    About Closing Yearend in QuickBooks

    I am often asked by customers about closing their books at year end. Many old school and complex accounting programs require you to perform a closing process at the end of a financial year before entering any information for the current year. In fact, at the large corporation I used to work, we had to close the books every month! After the closing process is complete, the information is locked down and there is no changing it. Period. This creates deadlines, bottlenecks, and stress for all of us in accounting trying to get our work done.

    Most small business owners are not native accountants and dont understand the exact reason for the closing procedure, they just know its something that is done, and dont they need to do it? The answer is yes, and no. Large businesses that provide periodic financial statements to shareholders and/or Board Members must ensure that the statements are accurate and will not be changed after presentation. They must close the books in finality atcertain periods in order to present this information as complete. For most small businesses, the cut off is related to filing their tax return. In other words, once you run the Profit and Loss and Balance Sheet and use that information to file your taxes, you do not want to make any further changes to that years data. That makes sense; after all, if you entered some additional Income or Expenses after the year is over, it wouldnt be reported on your tax return ever.

    QuickBooks doesnt have a formal closing process, and this makes some people feel like it must not be a real accounting program. But QuickBooks is designed for Small Business users, and, although it can be dangerous, there are practical reasons why QuickBooks leaves prior year data open for editing. The main reason is that it is just not

    practical to expect every small business to complete all of their yearend work before creating any other transactionsin the New Year. Often there are credit card expenses coming in on statements clear through February. Another reason is that many of us depend on our CPA or tax preparer to provide us with adjustments like depreciation expenses that need to be entered once the tax return is prepared and that could be much later. So, rather than imposing a locked down closing, QuickBooks creates a Journal Entry automatically at the end of the year to transfer the Net Income to Retained Earnings and allows you to set a closing date password. The closing date password feature allows anyone with the password to change prior years data, and helps keep you from accidentally entering anything into the wrong year.

    Once I have completed my year end closing tasks (see the Year End Checklist under QuickBooks Corner at www.nevadacountybiz.com ), I set a closing date password. To access the feature in QuickBooks: From the Edit menu select Preferences on the left of this new window At the top of the Preferences Menu click Accounting and then choose the Company Preferences tab on the Right. At the bottom of the Company Preferences window, you will see the Set Date/Password button under the Closing Date section. When you click this button, another window opens and allows you to select a closing date and enter a password. For the closing date, you should enter the last day of the year, not the first date of the New Year. Keep your password simple and easy to remember, I recommend writing it down. And, of course not forgetting where you wrote it down.

    Rehiring Laid Off Employees

    During tough economic times, companies may need to downsize through layoffs. However, whenbusiness starts to pick up, employers who laid off workers may want to rehire those same employees.While there are few legal pitfalls involved with rehiring employees in the same capacities they heldbefore the layoff, there are potentially thorny issues involved when rehiring a laid off employee in adifferent capacity.

    Employers have no duty to rehire laid off employees, absent a collective bargaining agreement, policy,or other verbal or written agreement (and if you do have such a policy or agreement, follow it).

    However, you should keep in mind pitfalls involved to rehiring.Rehiring a Different Worker to the Position Vacated by a Recently Laid Off EmployeeDon't disguise a termination "for cause" as a layoff. Layoffs are not to be used to get rid of problememployees. Rather, layoffs are used to dismiss employees when a company needs to downsize itsworkforce (i.e., lack of work, lack of funds).

    A critical concern with laying off employees, especially if you are replacing them, is to be sure thereason for layoff is non-discriminatory. If you lay off an employee but keep the position open and hire adifferent person to that position, the laid off employee may sue you for discrimination or retaliation. Anemployee may claim retaliation, for example, if he or she engaged in a protected activity (such as filinga workers' compensation claim, filing a complaint of sexual harassment, or even making a request for anaccommodation) and was subsequently laid off.

    If you rehire another person in that position, the employee can use that rehire as evidence that his orher layoff was a pretext for an unlawful motive. As another example, if you lay off an employee who isover 40 and replace that person with someone younger than 40, you could expose yourself to an agediscrimination claim. California law prohibits considering salary as a determining factor in making adecision to lay off someone.

    Rehiring a Laid Off W orker as an Independent ContractorYou should tread carefully when considering rehiring a laid off employee as an independent contractor.Consult with counsel before taking any action. There are many landmines to be aware of that couldsubject you to significant legal liability. Not only do you risk the employee coming back with one or morelegal claims (including but not limited to discrimination and/or failure to pay overtime, wages, and otherbenefits), but you might also be liable to the government.

    Motivated by the harsh economic realities brought forth by the recession, the IRS and state taxationagencies plan to step up their efforts to uncover business that are improperly classifying employees asindependent contractors. You can end up paying significantly for a misclassification, including back taxesand penalties.

    Rehiring a Laid Off Worker W ho Work ed Full-Time to a Part-Time PositionYou're free to recall a once-full time employee into a part-time position if you have a legitimate businessneed to do so, but you should proceed carefully. An employee you laid off from a full-time position andthen re-hire to a part-time position might claim that such an action evidences discrimination orretaliation for a protected activity. The following factors are just some things a court might consider insuch a scenario and do not represent a comprehensive list:

    The length of time between layoff and recall Your company's relevant policies, procedures, and past practices Whether you can demonstrate a genuine business need to re-hire part-time Whether the employee has made a protected complaint (sexual harassment, workers'

    compensation, etc.) or taken a protected leave (FMLA, CFRA) shortly prior to the layoff

    It's important when recalling laid off workers to less favorable positions that you follow your company'spolicies and treat the recalled employee the same as other employees in his or her situation. Follow yourcompany's past practices related to layoffs and rehires.

    Diesel ExhaustWhat is Diesel Exhaust? The diesel engines in automobiles, buses, and trucks produce exhaustfrom the combustion of diesel fuel. Diesel exhaust is made up ofharmful chemicals including very small toxic particles and hazardousgases. Some of the hazardous gases in diesel exhaust (e.g. nitrogenoxides, benzene, sulfur dioxide and formaldehyde) have been found topossibly cause cancer.

    Health Hazards of Diesel Exhaust Breathing diesel exhaust is the most common method of exposure. Aswe breathe, the fine particles and toxic gases in diesel exhaust canenter into the lungs. Being exposed to diesel exhaust for short periodsof time may cause headaches, nausea, chest tightness, wheezing,cough and irritation of the eyes, nose, and throat.

    Exposure to diesel exhaust over long periods of time (usually years)may increase the chances of getting cancer. Those workers who

    already have respiratory illnesses, such as bronchitis, emphysemaand/or asthma, may be adversely affected if they are exposed to long-term, or chronic exposure to diesel exhaust.

    Who is at Risk? Workers most likely to be exposed to diesel exhaust include bridge,tunnel, and loading dock workers, truck and bus maintenance garageworkers, miners, toll booth collectors, truck and forklift drivers, andmaterial handling machine operators.

    Methods of Control of Diesel Exhaust Substitution Where possible, replace diesel engines with propane engines.Propane burns more completely with fewer emissions than diesel fuel.However, it is important to ensure there is adequate ventilation whenusing any combustion engine (diesel or propane) indoors, such as in

    warehouses or garages. Breathing harmful levels of combustion gases,such as carbon monoxide, carbon dioxide, and nitrogen oxides can beharmful to your health.

    Ventilation If you cannot replace your diesel engine, diesel exhaust can be

    removed by using local exhaust ventilation. Local exhaust ventilationshould include both intake and exhaust fans that remove dieselexhaust at its source. General ventilation air movement by openingdoors, windows, roof vents, roof fans and floor fans is helpful, but notas effective as local exhaust ventilation.

    Safe Work Practices Some possible methods to reduce and/or minimize diesel exhaustemissions are:

    When diesel equipment is not in use, the engine should notbe allowed to idle.

    Diesel equipment should be turned off and restarted asneeded.

    Enforce diesel equipment (bus, truck, etc) idlingrestrictions.

    Check all ventilation systems to ensure proper functioning.

    Conduct routine maintenance of engines to minimizeemissions.

    Diesel equipment that is producing visible, smoky exhaustshould be removed from service until the condition hasbeen corrected. Vehicles should be fitted with emissioncontrols (e.g. collectors, air cleaners, ceramic particle traps,etc.).

    Emissions controls should be checked regularly andreplaced when necessary.

    Preventing Strains & Sprains

    Lifting, pushing, and overreaching are common causesof strains and sprains. Any job that requires you to sit orstand bent in an awkward position for long periods oftime can cause excess stress and strain on muscles.Most strains and sprains affect the back, arms, andshoulders. However, there are some very simple thingsyou can do to prevent or minimize body strains andsprains.

    Many strains and sprains occur because of poor materialhandling. Workers lift things that weigh too much or theylift incorrectly. Lift correctly by bending your knees, notyour back. Carry loads close to your body. Injuries canoccur when workers try to pull or lift a heavy or awkwardobject without help or lift an object while twisting from thewaist. When carrying a load, avoid bending or liftingupward unnecessarily. Keep as much of the load as youcan at waist level.

    Get help with heavy loads. Don't try to move or lift anobject you can't handle. Instead of lifting a 75-poundload, break it down into smaller parts. If you can't breakit down, get help from a mechanical device or lift it withanother worker. Make sure moving equipment worksproperly or it will cause you to strain unnecessarily justtrying to get it to work. If the wheels on a cart are not

    aligned, you could strain your arms, shoulders, and backtrying to move it.

    Change your working positions frequently. Chronic straindue to an unchanging work position can weaken yourback, arms, and shoulders. Adjust working heights toprevent slumping or excessive reaching. A vicious cycle

    develops when chronic strain continues; musclesbecome less able to withstand strenuous activity andgrow more prone to injury of all kinds. Stretch duringthe day to increase your flexibility. Take body relaxationbreaks by letting your shoulders and neck muscles golimp; swivel your head or arms or flex your hands andfingers.

    Take care of your whole body with exercise, properposture, a sensible diet and adequate rest. If yourmuscles or ligaments have weakened over time fromlack of exercise or age, you are more apt to get a strainor sprain than if your are physically fit.
