intellectual property law, both inside the EU, but also worldwide.

To ensure a high professionalism and academic level, we will thoroughly pick out lecturers among highly recognized lawyers and specialists, all with experience within intellectual property law from the University of Copenhagen, law firms, private businesses and government authorities.

During the seminar, there will be held 8-10 lectures, with duration of approximately 90 minutes each.

The seminar also includes several social events, and sightseeing tours around Copenhagen will also be available. Furthermore we are planning on visiting museums with relevance to the topic, including Danish Design Center and Fritz Hansen.

ELSA’s projects make it possible for law students and young

lawyers to gain valuable legal experience abroad and plunge into the culture of another country. For every transnational lawyer and for me personally, it is a good chance to acquire new skills in a number of key areas of law. Being the Head of OC in the first conference on International Trade Law within ELSA Moscow I realized that it was such an excellent forum for establishing working relationships, sharing

experience and an outstanding opportunity to improve and expand legal skills in the sphere of international trade. As we are going to host the conference this Autumn, I warmly welcome all of you in the beautiful capital of Russia – Moscow! We will provide you with outstanding academic program including lecture of lawyers and professors and exciting social program. This conference comprise of international public law, international private law and European Law.
