CONVENTION AGAINST TRANSNATIONAL ORGANIZED CRIME

Preamble

The Stales Parties to this Protocol,

4. A State Party shall respond expeditiously to a request from another State Party to determine whether a vessel that is claiming its registry or flying its flag is entitled to do so and to a request for authorization made in accordance with paragraph 2 of this article.

5. A flag State may, consistent with article 7 of this Protocol, subject its authorization to conditions to be agreed by it and the requesting State, including conditions relating to responsibility and the extent of effeclive measures to be taken. A State Party shall take no additional measures without the express authorization of the flag State, except those necessary to relieve imminent danger to the lives of persons or those which derive from relevant bilateral or multilateral agreements.

A State Party that has reasonable grounds to suspect that a vessel is engaged in the smuggling of by sea and is without nationality or may be assimilated to a vessel without nationality may board and search the vessel. I f evidence confirming the suspicion is found, that State Party shall take appropriate measures in accordance with relevant domestic and intemationallaw.

Article 9

Safeguard clauses

\. Where a State Party takes measures against a vessel in accordance with article 8 of this Protocol, it shall:

(a) Ensure the safety and humane treatment of the persons on board;

(b) Take due account of the need not to endanger the security of the vessel or its cargo;

(c) Take due account of the need not to prejudice the commercial or legal interests of the flag State or any other interested State;

(d) Ensure, within available means, that any measure taken with regard to the vessel is environmentally sound.

2. Where the grounds for measures taken pursuant to article 8 of this Protocol prove to be unfounded, the vessel shall be compensated for any loss or damage that may have been sustained. provided that the vessel has not committed any act justifying the measures taken.

3. Any measure taken, adopted or implemented in accordance with this chapter shall take due account of the need not to interfere with or to affect:

7. Todo Estado Parte que tenga motivos razonables para sospechar que un buque est6. involucrado en el trafico iUcito de migrantes por mar y no posce nacionalidad 0 se haee pasar por un buque sin podrci visitar y re­

se &laBan pruebas que eonfirmen la sospecha., ese Estado Parte adoptara aprop&ada.s de conformidad eon derecho interno e in-temacional, segUn proceda.

Articulo 9 CJausulas de protecci6n

1. Cuando un Estado Parte adopte medidas contra un buque con arre-glo al articulo 8 del prescote Protocolo:

a) Garantizara la seguridad y el trato humano de las personas que se encuentren a bordo;

b) Tendra debidamente en cuenta la necesidad de no poner en peHgro la seguridad del buque 0 de su carga;

c) Tendra debidamente en cuenta la necesidad de no perjudicar los in-tert~ses comerciales 0 juridicos del del pabell6n 0 de cualquier otro Esta-do interesado;

d) Velara, dentro de los medios disponibles, por que las medidas adoptadas can respecto al buque sean ecol6gicamente razonables.

4. Al aplicar las disposiciones del presente artIculo, los Estados Parte tendran en cuenta las necesidades especiales de las mujeres y los nmos.

S. En el caso de la detenci6n de personas que sido objeto de las conductas en el 6 presente cada Estado Parte

las obligaciones contraidas con arreglo a la Convencion de Viena sobre ReIaciones Consulares, cuando proceda. incluida la infonnar demofe a la persona sobre relativas a la nolificaci6n del personal consular y a personal.

Articulo 17 Acuerdos y arng/os

Los Estados Parte consideraran la posihilidad de celebrar acuerdos bilate­rales 0 regionales 0 arreglos operacionales con miras a:

a) Adoptar las medidas mas apropiadas y eficaces pa.ra prevenir y cornbatir las conductas enunciadas en el articulo 6 del presente Protocolo; 0

b) Contribuir conjuntamente Ii reforzar las disposiciones del presente Prolocolo.

Nada de 10 dispuesto en el presente articulo sfectara a las obliga-ciones contraidas con arreglo a cualquier otro tratado bilateral 0 multilateral aplicable 0 a cualquier otro acuerdo 0 arreglo operacional que rija, parcial 0 to­talmente, la repatriaci6n de las personas que hayan side objeto de las conductas enunciadas en ef articulo 6 del presente Protoeolo.

IV. Disposiciones finales

Articulo 19 Cldusu/a de salvaguardia

1. Nada de 10 dispuesto en el presente Protocolo afectara a los demas derechos, obligaciones y responsabilidades de los Estados y las personas con arreglo al derecho intemacional, incluidos el derecho intemacional humanitario y la normativa internacional de derechos humanos y, en particular. cuando sean aplicables, Is Conveneion sobre el Estatuto de los Refugiados de 1951 y su Pro­tocolo de 1967, as! como el principio de non-refoulement consagrado en diehos instrumentos.

2. Las medidas previstas en el presente Protocolo se interpretanm y aplicaran de forma que no sea discriminatoria para las personas por el heeho de ser objeto de las conduetas enunciadas en el articulo 6 del presente Protocolo. La interpretaci6n y aplicaci6n de esas medidas est.aran en consonancia con los prin­cipios de no discriminacion internacionalmente reconocidos.

Articulo 20 So/ucian de con/roversias

1. Los Estados Parte procuranm solucionar toda controversia relacionada con la interpretaci6n 0 aplicaci6n del presente Protocolo mediante la negociaci6n.

2. Toda controversia entre dos 0 mas Estados Parte acerca de la inter-pretaci6n 0 la aplicaci6n del presente Protocolo que no pueda resolverse me­diante la ncgociaci6n dentro de un plazo razonable debera, a solicitud de uno de esos Estados Parte, someterse a arbitraje. Si, seis meses despues de la fecha de la de arbitraje, esos Estados Parte no han podido ponerse de acuerdo

controversia a la Corte Internacional de Justicia mediante solicitud confonne al Estatuto de ia Corte.

3. Cada Estado Parte podrs. en el momenta de la firma. ratificaci6n. aceptaci6n 0 aprobaci6n del presenle Protocoio 0 la adhesion a el, declarar que no se considera vinculado por eJ pa.rrafo 2 def presente artIculo. Los demas Estados Parte no quedaran vinculados por el panafo 2 del prescnte articulo res­pecto de todo Estado Parte que hays hecho esa reservs.

4. El Estado Parte que hays. hecho una reserva de conformidad con el parrafo 3 del presentc articulo podra en cualquier momento reHrar esa reserva notificandolo 81 Secretario General de las Naciones Unidas.

Artfcul0 21 Firma, ratiflcacion. aceptacion, aprobacion y adhesion

I. EI presente Protocolo estara abierto a 18. firma de todos los Estados del 12 al 15 de diciembre de 2000 en Palermo Otalia) y despues de esa fecha en la Sede de las Naciones Unidas en Nueva York hasta el 12 de diciembre de 2002.

2. EI presente Protocolo tambit!n estara abierto a la firma de las orga-nizaciones regionales de ifttegracion siempre que al menos uno de los Estados miembros de tales organizaciones baya finnado el presente Protocolo de conformidad con 10 dispuesto en el pArrafo I presente articulo.

3. El presente Protocolo estars sujeto a ratificaci6n, aceptaci6n 0

aprobaci6n. Los iostrumentos de ratificaci6n, aceptaci6n 0 aprobaci6n se depo­sitarin en poder del Secretario General de las Naciones Unidas. Las organiza­ciones regionales de integraci6n economics podran deposita! su instrumento de ratificaci6n, aceptaci6n 0 aprobaci6n si por 10 menos uno de sus Estados miem-bros ha procedido de manera. ese de ace pta-ci6n a aprobacion, esas organizaciones declararlin afcance de su competencia can respecto a las cuestiones regidas por el presente Protocolo. Dichas organiza­cianes comunicaran tambien depositario cualquier modificacion pertinente del alcance de III competencia.
