BRIEF IN SUPPORT OF MEMORANDUM IN OPPOSITION TO MOTION TO

DISMISS... Motions of withdrawl of plea Cr. 32.1 are active presently all cases.

1. Respondent misrepresents the history and facts of this Petition seeking command

enforcement of the law as stated and eriforcement of CODE OF JUDICIAL

CONDUCT 211 AND OTHER SPECIFIED RULES, LAWS THEREBY, AND

CONSTITUTIONAL LAW, DUE PROCESS, U. S. CONSTITUTIONAL

AMENDMENT 14 & 5 etc. against the Administrative duties of respondent.

II. Actual history of relevant facts ; relator was originally transferred from

(convicted of corruption judge Bridget McCafferty ) case # 516154 transferred to judge

Timothy McMonagle AS the mental health docket rules 30.1 require as a matter of

law. Relator was then manually assigned, again, judge McMonagle as mental health

eligible and required by Court's own rules on cases 534012 and 544297 ( see attached

docket summaries) also note the present court has failed to update it's 555897 docket

summary since Jo'y to conceal impropriety [see dockets all cases as requested]. On

present case the arraignment judge errantly assigned me to judge Maureen Clancy though

she is Not mental health certified , ( when Judge Timothy McMonagle retired my

mental health docket status was illegally interfered with R.C. 2921.45 since the rule

requires I was to have been maintained on the MENTAL-HEALTH DOCKET BY

LAW AND M.D.O. it is an administrative judges duty to enforce the rule and to correct

the prior incorrect judge assignment to the mental health docket whiGh the law requires I

sworn affidavit as accepted by the OFFICE OF THE SUPREME COURT OF OHIO, is

fully compliant, and then the respondent falsely claims I failed to attach an affidavit.

I refuse to entertain such blatant *stupidity. (With all due respect)*

Regarding ` B.'respondent clearly has no grasp of the law.

Federal civil rights lawsuit 1:12 cv 2265James Hayden v Nancy A. Fuerst

(no mention of any government entity in the caption of case , not that it would matter

since statute 2969.25 R.C.is irrelevant since a Mandamus actions are not the legislative

intent of that statute (check your case law you are not on point. It's for law suits and I

did file and confirmed by the federal 6th district OFFICE OF THE CLERK OF COURT

ACCEPTANCE OF MY LAWSUIT CIVIL ACTION FOR FILING. Plus the office

of the clerk of Ohio fupreme Court of whoms' jurisdiction it is to accept or reject

such filings has deemed mine compliant by APPENDIX E. WHICH SPECIFIES

MY FINANCIAL STATUS AND WAS CONFIRMED AND NOTORIZED BY

SPECIFIC JAIL STAFF. MY LAWSUIT IS EXPLICITLY DESCRIBED IN

30.1 ASSIGMNENT OF CRIMINAL CASES TO MENTAL HEALTH DOCKETS.0200-- "aw- ®..-._

(A) DEFINITIONS

Mental health dockets shall include cases where the defendant has a confirmed seriousmental illness or is developmentally disabled as defined below:

(1) For purposes of this section, a defendant is deemed to have a confirmed serious 1mental illness if within the previous six months prior to arraignment, there is a clinicaldiagnosis of a severe mental illness with a psychotic feature or defendant waspreviously found eligible or was assigned to a MHCD.

(2) For purposes of this section, a defendant is deemed to be developmentally disabledif there is a clinical diagnosis that the defendant meets current DevelopmentallyDisabled Offender eligibility of an IQ of 75 or less and/or an adaptive skills deficit basedon either a diagnostic report or on the defendant previously having been found eligibleor assigned to a MHCD.

(B) APPOINTMENT OF JUDGES TO PRESIDE OVER MENTAL HEALTH DOCKETS

The Administrative Judge will select Common Pleas Court General Division judges forthe mental health dockets. The judges will serve for a period of two years from date ofassignment. Upon approval of the Administrative Judge, the judges may be reappointedto successive terms. Thereafter, any Common Pleas Court General Division Judges whodesire to preside over a mental health docket may submit their names to theAdministrative Judge for consideration.
