INDEPENDENT ACCOUNTANT'S REVIEW REPORT

To the Distnct Attorney of the 34th Judicial District,

Chalmette, Louisiana.

We have reviewed the accompanying financial statements of the governmental activities, and the General Fund and Special Revenue Fund of the Office of the District Attorney of the 34th Judicial District (the "Office"), as of and for the year ended December 31, 2011, which collectively comprise the Office's basic financial statements as listed in the table of contents. A review includes primarily applying analytical procedures to management's financial data and making inquiries of the management of the Office A review is substantially less in scope than an audit, the objective of which is the expression of an opinion regarding the financial statements as a whole Accordingly, we do not express such an opinion.

The management of the Office is responsible for the preparation and fair presentation of the financial statements in accordance with accounting principles generally accepted in the United States of America and for designing, implementing, and maintaining internal control relevant to the preparation and fair presentation of the financial statements.

Our responsibility is to conduct the review in accordance with Statements on Standards for Accounting and Review Services issued by the American Institute of Certified Public Accountants Those standards require us to perform procedures to obtain limited assurance that there are no material modifications that should be made to the financial statements We believe that the results of our procedures provide a reasonable basis for our report

Based on our review, we are not aware of any material modifications that should be made to the accompanymg financial statements in order for them to be in conformity with accounting principles generally accepted in the United States of America.

In accordance with the Louisiana Governmental Audit Guide and the provisions of state law, we have issued a report dated June 28, 2012, on the results of our agreed-upon procedures

Our review was made primarily for the purpose of expressing a conclusion that there are no material modifications that should be made to the financial statements for them to be in conformity with accounting principles generally accepted in the United States of America. The management's discussion and analysis and budgetary comparison information on pages 3 through 7, and page 12, are presented for purposes of additional analysis. Such information, although not a required part of the basic financial statements, is required by the Governmental Accounting Standards Board who considers it to be an essential part of financial reporting and for placing the basic financial statements in an appropriate operational, economic, or historical context. The supplementary information has not been subjected to the inquiry and analytical procedures applied in the review of the basic financial statements, but it has been compiled from information that is the representation of management We have not audited or reviewed the supplementary information and accordingly, we do not express an opinion or provide any assurance on such supplementary information.

MANAGEMENT'S DISCUSSION AND ANALYSIS

Office of the District Attorney of the 34th Judicial District

The Management's Discussion and Analysis of the Office of the District Attorney of the 34th Judicial District's (the "Office") financial performance presents a narrative overview and analysis of the Office's financial activities for the year ended December 31,2011. This document focuses on the current year's activities, resulting changes, and currently known facts. Please read this document in conjunction with the basic fmancial statements, which follow this section.

FINANCIAL HIGHLIGHTS

The Office's assets exceeded its liabilities at the close of the fiscal year by $2,476,673 (net assets), which represent a 4.32% increase from last year.

The Office's revenues decreased $41,315 (or 21 30%) principally due to a decrease in bond premium fees.

Due to a decrease in capital outlay the Office's expenses decreased by $12,330 (or 19.77%)

The Office did not have any funds with deficit fund balances.

OVERVIEW OF THE FINANCL\L STATEMENT'S

This discussion and analysis is intended to serve as an introduction to the Office's basic financial statements. The Office's financial report consists of three parts: (1) management's discussion and analysis (this section), (2) basic financial statements, and (3) special reports by certified public accountants and management.

The basic financial statements include two kinds of statements that present different views of the Office:

Government-wide Financial Statements

The government-wide financial statements are designed to provide readers with a broad overview of the Office's finances, in a manner similar to a private sector business. The Statement of Net Assets presents information on all of the Office's assets and liabilities, with the difference between the two reported as net assets. Over time, increases or decreases in net assets may serve as a useful indicator of whether the financial position of the Office is improving or deteriorating The Statement of Activities presents infonnation showing how the Office's net assets change during each fiscal year All changes in net assets are reported as soon as the underlying event giving rise to the change occurs regardless of the timing of the related cash flows. Thus, revenues and expenses are reported in this statement for some items that will only result in cash flows in future fiscal periods. The governmental activity of the Office has charge of every criminal prosecution by the state in its District.

Fund Financial Statements

A fund IS a grouping of related accounts that is used to maintain control over resources that have been segregated for specific activities or objectives All of the fiinds of the Office are governmental funds

Governmental Funds

Govemmental ftinds are used to account for essentially the same functions reported as governmental activities in the govemment-wide financial statements However, unlike the govemment-wide financial statements, govemmental fund financial statements focus on near-term inflows and outflows of spendable resources, as well as on balances of spendable resources available at the end of the fiscal year. Because the focus of govemmental funds is narrower than that of the govemment-wide financial statements, it is useful to compare the information presented for govemmental funds with similar information presented for govemmental activities in the govemment-wide financial statements. Both the Govemmental Fund Balance Sheet and the Govemmental Fund Statement of Revenues, Expenditures, and Changes in Fund Balance provide a reconciliation to facilitate this comparison between govemmental funds and govemmental activities.

The Office maintains two individual govemmental funds. Information is presented separately in the govemmental fund balance sheet and in the govemmental fund statement of revenues, expenditures, and changes in fund balances for the General Fund and Title IV-D Incentives Special Revenue Fund A budgetary comparison statement has been provided for the General Fund and Title IV-D Incentives Special Revenue Fund to demonstrate compliance with this budget. The govemmental fund fmancial statements can be found on pages 8-12 of this report.

FINANCIAL ANALYSIS OF THE GOVERNMENT'S FUNDS

As noted earlier, the Office uses fund accounting to ensure and demonstrate compliance with finance-related legal requirements

Governmental Funds

The focus of the Office's govemmental fund is to provide information on near-term inflows, outflows, and balances of spendable resources. Such information is useful in assessing the Office's financing requirements. In particular, unreserved fund balance may serve as a useful measure of a government's net resources available for spending at the end of the year. As of the end of the current year, the Office's govemmental funds reported a combined ending fund balance of $2,476,673, an increase of $102,590 in comparison with the prior year that is available for spending at the Office's discretion.

The General Fund is the chief operating fund of the Office. At the end of the current fiscal year, unreserved fund balance of the General Fund was $2,347,230. Office's General Fund balance increased by $102,402 during the current fiscal year.

General Fund Budgetary Highlights

The Office adopted a budget dunng the year and had no amendments

Dunng the year, revenues were higher than budgetary estimates by approximately $41,000 and expenditures approximated budgetary estimates

Note 1 - NATURE OF OPERATIONS AND SUMMARY OF SIGNIFICANT ACCOUNTING POLICIES

As provided by Article V, Section 26 of the Louisiana Constitution of 1974, the District Attomey has charge of every criminal prosecution by the State in his District, is the representative of the State before the grand jury in his district, and is the legal advisor to the grand jury. The District Attomey performs other duties as provided by law and is elected by the qualified electors of thejudicial district for a term of six years. The judicial district encompasses the parish of St Bemard, Louisiana.

The accounting policies of the Office of the District Attomey of the 34th Judicial District (the "Office") conform to accountmg principles generally accepted in the United States of America ("GAAP") as applied to govemmental units. The Govemmental Accounting Standards Board ("GASB") is the accepted standard-setting body for establishing govemmental accounting and financial reporting principles The following is a summary of significant accounting policies.

a. Reporting Entity

The Office has reviewed all of its activities and determined that there are no potential component units which should be included in its financial statements

The District Attomey is an independently elected official and is not considered fiscally dependent on the St Bemard Parish Council (the "Council") As the governing authority of the parish, for reporting purposes, the St. Bemard Parish Council is the financial reporting entity for the St. Bemard Pansh The financial reporting entity consists of (a) the pnmary government, (b) organizations for which the primary government is financially accountable, and (c) other organizations for which nature and significance of their relationship with the primary government are such that exclusion would cause the reporting entity's financial statements to be misleading or incomplete

a. Reporting Entity (Continued)

Govemmental Accounting Standards Board Statement No. 14 established criteria for determining which component units should be considered part of the St Bemard Parish Council for fmancial reporting purposes. The basic criterion for including a potential component unit within the reporting entity is financial accountability. The GASB has set forth criteria to be considered in determining financial accountability. This critena includes*

1. Appointing a voting majority of an organization's governing body, and

a The ability of the Council to impose its will on that organization and/or,

b The potential for the organization to provide specific financial benefits to or impose specific financial burdens on the Council

2. Organizations for which the Council does not appoint a voting majority but are fiscally dependent on the Council

3. Organizations for which the reporting entity financial statements would be misleading if data of the organization is not included because of the nature or significance of the relationship.

Because the Council does not appoint the District Attomey, does not provide funding (other than the use of facilities), or have any control over the District Attomey, the District Attomey has determined that the Office is not a component unit of the St. Bemard Parish Council. The accompanying financial statements present information only on the funds maintained by the District Attomey and do not present information on the Council, the general government services provided by that govemmental unit, or the other govemmental units that comprise the financial reporting entity of St Bemard Parish.

b. Basis of Presentation

The Office's basic financial statements consist of the govemment-wide statements on all activities of the Office and the govemmental fund financial statements (individual major fiinds)

b. Basis of Presentation (Continued)

Government-Wide Financial Statements:

The govemment-wide financial statements include the Statement of Net Assets and the Statement of Activities for all activities of the Office As a general rule, the effect of interfimd activity has been removed fi'om these statements. The govemment-wide presentation focuses primarily on the sustainability of the Office as an entity and the change in aggregate financial position resulting from the activifies for the fiscal period. Govemmental activities generally are financed through taxes, intergovemmental revenues and other non-exchange revenues.

Fund Financial Statements:

The fimd financial statements are very similar to the traditional government fund statements as presented by govemments prior to the issuance of Statement No 34 Emphasis is now on major funds in goverrmiental categories The daily accounts and operations of the Office continue to be organized on the basis of a fund and accounts group, each of which is considered a separate accounting entity. The operations of the fiind are accounted for with a separate set of self-balancing accounts that compromise its assets, liabilities, fund balance, revenues, and expenditures. Government resources are allocated to and accounted for in the fund based upon the purpose for which they are to be spent and the means by which spending activities are controlled. The following are the govemmental funds of the Office:

General Fund - The General Fund is the general operating fund of the Office. The General fund accounts for all financial resources except those required to be accounted for in other funds. The General Fund is always a major fijnd The General Fund was established in compliance with Louisiana Revised Statute 15-571.11, which provides that a percentage of the fines collected and bonds forfeited within thejudicial district be transmitted to the District Attomey to defray the necessary expenses of the Office.

Special Revenue Funds - Special Revenue Funds are used to account for the proceeds of specific revenue sources (other than major capital projects) that are legally restricted to expenditures for specific purposes. Special Revenue Funds reported as major fiinds in the fund financial statements are as follows:

Title IV-D Incentives Special Revenue Fund - The Title IV-D Incentives Special Revenue Fund consists of incentive payments from the Louisiana Department of Health and Hospitals, as authorized by Act 117 of 1975, to establish family and child support programs compatible with Title IV-D of the Social Security Act. The purpose of the program is to enforce the support obligation owed by absent parents to their families and children, to locate absent parents, to establish paternity, and to obtain family and child support The contract for Title IV-D Incentive Funds was canceled in 1991 and was not renewed as of December 31, 2011

c. Measurement Focus and Basis of Accounting

Measurement focus is a term used to describe "which" transactions are recorded within the various financial statements. Basis of accounting refers to "when" transactions are recorded regardless of the measurement focus applied

Government-wide Financial Statements:

The govemment-wide financial statements are reported using the economic resources measurement focus and the accmal basis of accounting. Revenues are recorded when eamed and expenses are recorded when a liability is incurred, regardless of the timing of related cash flows.

Fund Financial Statements:

All govemmental funds are accounted for using a current financial resources measurement focus With this measurement focus, only current assets and current liabilities generally are included on the balance sheet. Operating statements of these funds present increases (revenues and other financing sources) and decreases (expenditures and other uses) in net current assets. Govemmental funds are maintained on the modified accmal basis of accounfing

d. Use of Estimates

The preparation of financial statements in confonnity with accounting principles generally accepted in the United States of America requires management to make estimates and assumptions that affect certain reported amounts and disclosures Accordingly, actual results could differ from those estimates.

e. Operating Budgetary Data

As required by the Louisiana Revised Statutes 39 1303, the District Attomey adopted a budget for the General Fund and Special Revenue Fund The budgetary practices include public notice of the proposed budget, public inspecfion and a public hearing on the budget prior to adoption. Any amendment involving the transfer of monies from one function to another or increases in expenditures must be approved by the District Attomey. The Office's budget was not amended during the year. All budgeted amounts which are not expended, or obligated through contracts, lapse at year-end.

Investments consist of certificates of deposits stated at cost, which approximates market value

g. Accounts Receivable

The basic financial statements of the Office contain no allowance for bad debts Uncollectible receivables are recognized as bad debts at the time information becomes available, which would indicate the uncollectibility of the particular receivable. These amounts are not considered to be material in relation to the financial position or operation of the funds.

h. Vacation and Sick Leave

The Office does not have a formal vacation and sick leave policy.

Fund balances classified as committed can only be used for specific purposes pursuant to constraints imposed by the Office Assigned fund balances are constraints imposed by mtent to be used for specific purposes, but are neither restricted not committed Assignments are made by management based on the Office's direction. As of December 31,2011, there were no restncted or assigned fund balances.

For classificafion of Govemmental Fund balances, the Office considers an expenditure to be made from the most restrictive first when more than one classificafion is available. The Office's fund balance as of December 31, 2011 totaled $2,476,673 all of which was classified as unassigned

Statement No 62, "Codification of Accounting and Financial Reporting Guidance Contained in Pre-November 1989 FASB andAICPA Pronouncements" Statement No 34, Basic Financial Statements - and Management's Discussion and Analysis -for State and Local Governments, provides that reporting for govemmental and business-type activities should be based on all applicable GASB pronouncements as well as the Financial Accounting Standards Board (FASB) Statements and Interpretation, Accounting Principles Board (APB) Opinions, and Accounfing Research BuUefins of the American Institute of Certified Public Accountants' (AICPA) Committee on Accounting Procedure, issued on or before November 30, 1989 (collectively, the 'TASB and AICPA pronouncements"), unless those pronouncements conflict with or contradict GASB pronouncements. The primary objective of Statement No. 62 is to directly incorporate the applicable guidance from those FASB and AICPA pronouncements into the state and local goverrmient accounting and financial reporting standards, with the provisions modified, as appropriate, to recognize the effects of the governmental environment and the needs of govemmental financial statements users without affecting the substance of the applicable guidance. k. Subsequent Events

The Office evaluates events occurring subsequent to the date of the financial statements in detennining the accounting for and disclosure of transactions and events that affect the financial statements. Subsequent events have been evaluated through June 28, 2012, which is the date the financial statements were available to be issued.

Note 2 - DEPOSITS AND INVESTMENTS

Louisiana state law allows all political subdivisions to invest excess funds in obligations of the United States or other federally insured investments, certificates of deposit of any bank domiciled or having a branch office I the State of Louisiana, guaranteed investments contracts and investment grade (A-l/P-1) commercial paper of domestic corporations.

Custodial credit risk is the risk that in the event of a bank failure, the Office's deposits may not be retumed to it. The Office has a written policy for custodial credit risk. As of December 31, 2011, approximately $1,729,000 of the Office's bank balances of approximately $2,479,000 was exposed to custodial credit risk. These deposits were uninsured and collateralized with securities held by the pledging financial institution's tmst department or agent, but not in the Office's name.

As of December 31,2011, cash and certificates of deposit were adequately collateralized by securities held by unaffiliated banks for the account of the Office. GASB considers these securities subject to custodial credit risk. Even though the pledged securities are considered subject to custodial credit risk under the provisions of GASB Statement 40, Louisiana Revised Statute 39 • 1229 imposes a statutory requirement on the custodial bank to advertise and sell the pledged securities within ten days of being notified by the depositor that the fiscal agent has failed to pay deposited funds upon demand

Note 3 - POST-EMPLOYMENT BENEFITS

The District Attomey does not offer post-retirement benefits to its employees.

Note 4 - PENSION PLANS

All individuals who work at the District Attorney's offices are paid by the St. Bemard Parish Government and are consequently members of the Parochial Employees Retirement System of Louisiana, a multiple-employer, public employee refirement system ('TERS"), which is controlled and administered by a separate board of tmstees The District Attomey is a member of the Louisiana District Attomeys' Retirement System, a multi-employer cost-defined sharing, and benefit pension plan GASB requires certain disclosure for employers who maintain retirement plans for their employees, both retirement systems mentioned above present the required retirement plan information in separately issued financial statements. Both retirement plans mentioned above are administered and controlled by separate boards of tmstees.

The Louisiana's District Attomeys' Retirement System's annual financial report includes financial statements and required supplementary information for the System. That report may be obtained by writing the Louisiana District Attomeys' Retirement System, 2109 Decatur Street, New Orieans, Louisiana 70116-2091, or by calling (504) 947-5551.

The Public Retirement System Actuarial Committee has recommended that the employee and employer contributions for the District Attomeys' Retirement System be set at 7.00% and 9.00%, respectively, for the fiscal year July 1, 2010 through June 30,2011 and 7.00% and 9 75% respectively, for the fiscal year July 1, 2011 through June 30, 2012

The Office is insured against various risks of loss related to workers compensation; torts, theft of, damage to and destmction of assets; errors and omissions; and natural disasters through the St. Bemard Parish Govemment's self insurance fund
