The Sta:tes. partie. to the prosant Convention hereby
establish the -Intergovernmental Maritime Consultative Organi
zation (hereinafter referred to as lithe Organization").
PART I
Purposes of the Organization'

The purposes of the Organization are:
(a) to provide machinery for co-operntion among , Governments 1n the field of governmental regulation
and practices relating to technical matters of all
kinds affect1ng shipping engaged in international trade.
and to encourage the general adoption of the highest
practicable standards in matters concerning maritime
safety and efficiency of navigation;
(b) to Slncourage the removal of discrim1natory action ,and
unnecessarY restrictions by Governments affecting
shipping engaged in international trade so as to
promote the availability ot shipping services to th6
eommerce of the world without discrimination;
assistance and encouragement given by a Government tor
the development of Its national shipplng and tor
purposes of secur1ty does not in itself constitute
discrimination, provided that such assistance and
encouragement i~ not based on measures designed to

restrlpt the freedom of shipping of all flags to take
part in Internatfonal trade;
(0) to ,provide for the consideration by the Organization of
matters concerning. unfair restrictive practices by
shipping conc~rns in accordance with Part II;
(d) to provide for the consideration by the Organization of
any matters con?ernlng shipping that may be referred to
it by any organ or Specialized Agency of the United ,
Nations;
(e) to provide for the exchange of information among
Governments on matters under consideration by the
Organization.
PART II
Functions
Article 2
The functions of the Organization shall be consultative and
advisory.
Article 3
In order to achieve the purposes set out in P~rt It the
functions of the Organization shall bel-

subject to the provisions of Article 4, to ponsider and make recommendations upon matters arising under Article 1 (a), (b) and (c) that may be remitted -to it by Members by any organ or Specialized Agency of the United Nations or by any other intergovernmental organization or upon matters referred to it under Article l(d);
to provide for the drafting of conventions, agreements, or other sUitable Instrwnents, and to recommend these to GoverrJDents and to intergovernmental organizations, and- to convene such conferences as may be necessary;
to/provide machinery for consultation among Members and the exchange of inforDW.tion amon!!, r.overnments.

In those matters which appear to the Organization capable
ot settlement through the normal processes at international
sh1pping business the organization shall 80 r.ecollllllend. When,
in the opinion of the Organization, any matter concerning unfair
restrictive practices by shipping concerns 1s incapable of
settlement through the normal processes of international shipping
business, or has 1n fact so pro~ed,-and provided it shall first
have b'een the subject of direct ne'gotiations between the Members
concerned, the Organization shall, at the request ot one of those
Members, consider the matter.
PART III
Membership
Article 5' ~embershlp in the Organization shall be open to all States,
subject to the provisions of Part III.
Article 6'
Members of the United Nations may become Members of the
Organization by becoming parties to the Convention in accordance (
with the provisions of Article ;7. Article 7
States not Members of the United Nations which have b~en
invited to send representa~ives to the United Nations Maritime
Conference convened in Gen(!v;). (,..1 the 19th February t94B, may
become Members- by becoming parties t'o the Convention in accordanoe
with the provisions of Article ;7.
Article B
Any State not entitled.-.to become a Member under Article
6 or 7 may apply through the Secretary-General ot the

-Organization to becume, a Member and shall be admitted. as
a Member upon .its ~com1ng a party to the Convention tn·
accordance with the provisions ot Article 'j7 provided that,
upon the recommendation ot the Coun~11, its application has
been approved by two-thirds of the Members other than Associate
Members.
Article 9
Any territory or grouP ot territories to which the
Convention has been made applicable und,er Article 58, by the
Hember having responsibility tor its international relAtions
or by the United Nations, may become an Associate Member of the
Organization by notification in writing given by-such Member
or by the United Nations, as the case may be, to the Secret4ry
General of the United Nations.
Article 10
An Associate Member shall have the rights and obl1gat1o:ns
of a Member under the Convention except that it shall 'not have
the right to vote in the Assembly or be ~UgiblE! tor .membership
on the Councilor on the Maritime Safety Committee and subje~t
to this the word "Member" in the Convention shall be deemed to
1nclud~ Associate Member unless the context otherwise requires.
Article 11
No State or' territory may become or, remain a Membe~ ot
-the Organization contrary to -a resolution ot the General
Assembly ot the United Nations.

The Assembly
Article 13
The Assembly shall consist ot all the Mambers.
Article lifo
Regu!3l' sossions of the Assembly shall take place

be convened att~r a notice of Sixty days whenever one~
third ot the Members give notice to the Secratary~Goneral
that they desire a Session to be arrangod, or at any time

Article, 15
A majority of the Members othor than Associato Members
shall constitute a quorum r~r tho_meetings ot the Assembly.
Article. 16 The tunc~lons of the Assembly shall be:
(a) to elect at each regular seSSion from among its Members, other than Associate Members, its President and two Vice Presidents who shall hold otfico until the next regular s~sslon;

(b) to detQrmln~ its own rules of procedure except as otherwise provided in the Convention;
(c) to establish any temporary or, upon recommendation of tho Council, pcrmnnont subs!d14ry. bodies it may consider to be necessary,
(d) to eloct the Mambers to be represented on the Council, as provided in Article 17, ond on the Maritime Safoty Committee as provided in Article 28;
(0) to receive and consld~r the reports of tho CounCil, and to decido upon any' question referred to it by the Council;
(r) to vote the budget and dete'rmno the financial arrangem~nts of the Organizat1on, in accordance with Part IX;

ARTICLE 18
Ezcept a. provided 1n APPQndlx I to the present Convention,
the Councll sball determine tor the purpose ot Article 17 (a),
the Members, govemaents ot nations v1tb the largest interest
,1n proViding international sh1pptnc services, an4 shall also
determine, tor the purpose ot Article 11 (0), the Members,
governments ot nationa havilll a substantial interest in
providing such services. Suoh detena1natlo". shaU be made by
a maj 01'1 ty vote ot the Councll lncluding the concurrlnc votes
ot a majority ot the Members represented on the Councll under
ArUcle 17 (a) and (c). The Councll sbaU f'Urther determintll tor
the purpose ot 4rtlcle 17 (b), the Members, Governments ot nations
vith the largest interest in internat10nal seaborne trade.
Each Council-sholl make these determinations at a reasonable
ttme before each regular seaaion ot the Assembly.

\ The Council shall make a report to the Assembly at each
regular session on the work of the Organization since the
previous regular session of the Assembly_

The Council shall submit to the Assembly the budget
estimates and the financial statements of the Organization,
together with its comments and recommendations.
T:-,e Council-may enter into agreements or arrangements
covering the relationship of the Organization with other
organizations, as provided for in Part XII. Suoh agreements
or arrangem~nt8 shall be subject to approval by the Assembly.
ARTICLE 27

function of making recommendations under Article l6(i).
PART VII
Maritime Safety Committee
ARTICLE 28
(a) The Maritime Safety Committee shall consist of
fourteen Members elected by the Assembly from, the Members,
governments of those nations having an important interest in
_maritime safety, ,of which not, less~than_ eight shall be the
largest ship-owning nations, and the remainder shall be elected
so as to ensure adequate representation of Members,' governments
of other nations vitn an important interest in maritime safety,
such as nations interested in the supply of large numbers of
crevs or in the carriage of large numbers of berthed and unbertned
passengers, and of major geographieal areas.
(b) Members shall be elected for a term of four years
and shall be eligible for're-eleet1on.

ARTICLE 29
(8) The Maritime Safety'Committee shall have the duty ot
conSiderlng any matter within the scope _ot the Organization and . . concerned with alds to navigation, construction and equipment ot
vessels, manning trom a safety stand'point, rules tor the
prevention ot collisions, handling ot dangerous cargoes, maritime
safety procedures and requirements, h1drographlc informat1on,
log-bookS and navigational records, marine casualty investigatiOD,
salvage and rescue, and any other matters directly affecting
marltim'e aatet)"_
(b) The Marit1me Safety Committee shall provide machinery tor
performing any duties assigned -to it by the Convention, or by
the Assembly, or any duty 'Within the scope ot th~.8 Article which
may be assigned to it by any other' 1ntergovernmental instrument.
(0) Having regard to the provisl~ns or Part XII, the Harit~
Safet~ Committee shall have the duty of maintaining such close
relationship with other intergovernmental bodies concerned with
transport and communications as may further the object of the
Organization in promoting maritime safety, and facilitate the
co-ordination or activities in the fields of shipping·, aviation,
telecommunications and meteorology with respect to safety and • rescue.
ARTICLE 30
The Maritime Bafety Committee, through the Counci1., shall:
(a) submit to the' Assembly at its regular 8es.Sions proposals made by Members for safety regulations or for amendments 'to existing safety regulatiOns, together with its cODUDents or recOIIIDendations thereon;
(b) report to the AssemblY on the work of the Maritime Satety Co.llIIIl1ttee since the previous regular session of the Assembly'.

The Maritime Satety Committee shall meet once a year and c ,
at other time. UpOD request ot any tlve of 1ta member.. It
shall elect 1t8 officers once a 79ar &ad shall adopt 1ta

constitute a quorum.
ARTICLE 32
The Mar1time Safety Ca.mlttGe shall invite a~ Mem~ to
parUo!pate, without vote, in 1ts del1berations on aD7 matter
ot particular concern- to that Member.
PARr VIII

ARTICLE 33
The Secretariat shall comprise the Secretary .. General,
• Secretary of thG Marlt~e Safety Committee and auch statt·
as the Orgam.zation Dl8)' require. The Seoreta17 .. General
shall be the obief administrative officer of the Orcantzatlon,
aDd shall, subject to tbe provisions ot Articlo 23, appoint the
above-mentioned porsonnel.
ARTICLE Vt The Secretariat shall maintain aU such recor4e as may be
necessary tar the efticient discharge of the tunetions ot the
Organization aDd shall prepare, collect and circulato tho
papers, documents, agenda, minutes and intornmUon that may be
required tor the work of the Assemb17, the Council, the Me,rUtme
Sarety Committee, and such subsidiary organs as the Organization
may establish.
ARTICLI 3$

ARtICLE 36
The Secreta17-General. shall keep Members '.1nt0rme4 with
respect to the activ1ties ot the Orlan1sation. 'Each Member
may appoint one or more representatives for the purpose ot
communication with the Secretary-General.

Finances
Article 39

Each Member shall bear the salary, travel and other,expenses
of its own delegation to the Assembly and ot its representatives
on the Council, the Maritime Safety Committee, other eommittees
and subsidiary bodies.
Article 40
The Council shall consider the financial statements and
budget estimates prepared by the Secretary-General and,submlt
tnem to the Assembly with its comments and recommendations.
Article 4-1
(a) Subject to any agreement between the Organization and
the United Nations, the Assembly shall review and approve the
budget estimates.
(b) The Assembly shall apportion the expensas among the
Members in accordance with a scale to be fixed by it after
eonsideration of the proposals of the Council thereon.
Article 42
Any Eember whleh ta.ils to discharge its financial
obligat1on to the Organization within one year from the date on
which it is due, shall have no vote 1n the Assembly, the Council,
or ~he Maritime Safety Comm1ttee unless th~ Assembly, at its
discretion, waives this provision.
Pl~RT X
Voting
Article 43
The following provisions shall apply to voting in the
Assembly, the Council and the Maritime Safety Committee:
(a) Each Member .hall have one vote.
(b) Except a8 otherwise provided in the Convention
or in any international agreement Vhicb conter.
!Unctions on the Assembly, th~ Council, or t~e
Maritime Safety Committee, decisions of these
organs shall be by a majority vote of the Nembers
present and voting and, for decisions where a
two-third. majority vote is required, by a two
thirds majorit,y vote of those present.
(c) For the purpose of the Convention, the phrase
tlMembers present and voting" means "Members
present ~d casting an affirmative or negative
vote" • Members which abstain from voting
shall be considered as not. voting.
PART XI
Headquarters of the Organization
Article 44 "J
(a) The headquarters of the Organization, shall
be established in London._
(b) The Assembly may by a tWQ~thirds majority vote
change the s1 te ot, the headquarters if necessa·ry.
(c) The Assembly may hold sess'ions in any place other
than the headquarters if the ~ouneil deems it
necessary.
PART XII
Relationship with the United Nations and other Organizations
Article If.'j
The Organization shall be brought into relationship
with the United Nations in accordance with Article 57 ot the
Charter of the United Nations as the Specialized AgenCy -in the
field ot shipping. This rela~ionship shall be effected through
an agreement with the United Nations under Article 6) of the

Charter of the United Nations', which agreement shall be eon
cluded as provided in Ar~lele 26.
Article 4~
The Organization shall co-operate with any Specialized
Agency of the United Nations in matters which may be the
common concern ot the Organization and of such Specialized
Agency, and shall consider such matters and act with respect
to them in accord with such Speclallz~d Agency.
Article 'tZ The Organization may, on matter, within its scope, co
operate with other inter-governmental organizations which arc
not Specialized Agencies of the United Nations, but whoso
interests and activities afe related to the purposes of the
Organization.
Article 48
The Organization maYt on matters within its scope, make
suitable arrangements for consultation and co-operation with
non-governmental international organizations.
Article 49
Subjeot to approval by a two-thirds majority vote of the
Assembly, the Organization may take over from any other
international organizations, governmental or non-governmental,
such functions, re,soul'cas and obl1gations within the seope of
the Organization as may be transferred to the Organization by
international agreements or by mutually acceptable ,_arrangements
entered into between competent authorities of the respective
organlzat1on8~ Similarly, the Organization may take over any
administrative functions which are within its scope and which
have been entrusted to a government under the terms of any
international instrument.

PART XIII

The legal capacity. privileges and tmmunlties to be , accorded to, or in connection with, the Organization, shall be
derived trom and governed b¥ the General Convention on the
Privileges and Immunities of the Specialized Agencies approved
b;y the General Assembly or the United Uations on the 21st
November, 1~7, subject to.sueh mod1tlcatlons as may be set
forth 1n the final (or revised) text ot the Annex approved bf
the Organization in accordance with Sections 36 and 38 of the
said General Convention.
Article n Pending It. aQCBa.lon to the said General Convention in
respect ot the Organization, each Member undertakes to apply
the provisions ot Appendix II to the present Convention.
PARt XIV
Amendment. Article 52
Texts of propo.ed amendments to the Convention shall be
c~1c&ted bf the Secretary-General to Members at least six
months in advanoe ot their consideration by the Assembly.
Amen4ments shall be adopted by a two-thirds majority vote of
the Assembly, Including the concurring votes or a majority ot
the Members represented on the Council. Twelve months atter

Article 53
Any ame~ent adopted under Article 52 shall be
deposited with the Secretary-Goneral of the United Nat1ons,
who will immediatoly forward a copy. ot the amendment to all
'Members.

Article 5'9
!'f1thdrawal
(a) AnY Member may withdraw trom the Organization by written
not1tication' given to the Secretary-Oeneral ot the' United ,
Nations, who will immediately' inform the other Members ,and
the Secretary-General of the Organization at such notification.
Notification or withdrawal may be given at any time after the
expiration of twelve mont~s trom the date on which the Convention
has come into foree. The withdrawal shall take effect upon
the exp1l'ation of twelve months from the date on whi,ch such
written notil'ication is received by, the Secretary":'General at . . the United Nations.

The present Convention shall enter into force on the
date when 21 States- of which 7 shall ea.ch have a total taMag.
of not less than 1,000,000 gross tons of Shipping, have becoae
parties to the Convention in aceordancp with Article 5"7.

other States as may havo become Members.

The United Rations 1s authorized to effect registration
of the Convention as soon as it comes into force.

Leeal Capacity. Privileges and Immypities
The following provisions ,on legal capacity, privileges 'and
immunities shall be applied by Members to, or in connection with,
the Organization pending their accession to the General Convention
on Privileges and Immunities of Specialized Agencies in- respect
of the Organization.
~9Jl.l The Organization shall enjoy in the territory of
each of its Members such legal capacity as is
necessary for the fulfilment of its purposes and the
exercise of lts functions
Section 2. (a) The Organization shall enjoy in the territory
at each of its Hembers such privileges And
immunities a~ are necGssnry for the fulfilment
of its purposes snd the exercise of its functions.
(b) Representatives of Members including alternates
and adviSers, and officials and employees of the
Organization shall similarly enjoy such
priVileges and. ilIImuni tl.ils as are necessary for
the independent exercise of their functions in
connection with the Organ1~~tion.
Section 3.' In applying the provisions of Sections 1 and 2 of
this Appendix, the Members shall take into account

THE ASSEMBLY,
RESOLUTION A.69(ES.II)
adopted on 15 September 1964
RECOGNIZING the need
•
(i) To increase the number of members on ths Council,
(ii) To have all members of the Council elected by
the Assembly,
(iii) To have equitable geographic repreeentation of Member States on the Council, and
CONSEQUENTLY HAVING ADOPTED, at ·the second ,extraordinary session of the Assembly held in Lo'ndon on 10-15 September
1964, the .amendments, the texts of which are contained in the Annex to this Resolution, to Articles 17 ani 18 of the Convention on the Inter-Governmental Maritime Consultative Organization,
DECIDES to postpone consideration of the proposed amendment to Article 28 of the Convention on the InterGovernmental Maritime Oonsultative Organization to the next session of the Asse:.1bly in 1965.
DETERMINES, in. accordance with the provisions of Article 52 of the Convention, that each amendment adopted hereunder is of such a nature that any Member which hereaf.ter declares that it does not accept such amendment and which does not accept the amendment within a period of twelve months after the amendment comes into force shall, upon the expiration of this period, cease to be a Party to the Convention,
REQUESTS the Secretary-General of the Organization to effect the deposit with the Secretary-General of the United Nations of the adopted amendments in conformity with Article 53 of the Convention and to receive declarations and
instruments of acceptance as ppovided for in ArtiCle 54, and
INVITES the Member Governments to accept each adopted amendment at the earliest possible date after receiving s copy thereof from the Secretary-General of the United Nations, by communicating an instrument of
acceptance to the Secretsry-General for daposit with the Secretary:"General of the United Nations.
l~ The existing text of Article 17 of the Convention is replaaed by the following:
The Council shall be composed o~ eighteen members elected by the Assembly.
2. The existing text of Article 18 of the Convention is replaced by the following:
In electing the members of the Council, the Aesembly shall observe the following principles:
(a) six shall be governments of States with the largest interest in providing international shipping services;
(b) six shall be governments of other .statea with the largest interest in international seaborne trade;
(c) six shall be governments of States not elected under (a) or (b) above, whiah have speaial interests in maritime transport or navigation and whose election to the Council will ensure the representation of all major geographic areas of the world,

THE ASSEMBLY,
RECOGNIZING the need to increase the number 9£ members of the Maritime Safety Committee and to modify their method of election,
CONSEQUENTLY HAVING ADOPTED, at the fourth regular session of the Assembly, an amendm:ent, the text of whioh 1s oontained in th~ Annex to this Resolution, to Article 28 of the Convention on the Inter-Governmental M$ritime Consultative Organization,
DETERMINES, in accordance with the provisions of Article 52 of the Convention, that the amendment adopted her~under is of suoh a nature that any Member which ~ereafter decl&res that it does not accept such amendment and which does not accept the amendment within a period of twelve mon~hs atter the amendment comes into force shall, upon the expiration of this period, cease to be a Party to the Convention,

The Maritime Safety Committee shall consist of sixteen members elected by the Assembly from members, Governments of those States having an important interest in maritime safety of which:
(a) Eight members shall be elected f~om among the ten largest shipowning States.
(b) Four members shall be elected in' such manner as to ensure that, under this subparagraph, a State in each of the following areas is represented:
1. Africa II. 'The Americas
III. ASia and Oceania IV. Europe.
(c) The remaining four members snaIl b~ elected from among States not otherwise represented on the Committee •
. For the purpose of this Artiole, States having an important interest in maritime safety shall include, for example, States interested in the supply of large numbers of orews or in the carriage of large numbers of berthed or unberthed passengers.
Members of the Maritime Safety Committee shall be eleoted for a term of four years and shall be eligible for re-eleotion.
