DIVISION FIVE - STANDARDS FOR LANDSCAPING

SECTION 5.1 GENERAL

Sec. 5.1.1 PURPOSE AND SCOPE

This division will apply to and regulate all walls and landscaping to be placed in public rightsof way and/or to be maintained by the City. It's intended to provide and promote adequate,coordinated, and modern development enhancing the esthetics of the City. These standardsestablish the minimum criteria of design, materials, plants, and methods to be used inproviding landscaping for developments in the City of Shafter.

Sec. 5.1.2 PLAN SUBMITTAL PROCESS

5.1.2.1 The construction plans for proposed landscaping and wall improvements shall besubmitted by the developer's engineer to the City Engineer, for review and approvalprior to construction.

5.1.2.2 An Engineer's Estimate, based on "unit" prices approved by the City Engineer, shallbe submitted and approved for the determination of plan check and inspection fees.

5.1.2.3 All plan check fees shall be paid to the Office of the City Engineer prior to thesubmission of any improvement plans.

5.1.2.4 An improvement plan checklist and two (2) sets of "blue-lines" shall be submitted forplan checking.

5.1.2.5 Plans must be accompanied by structural calcs for retaining walls, if applicable,signed by a Registered Civil Engineer, and the landscape portion of the plans mustbe signed by a registered landscape architect (not required for small landscapingprojects).

5.1.2.6 Plans are subject to a multiple checks until they are amended to the satisfaction ofthe City Engineer.

5.1.2.7 Landscaping plans being submitted for "Final Signature" shall be submitted in ink onfilm or vellum. Once approved by the City, the developer's engineer shall beresponsible for submitting three (3) sets of "blue-lines", to the Department of PublicWorks, at least 48 hours prior to the start of construction.

5.1.2.8 As-Built Drawings: Upon completion of the improvements and prior to finalacceptance of the landscape improvements the engineer/architect shall submit "AsBuilt, Record Drawings" to the Department of Public Works, showing every changefrom the original drawings and the exact "as-built" locations, sizes, and kinds ofequipment. The "as-built" plans shall be submitted on film or mylar with either handnotations or computer generated notation. All notations shall completely illustratethe as-built condition in a neat, complete, and legible manner.

The locations of all improvements shall be dimensioned from two permanent pointsof reference, i.e., sidewalk or wall corners, etc., the location of the following items:

a) Connection to existing water lines.

b) Connection to existing electrical power.

c) Gate valves, remote control valves, quick couplings and related equipment.

d) Routing and directional turns of control wiring, and supply and sprinkler lines

Sec. 5.1.3 WAIVER OF REVIEW PROCESS

These standards do not apply to landscaping projects not presently or, in the future, ownedor maintained by the City of Shafter.

Sec. 5.1.4 ALTERNATIVE DESIGN

5.1.4.1 The provisions of this manual are not intended to prevent the use of any material,layout, or method of construction not specifically prescribed by this manual if suchalternate has been submitted to and has been approved by the City Engineer.

5.1.4.2 The City Engineer may approve alternate designs if such alternate is found to be forthe purpose intended and at least the equivalent of that prescribed in this manual inquality, strength, capacity, durability, safety, and effectiveness.

5.1.4.3 Prior to the approval of an alternate design the City Engineer may require thedeveloper’s engineer to submit calculations or data supporting alternate designs.

Sec. 5.1.5 ENFORCEMENT

5.1.5.1 Provisions of these standards for landscaping shall be enforceable by the CityEngineer.

Sec. 5.1.6 DEFINITIONS, TERMS, AND ABBREVIATIONS

Whenever any of the following words, expressions or pronouns are used in these minimumstandards, they shall be understood to have the meanings given below:

A.D.A Americans with Disability Act, which standards shall be partof all pedestrian used facilities.

APPLICANT Any person, governmental agency, or other entity thatexecutes the necessary forms to procure official approvalof a project or a permit to carry out construction of aproject.

APWA American Public Works Association

ASTM American Standards for Testing Materials.

AWWA American Water Works Association

BACKFILL Soil materials used to fill an excavation.

BACKFLOW A flow of water or other liquids, gases or solids from anysource back into the customer's plumbing system or thewater purveyor's distribution system.

BACKFLOWPREVENTION DEVICE

A device, approved by the State Department of Health andby the American Water Works Association, used tocounteract back pressure or prevent back-siphoning intothe distribution system of a public water supply.

CITY The City of Shafter or the City Council for the City ofShafter.

CITY ENGINEER The City Engineer for the City of Shafter, or a dulyauthorized representative.

COMPACTION The densification of materials by mechanical means.

CONDUIT Underground pipe constructed for the purpose of protectingunderground electrical wires

DEDICATION The deliberate appropriating of land by an owner(s) for anygeneral and public uses, reserving to themselves no otherrights than such as are compatible with the full exerciseand enjoyment of the public uses to which the property is tobe devoted. The intent to dedicate will be evidencedpresentation of a deed.

DEVELOPERREIMBURSEMENTAGREEMENT

Agreement between the City and a developer, who installedpublic improvements. The agreement provides forreimbursement of a fair prorated share by any real estateowners who have not contributed to the original cost ofsuch facilities, and who subsequently connect to, or use theimprovement.

DEVELOPER The applicant for a development permit, his successors,and/or assignees.

DEVELOPERAGREEMENT

An agreement between the City and the Developer, whichcontains work descriptions, estimated costs,responsibilities for the work performance and an expirationdate.

DEVELOPMENT Any man-made change of improved or unimproved realestate, the construction, reconstruction, conversion,structural alteration, relocation, or enlargement of anystructure; any mining, excavation, landfill, clearing, or landdisturbance; or any use or extension of the use of land.

EASEMENT Interest in land which does not include any rights ofpossession. A right of one owner of land to make lawfuland beneficial use of the land of another created by anexpress or implied agreement.

EROSION The wearing away of the ground surface as a result ofmovement of wind, water, and/or ice.

EXCAVATION The mechanical removal of earth material.

IMPROVEMENTS Any improvement to public, real, or personal property,including but not limited to, installation of streets, roads,pedestrian/bike facilities, streetlights; landscape features;sewer and waterlines; bridge structures; storm drainagefacilities; and traffic control devices.

LANDSCAPING Shall consist of any of the following or combinationsthereof: material such as, but not limited to, grass, groundcovers, shrubs, vines, hedges, trees or palms; andnon-living durable material commonly used in landscaping,such as, but not limited to, concrete, rocks, pebbles, sand,walls or fences, but excluding paving.

LOT The smallest platted parcel of real property created by alegal subdivision.

PLANNINGCOMMISSION

The Planning Commission for the City of Shafter

PLANNING DIRECTOR The Planning Director for the City of Shafter, or a dulyauthorized representative.

OBSTRUCTION Any obstacle of whatever kind or nature and shall include,but shall not be limited to, structures, power poles,telephone or telegraphic poles and appurtenances, pipelines, conduits and canals.

PLANS The plans, profiles, cross sections, elevations, details, andsupplementary specifications, signed by a licensedprofessional engineer and approved by the Director,showing the location, character, dimensions, and details ofthe work to be performed.

RIGHT OF WAY A strip of land acquired by reservation, dedication, forceddedication, prescription, or condemnation and intended tobe occupied by a road, crosswalk, railroad, electrictransmission lines, oil or gas pipeline, water line, sanitarysewer, storm sewer, or other similar public accesses orpublic uses;

Definition includes the right of one to pass over the propertyof another.

SITE For purposes of this manual, a specific location on whichany of the following activities are underway: excavation,cutting, or filling of earth or related earthwork.

SITE PLAN The graphical plan, usually in map form, prepared pursuantthe construction of a development.

SLOPE An inclined ground surface the inclination of which may beexpressed as the ratio of horizontal distance to verticaldistance.

SOIL Naturally occurring surface deposits overlying bedrock.Storm water: The waters derived from rain falling or snowmelting within a tributary drainage basin, flowing over thesurface of the ground or collected in a storm waterdrainage system.

STANDARD DETAIL Drawings approved by the City Council and adopted by saidCouncil as part of these standards.

STREET Includes roads and highways. The terms street, road, andhighway are used interchangeably and refer to the rights ofway used for vehicular traffic, whether improved orunimproved

SECTION 5.2 DESIGN STANDARDS

Sec. 5.2.1 GENERAL

5.2.1.1 Landscaping and walls plans shall be designed so as to conform to the approvedconceptual plans for the development.

5.2.1.2 Landscaping shall be provided on major arterial streets, major collector streets onwhich is placed a requirement for construction of masonry walls, median islands, andat the entrance to drainage basins or on other such areas as required by the City.

5.2.1.3 Arterials will require a landscaped area with a minimum width of fourteen (14) feetincluding the width of the wall and city standard sidewalk. Arterials will also requirelandscaped medians. Medians shall conform to Division 4, Standards for Streetsand Traffic Circulation.

5.2.1.4 Major collectors will require a landscaped area with a minimum width of twelve (12)feet including the width of the wall and city standard sidewalk.

5.2.1.5 Minor collectors will require a landscaped area with a minimum width ten (10) feetof including the width of the wall and city standard sidewalk.

5.2.1.6 With approval of the Planning Commission, a meandering sidewalk may beconstructed.

5.2.1.7 “Conceptual” plans must be approved by the Planning Commission prior to thesubmittal of landscape improvement plans.

Sec. 5.2.2 FINAL MAP REQUIREMENTS

5.2.2.1 With regards to the requirement of landscape improvements for a development, thefollowing requirements must be satisfied, prior to recordation of a Final Map:

a) The developer’s engineer shall form a “Landscape & Lighting” maintenancedistrict as directed by the City Engineer and prior to approval of landscapeplans.

b) The Developer shall have the City approve detailed landscape and wallplans in conformance with approved “conceptual” plans, and thesestandards.

c) The Developer shall do either of the following:(1) Construct the landscape and irrigation system to the satisfaction of

the City Engineer , and enter into a “Maintenance” agreement withthe City (sample shown in appendix) securing a ninety (90) daymaintenance period by the developer.

(2) Enter into a separate “Landscape Improvement” agreement(sample shown in appendix), and post an improvement security toguarantee the installation of the landscaping and irrigation system,to the satisfaction of the City Engineer.

Sec. 5.2.3 WALLS

5.2.3.1 Walls shall be six (6) foot masonry walls as measured from the highest grade.Masonry Wall may consist of the following:

a) Wood framed wall covered in stucco on both sides:(1) Structure to be approved by City Engineer. (2) Calculations shall be submitted to show wall will endure earth, wind,

and seismic loading (as applicable).(3) Design must incorporate pressure treated wood and vapor barriers.(4) Appearance to be approved by Planning Director

b) Cement Masonry Unit (CMU) Wall(1) CMU block walls with grouted cells and reinforcement in

conformance with City Standard Detail L-12.(2) Calculations shall be submitted to show wall will endure earth, wind,

and seismic loading (as applicable).(3) Type of wall and cap shall be as approved by the Planning

Commission with the conceptual plans for the development.(4) Actual cement masonry unit used for construction shall be

approved by the Planning Commission prior to construction.

c) Retaining Walls: Any retaining walls shall be designed by a Registered CivilEngineer. Retaining walls shall consist of the following:(1) CMU block walls with grouted cells and reinforcement in

conformance with City Standard Detail L-13.(2) Structure to be approved by City Engineer. Calculations shall be

submitted to show wall will endure earth, wind, and seismic loading(as applicable).

(3) Drainage facilities shall be provided for retaining walls subject tomore that two (2) feet of retained earth

(4) Wood shall not be used to retain earth of any depth.

d) Gates: Vehicular or pedestrian gates provided for walls designed per thissection shall be galvanized steel framed gate with facing that iscomplimentary to the adjacent wall and approved by the City of Shafter.

Sec. 5.2.4 SIDEWALKS

5.2.4.1 Sidewalks within landscaped areas shall conform to the provisions of Division 4,Standards for Streets and Traffic Circulation, Section 4.3.12, “SIDEWALKS”.

5.2.4.2 Meandering sidewalks shall be designed so as to conform to the approvedconceptual plans for the development.

5.2.4.3 Minimum width shall be five (5) feet.

5.2.4.4 Slope and accessibility requirements of the American with Disabilities Act (ADA) willbe adhered to.

Sec. 5.2.5 LANDSCAPING

5.2.5.1 Location & Placement of Trees/Shrubs: Trees and shrubs shall be placed insufficient quantity so as to fill the landscape area with mature shrubs and trees.Additionally, a sufficient quantity shall be placed directly in front of walls so as todeter graffiti vandals.

5.2.5.2 Site distance: Where shrubs or trees are to be planted, the sight distance lines,conforming to City Standard Detail T-26, shall be overlaid on the plans to show thatthe plants and other improvements do not interfere with clear zones. See DivisionFour, Section 4.3.3, “Line of Sight”, for sight distance requirements.

5.2.5.3 Soil: Engineer shall submit to the City Engineer for approval a soil nutrient report;this requirement may be waived if the City has on file acceptable information toindicate that it is not warranted. The report shall contain recommendations of soilamendments, fertilizers, as well as an indication of the soil's suitability for thepurpose intended.

5.2.5.4 Plants: Small patches of turf which will not lend themselves to maintenance withriding mowers will not be acceptable, particularly narrow strips which will be costlyto maintain. Encouraged are the use of ground cover plants with a few shrubs. Theuse of trees will be allowed where the trees or their overhang do not interfere withthe sight distance at intersections. Trees shall not be a type which have a lot ofsurface roots or drop fruit, or are a maintenance problem. The use of root guardsis prohibited. The species of any trees planted within five feet of a permanentstructure (street, curb sidewalk, or wall) shall be approved by the City Engineer priorto construction. All plants shall be tolerant of and readily adaptable of the climaticarea in which they are to be planted. Trees which exceed a four (4) inch diametertrunk at 10 years growth shall not be placed in the right-of-way without specificapproval from the City Engineer.

Sec. 5.2.6 IRRIGATION SYSTEM

5.2.6.1 General Design Criteria:

a) Design Pressure - irrigation systems shall be designed for performance at30 PSI.

b) PVC sleeves shall be used for both electrical and irrigation lines underconcrete and pavement.

c) All electrical wiring, controls, and devices shall be U.L. listed, and solabeled. Other approval organizations will be subject to review and approvalprior to installation.

d) The landscape system shall be designed to properly function from servicepressure without the use of pumps.

e) Sprinkler heads shall be selected to limit the amount of over spray on walls,sidewalks, or pavement.

f) All sprinklers and quick coupling valves shall be installed using double swingjoints.

SECTION 5.3 MATERIAL STANDARDS

Sec. 5.3.1 PVC PIPE AND FITTINGS

5.3.1.1 Pressure Main Line Piping and Fittings: Sizes two and one half (2-1/2) inches orlarger shall be P.V.C. class 200 ring-tite or approved equal.

5.3.1.2 Pressure Main Line Piping and Fittings: Sizes two (2) inches and smaller shall beSchedule 40 P.V.C.

5.3.1.3 Non-pressure laterals shall be minimum thickness Schedule 40 P.V.C.

5.3.1.4 P.V.C. nipples shall be schedule 80 with molded threads.

5.3.1.5 All pipe and fittings shall conform to specific requirements as follows:

a) P.V.C. Pipe: Manufactured from virgin polyvinyl chloride compound inaccordance with ASTM D1784 or ASTM D2241, Cell classification 12454B

b) P.V.C. Fittings (solvent weld or thread): Standard weight, schedule 40, sidegated, injection molded P.V.C. complying with ASTM D1784, cellclassification 13454B, including threads when required.

Sec. 5.3.2 ELECTRICAL (LOW VOLTAGE)

5.3.2.1 Wiring sizing shall be a minimum of #14 direct burial AWG-UF, 600 volt wire,insulation thickness 3/64 inch, utilizing low density high molecular weightpolyethylene insulation. Wiring shall be color coded with the common wire to bewhite and all others in different colors. An extra wire for every six (6) stations shallbe looped in each valve box and housed in a box.

5.3.2.2 Splices, where necessary or permitted, shall be waterproofed using Rain-Bird, PenTite, or other approved equal connectors.

5.3.2.3 All wiring placed under concrete or pavement shall be placed in a sleeve with pullboxes at each end.

Sec. 5.3.3 WATER SERVICE CONNECTION

5.3.3.1 A City standard 2" or larger water service connection conforming to Division III of thismanual shall be the type of service connection used for landscaping.

5.3.3.2 If the landscaped piping system requires booster pumps drawing directly from theCity water main, then the minimum size service connection shall be 4" and shall benot be subject to collapsing or cavitation due to suction head.

Sec. 5.3.4 BACKFLOW PREVENTION UNITS

5.3.4.1 Backflow preventer shall be designed to operate on a "reduced pressure" principle;Backflow preventer shall be installed in accordance with the latest edition of theManual of Cross Connection & Control and City standard detail L-3.

5.3.4.2 Backflow preventer shall be installed, tested in place, and certified by a certifiedbackflow preventer tester prior to being placed into full time operation

5.3.4.3 Backflow preventer shall be installed in a landscaped area adjacent to the serviceconnection.

Sec. 5.3.5 AUTOMATIC CONTROLLER

5.3.5.1 Automatic controllers shall be the fully automatic operation type capable ofindependently operating the number of stations indicated. City Engineer may requireadditional capacity if landscaping can be continued with another project.

5.3.5.2 Controller shall be Rainbird IM series, or approved equal; each valve shall becontrolled by a separate station.

5.3.5.3 Wall mount type in a housing with locking hinged cover.

5.3.5.4 Fuse and chassis ground all controller components.

5.3.5.5 The controller shall be mounted inside a stainless steel or aluminum, vandal-resistant enclosure with a pre-drilled backboard with 117 volt duplex outlet. Metalconduit shall run from the 117 volt supply to the controller housing. All power withinthe housing shall be properly phased. The enclosure shall be a Myer MEUG-I-M285, LeMeur EM 100 or equal. See City standard detail L-6.

5.3.5.6 The electric meter may be installed in the above cabinet or a separate, approvedvandal-resistant enclosure.

Sec. 5.3.6 REMOTE CONTROL VALVES

5.3.6.1 Valve type shall be spring-loaded, packless diaphragm activated, normally closedtype with plastic body, equipped with adjustable flow control.

5.3.6.2 Installation of remote control valves shall be per City standard detail L-4.

5.3.6.3 Valve solenoid shall be 24 volt AC, 45 watt maximum, 500 milliamp maximum surge,corrosion-proof, stainless steel construction, epoxy encapsulated to form a singleintegral unit.

5.3.6.4 Provide bleeder valve to permit operation in the field without power at the controller.

5.3.6.5 All valves shall be installed with schedule 80 unions to provide for easy maintenance.

5.3.6.6 Identification tags shall be attached to each remote control valve, showing thenumber that corresponds with the controller sequence. Tags shall be stainless steelor aluminum with the station number stamped with ½ inch letters.

Sec. 5.3.7 GATE VALVES

5.3.7.1 Gate valves three (3) inches and smaller: ASTM B62 brass body, 150 poundsaturated steam rated; with screwed joints; non-rising stem; screwed bonnet, soliddisc. Provide with handwheel.

5.3.7.2 All gate valves shall be installed with schedule 80 unions to allow easy removal andplaced in an approved valve box.

Sec. 5.3.8 SMALL LAWN SPRINKLER HEADS

5.3.8.1 Pop up sprinkler heads shall be used in lawn or turf areas.

5.3.8.2 Heads shall have screw adjustments that adjust the amount of water from thesprinkler nozzle.

5.3.8.3 Nozzles shall rise a minimum of six (6) inches.

5.3.8.4 See City standard detail L-7.

Sec. 5.3.9 ROTARY SPRINKLER HEADS

5.3.9.1 Rotary sprinkler heads shall be gear driven with minimum six (6) inch pop-upsprinkler heads.

5.3.9.2 Part circle heads shall have variable arc setting capability.

5.3.9.3 See City standard detail L-7.

Sec. 5.3.10 SMALL SHRUBBERY SPRINKLER HEADS

5.3.10.1 Pop up sprinkler heads shall be used in shrubbery areas.

5.3.10.2 Heads shall have screw adjustments that adjust the amount of water from thesprinkler nozzle.

5.3.10.3 Nozzles shall rise a minimum of twelve (12) inches.

5.3.10.4 See City standard detail L-7.

Sec. 5.3.11 QUICK COUPLING VALVES

5.3.11.1 Type: Heavy-duty, brass construction, with stainless steel internal valve spring, usinga 3/4 inch valve key, Rainbird 33 or equal, and shall have a locking rubber cover.

5.3.11.2 Quick Coupling Valves shall be spaced no more than 100 feet apart or 50 feet fromeither end of landscape sections.

5.3.11.3 All Quick Coupling Valves shall be installed in approved round valve boxes inaccordance with City standard detail L-5.

Sec. 5.3.12 VALVE BOXES

5.3.12.1 Valve boxes shall be fabricated from a durable plastic material resistant to weather,sunlight and chemical action of soils.

5.3.12.2 Gate valve boxes shall be round plastic boxes with flex lock covers, AMETEK,BROOKS, CARSON, or approved equal.

5.3.12.3 Remote control valve boxes shall be rectangular plastic boxes, AMETEK, BROOKS,CARSON, or approved equal, with hinged covers with flex lock.

5.3.12.4 See City standard detail L-4.

Sec. 5.3.13 INSTALLATION

5.3.13.1 All irrigation installations shall be in accordance with City standards, the latest editionof the California plumbing code, manufacturer's recommendation, Section 20 of theStandard Specifications, and as directed by the City Engineer.

5.3.13.2 The Developer shall notify the Department of Public Works prior to the installationof the irrigation system and landscaping.

5.3.13.3 Irrigation system improvements shall be installed in accordance with the followingguidelines, City standard detail L-2, and as directed by the city inspectors.

a) All plastic pipe and fittings shall be installed and backfilled in accordancewith manufacturer's instructions and the approved details.

b) Line Clearance: All lines shall have a minimum clearance of six (6) inchesfrom each other and from lines of other trades. Parallel lines shall not beinstalled directly over one another.

c) Provide minimum coverage as follows:(1) Pressure supply lines (two and one half - (2½) inches and smaller):

18 inches(2) Pressure supply lines (three (3) inches and larger): 30 inches(3) Non-pressure lines (lines under pressure only during operation): 12

inches(4) Control wire: 18 inches

d) All lines placed under paving or concrete shall be contained in a schedule40 P.V.C. sleeve. The size of the sleeve shall be the minimum size whichwill allow the interior pipe or control wire to be freely removed and replaced.All wire and pipes under paving shall be at least 30 inches deep, asmeasured from top of pavement.

SECTION 5.4 CONSTRUCTION STANDARDS

Sec. 5.4.1 GENERAL

5.4.1.1 The Developer shall maintain all irrigation and landscaping for a period of ninetydays after receiving written notification, by the City Engineer, that the improvementsare complete per the approved plans, and improvement agreements.

5.4.1.2 The Developer shall pay all costs for water and electricity until the end of the ninetyday maintenance period.

5.4.1.3 At the discretion of the City Engineer, the maintenance period may be extended ifa substantial number of shrubs or trees were replaced during the 90 day period.

Sec. 5.4.2 TESTING AND ADJUSTMENT

5.4.2.1 Adjustment: The Contractor shall adjust all sprinkler heads and valves foroptimum performance and to minimize over spray onto walks and roadways.

5.4.2.2 Testing of Irrigation System:

a) Test all pressure lines under hydrostatic pressure of 100 pounds per squareinch, and prove watertight, in the presence of the city inspector.

b) Testing of pressure main lines shall occur prior to installation of electriccontrol valves, quick couplers or any other equipment that might prevent aproper test from being performed.

c) All piping under paved areas shall be tested to the satisfaction of the cityinspector prior to paving. Pressure in lines shall be sustained for not lessthan two (2) hours. If leaks develop, replace joints and repeat test untilentire system is proven watertight.

Sec. 5.4.3 FINAL ACCEPTANCE

5.4.3.1 Prior to the Maintenance District taking over the landscape improvements, theDeveloper shall replace all plants which are not in a healthy condition, readjustsprinklers and make all necessary repairs to the system, as directed by the CityEngineer.

5.4.3.2 At the end of the maintenance period and after receiving the final written acceptanceby the City, the Developer shall be responsible for notifying the utility companies byletter to arrange for the utility meters to be transferred to the City. Copies of thenotification shall be sent to the City Engineer.

Sec. 5.4.4 MANUALS AND CHARTS

5.4.4.1 Controller Charts:

a) Provide three controller charts for each controller supplied, one is to beattached in the controller and the other turned over to the City in theOperation and Maintenance Manuals.

a) Prepare and deliver prior to completion of construction, two (2) hard coverthree (3) ring binders containing the following information:(1) Index sheet stating landscape Contractor's address and telephone

number, list of equipment with contacts for manufacturer'srepresentative.

(2) Catalog and part sheets on all material and equipment installed.(3) Complete operating and maintenance instructions on all major

equipment

Sec. 5.5.4 SAMPLE GENERAL NOTES

General notes shall include all necessary notes to convey the intent of the City of ShafterStandards for Landscaping, the project at hand, and as directed by the City Engineer. Theyshall include, but not be limited to the following.

5.5.4.1 24 hour inspection notice - Prior to the start of any phase of construction, the Office ofthe City Engineer shall be given at least 24 hours notice. Phone: (661) 746-2065.

5.5.4.2 Compaction test note - Compaction testing shall be the responsibility of the developer/subdivider/contractor. The number and location of required test shall be determined bythe City Engineer.

5.5.4.4 Contractor shall obtain all necessary permits before start of construction. A permit shallbe obtained from the Office of the City Engineer for all work to be performed in city right-of-way.

5.5.4.5 The locations of existing utilities and underground pipelines shown on these plans areapproximate only. The contractor shall determine the exact location of all existing utilitiesand underground pipelines before commencing work. Contractor assumes all liability forany and all damages to existing utilities occasioned by his failure to exactly locate,preserve, and protect any and all underground utilities and pipelines.

5.5.4.6 Any trenching conducted within this project shall be backfilled and compacted inaccordance with the City’s standard drawings.

5.5.4.7 The contractor shall remove and/or relocate all obstructions within the street right-of-wayas directed by the City Engineer.

5.5.4.8 Contractor agrees that he shall assume sole and complete responsibility for job siteconditions during the course of construction of this project, including the safety of allpersons and property; that this requirement shall apply continuously and not be limitedto normal working hours; that the contractor shall defend, indemnify, and hold the owner,engineer, and the City of Shafter harmless from any and all liability, real or alleged, inconnection with the performance of work on this project, excepting the liability arisingfrom the sole negligence of the owner/engineer/City of Shafter.

5.5.4.9 All construction work shall be performed in accordance with City of Shafter Standards,the State of California, Department of Transportation Standard Specifications, and asdirected by the City Engineer.

Sec. 5.5.5 SAMPLE LANDSCAPING NOTES

5.5.5.1 There shall be no substitutions or deletions of plant materials without the express writtenconsent of the City Engineer and the Planning Commission.

5.5.5.2 All landscaping plant materials and related infrastructure shall be installed in accordancewith the City of Shafter Standards for Landscaping and as directed by the City Engineer.

5.5.5.3 Backflow preventers shall be installed, tested, and certified and functioning correctly priorto being placed into service.

PARTIES AND DATE

Effective on the date above, , hereinafter called "Developer", and theCity of Shafter, hereinafter called “City”, mutually promise and agree as follows concerning the landscape andirrigation improvements, as approved by the City Engineer and the Planning Commission for the abovereferenced project:

PURPOSE

Developer desires to file final Map for Subdivision identified above prior to installation of landscape andirrigation improvements required in approval by the City of the above Subdivision. City agrees to defermentof such landscaping and irrigation improvements continent upon Developer constructing the improvementsin conformance with the “conceptual” plans, as approved by the Planning Commission, and as hereinafterpromised.

IMPROVEMENTS

Developer shall construct, install and complete landscape and irrigation improvements, as required by thisAgreement, and as depicted in the approved landscape improvement plans on file with the Department ofPublic Works for this project; Developer shall complete this work and improvements (hereinafter called"work") within the above completion period from the effective date herein, in a good workmanlike manner, inaccordance with accepted construction practices.

GUARANTEE AND MAINTENANCE

Developer guarantees that the work will be free from defects and will perform satisfactorily in accordance withthe approved plans and requirements of this Agreement. Developer further agrees to enter into a“Maintenance” agreement with the City of Shafter assuring maintenance of the improvements for a ninety (90)day period.

IMPROVEMENT SECURITY

Upon executing this Agreement, Developer shall deposit as security with the City: a cash deposit, bond orletter of credit in the amount specified above as security to assure completion of the work as specified in thisAgreement. The City agrees to release the security in full when the work has been completed to the

WARRANTY

Developer warrants that said improvement plans are adequate to accomplish the work as outlined in said“conceptual” plans.

NO WAIVER BY

Inspection of the work and/or materials, or approval of work and/or materials inspected, or statement by anyofficer, agent or employee of the indicating the work or any part thereof complies with the requirements of thisAgreement, or acceptance of the whole or any part of said work and/or materials, or payments therefor, orany combination of all these acts, shall not relieve the developer of this obligation to fulfill this contract asprescribed; nor shall the City be thereby stopped from bringing any action for damages arising from the failureto comply with any of the terms and condition hereof.

INDEMNITY

Developer shall hold harmless and indemnify the indemnities from the liabilities as defined in this section.

A. The indemnities benefited and protected by this promise are the City and its special districts,elective and appointive boards, commissions, officers, agents, and employees.

B. The liabilities protected against are any liability or claim for damage of any kind allegedlysuffered, incurred or threatened because of actions defined below, and including personalinjury, death , property damage, Inverse condemnation or any combination of these, andregardless of whether or not such liability, claim or damage was unforeseeable at any timebefore the City approved the improvement plan or accepted the improvements as completedand including the defense of any suit(s), action(s), or other proceeding(s) concerning these.

C. The actions causing liability are any act or omission (negligent or non-negligent) inconnection with the matters covered by this Agreement and attributable to the Developer,contractor, subcontractor, or any officer, agent or employee of one or more of them.

D. Non-Conditions. The promise and agreement in this section is not conditioned or dependenton whether or not any indemnitee has prepared, supplied, or approved any plan(s) orspecification(s) in connection with this work or development or has insurance or otherindemnification covering any of these matters, or that the alleged damage resulted partlyfrom any negligent or willful misconduct of any indemnitee.

COSTS

Developer shall pay when due all the costs of the work.

NON-PERFORMANCE AND COSTS

If Developer fails to complete the work and improvements within the time specified in this Agreement orextensions granted, the City may proceed to complete them by contract or otherwise, and Developer shallforfeit the improvement security to pay the costs and charges therein. If the City takes legal action to compelperformance of this Agreement or recover the cost of completing the improvements, Developer shall pay allreasonable attorney's fees, costs of suit, and all other expenses of litigation incurred by inconnection therewith.

APPENDIX B SAMPLE LANDSCAPE MAINTENANCE AGREEMENT

This agreement is made this day of , 20 _____ between the CITY OFSHAFTER, a municipal corporation, hereinafter called city, and ,hereinafter called Owner, with reference to the following facts:

A. Owner has undertaken to landscape the real property located at , in the City of Shafter, California, according to landscape

plans and specifications entitled on file with theDepartment of Public Works with city, hereby referenced to and made a part hereof.

B. City requires that landscaping installed in compliance with City-approved plans bemaintained for a minimum of 90 days.

C. Owner now desires to enter into an agreement to guarantee maintenance of saidlandscaping so that a map can be recorded for his development, or properties can becleared for occupancy.

IT IS THEREFORE AGREED:

1. That the Owner shall maintain and nurture landscape materials (of numbers and varieties asdescribed in said improvement plans for 90 days from the date of completion of landscapeinstallation as certified by the City in writing.

2. That the Owner shall maintain, in good working order, any irrigation system required as partof said improvement plans, for the same 90 day period.

3. If any time on or before the 90 day period has elapsed the City determines through inspectionof the property that requirements 1 or 2 above are not being complied with, the City shallnotify the Owner of the nature of the problems and what must be done to restore landscapingto the condition when it was certified complete.

4. Upon receiving such notice, the Owner agrees to promptly perform such restorative work ina professional manner in accordance with accepted landscape construction practices anda new 90 day maintenance period shall then be enacted.

5. In the event Owner fails or neglects to promptly complete all said restorative work, the Cityshall have the right at any time thereafter to complete the same by contractor force account,or both, and thereupon recover from owner provided improvement security, the full cost andexpenses thereby incurred by the City; the city may extend the completion period uponwritten request of the Owner based on justifiable delays.

6. Should city be required to institute legal action to recover any of said amount, Owner agreesto pay all reasonable attorney's fees, costs of suit, and all other expenses of litigation incurredby the City in connection therewith.

7. Owner has deposited with the City agreement security in the form of a surety bond, cashdeposit, or certificate of deposit (Government Code, Section 66499) in the amount of$________________________to secure faithful performance of this agreement.

8. This agreement shall be binding upon heirs, executors, administrators, assigns andsuccessors in interest of the parties hereto.
