    EBMD2 2010Budgethe Eagle Bend Metropolitan District #2 has completed the budg-ting process for its three separate funds and, after concluding aublic hearing, approved the final budget at its November 11,009 Board meeting.

    o operate the government side of the Districts activities, we an-cipate tax revenue of $833,000 from our 12 mill operating levynd our share of Arapahoe County motor vehicle taxes. After fund-ng $203,000 for the various governmental activities required byhe state, we will spend the balance of our projected governmen-al operating revenues on maintaining the existing landscapedreas within the District as well as enhancing some medians andther areas to improve their appearance as well as reduce water

    consumption. We alsohave some seed money tohelp jump start projects inour various communitieswhich would enhance prop-erty values and improvethe esthetic quality of living

    in the Eagle Bend area.

    Our water enterprise fundanticipates selling 110 mil-lion gallons of non-potableirrigation water from theDistricts wells as well as our 8 inch straw tapping the East ChCreek Valley water line running along the south side of E-This activity, which is supervised by the governmental expetures above, is expected to generate $433,000 in revenues wwill cover the purchase price of the water and costs of operatingdistribution system delivering the water to our customers.

    During 2010, the District intends to evaluate other sources of wit may develop within our boundaries which would help insureliable supply of reasonably priced irrigation water to ourtomers.

    Lastly, our largest area of expenditures relates to the $36,600in development debt carried over into 2010. Largely fromestate tax revenues, we anticipate making a $670,000 principaduction during the year as well as interest payments of $1,812on that debt.

    AN INTERVIEW WITHTHE PRESIDENT . . .n December Audrey Davie, Board Recording Secretary, sat down withom Coker, Eagle Bend Metro District #2 Board President, to conduct theollowing interview.

    AUDREY: Tom, in September of this year you received the Distinguishedoard Member award from the Special District Association; and we know

    hat behind every great leader there is a great team. Tell me about theeam who worked behind the scenes with you.

    OM: Well, you are too kind, but are you ever right about the team! Somany elements come into play when dealing with a complex public entity

    ke a Metro District. To answer the question Ill focus on seven (7) of theroups who have helped me and the Metro District with their expertise,

    wisdom and leadership.

    OM: The District is fortunate to represent a diverse and active Com-munity (1) with three HOAs, as well as over 60 acres of commercial area.he community has continued to demonstrate a high voting percentage forocal, county, state and national elections.

    OM: I have served on the Metro District for almost 6 years and have hadhe opportunity to work with various multi-talented Board Members (2)ast and present.

    AUDREY: Please, tell me about them.

    OM: The first two years I served on a Board controlled by Lennar/U. S.Homes. I owe a special thanks to Lennar employees Tim Tennant andDavid Snow, who were most helpful and supportive of our numerous en-

    eavors. Homeowner, Ken Vosika, was appointed to the Metro Districteveral years ago. He was most insightful during his service and we ap-reciate Kens contributions.

    AUDREY: I live in a neighboring subdivision which has hired a man-

    gement company to oversee the community. How does the Metro Districtperate?

    OM: Our Board has not hired a management firm which allows us tomaximize the Districts revenues. All of the duties and projects fall on thehoulders of the Board Members who volunteer an immense amount of

    time to complete each project.

    AUDREY: Who currently serves on the Board and what are their aof expertise?

    TOM: Rex Rexroat has helped us with easements, utilities and the pipdevelopment. His extensive experience in dealing with cities and couas well as installing cable systems all over the world has been invaluHes a great resource!

    George Arellano, Board Vice President, has been an integral part oDistricts direction and accomplishments over the last six years. He n

    tiates most of our contracts and his no non-sense style and political have kept the District focused.

    AUDREY: What about outside resources or agencies youve worked w

    TOM: In a highly legislated industry such as Special Districts, havinright mix of CONSULTANTS (3) is very important. The expertise and ance of our legal firm, White, Bear & Ankele, and our CPA firm ofmons and Wheeler, P.C. help to ensure we meet all local and regulations. STATE (4) Legislature, Senator Carol Spence has been

    helpful and attentive when weve sought information from the Stawhen weve voiced our position on issues. Nancy Doty and her stArapahoe COUNTY (5) have been most helpful with our election pralong with many other issues concerning Special Districts. The MayoCITY (6) Council of Aurora continue to be very supportive and availabresolve issues. Special thanks to Mayor Tauer, Councilmen Ryan Frand Bob Fitzgerald and staff for their long-term support.

    AUDREY: How does the Board stay current about regulations, legsues and concerns of Special Districts?

    TOM: EDUCATION (7) is very important to the Board. We are fortuto have an active Special District Association. Their annual confehas provided all Board members an opportunity to learn and to bemore educated and informed about a variety of issues. The Associis also very diligent in keeping us abreast about many legislative ters.

    Voter fraud chargesfiled against voters

    in 2008 election.

    Four charged as criminals for voting twice in the same election, moremay be charged. Littleton, Colo. - 18th Judicial District Attorney,Carol Chambers and Arapahoe County Clerk and Recorder Nancy A.Doty have announced criminal charges are being brought againstour Arapahoe County voters who voted twice in the 2008 Presiden-ial General Election.

    We will not tolerate people flaunting the law when it comes to Elec-ions, Clerk and Recorder Nancy A. Doty said, adding We each have

    a right to vote, but only once. Those who vote twice are diluting thempact of each and every other citizens vote. A total of 44 poten-ial violations were turned over to the Arapahoe County District At-orneys Office and after investigation of all of the cases, three have

    been charged with misdemeanors and one with a felony. An addi-ional seven voters are still under investigation for voting twice andace a strong probability of being charged, according to a spokesper-on for the District Attorney.

    Depending on the exact circumstances, voting twice can be either amisdemeanor or a felony but the message is simple: voting morehan once in the same election is election fraud, and a crime. Clerk

    and Recorder Nancy A. Doty said, We want to publicize the resultsof these investigations, and the fact that charges are being aggres-ively sought because we believe it will be a strong deterrent to oth-

    ers who may think they can commit election fraud.

    Our goal is to see that each voters vote is properly cast and counted,

    o the candidates chosen by the legitimate voters, who legally castheir ballots, are the ones who we declare as elected. Anything lesss not acceptable and we will pursue prosecution, according to Clerk

    and Recorder Nancy A. Doty, who added, We are extremely grate-ul for a District Attorney who agrees with us that voter fraud is a pri-

    ority for prosecution, and we appreciate the Investigators andAttorneys who have brought us to this point.

    January is a very busy month for the Metro District becathey are required by law to submit various reports to sev

    state and local governmental entities. Below is a partiaof the statutory requirements.

    House Bill 09-087HB 09--087 requires that by January 15, 2010 all special disprovide to their electors a notice containing basic information athe district such as: contact information, board members, millelection dates etc. The Eagle Bend Metro District has posted all oabove information on the Special District Associations official wsite. Log onto www.sdaco.org to read about your Metro Distric

    January 2010: File a current and accurate map of the Districts boundaries

    the Department of Local Governments (DLG), County Asseand the Clerk and Recorder of Arapahoe County.

    File a notice with names, address, contact person and chairto: Division of Local Government, Board of County Comsioners, County Assessor, County Treasurer, County Clerk aRecorder and any governing body of any municipality in wEBMD #2 is located.

    The south-western US is suffering itsnineth consecutive year of drought.There are concerns that the Col-orado River, which has sustained lifein the area for thousands of years,can no longer meet the needs oftens of millions of people living inmajor cities such as Las Vegas, LosAngeles, and some cities on Col-orados western slope.

    hat though is exactly what Stephen Goldstein, who is in charge ofBlack Mountain Golf and Country Club outside Las Vegas did, after

    ringing his golf cart to an abrupt stop on the way back to the clubouse. Mr. Goldstein is having 55 acres of the grass on his course re-

    moved. It is costing between $2m and 3m to have it done. It shouldave him more than $50,000 a year. The main reason was finan-ial, says Mr Goldstein. We knew that as time went on that waterosts were going to increase. There was going to be a time when

    we would either be mandated to reduce our water consumption orbviously from a financial condition it would be difficult for us to

    water all the areas.

    Water in Las Vegas is at a premium. One of the most important citiesn the United States is slap-bang in the middle of one of the driestreas in the world. The reason Mr Goldstein can afford to tear upome of his grass is because the Southern Nevada Water Author-ty is so keen to get people and businesses to use less water that itsaying them $1.50 for each square foot of grass they remove. So

    some gardens now no longer have grassand thirsty shrubs in them. They havegravel, desert landscapeing, and cacti.

    WILL OUR WATER SUPPLY RUN DRY ?Something To Think About

    This part of the US has suffered almost a decade of drought.Vegas is at the sharp end, but all the states in the region arfected. There is plenty of disagreement about whats causingdrought. Many here say its just a dry spell, that the rains witurn. But the General Manager of the Southern Nevada Waterthority, says that thers no doubt in her mind that the man-mclimate change is to blame.

    Were going to have to change our whole approach to water magement in this part of the United States, she says. Its such thing that helps explaine the water authoritys push to stop any w

    being wasted. Already they recycle all the citys used water. If itdown a plug hole, or drain it stays in the system. But if a rogue skler sprays the road, or a hose is left running into a lawn, the wis lost.

    Hence the Water Police.

    On patrol every day, they are chasing the source of every little ble of water. So when Scott stops his patrol vehicle by the side oroad, and starts filming a small puddle of surface water on the p

    With the onslaught of the drought and the rude wake-up callglobal warming and climate change is bringing to the entire wern United States, this community (in Las Vegas) is realizingthey need to adapt to the desert. its a cultural shift that wegoing through first, but every other western community will hago through.The lakes and reservoirs, and the Colorado River wserves them, are still the principal water source for millions of Aicans. Some argue that one day there may not be enough watfeed the cities and towns, which rely on the reservoirs and laThere are disagreements as to why water levels are dropping. Menvironmentalists argue climate change is to blame.

    Richard Seager from the Lamont Dougherty Earth Observatorythat they expect global warming to reduce the amount of watsome areas by 10% to 15% by the middle of the century. It macomparable to the 1930s dust bowl drought, but instead of thating just a few years.. it will become the newer drier climate thabe there for ever.

    Othersdo not believe climate change is to blame, arguingweather is cyclical and that the lakes and reservoirs will regain normal levels one day. Either way, water resources are very scand may be overused. The whole worlds getting overused. and more people are overusing all our resources.

    We are now relying on the weather. We need more snow up imountains to feed the river and the lakes and reservoirs. Soonlater water is going to become a major problem. We have tthings to curb water usage. Its not exactly a radical idea, consing the fact that were in a semi arid region and low precipita

    Do people who live in this semi arid climate realize they live wthere is limited precipitation? I dont think so but I think the people relies it. I think that people who move here from elsewhavent a clue. They have no idea its dry here.

    This year we did get some good snowfall, and lakes, reservoirsrivers rose quite dramatically, eight inches at a time, but this isone year. Now that water is becoming more of an issue, anythincan do to save water, we need to try.

    2010 will be a very big election year in Colorado. Next Novber, voters will be casting votes for all statewide elected of

    and as well as many state senate, house representatives, locaficials and perhaps several ballot issues and questions.

    The best way to get involved in the election process is to papate in your local neighborhood caucus held by your political pAt the party caucus you will elect the delegates who will repreyour precinct at the county assembly and all higher assembThis is a great way for you to be involved in helping to seleccandidates who will then be on the August Primary and the ember General Election Ballots.

    Important dates to remember are:

    January 19, 2010 is the last day to affiliate with a political pin order to participate in the party caucus.

    February 16, 2010 is the deadline to register in your precinorder to participate in the caucus. (An elector must be registin ones precinct prior to the date of the caucus.)

    March 16, 2010 is the date of the precinct caucus meetings for political parties.
