Councillor Coulson's recommendation:
WHEREAS the subdivision application of Lone Tree Propertiesspecifically references providing water connections to another property ownerwithout approval or application to the District and Subdivision andDevelopment Bylaw No. 55,2005;
AND WHEREAS, Amendment Bylaw No. 55.1 was allegedly passed in2006 order to prevent the private buying, selling, or transferring of waterconnections within the community in conjunction with Water Supply andConnection Policy # 3007-3;
AND WHEREAS, in the past previous property owners have been advisedthat such connections or transfers are not permissible unless the properties arein a comprehensive development area;
THEREFORE be it resolved THAT Council directs staff to provideCouncil and the community with a report on the history of Subdivision andDevelopment Bylaw No. 55,2005, Amendment Bylaw No. 55.1, and the legalityof Lone Tree Properties proposed actions in light of our current bylaws andpolicies.
b) Snaw-Naw-As First Nation Request for Water Access to Wallace PointCouncillor Colclough's recommendation:
WHEREAS the Snaw-Naw-As First Nation have requested water access toWallace Point, Canadian Maritime Experimental and Test Range;
BE IT RESOLVED THAT Council directs staff to write a letter to the
Director General of Governance, Policy and Strategy, ADM (IE), Departmentof National Defense stating the District's support for the Snaw-Naw-As FirstNation's request for access to Wallace Point (Canadian Maritime Experimentaland Test Range) from the water.

c) Development Permit 7144 Eby Road - Variances Status & Site PreparationCouncillor Swain's recommendation:
WHEREAS CouncU considered a Development Permit Application withVariances for 7144 Eby Road at the regular meeting of Council held July 25,2016;
AND WHEREAS Council approved Development Permit Application No.3060-20-DPl6-004 to accommodate a new dwelling on the property located at7144 Eby Road, legally described as Lot 1, District Lot 53, Nanoose District, Plan22717 and located within Development Permit Area I - Watercourse Protectionand Development Permit Area IV - Coastal Protection, including the followingvariances to:
i. Section 3.4.61 Maximum Number and Size of Buildings and Structures -Height, District of Lantzville Zoning Bylaw No. 60,2005, from 8m to 9.8m;and
ii. Section 33.8. a) i) Setback - Watercourses, excluding the Sea, District ofLantzville Zoning Bylaw No. 60,2005, from 15m to 10m.NOW THEREFORE BE IT RESOLVED THAT Council directs staff to
prepare a status report regarding the variances approved by Council inrelationship to Development Permit Application No. 3060-20-DP16-004;

d) Canada-British Columbia Clean Water and Waste Water Fund GrantApplication for the Lantzville-Nanaimo Interconnection Pipe ProjectMayor Haime's recommendation:
THAT Council directs staff to proceed with submitting a Canada-BritishColumbia Clean Water and Waste Water Fund grant application to the BCMinistry of Community, Sport and Cultural Development for the Lantzville-Nanaimo Interconnection Pipe Project;
AND THAT the District's share of the project will be provided fromWater Capital Reserves.

REVIEW AND UPDATE OF DISTRICT OF LANTZVILLE DEVELOPMENT COST
CHARGES BYLAW
Mayor Haime announced that he will declare a conflict and leave the meeting for any discussion aboutthe Village Core that includes his property.
The Community Planner, Frank Limshue, reviewed the purpose of the meeting, noting it is acontinuation of the June 27,2016 Committee of the Whole meeting discussion, to provide additionalinformation regarding four additional water projects and to seek direction on including none, some orall of the projects in the development cost charges bylaw.
Chris Holmes gave a PowerPoint presentation on the addition of the four water service areas.
Staff and consultants responded to questions fi*om the Committee regarding the draft report and thecircumstances in which DCC apply.

SUBJECT: Bylaw No. 1547.01 - A bylaw to amend the wastewater development cost charge bylaw forthe Southern Community Sewer Service Area (Greater Nanaimo Pollution Control Centre)
BACKGROUND
Municipalities and local governments collect a development cost charge (DCC) when a property In anarea that receives services (I.e. sewer) is developed. DCCs help recover the costs to expandinfrastructure to accommodate growth.
The Regional District of Nanaimo (RDN) owns and operates the Greater Nanaimo Pollution Control
Centre (GNPCC); a facility to treat and dispose of wastewater from the City of Nanaimo and the Districtof Lantzvllle. The treatment plant, and the connected interceptor pipes and pump stations, have specificflow capacities. Wastewater Infrastructure must be expanded as the service area grows.
DCCs are established by bylaw and are updated from time-to-tlme. The Southern Community SewerService Area Development Cost Charges Bylaw (Bylaw No. 1547) was last updated in 2009.
CURRENT DCC REVIEW
The RDN retained professional engineering consultant AECOM to lead the current DCC review process.The current DCC review's process and schedule Is shown in Table 1.

The DCC review is proceeding in accordance with the province's Development Cost Charge Best PracticesGuide. The key updates are to the capital projects and development projections. There are also minorupdates to the DCC boundaries to better reflect existing and potential sewer expansion.

The proposed DCCs are based on the capital projects listed in Table 2. Capital projects and developmentprojections are based on a 20-year horizon (until 2036). DCCs are recoverable for the portion of thecapital project that increases capacity.

As shown in Table 3, to determine the DCC rate per population equivalent, the DCC Recoverable amountless the existing DCC reserve is divided by the expected development projection which is expressed as atotal population equivalent:

Existing and Proposed DCCs
Using the projected capital projects and development estimates, the DCCs were calculated for eachdevelopment type. The DCC rates are calculated by multiplying the DCC per equivalent growthpopulation (from Table 3) by the estimated population equivalency for each category (shown in Table 4).Tables 4 shows the existing and proposed DCC rates for each category.

The DCC rates under Bylaw No. 1547 were last updated In 2009. If adopted in 2017, the proposed 30%Increase represents a 3.8% annual increase in DCCs since the last update.
SUMMARY/CONCLUSIONS
Development Cost Charges (DCCs) are a key tool used by local governments in long-term assetmanagement and capital project planning. The Greater Nanaimo Pollution Control Centre has severalcapital expansion projects in the coming years. The Southern Community Sewer Service AreaDevelopment Cost Charges Bylaw (Bylaw No. 1547) was last updated in 2009.
The current wastewater DCC rates and bylaws were reviewed and revised to better reflect currentgrowth projections and capital plans. The review and revision process and methodologies follow theProvincial Development Cost Charge Best Practices Guide. Based on the DCC calculations prepared byprofessional engineering consultant AECOM, the DCC rates are proposed to increase by approximately30%, or 3.8% per year, for the Southern Community.

Recommendation For Information
Purpose
To provide a report for activities in the third quarter provided by the District of Lantzville FireRescue Service.
Responses
In the third quarter of 2016, the Department responded to a total of 40 calls for service, about a30% decrease over last year's responses. Year to date we are seeing an approximate decrease of10% less calls for service then previous years.
August saw the typical summer conditions and by August 17*^ a full ban of any outdoor fire,including campfires was enacted. During this full ban there was only one valid complaint wheresome unidentified individuals had a small fire on the beach. Most people were still very aware ofthe dry conditions and were diligent by stopping any outdoor burning.
On the morning of August 23,2016, Lantzville Fire was notified of a large brushfire in theFoothills land off Vipond Road. Nanaimo Fire had been chasing the smell of smoke the previousevening and as daylight came the fire was located. Both Nanaimo Fire and Lantzville Fireresponded as it wasn't clear where exactly the incident was, but it didn't take long to determine itwas in Lantzville's district.
The request for support fi*om the EC Wildfire Branch was immediately done and we suggestedair support right away. It was a hot morning, there was a gusting wind and while we could drivea 4x4 to the fire, getting water there was a challenge. BC Wildfire Branch arrived quickly andconcurred with my request, not only bringing a helicopter to bucket the leading edge but we alsoreceived 3 Initial Attack crews as the wind was pushing the fire closer to some rural properties.We managed to control the fire by early afternoon keeping it to just imder a hectare. Lantzvillecrews worked for 2 days on this fire logging over 21 hours.
While Wildland firefighting is part of what we do, most of our members had never experiencedthat large or complex of an incident. Air support and working with our mutual aid partners fi*omthe Wildfire Branch made the incident go much smoother and provided a great learningexperience for our members. 1 was very proud of their efforts and hard work, as were theproperty owner and the neighbouring residents.
This event also brought to li^t, the need for adequate Personal Protective Equipment foreveryone. 1 found that a 1/3 of the Department did not have flame resistant coveralls for wildlandfires, and spent the day in their structural turnout gear. None of our members have properfootwear for this type of call as they were wearing their rubber fire boots that are not appropriatein the bush.

Working so hard without the right protective equipment was difficult but showed theircommitment. This will be addressed as part of the Fire Department's 2017 budget process forCouncils consideration.
Member Training
16 regular training sessions were held with an average number of 12 members attending. Given itwas summertime this number was average for the time of year. 2 extra training sessions wereheld by shift workers to try to keep their skills up.
Activities
Apart from training and calls, July and August are typically quiet for Department activities soSeptember typically arrives with a flurry of activity.
Our members represented both Lantzville Fire Rescue and the Lantzville Volunteer FirefightersAssociation during the Annual Minetown Days celebration. We had 14 members attendthroughout the day, starting with the parade and continuing with our Public Safety and Educationactivities at Minetown Day in Huddlestone Park. Information regarding smoke alarms, home fireescape plans and general home fire safety were discussed with many attendees.
We were invited to participate jointly with Nanaimo Fire Rescue during the Annual FirefightersBoot Drive for the Muscular Dystrophy Association of Canada (MDAC). 13 Lantzville membersattended to the Cabela's store in shifts covering off Friday evening and Saturday, September 16and 17,2016. Over $20,000 was raised that weekend between Nanaimo and Lantzville, thehighest total since this has been occurring.
I am continuing to work on our administrative processes. Operational Guidelines and preventivemaintenance programs which must be brought up to date.Any concerns brought to li^t through this process will also be addressed as part of the FireDepartments 2017 budget process for Councils consideration.
In mid-September we also experienced a break and enter to the fire hall. Sometime over theevening of September IS*'^ a person(s) forced entry through a rear door and gained access into theApparatus Bay. It was determined that an old oak barrel from the Association, some fabricshopping bags and a pair of leather work boots were taken but that was all. To say we were luckyis an understatement.
On September 16 and 17, 2016,1 attended a Train the Trainer program to deliver the new TeamLeader program that is a requirement in the Province. As part of the new Minimum TrainingStandard imposed by the BC Fire Commissioner (The Playbook), I was one of 10 fire servicemembers across the Province to present this program regionally. It was quite an honor to beselected and currently I am the only trainer in Zone 1 (Vancouver Island).
The Team Leader program is designed to provide some direction and instruction on being aneffective Leader/Supervisor in the Fire Service. Any Department who declared themselves asExterior or Interior must take a Team Leader program. This program will ensure smallerDepartments across the Province have trained, informed and responsible leaders to ensure theymeet the required legislative processes, best practices and are effective Commanders on the FireGround. The goal is to ensure everyone goes home, by making the best decisions given thatresponse.

PURPOSE

BACKGROUND
Section 165 (1) of the Community Charter states that a municipality must have a financial plan that isadopted annually, by bylaw, before the annual property tax bylaw is adopted. Section 197 of theCommunity Charter states that each year, after adoption of the financial plan by before May 15, acouncil must, by bylaw, impose property value taxes for the year.
District of Lantzville Financial Plan Bylaw No. 120,2016 was adopted by Council on April 25,2016.
Section 165 (2) of the Community Charter states that for certainty, the financial plan may be amendedby bylaw at any time.
Through 2016 Council has directed staff to bring forward various Financial Plan amendments.

DISCUSSION
Section 165 (2) of the Community Charter states that for certainty, the financial plan may be amendedby bylaw at any time. The following changes have been incorporated into the amendment bylaw.
• Move $743,000 fi-om 2017 to 2016 for the Nanaimo Water Interconnection. Funding to remainunchanged, with $115,000 fi-om Water Development Cost Charges, $413,000 fi-om theWaterworks Reserve, and $215,000 from Gas Tax.
• Add $5,972 for the addition of audio video equipment for the District Council chamber. Fundingto come from Surplus.
• Add $3,000 to Minetown Day 2016. Funds to come from donation revenue.
FINANCUL IMPLICATIONS
The financial plan amendment results in an additional $5,972 being transferred from surplus and thetiming of the expenditure for tlie Nanaimo Water Interconnection being moved forward by a year.

Section 165(3.1) of the Community Charter, requires the following discussion regarding the policies andobjectives surrounding the District's funding sources, distribution of property taxes among property classes,and permissive tax exemptions be provided as an addendum to the five year financial plan.

1) Property Taxes
The District's property tax base is largely residential. This provides a generally stable and consistentrevenue source for the District to fund basic operational expenditures such as administration of the District,fire protection services, public works, and parks and recreation.
Council policy is to use the property tax levy to fund the operational expenditures of the District. TheDistrict expects this to continue to be the major source of municipal revenue.
2) Parcel Taxes
Parcel taxes are fees levied on a parcel of land without reference to the assessed value of that land. It isusually the same amount for every parcel within a defined area. Parcel taxes are generally used for specificpurposes, like a local area service.
Council policy to date has been to use parcel taxes where the nature of the expenditure being funded isspecific to tlie parcel, and not based on assessment of the property. In 2016 the District will collect parceltaxes on capital costs related to phase 1 and 2 sewer infrastructure (residents within the defined local areaservice), and capital costs related to the Knarston Creek Overflow Project.
3) User Fees and Charges
User fees attempt to fairly apportion the cost of some municipal services to those residents who actually usethe service. Tlie District currently collects user fees on a quarterly basis for water and sewer services aswell as annually for waste collection.
Council policy is to recover 100% of costs related to the water distribution and sewer collection systemsthrough user fees. User fees are reviewed each year as part of the financial planning process. P26

4) Proceeds from Borrowing
Council policy is to use long term debt only for significant capital projects that cannot be efficiently carriedout on an incremental basis using internal reserves or current funding sources. The Community Charterlimits the amount of debt the District can incur based on the District's ability to pay which is a calculationbased on continuing revenues. To date the District has not incurred any external debt.
5) Other Sources
Revenues in this category consist of appropriations fi-om accumulated operating surplus, investmentrevenue, as well as insignificant miscellaneous revenues. These revenues vary from year to year.
Other sources includes grant revenue. Grants are funds received by the District usually from othergovernments or agencies for specific purposes. These grants usually involve some cost sharing between thefunding agency and the District. Regarding optional grant funding available, Council policy is to considerapplying for grants with funding arrangements that are affordable to the District.
Provincial Small Communities Protection Grant funds historically have been a significant source of fundsfor District operations. The grant amount and funding formula change periodically. The 2016 grant amountin the amount of $426,000 has been confirmed by the Province.
Council established a Winter Road Maintenance Reserve in 2014 to offset higher than average operatingexpenses for snow clearing and other winter road maintenance expenditures.

Thus taxing otherclasses at a high multiple of the residential rate would generate very little additional property tax revenue,while imposing a undue burden on non-residential residents of the District. C. Permissive Tax ExemptionsPermissive tax exemptions are a way for the District to recognize the value of services provided to thecommunity by non-profit organizations. The District's Annual Report provides a list of permissiveexemptions granted each year and the amount of tax foregone.
Council policy is to review the one-year permissive tax exemptions granted in the prior year as well as anynew requests for exemption prior to October 31 of each year. One ten-year permissive tax exemption hasbeen granted to the Island Corridor Foundation.

BACKGROUND
In accordance with sections 220 - 226 of the Community Charter, Council may grant pennissiveexemptions from property taxes to eligible properties. These sections permit exemptions frommunicipal taxes, and there are similar provisions in other taxing authority legislation to extend thepermissive exemption to those levies.
The Community Charter also requires the District to publish notice of Council's intention to adopt apermissive tax exemption bylaw. This notice must identify the property, the proposed exemption, theterm of the exemption, and provide an estimate of the amount of taxes being exempted. The bylawmust be adopted by October 31®^ in the year before which the exemption applies.
Properties eligible for exemption in the District of Lantzville include:
A. Public worship property• St. Philip's by the Sea Anglican Church• Heritage Church, which is owned by the District, leased by the Seaside Community Society
and sublet to the Woodgrove Christian Community Church Society
B. Property owned or held by charitable/service club/recreational/philanthropicorganizations used for public recreation, charitable or philanthropic purposes• Tennis Court Property (parking lot only), which the District has leased to the Seaside
Community Society, the Legion and School District #68• Costin Hall, which the District leases to the Seaside Community Society• The Seaview Centennial Branch 257 of The Royal Canadian Legion
DISCUSSION
The proposed bylaw (attached) identifies one-year permissive tax exemptions for the same propertiesthat were exempted by Council in the previous year. The bylaw may only be adopted after publicnotice of the proposed bylaw in accordance with section 227 and section 94 of the Community Charter.A 10-year (2012-2021) permissive tax exemption for the Island Corridor Foundation was approved in aseparate bylaw by Council in 2011. All permissive tax exemptions are listed in the District's AimualReport, regardless of their term. The Community Charter does allow council to grant permissive taxexemptions for a maximum term of 10 years.

A BYLAW TO EXEMPT CERTAIN PROPERTIES FROM TAXATION FOR THE
YEAR 2017
WHEREAS Sections 220 - 226 of the Community Charter provide general regulations for theexemption of property from taxation;
AND WHEREAS Section 220 of the Community Charter provides specific exemptions forcertain types or uses of property;
AND WHEREAS Council may, by bylaw, pursuant to Section 224 of the Community Charterexempt additional property fi-om taxation;
AND WHEREAS Council deems it expedient to exempt property enumerated herein;
NOW THEREFORE the Municipal Council of the District of Lantzville in open meetingassembled enacts as follows:
Citation
1.1 This bylaw may be cited for all purposes as "District of Lantzville 2017 Property TaxExemption Bylaw No. 135,2016"
Property to be Exempted
2.1 Subject to Section 2.3 of this Bylaw, the following Church lands, together with thebuildings thereon, shall be exempt fi'om taxation for the 2017 property taxation year:
