La Republica de Bolivia y los EstadosUnidos de America ("las Partes"), medianteIa Agencia de los Estados Unidos para elDesarrollo Internacional ("USAID"),suscnbieron el Convenio de Donacion("Convenio") en fecha 3 de Kunio de 2005, yposteriores enmiendas de fechas 2 deagosto de 2006 y 17 de Julio de 2007, enapoyo al Objetivo Estrategico de USAID"La Economia Licita en Zonas de Cultivo deCoca y Areas Asociadas CrecientementeMas Sostenibles"

POR CUANTO las Partes desean modificarel Convenio para 1) describir el nuevomarco programatico a nivel mundial deUSAID, 2) comprometer fondos adicionales,3) describir los requenmientos relacionadosal reconocimiento de USAID y de sulogotipo, 4) aclarar la facultad de USAIDpara realizar ajustes presupuestarios, y 5)actualizar seleccionadas clausulas de lasEstipulaciones Generales

Las Partes acuerdan por Ia presenteenmendar el Convenio como segue

1) Nuevo Marco Programatico a NivelMundial de USAID

a En el alio 2007, el Gobierno de losEstados Unidos adoptO un nuevo marcoglobal a nivel mundial para planificar,monrtorear e informar sobre su ayudaexterna para el desarrollo Estas reformasmundiales incorporan cambios en lossistemas de administracion y contabilidadafectando la categorizacion de resultados yactividades En el nuevo marco, el termino"Elementos Programaticos" sustituye a

The Republic of Bolivia ("the Grantee" or"the GOB") and the United States ofAmerica, acting through the United StatesAgency for International Development("USAID") (together "the Parties"), enteredinto a Grant Agreement ("the Agreement")on June 3, 2005, and subsequentamendments dated August 2, 2006, andJuly 17, 2007, in support of the USAIDStrategic Objective, "Licit Economy inCoca-Growing and Associated AreasIncreasingly Sustainable "

WHEREAS the Parties desire to modify theAgreement to 1) describe USAID's newworldwide programming framework, 2)obligate additional funds, 3) describeUSAID branding and marking requirements,4) clarify the role of USAID in makingbudget adjustments, and 5) updateselected clauses of the StandardProvisions

The Parties hereby agree to amend theAgreement as follows

1) USAID's New Worldwide ProgrammingF ramework

a In 2007, the United States Governmentadopted a new global framework forplanning, monitoring and reporting on itsdevelopment assistance These globalreforms change USAID's financialmanagement and accounting systems, andaffect how results and activities arecategorized The new framework changesbudget "Programmatic Areas" to "ProgramElements "

b SegOn el nuevo marco, el actual ObjetivoEstrategico "La Economia Licita en Zonasde Cultivo de Coca y Areas AsociadasCrecientemente Mas Sostenibles" apoya elapoya el Area Programatico Global"Antinarcoticos" Las antenores areasprogramaticas 1 "Competitividad Rural", 2"Desarrollo Democratico" y 3 "DesarrolloSocial", se identificarà en lo sucesivo comoElemento Programatico, "AntinarcoticosDesarrollo Alternativo y AlternativasEconOmicas" USAID continuaraproveyendo informacion presupuestariabajo las tres areas programaticas Lasactividades administradas por USAID,"Apoyo administrativo de USAID", seidentificaran en lo sucesivo como"AdministraciOn del Programa"

c Los nuevos formatos de presupuestos ycontabilidad estan reflejados en el cuadropresupuestario del Adjunto 1 Todas lasubsiguientes Enmiendas, Cartas deImplementaciOn y otros documentosutilizaran este nuevo sistema deinformacion

2) Incremento del Financiamiento

a Mediante Ia presente Enmienda, USAIDcompromete fondos adicionales por elmonto de Veintiseis Millones NovecientosSesenta y Siete Mil Quinientos DOlaresAmericanos (US$26 967 500)

b En Ia Sem& 3 1 (b) "La Donacion", Iafrase "Sesenta y Seis Millones Cuarenta ySiete Mil Cuatrocientos Sesenta y DosDólares Americanos (US$66 047 462)" seelimina en su integridad y se sustituye conla frase "Noventa y Tres Millones Catorce

b Under the new framework, the presentStrategic Objective, "Licit Economy inCoca-Growing and Associated AreasIncreasingly Sustainable" supports theglobal Program Area, "Counternarcotics "Former Programmatic Areas 1 "RuralCompetitiveness," 2 "DemocraticDevelopment" and 3 "Social Development"will henceforth be identified under ProgramElement "Counternarcotics AlternativeDevelopment and Alternative Livelihoods "USAID will continue to provide budgetinformation for the three programmaticareas USAID-managed budgetProgrammatic Area, "USAID ManagementSupport" will henceforth be identified byProgram Element, "Program Support "

c The new budgeting and accountingformats are reflected in the budget table ofAttachment 1 All subsequentAmendments, Implementation Letters andother documentation will use this newreporting system

2) Incremental Funding

a Through this Amendment, USAIDobligates additional funds in the amount ofTwenty-Six Million Nine Hundred Sixty-Seven Thousand Five Hundred UnitedStates Dollars (US$26,967,500)

a USAID y el Gobierno de Bolivia (GOB)daran Ia publicidad debida al Conveniocomo un programa al cual los EstadosUnidos ha contnbuido, identificaran loslugares donde se Ilevan a cabo lasactividades del Convenio y marcarân losproyectos, actividades, comunicacionespUblicas y articulos financiados en sutotalidad o en parte por USAID con IaIdentidad Grafica de USAID Tal publicidadincluye presentar el programa como unaalianza entre el GOB y el Gobierno de losEstados Unidos, utilizando tanto IaIdentidad Grafica de USAID como Iaidentidad pertinente o logotipo delDonatario, ambas de igual tamano ynotonedad La "Identidad Grafica deUSAID" es el logotipo, la marca y el lema deUSAID Los detalles y excepcionesaprobados por USAID seran descritos enCartas de Implementacion

4) Aclarar la Facultad de USAID paraRealizar Alustes Presupuestarios

a USAID and the GOB will give appropriatepublicity to the Agreement as a program towhich the United States has contributed,identify Agreement activity sites, and markprojects, activities, public communications,and commodities financed in whole or inpart by USAID with the USAID IdentitySuch publicity includes showcasing theprogram as a partnership between theGOB and the Government of the UnitedStates, with both the USAID Identity andthe Grantee's relevant identity or logo ofequal size and prominence The "USAIDIdentity" is the USAID logo, brand mark andtagline Details and exceptions approvedby USAID may be described inImplementation Letters

4) Clarify the Role of USAID in MakingBudget Adjustments

a USAID and the GOB mutually agree thatin a fiscal year USAID can realign up tofifteen per cent (15%) of the TotalObligations to Date among the budget lineitems, as part of its management oversight

5) Plan Nacional de Desarrollo del Gobiernode Bolivia

El GOB, a traves de las contrapartes, yUSAID, con el espiritu continuo ycompartido de promover la eficiencia,transparencia, y resultados significativospara el desarrollo de Bolivia, acuerdancontinuar evaluando de manera conjunta lacompatibilidad entre las actividadesfinanciadas a traves de este Convenio y elPlan Nacional de Desarrollo (PND) del GobComo resultado de esta evaluacion, laPartes acuerdan adernâs realizar en unplazo razonable los ajustes necesanos alConvenio para asegurar que este conveniose mantenga compatible y alineado con lasprioridades del PND del GOB, a traves deenmiendas y/o cartas de implementacionsegOn corresponda

El GOB, a traves de las contrapartes, yUSAID conjuntamente con susorganizaciones ejecutoras, realizaran demanera conjunta la elaboraciOn y

5) The Bolivian Government's NationalDevelopment Plan

The GOB, through the counterparts, andUSAID, in an ongoing and shared spirit ofpromoting efficiency, transparency andsignificant results for Bolivia's development,agree to continue evaluating together thecompatibility between the activitiesfinanced under this Agreement and theGOB's National Development Plan (NDP)As a result of this evaluation, the Partiesalso agree to undertake in a reasonabletime frame the necessary adjustments tothe Agreement to ensure that thisAgreement continues to be compatible andaligned with the priorities of the GOB'sNDP, through Amendments and/orImplementation Letters as appropriate

The GOB, through the counterparts, andUSAID, together with its implementingpartners, will jointly undertake thepreparation and monitoring of theimplementation of the 2008 annual work

Section B 4 Taxation

(a) General Exemption The Agreementand the assistance thereunder are free fromany taxes imposed under laws in effect in theterritory of the Grantee

(b) Except as provided otherwise in thisprovision, the General Exemption insubsection (a) applies to, but is not limited to(1) any activity, contract, grant or otherimplementing agreement financed by USAIDunder this Agreement, (2) any transaction orsupplies, equipment, materials, property orother goods (hereinafter collectively named"goods") under (1) above, (3) any contractor,grantee, or other organization carrying outactivities financed by USAID under thisAgreement, (4) any employee of suchorganizations, and (5) any individualcontractor or grantee carrying out activitiesfinanced by USAID under this Agreement

(c) Except as provided otherwise in thisprovision, the General Exemption insubsection (a) applies to, but is not limited to,the following taxes

(1) Exemption 1 Customs duties, tariffs,import taxes, or other levies on theimportation, use and re-exportation ofgoods or the personal belongings andeffects (including personally-ownedautomobiles) for the personal use of non-national individuals or their familymembers Exemption 1 includes, but isnot limited to, all charges based on thevalue of such imported goods, but doesnot include service charges directlyrelated to services performed to transfer

(3) Exemption 3 Taxes levied on the lasttransaction for the purchase of goods orservices financed by USAID under thisAgreement, including sales taxes, value-added taxes (VAT), or taxes onpurchases or rentals of real or personalproperty The term "last transaction"refers to the last transaction by which thegoods or services were purchased for usein the activities financed by USAID underthis Agreement

(d) If a tax has been levied and paidcontrary to the provisions of an exemption,USAID may, in its discretion, (1) require theGrantee to refund to USAID or to others asUSAID may direct the amount of such taxwith funds other than those provided underthe Agreement, or (2) offset the amount ofsuch tax from amounts to be disbursed under

Articulo C

(a) A excepciOn de lo indicado aqui, oen un sub-convenio emitido por USAID, losfondos de la Donation serer' utilizados parafinancier el costo de los bienes y serviciosque tienen su fuente y origen y en relacion alos proveedores de bienes y servicios, sunacionalidad, en los Estados Unidos Lasexcepciones a este requisito incluyentransacciones locales de adquisiciones deacuerdo con las politicas de USAID oadquisiciones realizadas despues de obtenerpor escrito de USAID la fuente, origen yautonzaciones para nacionalidad

(e) In the event of a disagreement aboutthe application of an exemption, the Partiesagree to promptly meet and resolve suchmatters, guided by the principle that theassistance furnished by USAID is free fromdirect taxation, so that all of the assistancefurnished by USAID will contribute directly tothe economic development of the country ofthe Grantee

Article C

Section C.1 Source and Origin

(a) Except as noted herein, or in a sub-agreement issued by USAID, Grant funds willbe used to finance the cost of goods andservices having their source and origin, andwith respect to suppliers of goods andservices, their nationality, in the UnitedStates Exceptions to this requirementinclude local procurement transactions inaccordance with USAID policy orprocurements made after obtaining source,origin, and nationality waivers from USAID inwriting

(1) Ocean transportation costs shall befinanced under the Agreement only onvessels under flag registry of countriesincluded in Code 935 Also see SectionC 6 on use of U S flag vessels

Disbursements

Section D 1 Disbursement for ForeignExchange Costs

(b) Banking charges incurred by theGrantee in connection with letters ofcommitment will be financed under theAgreement unless the Grantee instructsUSAID to the contrary Such other chargesas the Parties may agree to may also befinanced under the Agreement

Article F

Miscellaneous

Section F 1 Investment Promotion

(a) Except as specifically set forth in theAgreement or otherwise authorized byUSAID in writing, no funds or other supportprovided hereunder may be used for anyactivity that involves investment promotion ina foreign country

(b) In the event the Grantee is requested orwishes to provide assistance in the above

Section F 2 Voluntary Family Planning

The Parties agree that all USAID fundsprovided under this Agreement shall be usedin accordance with applicable United Statespolicy and statutory requirements relating tovoluntary family planning projects, and thatnone of the USAID funds provided under thisAgreement, or goods or services financed bysuch funds, may be used for

(a) the performance of abortion as amethod of family planning or to motivate orcoerce any person to practice abortions,

(b) the performance of involuntarystenlizations as a method of family planningor to coerce or provide any financial incentiveto any person to undergo sterilizations, or

(c) any biomedical research whichrelates, in whole or in part, to methods of, or

(A) The Grantee shall take any stepsnecessary to ensure that USAID funds madeavailable under this Agreement will not beused to coerce any individual to practicemethods of family planning inconsistent withsuch individual's moral, philosophical, orreligious beliefs Further, the Grantee shallconduct its activities in a manner whichsafeguards the rights, health and welfare ofall individuals who take part in the program

(B) Activities which provide familyplanning services or information toindividuals, financed in whole or in part underthis Agreement, shall provide a broad rangeof family planning methods and servicesavailable in the country in which the activityis conducted or shall provide information tosuch individuals regarding where suchmethods and services may be obtained

(2) Requirements for Voluntary FamilyPlanning Projects

(A) A family planning "project" mustcomply with the requirements of thisparagraph

(B) A "project" is a discrete activitythrough which a governmental ornongovernmental organization or publicinternational organization provides familyplanning services to people and for which

(D) The project shall not include thepayment of incentives, bribes, gratuities orfinancial rewards to (i) any individual inexchange for becoming a family planningacceptor or (ii) any personnel performingfunctions under the project for achieving anumerical quota or target of total number ofbirths, number of family planning acceptors,or acceptors of a particular method ofcontraception This restriction applies tosalaries or payments paid or made topersonnel performing functions under theproject if the amount of the salary or paymentincreases or decreases based on apredetermined number of births, number offamily planning acceptors, or number ofacceptors of a particular method ofcontraception that the personnel affect orachieve

(F) The project shall provide familyplanning acceptors comprehensibleinformation about the health benefits andrisks of the method chosen, including thoseconditions that might render the use of themethod inadvisable and those adverse sideeffects known to be consequent to the use ofthe method This requirement may besatisfied by providing information inaccordance with the medical practices andstandards and health conditions in thecountry where the project is conductedthrough counseling, brochures, posters, orpackage inserts

(G) The project shall ensure thatexperimental contraceptive drugs anddevices and medical procedures areprovided only in the context of a scientificstudy in which participants are advised ofpotential risks and benefits

(H) With respect to projects for whichUSAID provides, or finances the contributionof, contraceptive commodities or technicalservices and for which there is no sub-agreement under paragraph (5), theorganization implementing a project for whichsuch assistance is provided shall agree thatthe project will comply with the requirementsof this paragraph while using suchcommodities or receiving such services

(3) Additional Requirements for VoluntarySterilization Programs

(A) None of the funds providedunder this Agreement shall be used to payfor the performance of involuntarysterilization as a method of family planning orto coerce or provide any financial incentive toany individual to practice sterilization

(B) The Grantee shall ensure that anysurgical sterilization procedures supported inwhole or in part by this Agreement areperformed only after the individual hasvoluntarily appeared at the treatment facilityand has given informed consent to thesterilization procedure Informed consentmeans the voluntary, knowing assent fromthe individual after being advised of thesurgical procedures to be followed, theattendant discomforts and risks, the benefitsto be expected, the availability of alternativemethods of family planning, the purpose ofthe operation and its irreversibility, and theoption to withdraw consent anytime prior tothe operation An individual's consent isconsidered voluntary if it is based upon theexercise of free choice and is not obtained by

(C) Further, the Grantee shalldocument the patient's informed consent by(i) a written consent document in a languagethe patient understands and speaks, whichexplains the basic elements of informedconsent, as set out above, and which issigned by the individual and by the attendingphysician or by the authorized assistant ofthe attending physician, or (ii) when a patientis unable to read adequately, a writtencertification by the attending physician or bythe authorized assistant of the attendingphysician that the basic elements of informedconsent above were orally presented to thepatient and that the patient thereafterconsented to the performance of theoperation The receipt of this oral explanationshall be acknowledged by the patient's markon the certification and by the signature ormark of a witness who shall speak the samelanguage as the patient

(D) The Grantee must retain copies ofinformed consent forms and certificationdocuments for each voluntary sterilizationprocedure for a period of three years afterperformance of the sterilization procedure

(4) Abortion restrictions

(A) None of the USAID funds providedunder this Agreement shall be used tofinance, support, or be attributed to thefollowing activities (i) procurement ordistribution of equipment intended to be used

(B) None of the USAID funds providedunder this Agreement shall be used to payfor any biomedical research, which relates, inwhole or in part, to methods of, or theperformance of, abortions or involuntarysterilizations as a means of family planningEpidemiologic or descriptive research toassess the incidence, extent orconsequences of abortions is not precluded

(5) Requirement for Sub-agreements

The Grantee shall insert theserequirements in all sub-agreements involvingfamily planning or population activities whichwill be supported in whole or in part withUSAID funds under the Agreement

Section F 3 Prohibition on Assistance toDrug Traffickers

(a) USAID reserves the right to terminate thisAgreement or take other appropriatemeasures if the Grantee or a key individualof the Grantee is found to have beenconvicted of a narcotics offense or to havebeen engaged in drug trafficking as defined

Section F 4 Workers' Rights

(a) Except as specifically set forth in theAgreement or otherwise authorized byUSAID in writing, no funds or other support
