: Easement * Abstract An easement is a right which the owner or occupier of the land has for beneficial use of that land. These rights normally include right of way, right of light & air, right of discharge of household water and right of support etc. Malikiyyah consider extension of these rights according to human needs while other fuqaha have specified their number. Hanafi fuqaha consider easement rights as huqooq-e-mujarradah which are not saleable, anyhow these can be compensated in case of withdrawal from right or settlement of case with consent while jamhur consider most of these as saleable. The crux of the matter relies on the difference of opinion present in the definition of bai' as described by them.
