What do you like most about it?We have young children so the schools

and abundance of activities were a major at-traction. I also think the sense of community is unmatched. My in-laws recently moved here from Wisconsin and they made friends instant-ly…it’s absolutely beautiful and the people are awe-some!

What is your specialty and what does that mean for the people you work with?

I lived in the Denver area before moving to Castle Pines so I can provide expertise to anyone moving from Denver to the suburbs or vice-versa. I am also prior Air Force and can relate to the challenges military families may face throughout the process.

What is the most challenging part of what you do?I want every client to remember me for my quality of

service and the value I bring. I am quite a perfectionist so achieving this level of excellence for every customer requires an extraordinary amount of organizational skills and cus-tomer service. Ultimately, the reward comes from seeing the

joy on peoples’ faces at the closing table!

What do you most enjoy doing when you’re not working?I played soccer at the AF Academy and loved mountain

bike racing and anything outdoors. At this stage of my life, I absolutely love watching my kiddos excel in these areas. We are pretty devoted to soccer, ski school, and biking/walking our two crazy dogs whenever we can.

What is one tip you have for someone looking to sell a house?

Start the planning process with your agent in advance to ensure your home shines. You only have one opportunity to make a � rst impression.

What is one tip you have for someone looking to buy a house?

� e process is not a sprint; treat it more like a marathon.

What is the most unusual thing you’ve encountered while working in Real Estate?

We had a showing for one of my listings but the home-owner could not make it home from work to get the dog. I volunteered to walk the dog during the showing and he de-cided he needed to “take care of business” ON the neighbors’

lawn…he was also a competing Real Estate agent. I did clean up a� er him although there is an extra fee for that!

If you either are or have been a landlord or tenant, you un-doubtedly have heard of Colo-

rado’s treble damage statute per-taining to security deposits.

Knowing that the statute exists is not enough. It is important to understand how it really works.

� e purpose of a security de-posit is to provide the landlord with a � nancial resource in the event of a default by the tenant or for damages done by the tenant to the property. However, the money, although held by the landlord, still belongs to the tenant.

Colorado law requires that at the end of one month a� er the termination of a lease or surren-der of the premises, whichever occurs last, the landlord must ei-

ther return the full amount of the security deposit to the tenant or provide the tenant with a written accounting of the damages in-curred and how that portion of the security deposit is to be withheld and applied by the landlord to re-pair damages. � is is true, whether there is a written lease or not. � e landlord may, in a written lease, extend the one month time period to no more than sixty days from the lease termination or surrender of the premises.

If the landlord fails to either re-turn the full amount of the securi-ty deposit or does not provide the written accounting required by the statute, together with the check for the remainder of the security de-posit, the landlord forfeits all of his rights to recover any part of the se-curity deposit. � e landlord then also becomes potentially liable for treble the amount of the secu-rity deposit, plus attorney fees and court costs, in the event that suit is brought against him. However, in order for the tenant to recover treble damages, attorney fees and court costs, he must send a writ-ten notice to the landlord provid-ing him with a seven day notice that a suit will be brought in the event that the full amount of the security deposit is not returned.

It is then too late for the landlord to get a second bite of the apple and refund only that portion of the security deposit a� er damages are deducted. � e landlord must return the full amount of the secu-rity deposit since he has forfeited all of it in failing to comply with the original one month or 60 day deadline called for by the statute, under C.R.S. 38-12-103. T o o o� en landlords think that they can provide a list of damages within the seven day notice period and return only that portion of the security deposit that they feel the tenant is entitled to because of the damages incurred. However, the landlord has missed the boat

and is now responsible for the full amount of the deposit despite any damages that may have been done to the premises.

If the case is brought to court, the landlord will be stuck with treble damages, attorney fees and court costs, but may be allowed an o� set for the damages incurred. If he fails to request that o� set, he might have to bring a separate court action only on damages in-curred to the premises, but in both cases, he will still be stuck with treble damages, attorney fees and court costs, all of which will make his oversight, even if an o� set is al-lowed, a losing proposition.

It is probably a good idea for a

landlord to include in his lease a 60 day time period within which to return the security deposit in order to give him su� cient time to assess the amount of dam-ages, if any, that were incurred. It is also important to note that the landlord may retain the security deposit in full for non-payment of rent, abandonment of the premis-es, non-payment of utility charges, repair work or cleaning contracted for by the tenant. He may not re-tain any portion of the security deposit for normal wear and tear.

Knowing how the statute works is essential to understanding your rights, whether you are a landlord or tenant.
