1st Day: Arrival is expected in Montecalvo in Foglia in the afternoon. Check-in at CA’ VIRGINIA, a country manor with original construction belonging to the XV century. Charming and elegant building with exceptional panoramic views of the Montefeltro countryside and genuine natural flavours. Maraviglia suggests a visit to Urbino, magnificent centre of Renaissance splendours, classified as world heritage patrimony of humanity by UNESCO. The package includes an optional guided tour to the historic and art riches in Urbino including tour guide services. Dinner time. The suggestion here is the refined and elegant atmosphere of Simposium 4 Seasons restaurant. Lucio Pompili, the chef, is a researcher and producer of local natural products and creative delicious dishes. Guests may taste (and eventually also buy) the famous extra-virgin olive oil from Cartoceto, DOP quality (Protected Designation of Origin certification) oil. Ideal warm atmosphere for after dinner relaxation.

2nd Day:After breakfast, guests set off on a truffle hunt excursion to Acqualagna where an expert truffle hunter and his dog will be waiting for them. (Transfer and courier services to accompany guests to Acqualagna are available on request). An enjoyable fulfilling experience on the Italian Central Apennine hillsides. Expert work of hunter and dog in order to find these precious treasures, ancestral techniques and long-experienced practical knowledge to enjoy this very particular outdoor activity.After the excursion, a tasting tour including truffle based products to the Acqualagna Tartufi store in Acqualagna. Delicious truffle scented creams, cheeses, oils and pasta. Later, a rewarding lunch at the Antico Furlo restaurant in Acqualagna. Italian precious home made pasta and truffle scented meat; unfailing “caciotta” cheese from Urbino and amber fossa (pit) cheeses.The rest of the day is spent according to guests’ pace and personal tastes. Maraviglia suggests the striking natural surroundings of the Furlo gorge or the ancestral narrow alleys of Fermignano and Acqualagna.Wonderful corners full of local life.

3rd Day:Enjoyable complete breakfast and check-out. Before leaving the area, it is worth visiting the cities of Pesaro or Fano. The enchanting small villages of the Montefeltro are also excellent choice.

The protagonists are wine, its growers, quality wine enthusiasts and vineyard lands. For 17 years now the wineries of Ascoli and Ripatransone open the doors to the public fostering a more direct contact between wine growers and consumers.

1st Day: Arrival is expected in Ripatransone in the afternoon. Check-in at Relais Del Colle. These beautiful lodgings are located on a quiet and enchanting hillside. Maraviglia recommends a stroll around the characteristic alleys and narrow streets of Ripatransone. The sights are so spectacular it has been awarded the title of ‘Belvedere del Piceno’ (best panoramic viewpoint of the Piceno). Dinner time: Maraviglia recommends reaching the highest area of Grottammare (‘Grottammare Alta’) where Osteria dell’Arancio will be ready to serve typical local dishes.

2nd Day: The entire day is dedicated to a discovery visit to these lands including some of its famous and prestigious wineries where the excellent Rosso Piceno Superiore and the Offida white wines such as Passerina and Pecorino are produced. Shortly after breakfast our expert guide will pick guests up at the Relais del Colle. A precious opportunity to come to know some of the untold secrets which these lands offer to those who can actually listen. Wine growers will unveil their wine production processes which go from their work in the vineyards to the fine techniques of wine fermentation in invaluable barriques; the expertise of ancestral practical knowledge and secrets lying behind world class quality excellences. Duke Federico of Montefeltro was highly involved in Humanism and gave great importance to that rebirth of art, literature and ideas of ancient Greeks and Romans. His court was well-known all across Europe because of this. He wanted the best artists to work, study and create for him. Francesco di Giorgio Martini and

Luciano Laurana were among these incredibly talented people. Urbino was Raffaello’s birthplace and his first steps into the art world were taken within this humanist context. • On the traces of antique Roman Flaminia road.An excursion that traces antique Roman logistics across the peninsula. Romans moved along fantastic stone road nets that they carefully built to facilitate their journeys and move faster and safer round their vast territories. Roman “via Flaminia” (220 B.C.) used to link Rome with the Adriatic and went past the lowest part of a gorge - today the Furlo Gorge - across the Apennines. They even hollowed a tunnel (38 m. long) through the rocky gorge which has been bettered and used ever since. Incredible surrounding Apennine sceneries; Fermignano and Cagli villages; the hermitage of Fonte Avellana.

1st Day: Arrival is expected in Urbino in the afternoon. Check–in at Urbino resort, beautifully decorated country style lodgings on the outskirts of the historic centre of Urbino. Gentle rolling landscapes and hundreds-year-old oak woods are the natural sceneries of this renaissance spot in Marche. Maraviglia suggests a horseback ride round these lovely woods and winding roads up to higher areas so as to admire its natural beauty. Later, the spa facilities at the hotel will provide rewarding soothing effects. San Giacomo restaurant in Urbino is the suggested excellence for dinner.

2nd Day: After breakfast at the hotel, our tour guide will be waiting in Urbino to set off on a visit to ‘Palazzo Ducale’ and the National Gallery of Marche. Renaissance splendours to be fully admired in every angle of the palace, the antique portals and fireplaces, frescoed ceilings and invaluable wall-to-wall carvings in Duke Federico’s private studio. The exhibition of priceless masterpieces such as world famous “The ideal city”; or “The flagellation” by Piero della Francesca; or Raffaello’s sense of introspection in the “The Dumb” are a few of the invaluable works or art on exhibition here. The tour continues round the alleys of the historic centre and up the Fortress of Albornoz; from its courtyards and gardens, it is possible to have some of the best panoramic sights of Urbino, the palace, the spires, its “cotto” (brick tiles) roofs of rusty reds, the cathedral and the “torricini” (narrow towers and its spires on the façade of Palazzo Ducale), then Carpegna mount and the scattered small medieval villages fortifications of the Montefeltro in the distance. Eventually the Salimbeni brothers’ frescoes in San Giovanni Oratory. Lunch time: gourmet lunch at the Osteria del Cucco inn, delicious traditional local dishes. In the afternoon the tour continues to Urbania, a nearby town famous for its ancestral majolica works. Craftsmen at work in their craft shops, hundreds-year-old techniques which have been used in Urbania uninterruptedly since renaissance times. Guests will also be able to do some shopping here. On request, a guided visit to the Chiesa dei Morti ( also called “mummies church” for the presence of actual mummies inside). Transfer services on request. 1st Day: Arrival is expected in Ascoli Piceno in the afternoon. Check-in at the Residenza 100 Torri, a charme hotel of significant historic interest, very near Piazza del Popolo square. In one of its beautiful internal yards, guests are welcomed with a cup of luscious Rosso Piceno wine and some Ascolan stuffed olives. Two delectable local authenticities of these lands. Maraviglia suggests a visit to the National Archaeological Museum, with plenty of ancient Piceno culture archaeological finds. Dinner time: the suggestion is Gallo d’Oro restaurant. Then, a relaxing stroll around this ancestral town so as to find out about its almost three times millenial features and traits.

2nd Day: After breakfast, guests set off on a tour to the city with a private guide. The visit to this wonderful historical town starts in ‘Piazza del Popolo’ (“People’s square”), one of the most beautiful Italian squares. It is possible to have a 360° view of the long crenellated walls of XVI century castles and other buildings including San Francesco church, the Loggia dei Mercanti and the art nouveau style of one-hundred-year-old Caffé Meletti by Piazza del Popolo (guests may try its delicious traditional coffee ‘corrected’ with ‘anisetta’, an espresso coffee with the addition of some anisette liqueur drops). The visit continues towards Piazza Arringo which is dominated by the caryatids of Arringo Palace; the Civic picture gallery exhibiting the works of outstanding artists including Carlo Crivelli, Tiziano, Pietro Alemanno and Cola d’Amatrice. Later different ‘rue’ (streets)of Medieval and Lombard neighbourhoods will lead the party to one of the Roman bridges.. The variety of antique architectural riches is endless including the peculiarities of the inscriptions on the architraves of old houses with proverbs and sayings in Latin and Vulgar Latin. • National Archaeological Museum.An impressive collection of local archaeological pieces belonging to a span which takes since pre-history times until the Middle Ages. It is relevant here to draw special attention to the archaeological pieces belonging to ancient Piceno civilization (IX to IV B.C.), origin of the Marchigian culture. Very interesting items are the Piceno stele stone of Castignano. Also, the incredible amount of glans plumbea (lead projectiles) used in the social rights struggles to obtain the Roman citizenship.

With this programme Maraviglia aims at making visitors enjoy some of the most well-known fortresses in Marche. For over 300 years (between the XIII and the XVI centuries) the Lords of Camerino, the Varano Lords, built a consistent system of defensive fortresses, including towers and walls in order to

protect and control the traffic of goods between Rome and the Adriatic sea. The regular clean sky conditions and military genius of these Lords gave origin to a very particular system of communication based on visual signals among the fortresses and towers. 2nd Day:Our guide will meet you at the reception area of the hotel shortly after breakfast. The day is dedicated to the excursion to the military grounds of the fortresses of Camerino. The tour begins from D’Ajello fortress, crucial point of the defensive fortification system created by the Varano Lords. Then, the Varano fortress, a stunning construction set on rocky walls. This fortress cannot be visited inside. Once having gone through Camerino medieval town, the tour continues to Pallotta Castle. This construction was completely refurbished in the XVI century, converting the military structure of the Varano Dukes into the luxurious residence of Counts and Cardinals Pallotta. The castle is set amidst centuries-old forests and it keeps a still working drawbridge and rooms with original features and elements including a medieval kitchen and toilets, antique items of clothing and weapons among other priceless historical items. It is possible to stay for lunch in the castle, delicious traditional Marchigian dishes crowning this enriching tourof historic discoveries. Another option for lunch being “Picciolo di Rame” restaurant in the fascinating castle village of Vetignano. After lunch the tour continues to Della Rancia castle. The city was born in function of the sea and that is the way its essence should be understood. Ancona stood out on the Guasco mount, its Syracusian founders’ traits still resound amidst its Roman remains: the amphitheatre, temples, villas and thermaes. With the dominant majesty of San Ciriaco cathedral -its ancient origins going back to an italic temple of the III century B.C- , and other unbelievable millennial icons, Ancona certainly has historic attractions to offer. 2nd. Day – SaturdayThe day will be entirely dedicated to the exploration of the Conero shores and the many other pleasures a sailing cruise involves. Sailing techniques on display. Guests will have the opportunity to improve their sailing skills or learn about the sport with hands-on practice. More specific sailing lessons, according to guests’ levels of expertise, may also be agreed on with the skipper. Crystal clear waters, white cliffs dropping into sea and the flowery hillsides of the Conero Mount with its promontories and reefs beaches will provide the backgrounds of this sailing experience. An offshore panoramic view towards Ancona reveals the skyline of dominant San Ciriaco Cathedral and the Arch of Trajan (Roman emperor Trajan times). • The Conero, its nights and stars. Unusual contact with night backgrounds. A walk after sunset along the paths of the Conero Park hillsides. Unpolluted environment, summer sea breeze, clear night skies, the sight of constellations in their full splendour. The presence of fireflies in the nights of June renders the walk even more spectacular. The trekking excursion, with naturalist guide, is available since May until September. Duration: 2 and a half hours. Meeting point: parking lot on the Conero mount, ex-Camaldolese monastery. Time: 9:00 p.m.

• Rosso Conero wine tasting. World class cru, impossible to reproduce anywhere else. The distinctive taste and harmonious of elegant Rosso Conero.

• Recanati, live memories of a poet. Recanati was Giacomo Leopardi’s birthplace. Giacomo Leopardi is considered by many as the most important Italian poet of the XIX century. Leopardi’s house, known as Leopardi Palace, is still inhabited by his descendants. Here, guests will find the square, called “Il sabato del villaggio”(“the village on Saturday”), after one of his poems, or the tower by the square having, again, a name after another of Leopardi’s poems: “Il Passero Solitario” (“the solitary bird”). Eventually, up the Conero so as to understand “Infinito”. Guided tour. Duration: 1 hour and a half.

• Loreto, shrine city. According to Christian Faith, the Holy Home of Nazareth was transported to Loreto by angels. The Holy House is a pilgrimage sanctuary of international importance.

• Conero offshore sailing. In order to get to unspoilt beaches at the foot of the Conero cliffs and otherwise unreachable promontories emerging at sea, Maraviglia offers a sailing cruise. Meeting point: tourist port of Marina Dorica in Ancona. Departure: 10:00 a.m. Return: 6:00 p.m. Guests should carry their own food and beverage supplies. Available for 4 to 10 guests.

• Round the Conero on a mountain bike. The lower rings of the mount offer enchanting paths for a mountain bike excursion. Minor internal roads and narrow passages amidst woods, vineyards and old typical Marchigian rural houses. Meeting point: Information Centre at Sirolo Park. Time: either 9:30 a.m. or 3:30 p.m. Duration: 2 hours. The excursion comprises tour guide services and bicycle rental including a protective helmet.

1st. Day: Arrival is expected in the afternoon in Sirolo, endearing fishermen’s village which seems to be carved directly on the white rocks of the Conero. Check-in at Sirolo**** hotel. The hotel is situated close to the historic centre with its lovely antique narrow alleys and squares. Enchanting panoramic views of the sea from a natural terrace on the cliffs overlooking the Mediterranean. Maraviglia suggests a visit to the Sirolo Park and from there, along the paths coming down from the park, the beach of San Michele. Dinner time: Maraviglia suggests La Torre restaurant in Numana.

2nd. Day: After breakfast. There are plenty of sandy and rocky beaches from which to choose in Sirolo. There are two possible ways to get to the beaches of Urbani and San Michele; either along the paths going down the Conero slopes or by public shuttle service, available since the middle of June until the middle of September. In order to get to ‘Sassi Neri’ beach (“black pebble”beach), Maraviglia suggests booking lunch at Da Silvio restaurant; customers will find not only top quality dishes and fantastic service there but also a very convenient shuttle bus service offered by the restaurant. In the afternoon a naturalist guide will be waiting to take guests on a trekking excursion through the hidden winding paths through mount Conero hillsides and slopes. Panoramic terraces on the hillsides of Pian Grande or Belvedere offer unforgettable magnificent views of Portonovo bay. Considered as one of the 10 best placesfor bird-watching in Italy, the highest crests of the Conero hills turn into mating and nesting area for migrant birds of pray during April and May. The itinerary continues with a visit to San Pietro abbey. Later, some prehistoric carvings complete this discovery journey to this millennial landmark. On Piani dei Raggetti, mighty sunset arrives, intense shades of crepuscular light on the Mediterranean. Upon request before dinner, the guide may also take customers for an aperitif to one of the famous world class Rosso Conero wineries.

3rd. Day: After breakfast, it is worth getting a closer look at the seaward side of Portonovo bay with its striking white pebble beaches. Visitors will find a variety of very good examples of historic interest here including the Guard Tower, built as a defensive construction by pirates; or the Napoleonic blockhouse, Napoleon Bonaparte’s military bulwark; the Romanesque church of Santa Maria (a guided tour explaining all its riches is available on request). Eventually, the delectable dishes based on clams from the local seas; “moscioli” as locals call them, offer one of the best options of seafood flavours.

4th. Day: Breakfast and check-out. Before leaving the area, Maraviglia suggests a visit to Recanati. Giacomo Leopardi, the famous Marchigian poet, was born here and immortalized some of Recanati iconic landmarks in his works. Another alternative being the “Holy House” in Loreto, with its religious, spiritual and historical connotation (guided visit available on request).

1st. Day:Arrival is expected in Ascoli Piceno in the afternoon. Check-in at the ALBERGO PICENO***, an elegant XVIII century construction near magnificent Piazza del Popolo in the heart of Ascoli Piceno. Maraviglia suggests a stroll around the alleys and wonderful narrow streets of this historic centre, the ‘rue’ as they call their streets. This city has been called the “pearl” of these Piceno lands. Towers, castles, and wonderful travertine constructions can be discovered with the help of a tour guide, as an optional service. For dinner time Maraviglia suggests Gallo d’Oro: the restaurant offers its delicious dishes based on truffle and fungi from the Sibillini mounts, unfailing Ascolan stuffed olives and first rate local Piceno wines.

2nd. Day:After a complete breakfast, a Nordic walking instructor will be waiting at Due Parchi centre in Arquata del Tronto, he will introduce guests to a preliminary lesson to Nordic walking so as to make the most of the excursion. Eventually, the party sets off on a Nordic walk to the Sibillini mounts. Transfer services will take guests to Piani di Castelluccio. Here, amidst sceneries of rare beauty, the Nordic walking experience will take place. The excursion takes 5 hours altogether. Maraviglia suggests taking lunch supplies on the excursion so as to be able to have lunch on the mounts with the rest of the participants. Later, in the evening, the hydro massage pool at the hotel will have a relevant protagonism; rewarding moments of utter relaxation . Dinner time: Maraviglia suggests a personal choice here.

3rd. Day: Breakfast at the hotel and check out. There are some optional excursion services that would complete this tourist offer very effectively. Pilato lake, Sibilla mount, Dell’Infernaccio gorges and the Fiastrone canyon are extraordinary choices to be included in your free time before leaving. All of them provide awesome majesty. Della Laga mounts near the Sibillini, the Volpara and della Prata falls, offer incredible fabled atmosphere in autumn or spring. Woods, streams and falls are enchanting fairy tale elements giving back fulfilling sensations of comfort and inner pleasure.

• Ascoli, the 100 towers city. Ascoli Piceno is an enchanting city with plenty of historic riches to offer. Roman and medieval monuments, gothic and renaissance art and architectural features. Widespread harmonic elegance of white travertine. The guided tour begins in Piazza del Popolo, one of the most beautiful squares in Italy, and it continues towards Arringo square with its fantastic Civic Picture Gallery. Medieval alleys and narrow streets, the “rue” as they call them. Roman bridges and numerous churches. Stunning historic beauty. Duration: 3 hours.

• Pilato lake. This is a trekking excursion along steep hairpin bends through a fantastic fagus trees wood towards rare 1940m high sceneries of almost moonlike appearance. Eventually, the Pilato lake basin, an extraordinary ecosystem that allows the existence of a shrimp species called the “Marchesini chirocefalo” which lives only in these waters. According to legend Pilato’s body was also taken to these waters. The excursion includes a naturalist guide. It is available since May until September and it has got a duration of 7 hours. Difficulty level: medium. Departure time: 8:00 a.m. Meeting point: Foce in Montemonaco. Guests should be properly attired in comfortable clothes, waterproof wind jacket, cap or hat and should carry their own food and water supplies.

• Sibilla mount. Prophetess Sibilla used to live on these peaks and for centuries has contributed to the legendary myths belonging to these hillsides today. Along the hiking paths towards Sibilla’s cave (the cave is currently blocked) astonishing vast panoramic views give visitors mind and soul enlightenment. The sights include Pilato lake valley, Dell’Infernaccio gorges and part of the Apennines reaching Vettore mount. The excursion is done with a naturalist guide, it is available since May until September it has a duration of 6 hours. Difficulty level: medium. Departure time: 8:00 a.m. Meeting point: Rifugio Sibilla (Sibilla shelter), in Isola di San Biagio in Montemonaco. Guests should be properly attired in comfortable clothes, trekking shoes, waterproof wind jacket, cap or hat and have sufficient water supplies.

•Della Volpara and Della Prata falls. A naturalist guide will lead customers on this stunning atmosphere excursion. It is a fairly long journey to the awesome magic of two lovely waterfalls. The Della Laga woods are known as the “water kingdom” because of its numerous water complexes including streams, falls and wells which are present all over in these enchanting wild lands. The journey takes to Della Volpara and Della Prata water falls and the sandy pools by Macera della Morte mount. Duration of the excursion: 7 hours. Difficulty level: low/medium. 2nd. DAY: One complete day dedicated to the 1st. lesson of the photographic course. The itinerary of the day depending on guests’ choice and the landscapes calendar (see landscapes calendar). After breakfast, Luca, the photographer, will meet guests at Le Case. He will lead guests towards the first photographic setting (transfer services on request). First theory lessons, first approach to landscapes photographic techniques. How to get into symbiotic relationship with the scenery and understand the correct photographic timing. Lunch time: lunch break at a suggested restaurant (depending on the chosen landscapes area). After lunch, guests will be guided to find the “genius loci”, an exploration of the surrounding sceneries for the application of the practical aspects that turn a photographic shot into a masterpiece. The end of the first lesson takes place in the late afternoon. Dinner time: the suggestion here is Delle Case Wine Bar/restaurant.

3red. DAY:Luca arrives to fetch guests before dawn (transfer services on request). Lovely colours of first light ready to be captured on water mirrors or snow covered surfaces. Ideal angles to grasp the magic of first light sceneries.After reinvigorating breakfast, the moment of post-production takes place with some theory and on hands activities regarding the resulting outcome of the precious shots. 2nd. DAY:After a complete breakfast in the splendid restaurant of the reserve, the excursion to the caves of Frasassi begins. An expert speleologist will be waiting at the entrance of the caves to lead guests’ into the ‘Blue Journey’. The excursion through the caves and passages takes approximately 2 hours and it is suitable for beginners, people without any previous experience on speleology. The caving excursion includes some climbing, passages and narrower sections amidst impressive stalactites and stalagmites, underground streams and caverns. Incredible forms. Total loss of real dimensions sense. The journey begins at ‘Sala dell’Inifinito’ (“The infinite hall”) (the last section of the classic tourist tour) and continues through a narrower section called ‘Cannella’ (“tap”) to get to the ‘Quattro Sorelle’ (“Four sisters”). Then a long tunnel leads into ‘Sala Finlandia’ (“Finland hall”) Here there is some wading to do across the meanders of a long passage towards the ‘Sala del Bivacco’ (“the bivouac hall”. A break to take some rest and a couple of photographs before going down a sliding passage towards the ‘Sala Gentile da Fabriano’; eventually, the peculiarities of the “leopard fur”.Once having come out of these incredible adventurous passages, we find the small village of Genga. Amidst high rocky Apennines walls, this lovely mountain town invites to explore its medieval constructions, the old Roman bridge, San Vittore Abbey, the Speleo- paleontologic museum and the Valadier chapel inside the Santa Maria Infrasaxa sanctuary inside a natural cavern accessible on foot. Lunch time: Maraviglia suggests Da Maria restaurant. A privileged hillside with plenty of panoramic sights in the village of Pierosara.

3rd. DAY:After having breakfast, the suggestion is some outdoor activities, on surface this time, including for example, canyoning along the gorge of Freddo (cold) river or trekking onto higher beautiful lands. In assenza di spese sostenute o di idonea documentazione e, comunque, in alternativa, riconoscerà un indennizzo forfetario pari ad euro 200,00.

INFORTUNI E MALATTIA DURANTE IL VIAGGIORimborso spese mediche da Infortunio o malattiaOggetto dell'assicurazioneNel limite dei massimali per Assicurato pari ad euro 2.500,00 in Italia verranno rimborsate le spese mediche sostenute durante il viaggio, conseguenti ad infortunio o malattia verificatosi durante il periodo di validità della garanzia relativamente a: onorari medici, cure dentarie solo a seguito di infortunio e con il limite di Euro 200,00, ricoveri ospedalieri, interventi chirurgici, medicinali prescritti da un medico.In caso di ricovero ospedaliero a seguito di infortunio o malattia indennizzabile a termini di polizza; la Centrale Operativa, su richiesta dell'Assicurato, provvederà al pagamento diretto delle spese mediche.Resta comunque a carico dell'Assicurato, che dovrà provvedere a pagarle direttamente sul posto, l'eventuale eccedenza ai massimali previsti in polizza e le relative franchigie.Per gli importi superiori a Euro 1.000,00 l’Assicurato deve richiedere preventiva autorizzazione da parte della Centrale Operativa.

INFORTUNI DOPO IL VIAGGIOLe spese mediche sostenute dopo il termine del viaggio, per i soli casi di infortuni verificatisi durante il viaggio saranno rimborsate nel limite di Euro 1.000,00, purché sostenute entro 60 giorni dalla data di rientro.

ANNULLAMENTO VIAGGIOL’Impresa indennizzerà, in base alle condizioni del presente contratto, l’Assicurato ed un compagno di viaggio, del corrispettivo di recesso per annullamento del viaggio, determinato ai sensi delle Condizioni Generali del regolamento di viaggio, che sia conseguenza di circostanze imprevedibili al momento della prenotazione del viaggio determinate da:- decesso, malattia o infortunio dell'Assicurato o del Compagno di viaggio, del loro coniuge/convivente, genitori, fratelli, figli, suoceri, generi, nuore, nonni, zii e nipoti sino al 3° grado di parentela, cognati, Socio contitolare della Ditta dell'Assicurato o del diretto superiore, di gravità tale da indurre l'Assicurato a non intraprendere il viaggio a causa delle sue condizioni di salute o della necessità di prestare assistenza alle persone sopracitate malate o infortunate.Per gli Assicurati ed i loro familiari si intendono incluse in garanzia le malattie preesistenti. Sono altresì comprese le patologie della gravidanza purché insorte successivamente alla data di decorrenza della garanzia;- danni materiali all'abitazione, allo studio od all'impresa dell'Assicurato che ne rendano indispensabile e indifferibile la sua presenza;

- impossibilità dell’Assicurato a raggiungere il luogo di partenza a seguito di gravi calamità naturali dichiarate dalle competenti Autorità.- guasto e/o incidente al proprio mezzo di trasporto che impedisca all’Assicurato di raggiungere il luogo di partenza del viaggio;- convocazione della Pubblica Autorità dell’Assicurato;- furto dei documenti dell’Assicurato necessari all'espatrio quando sia comprovata l'impossibilità materiale per il loro rifacimento.- impossibilità di usufruire da parte dell’Assicurato delle ferie già pianificate a seguito di assunzione o licenziamento da parte del datore di lavoro;- impossibilità di raggiungere la destinazione prescelta a seguito di dirottamento causato da atti di pirateria aerea.- impossibilità ad intraprendere il viaggio a seguito della variazione della data: della sessione di esami scolastici o di abilitazione all’esercizio dell’attività professionale, di partecipazione ad un concorso pubblico, del matrimonio;- impossibilità ad intraprendere il viaggio nel caso in cui, nei 7 giorni precedenti la partenza dell’Assicurato stesso, si verifichi lo smarrimento od il furto del proprio animale (cani e gatti) o un intervento chirurgico salvavita per infortunio o malattia subito dall’animale regolarmente registrato.

In caso di iscrizione contemporanea di un gruppo precostituito di partecipanti l’Assicurato che annulla il viaggio potrà indicare una sola Persona quale “Compagno di viaggio”.

Obblighi dell'assicurato in caso di sinistroL’Assicurato o chi per esso è obbligato, entro le ore 24 del giorno successivo al giorno dell’evento (intendendosi per tale il manifestarsi delle cause che determinano l’annullamento del viaggio), a fare immediata denuncia telefonica contattando il numero verde 800335747 oppure al numero 039/6899965 attivo 24 ore su 24.L’Assicurato è altresì obbligato ad informare l'Agenzia di Viaggio presso la quale è stato prenotato il viaggio.Nel caso in cui l’Assicurato si trovi nelle condizioni di rinunciare al viaggio per malattia o infortunio, senza ricovero ospedaliero, la Centrale Operativa provvederà, con il consenso dell’Assicurato, ad inviare gratuitamente il proprio medico fiduciario al fine di certificare che le condizioni dell’Assicurato siano tali da impedire la sua partecipazione al viaggio e per consentire l’apertura del sinistro attraverso il rilascio da parte del medico dell’apposito certificato. In questo caso il rimborso verrà effettuato applicando la franchigia indicata nell’articolo precedente.L’impresa, a fronte della sopracitata richiesta da parte dell’Assicurato, si riserva il diritto eventualmente di non inviare il proprio medico fiduciario; in questo caso l’apertura del sinistro verrà effettuata direttamente dal medico della Centrale Operativa. Anche in questo caso il rimborso verrà effettuato con l’applicazione della franchigia indicata nell’articolo precedente.Qualora l'Assicurato non consenta all’Impresa di inviare gratuitamente il proprio medico fiduciario al fine di certificare che le condizioni dell’Assicurato siano tali da impedire la sua partecipazione al viaggio e/o non denunci il sinistro entro le ore 24.00 del giorno successivo il giorno dell'evento, verranno applicati i seguenti scoperti tranne nei casi di morte o ricovero ospedaliero:• 10% in caso di corrispettivo di recesso inferiore o pari al 50%; • 20% in caso di corrispettivo di recesso compreso tra il 51 % e il 75%; •30% in caso di corrispettivo di recesso compreso tra il 76% e il 100%. In ogni caso verrà applicata, dopo aver dedotto lo scoperto, la franchigia come da tabella indicata nell’articolo precedente.

L’Assicurato deve consentire all’ Impresa le indagini e gli accertamenti necessari alla definizione del sinistro nonché produrre alla stessa, tutta la documentazione relativa al caso specifico liberando, a tal fine, dal segreto professionale i Medici che lo hanno visitato e curato eventualmente investiti dall’esame del sinistro stesso.L’inadempimento di tali obblighi e/o qualora il medico fiduciario dell’Impresa verifichi che le condizioni dell’Assicurato non siano tali da impedire la sua partecipazione al viaggio e/o in caso di mancata produzione da parte dell’assicurato dei documenti necessari all’Impresa per la corretta valutazione della richiesta di rimborso possono comportare la perdita totale o parziale del diritto all’indennizzo.

IMPORTANTE: L’indennizzo spettante all’Assicurato è pari al corrispettivo di recesso (cioè alla penale prevista dal contratto di viaggio, nel caso di cancellazione dello stesso), calcolato alla data in cui si è manifestato l’evento, ovvero il verificarsi delle circostanze che hanno determinato l’impossibilità ad intraprendere il viaggio. L’eventuale maggior corrispettivo di recesso, addebitato dal Tour Operator in conseguenza di un ritardo da parte dell’Assicurato nel segnalare l’annullamento del viaggio al Tour Operator resterà a carico dell’Assicurato.

Impegno di filo diretto assicurazioniFilo diretto Assicurazioni, qualora l'Assicurato denunci telefonicamente il sinistro entro le ore 24 del giorno successivo al giorno dell’evento, si impegna a liquidare il sinistro entro 45 giorni dalla data di denuncia a condizione che la documentazione completa arrivi entro il 15° giorno dalla data di denuncia stessa.Qualora per ragioni imputabili a Filo diretto Assicurazioni la suddetta liquidazione avvenga dopo 45 giorni, sarà riconosciuto all'Assicurato l'interesse legale (composto) calcolato sull'importo da liquidare.

Diritto di Subentro Per ogni annullamento viaggio di cui all'articolo Oggetto dell'assicurazione, soggetto a corrispettivo di recesso superiore al 50%, l'Assicurato riconosce espressamente che la proprietà ed ogni diritto connesso allo stesso si intendono trasferiti all’Impresa che ne potrà disporre liberamente sul mercato acquisendone in via definitiva e senza richiesta alcuna di risarcimento da parte dell'Assicurato, gli eventuali corrispettivi che ne dovessero derivare.

ASSISTENZA ALLA PERSONA L’Impresa si obbliga entro i limiti convenuti in polizza, a mettere ad immediata disposizione dell'Assicurato, mediante l'utilizzazione di personale ed attrezzature della Centrale Operativa, la prestazione assicurata nel caso in cui l'Assicurato venga a trovarsi in difficoltà a seguito del verificarsi di una malattia o di un evento fortuito. L'aiuto potrà consistere in prestazioni in denaro od in natura:

SERVIZIO DI TELECONSULTO TRAVEL CAREL’Assicurato in viaggio all’estero che incorra in infortunio o malattia, recandosi presso una delle strutture sanitarie dotate delle stazioni di telemedicina Net for Care (*), ha la possibilità di ricevere un teleconsulto medico specialistico “online” direttamente da primarie strutture sanitarie italiane e internazionali.

Net for Care è la piattaforma tecnologica che, attraverso le più innovative soluzioni telematiche, unisce in rete una serie di ospedali altamente specializzati in Italia e nel mondo con la Centrale Operativa dell’Impresa permettendo all’assicurato di accedere a servizi di consulenza medico-specialistica on line.

BAGAGLIOL’Impresa garantisce entro i massimali fino ad euro 500,00 in Italia:

- il bagaglio dell'Assicurato contro i rischi di incendio, furto, scippo, rapina nonché smarrimento ed avarie da parte del vettore.- entro i predetti massimali, ma comunque con il limite di euro 300,00 a persona, il rimborso delle spese per rifacimento/duplicazione del passaporto, della carta d'identità e della patente di guida di autoveicoli e/o patente nautica in conseguenza degli eventi sopradescritti;- entro i predetti massimali ma comunque con il limite di euro 300,00 a persona, il rimborso delle spese documentate per l'acquisto di indumenti di prima necessità, sostenute dall'Assicurato a seguito di furto totale del bagaglio o di consegna da parte del vettore dopo più di 12 ore dall'arrivo a destinazione dell'Assicurato stesso.

RIPETIZIONE VIAGGIOL’Impresa mette a disposizione dell'Assicurato e dei familiari che viaggiano con lui un importo pari al valore in pro - rata del soggiorno non usufruito dall'Assicurato a causa dei seguenti eventi:

a) Utilizzo delle prestazioni “Trasporto Sanitario Organizzato”, “Trasporto della salma” e “Rientro Anticipato” che determini il rientro alla residenza dell'Assicurato;

b) Ricovero Ospedaliero dell’Assicurato che causi l’interruzione del viaggio;

L'importo verrà messo a disposizione dell'Assicurato esclusivamente per l'acquisto di un viaggio organizzato dal Contraente. L'importo in pro - rata, non cedibile e non rimborsabile dovrà essere utilizzato entro 12 mesi dalla data di rientro.

TUTELA GIUDIZIARIAL’Impresa assume a proprio carico, nei limiti del massimale per Assicurato pari ad euro 2.500,00 ed alle condizioni previste nella presente polizza, l'onere delle spese giudiziali e stragiudiziali come di seguito indicate:a. le spese per l'intervento di un legaleb. le spese peritalic. le spese di giudizio nel processo penaled. le eventuali spese del legale di controparte, in caso di transazione autorizzata dall’Impresa, o quelle di soccombenza in caso di condanna dell'Assicurato esclusivamente per eventi non dolosi, avvenuti all'estero e verificatosi in relazione alla partecipazione dell'Assicurato al viaggio e/o soggiorno e più precisamente per:• danni subiti dall’Assicurato in conseguenza di fatti o atti illeciti di terzi;• formulazione di Denuncia – Querela quando vi segua costituzione di Parte Civile;• controversie per danni cagionati a terzi in conseguenza di fatti o atti dell’Assicurato o di Persone delle quali debba rispondere a norma di legge;• difesa penale per reato colposo o contravvenzionale per atti commessi o attribuiti;

ASSISTENZA AUTOLe seguenti prestazioni si intendono operanti durante il trasferimento dell’Assicurato per recarsi dalla propria residenza fino alla stazione di partenza del viaggio (ferroviaria, marittima, aeroportuale) o nella località prenotata e viceversa.

conclusione del contratto stesso ma prima della partenza e non accettata dal consumatore.Nei casi di cui sopra, il consumatore ha alternativamente diritto:- ad usufruire di un pacchetto turistico alternativo, senza supplemento di prezzo o con la restituzione dell’eccedenza di prezzo, qualora il secondo pacchetto turistico abbia valore inferiore al primo; - alla restituzione della sola parte di prezzo già corrisposta. Tale restituzione dovrà essere effettuata entro sette giorni lavorativi dal momento del ricevimento della richiesta di rimborso.Il consumatore dovrà dare comunicazione della propria decisione (di accettare la modifica o di recedere) entro e non oltre due giorni lavorativi dal momento in cui ha ricevuto l’avviso di aumento o di modifica. In difetto di espressa comunicazione entro il termine suddetto, la proposta formulata dall’organizzatore si intende accettata.Al consumatore che receda dal contratto prima della partenza al di fuori delle ipotesi elencate al primo comma, saranno addebitati – indipendentemente dal pagamento dell’acconto di cui all’art. 8 comma 1 – il costo individuale di gestione pratica, la quota di iscrizione, l’eventuale corrispettivo di coperture assicurative già richieste al momento della conclusione del contratto o per altri servizi già resi, nonché le penali nella misura meglio specificate nella scheda tecnica del catalogo o programma.

13. MODIFICHE PRIMA DELLA PARTENZA da parte del consumatoreLe modifiche richieste dal cliente a prenotazione già avvenuta ed accettata non obbligano l’organizzatore nei casi in cui non possano essere soddisfatte. In ogni caso qualsiasi richiesta di modifica deve essere effettuata dal consumatore per iscritto, anche a mezzo mail e comporta per il cliente un addebito fisso di almeno Euro 25 per persona, nel caso in cui vengano soddisfatte, a cui si aggiungono (per le sole modifiche sotto specificate) le seguenti percentuali della quota di partecipazione, calcolate in base a quanti giorni prima della partenza prevista è stata chiesta la modifica:a) nel caso di viaggio con aerei noleggiati (voli speciali ITC) o autopullman (a condizione che anche dopo la modifica il viaggio preveda un volo speciale ITC o un tour in autopullman) e nel caso di modifica della destinazione e/o della data di partenza (escluse partenze nello stesso weekend o in data precedente):- da 29 a 20 gg. - 10%- da 19 a 10 gg. - 20%- da 9 a 4 gg. - 40%- da 3 a 0 gg. - 70%b) per tutti gli altri tipi di viaggio in caso di modifica della destinazione e/o del complesso alberghiero e/o della data di partenza e/o per diminuzione della durata del soggiorno:- da 29 a 20 gg. - 20%- da 19 a 10 gg. - 30%- da 9 a 4 gg. - 50%- da 3 a 0 gg. - 80%Nota: la diminuzione del numero dei passeggeri all’interno di una pratica è da intendersi come annullamento parziale e quindi si applica la norma relativa al recesso (art. 10). In caso di più modifiche richieste contemporaneamente viene applicata solo la penale di più alto importo.

14. MODIFICHE DOPO LA PARTENZA L’organizzatore, qualora dopo la partenza si trovi nell’impossibilità di fornire per qualsiasi ragione, tranne che per un fatto proprio del consumatore, una parte essenziale dei servizi contemplati in contratto,

dovrà predisporre soluzioni alternative, senza supplementi di prezzo a carico del contraente e qualora le prestazioni fornite siano di valore inferiore rispetto a quelle previste, rimborsarlo in misura pari a tale differenza.Qualora non risulti possibile alcuna soluzione alternativa, ovvero la soluzione predisposta dall’organizzatore venga rifiutata dal consumatore per comprovati e giustificati motivi, l’organizzatore fornirà senza supplemento di prezzo, un mezzo di trasporto equivalente a quello originario previsto per il ritorno al luogo di partenza o al diverso luogo eventualmente pattuito, compatibilmente alle disponibilità di mezzi e posti, e lo rimborserà nella misura della differenza tra il costo delle prestazioni previste e quello delle prestazioni effettuate fino al momento del rientro anticipato.

15. SOSTITUZIONI Il consumatore rinunciatario può farsi sostituire da altra persona sempre che:a) l’organizzatore ne sia informato per iscritto almeno 4 giorni lavorativi prima della data fissata per la partenza, ricevendo contestualmente comunicazione circa le ragioni della sostituzione e le generalità del cessionario;b) il cessionario soddisfi tutte le condizioni per la fruizione del servizio (ex art. 89 Cod. Cons.) ed in particolare i requisiti relativi al passaporto, ai visti, ai certificati sanitari;c) i servizi medesimi o altri servizi in sostituzione possano essere erogati a seguito della sostituzione; d) il sostituto rimborsi all’organizzatore tutte le spese aggiuntive sostenute per procedere alla sostituzione, nella misura che gli verrà quantificata prima della cessione.Il cedente ed il cessionario sono solidalmente responsabili per il pagamento del saldo del prezzo nonché degli importi di cui alla lettera d) del presente articolo.In relazione ad lacune tipologie di servizi, più verificarsi che un terzo fornitore di servizi non accetti la modifica del nominativo del cessionari, anche se effettuata entro il termine di cui al precedente punto a). L’organizzatore non sarà responsabile dell’eventuale mancata accettazione della modifica da parte di terzi fornitori di servizi. Tale mancata accettazione sarà tempestivamente comunicata dall’organizzatore alle parti interessate prima della partenza.

16. OBBLIGHI DEI CONSUMATORI Nel corso delle trattative e comunque prima della conclusione del contratto, ai cittadini italiani sono fornite le informazioni all’interno del catalogo medesimo relative agli obblighi sanitari e alla documentazione necessaria per l’espatrio. I cittadini stranieri reperiranno le corrispondenti informazioni attraverso le loro rappresentanze diplomatiche presenti in Italia e/o i rispettivi canali informativi governativi ufficiali.In ogni caso i consumatori provvederanno, prima della partenza, a verificarne l’aggiornamento presso le competenti autorità (per i cittadini italiani le locali Questure ovvero il Ministero degli Affari Esteri tramite il sito www.viaggiaresicuri.it ovvero la Centrale Operativa Telefonica al numero 06.491115) adeguandovisi prima del viaggio. In assenza di tale verifica, nessuna responsabilità per la mancata partenza di uno o più consumatori potrà essere imputata al venditore o all’organizzatore. I consumatori dovranno informare il venditore e l’organizzatore della

propria cittadinanza e, al momento della partenza, dovranno accertarsi definitivamente di essere muniti dei certificati di vaccinazione, del passaporto individuale e di ogni altro documento valido per tutti i Paesi toccati dall’itinerario, nonché dei visti di soggiorno, di transito e dei certificati sanitari che fossero eventualmente richiesti. Il consumatore con l’acquisto del pacchetto dichiara di aver acquisito e valutato autonomamente le informazioni circa la situazione sanitaria e di sicurezza dei Paesi di destinazione e, dunque, l’utilizzabilità oggettiva dei servizi acquistati per i quali si assume integralmente il rischio di non utilizzabilità oggettiva o soggettiva in caso di accadimenti sociali, sanitari o di carattere naturale che si possano verificare tra la data di acquisto ed il periodo stabilito per il soggiorno.I consumatori dovranno inoltre attenersi all’osservanza della regole di normale prudenza e diligenza a quelle specifiche in vigore nei paesi destinazione del viaggio, a tutte le informazioni fornite loro dall’organizzatore, nonché ai regolamenti alle disposizioni amministrative o legislative relative al pacchetto turistico. I consumatori saranno chiamati a rispondere di tutti i danni che l’organizzatore e/o il venditore dovessero subire anche a causa del mancato rispetto degli obblighi sopra indicati.Il consumatore è tenuto a fornire all’organizzatore tutti i documenti, le informazioni e gli elementi in suo possesso utili per l’esercizio del diritto di surroga di quest’ultimo nei confronti dei terzi responsabili del danno ed è responsabile verso l’organizzatore del pregiudizio arrecato al diritto di surrogazione.Il consumatore comunicherà altresì per iscritto all’organizzatore, all’atto della prenotazione, le particolari richieste personali che potranno formare oggetto di accordi specifici sulle modalità del viaggio, sempre che ne risulti possibile l’attuazione.Il consumatore è sempre tenuto ad informare il Venditore e l’Organizzatore di eventuali sue esigenze o condizioni particolari (gravidanza, intolleranze alimentari, disabilità, ecc…) e a specificare esplicitamente la richiesta di relativi servizi personalizzati. Il consumatore dichiara e riconosce di assumersi la piena responsabilità circa l’operato della Agenzia Viaggi da lui stesso selezionata in relazione alle informazioni ricevute, alla consegna dei documenti nonché per il corretto e puntuale pagamento del corrispettivo dovuto all’organizzatore per i servizi turistici dallo stesso prenotati/acquistati. In caso di mancato pagamento del corrispettivo l’organizzatore avrà la facoltà di risolvere il contratto di viaggio di diritto mediante invio di semplice comunicazione scritta presso l’Agenzia di viaggi intermediaria.

17. CLASSIFICAZIONE ALBERGHIERA La classificazione ufficiale delle strutture alberghiere viene fornita in catalogo od in altro materiale informativo soltanto in base alle espresse e formali indicazioni delle competenti autorità del paese in cui il servizio è erogato. In assenza di classificazioni ufficiali riconosciute dalle competenti Pubbliche Autorità dei Paesi anche membri della UE cui il servizio si riferisce, l’organizzatore si riserva la facoltà di fornire in catalogo o nel depliant una propria descrizione della struttura ricettiva, tale da permettere una valutazione e conseguente accettazione della stessa da parte del consumatore.

18. REGIME DI RESPONSABILITÀ L’organizzatore risponde dei danni arrecati al consumatore a motivo dell’inadempimento totale o parziale delle prestazioni contrattualmente dovute, sia che le stesse vengano effettuate da lui personalmente che da terzi fornitori dei servizi, a meno che provi che l’evento è derivato da fatto del consumatore (ivi comprese iniziative autonomamente assunte da quest’ultimo nel corso dell’esecuzione dei servizi turistici) o da circostanze estranee alla fornitura delle prestazioni previste in contratto, da caso fortuito, da forza maggiore, ovvero da circostanze che lo stesso organizzatore non poteva, secondo la diligenza professionale, ragionevolmente prevedere o risolvere.Il venditore presso il quale sia stata effettuata la prenotazione del pacchetto turistico non risponde in alcun caso delle obbligazioni nascenti dall’organizzazione del viaggio, ma è responsabile esclusivamente delle obbligazioni nascenti dalla sua qualità di intermediario e comunque nei limiti previsti per tale responsabilità dalle norme vigenti in materia.

19. LIMITI DEL RISARCIMENTOIl risarcimento dovuto dall’organizzatore per danni alla persona non può essere in ogni caso superiore ai limiti indicati dagli artt. 94 e 95 del Codice del Consumo, né ai limiti previsti dalle convenzioni internazionali di cui siano parte l’Italia e l’Unione Europea in riferimento alle prestazioni il cui inadempimento ne ha determinato la responsabilità.

20. OBBLIGO DI ASSISTENZAL’organizzatore è tenuto a prestare le misure di assistenza al consumatore imposte dal criterio di diligenza professionale esclusivamente in riferimento agli obblighi a proprio carico per disposizione di legge o di contratto.L’organizzatore ed il venditore sono esonerati dalle rispettive responsabilità (artt. 16 e 17 delle presenti Condizioni Generali), quando la mancata od inesatta esecuzione del contratto è imputabile al consumatore o è dipesa dal fatto di un terzo a carattere imprevedibile o inevitabile, ovvero è stata causata da un caso fortuito o di forza maggiore.

21. RECLAMI E DENUNCE Ogni mancanza nell’esecuzione del contratto deve essere contestata dal consumatore senza ritardo, durante il soggiorno, affinché l’organizzatore, il suo rappresentante locale o l’accompagnatore possano verificare il merito di quanto asserito dal consumatore. Il consumatore dovrà altresì – a pena di decadenza - sporgere reclamo mediante l’invio di una raccomandata, con avviso di ricevimento, all’organizzatore, entro e non oltre dieci giorni lavorativi dalla data del rientro presso la località di partenza.

22. ASSICURAZIONE CONTRO LE SPESE DI ANNULLAMENTO E DI RIMPATRIO Se non espressamente comprese nel prezzo, è possibile, ed anzi consigliabile, stipulare al momento della prenotazione presso gli uffici dell’organizzatore o del venditore speciali polizze assicurative contro le spese derivanti dall’annullamento del pacchetto, infortuni e bagagli. Sarà altresì possibile stipulare un contratto di assistenza che copra le spese di rimpatrio in caso di incidenti e malattie.

23. FONDO DI GARANZIA Il Fondo Nazionale di Garanzia (art. 100 Cod. Cons.) è istituito a tutela dei consumatori che siano in possesso di contratto.

1. OGGETTO DEL CONTRATTO E CAMPO DI APPLICAZIONEMaraviglia è il marchio commerciale attraverso il quale GGF GROUP S.R.L. svolge attività di intermediazione di servizi turistici e attività di organizzazione e vendita di pacchetti turistici. Le presenti condizioni generali di vendita si applicano a tutti i prodotti proposti in catalogo, fatto salvo quanto eventualmente comunicato all’atto della richiesta di prenotazione. Con l’esecuzione della prenotazione il consumatore dichiara e riconosce di aver visionato, letto e ricevuto dall’Agenzia di Viaggi presso la quale ha eseguito la prenotazione una copia integrale delle Condizioni generali di Vendita in vigore all’atto della prenotazione.

2. FONTI LEGISLATIVE La vendita di pacchetti turistici, che abbiano ad oggetto servizi da fornire in territorio sia nazionale che estero, è disciplinata dalla L. 27/12/1977 n° 1084 di ratifica ed esecuzione della Convenzione Internazionale relativa al contratto di viaggio (CCV) firmata a Bruxelles il 23.4.1970 - in quanto applicabile - nonché dal Codice del Consumo di cui al D. Lgs n. 206 del 6 settembre 2005 (artt. 82-100) e sue successive modificazioni.

3. DEFINIZIONE DEI SOGGETTI DI COMPRAVENDITA DI PACCHETTI TURISTICIAi fini del presente contratto si intende per:a) organizzatore di viaggio, il soggetto che realizza la combinazione degli elementi di cui al seguente art. 4 e si obbliga in nome proprio e verso corrispettivo forfetario a procurare a terzi pacchetti turistici;b) venditore, il soggetto che vende, o si obbliga a procurare pacchetti turistici realizzati ai sensi del seguente art. 4 verso un corrispettivo forfetario;c) consumatore di pacchetti turistici, l’acquirente, il cessionario di un pacchetto turistico o qualunque persona anche da nominare, purché soddisfi tutte le condizioni richieste per la fruizione del servizio, per conto della quale il contraente principale si impegna ad acquistare senza remunerazione un pacchetto turistico.Ai sensi degli artt. 85 e 86 Cod. Cons., il consumatore ha diritto di ricevere copia del contratto di vendita di pacchetto turistico, sottoscritto e timbrato dall’organizzatore o venditore, che è anche documento per accedere eventualmente al Fondo di Garanzia di cui all’art. 20 delle presenti Condizioni Generali di Contratto.

4. NOZIONE DI PACCHETTO TURISTICO La nozione di pacchetto turistico è la seguente: “I pacchetti turistici hanno ad oggetto i viaggi, le vacanze ed i circuiti “tutto compreso”, risultanti dalla prefissata combinazione di almeno due degli elementi di seguito indicati, venduti od offerti in vendita ad un prezzo forfetario, e di durata superiore alle 24 ore ovvero estendentisi per un periodo di tempo comprendente almeno una notte:a) trasporto;b) alloggio;c) servizi turistici non accessori al trasporto o all’alloggio (omissis) ... che costituiscano parte significativa del “pacchetto turistico” (art. 84 Cod. Cons.).

5. INFORMAZIONI OBBLIGATORIE - SCHEDA TECNICAL’organizzatore ha l’obbligo di realizzare in catalogo o nel programma fuori catalogo una scheda tecnica. Gli elementi obbligatori da inserire nella scheda tecnica del catalogo o del

programma fuori catalogo sono: - estremi dell’autorizzazione amministrativa o, se applicabile, la D.I.A. dell’organizzatore - estremi della polizza assicurativa di responsabilità civile in conformità con quanto previsto dagli artt. 94 e 95 Cod. Cons- periodo di validità del catalogo o del programma fuori catalogo;- modalità e condizioni di sostituzione del viaggiatore e di cessione contratto, disciplinate in conformità con l’art. 89 Cod. Cons. (si veda art. 15 delle presenti condizioni);- parametri e criteri di adeguamento del prezzo del viaggio (Art. 90 Cod. Cons.).- i cambi di riferimento;- parametri e i criteri di adeguamento del prezzo del viaggio (art. 90 Cod. Cons.)L’organizzatore inoltre informerà i passeggeri circa l’identità del/i vettore/i effettivo/i nei tempi e con le modalità previste dall’art. 11 del Reg. CE 2111/2005.

6. VALIDITÀ DEL PROGRAMMA E DEL LISTINO PREZZII servizi turistici ed i pacchetti di viaggio descritti in questo catalogo hanno validità sino alla data sotto indicata alla voce VALIDITÀ DEL PROGRAMMA. I prezzi, gli sconti, le riduzioni e quant’altro relativo alla determinazione dei prezzi dei servizi turistici e dei pacchetti di viaggio restano validi sino alla data sotto indicata alla voce VALIDITÀ DEL LISTINO PREZZI. Eventuali sconti, offerte, promozioni su pacchetti viaggio, predisposte unilateralmente dall’organizzatore, avranno validità temporale limitata, debitamente indicata nel sito www.maravigliatravel.it. Per una versione aggiornata del catalogo e del listino prezzi consultare il sito www.maravigliatravel.it.

7. PRENOTAZIONI La domanda di prenotazione dovrà essere redatta su apposito modulo contrattuale, se del caso elettronico, compilato in ogni sua parte e sottoscritto dal cliente, che ne riceverà copia. L’accettazione delle prenotazioni si intende perfezionata, con conseguente conclusione del contratto, solo nel momento in cui l’organizzatore invierà relativa conferma scritta, anche a mezzo sistema telematico, al cliente presso l’agenzia di viaggi venditrice.Le indicazioni relative al pacchetto turistico non contenute nei documenti contrattuali, negli opuscoli ovvero in altri mezzi di comunicazione scritta, saranno fornite da Maraviglia Travellers’ Company in regolare adempimento degli obblighi previsti a proprio carico dall’art. 87, comma 2 Cod. Cons. prima dell’inizio del viaggio.

8. PAGAMENTI All’atto della prenotazione o della richiesta impegnativa dovrà essere versato, a titolo di acconto, fino ad un massimo del 25% del prezzo del pacchetto turistico. Il saldo dovrà essere versato almeno 20 giorni prima della prevista partenza, oppure in concomitanza con la prenotazione o all’atto della richiesta impegnativa, se questa venga effettuata nei 20 giorni antecedenti la partenza. Qualora siano previste differenti condizioni e tempistiche di pagamento, queste saranno specificatamente indicate nei singoli pacchetti dal catalogo, dall’opuscolo o da quanto altro. Il mancato pagamento delle somme di cui sopra alle date stabilite costituisce clausola risolutiva espressa tale da determinarne, da parte dell’agenzia intermediaria e/o dell’organizzatore

la risoluzione di diritto del contratto e la corresponsione da parte del consumatore di una penale pari al 100% del prezzo del pacchetto.

9. PREZZO I prezzi del pacchetti turistici pubblicati su questo catalogo sono espressi in Euro e sono determinati nel contratto, con riferimento a quanto indicato in catalogo o programma fuori catalogo (sino alla data di validità del listino prezzi) ed agli eventuali aggiornamenti degli stessi cataloghi o programmi fuori catalogo successivamente intervenuti. Esso potrà essere variato fino a 20 giorni precedenti la partenza e soltanto in conseguenza alle variazioni di: - costi di trasporto, incluso il costo del carburante; - diritti e tasse su alcune tipologie di servizi turistici quali imposte, tasse di atterraggio, di sbarco o di imbarco nei porti e negli aeroporti; - tassi di cambio applicati al pacchetto in questione.Per tali variazioni si farà riferimento al corso dei cambi ed ai costi di cui sopra in vigore alla data di pubblicazione del programma così come riportati nella scheda tecnica del catalogo o nei programmi fuori catalogo ovvero alla data riportata negli eventuali e successivi aggiornamenti.Le oscillazioni incideranno sul prezzo forfetario del pacchetto turistico nella percentuale massima dell’80%. Le quote non subiranno variazioni per oscillazioni di cambio al di sotto del 3%. Qualora l’oscillazione dovesse superare tale percentuale, l’adeguamento verrà applicato per intero.Il Tour Operator si riserva il diritto di applicare e chiedere al consumatore il pagamento delle spese amministrative di revisione/variazione pratica.Il prezzo di ogni servizio (hotel, transfert, escursione, ecc.) o pacchetto visualizzabile sul sito www.maravigliatravel.it o comunicato telefonicamente dal Call Center può essere soggetto a variazione nel tempo ed è valido esclusivamente per le date visualizzate / richieste; inoltre, esso è valido solo fino al perfezionamento della prenotazione. Le quote indicate si intendono confermate solo al momento in cui l’operazione di prenotazione viene portata a termine con l’assegnazione del numero di prenotazione da parte del sistema (per le prenotazioni effettuate sul sito) o da parte del Call Center (in caso di prenotazioni telefoniche). In caso di prenotazione effettuata dal sito, conferma e numero di prenotazione vengono assegnate dopo il pagamento con Carta di Credito. Le offerte speciali pubblicati sul sito sono sempre a posti limitati e soggette a verifica di disponibilità; non hanno valore retroattivo e pertanto non sono applicabili su prenotazioni concluse precedentemente alla data d’uscita delle stesse.L'Utente può verificare la disponibilità del Servizio di Viaggio scelto sul Sito ed il prezzo attuale prima di effettuare l'Acquisto. Tuttavia le tasse per i visti, tasse aeroportuali d'oltreoceano, e qualunque altra tassa o imposta non sono incluse nel prezzo del servizio offerto. Per ogni Acquisto, inoltre, verrà addebitata all'Utente un costo di gestione da parte dell'Intermediario.

10. DOCUMENTI DI VIAGGIO Una volta effettuato il pagamento, i documenti di viaggio, insieme a un programma dettagliato dell’itinerario acquistato, saranno consegnati al Cliente prima della partenza, tramite corriere oppure in formato elettronico. Nel caso di ritardi nei pagamenti o di

acquisti effettuati con breve anticipo, i documenti potranno essere consegnati solo tramite e-mail. Gli stessi documenti di viaggio, ad ogni modo, potranno essere scaricati anche direttamente dal sito www.maravigliatravle.it nell’area “I miei viaggi” mediante digitazione del proprio codice pratica/password. I documenti di viaggio contengono informazioni importanti per lo svolgimento del viaggio. Il Cliente pertanto è tenuto a leggere e a controllare con attenzione l'esattezza delle ivi informazioni riportate e a segnalare immediatamente al Call Center, al numero 800.65.00.65, eventuali discrepanze riscontrate tra quanto prenotato e quanto indicato nei documenti, così da rettificare possibili errori. Eventuali modifiche, apportate per motivi tecnici a quanto prenotato, saranno comunicate per iscritto prima della partenza e indicate sui documenti di viaggio.

11. MODIFICA O ANNULLAMENTO DEL PACCHETTO TURISTICO PRIMA DELLA PARTENZA da parte dell’organizzatorePrima della partenza l’organizzatore o il venditore che abbia necessità di modificare in modo significativo uno o più elementi del contratto, ne dà immediato avviso in forma scritta al consumatore, indicando il tipo di modifica e la variazione del prezzo che ne consegue. Qualsiasi modifica significativa da parte dell’organizzatore del pacchetto o di un suo elemento essenziale deve essere sottoposto ad accettazione del cliente ai sensi dell’art. 91 Cod. Cons, fatto salvo quando previsto e specificato nell’Addendum “escursioni e servizi”. Ove non accetti la proposta di modifica di cui al comma 1, il consumatore potrà esercitare alternativamente il diritto di riacquisire la somma già pagata o di godere dell’offerta di un pacchetto turistico sostitutivo ai sensi del 2° e 3° comma dell’art. 10.Il consumatore può esercitare i diritti sopra previsti anche quando l’annullamento dipenda dal mancato raggiungimento del numero minimo di partecipanti previsto nel Catalogo o nel Programma fuori catalogo, o da casi di forza maggiore e caso fortuito, relativi al pacchetto turistico acquistato.Per gli annullamenti diversi da quelli causati da forza maggiore, da caso fortuito e da mancato raggiungimento del numero minimo di partecipanti, nonché per quelli diversi dalla mancata accettazione da parte del consumatore del pacchetto turistico alternativo offerto, l’organizzatore che annulla, (Art. 33 lett. e Cod. Cons.) restituirà al consumatore il doppio di quanto dallo stesso pagato e incassato dall’organizzatore, tramite l’agente di viaggio.La somma oggetto della restituzione non sarà mai superiore al doppio degli importi di cui il consumatore sarebbe in pari data debitore secondo quanto previsto dall’art. 10, 4° comma qualora fosse egli ad annullare.

12. RECESSO DEL CONSUMATORE Ai sensi del D.lgs 206/05 artt. 82 e ss. il consumatore può recedere dal contratto, senza pagare penali, nelle seguenti ipotesi: - aumento del prezzo di cui al precedente art. 8 in misura eccedente il 10%;- modifica in modo significativo di uno o più elementi del contratto oggettivamente configurabili come fondamentali ai fini della fruizione del pacchetto turistico complessivamente considerato e proposta dall’organizzatore dopo la

L’organizzatore concorre ad alimentare tale Fondo nella misura stabilita dal comma 2 del citato art. 100 Cod. Cons. attraverso il pagamento del premio di assicurazione obbligatoria che è tenuto a stipulare, una quota del quale viene versata al Fondo con le modalità previste dall’art. 6 del DM 349/99.Il Fondo provvede alle seguenti esigenze in caso di insolvenza o di fallimento dichiarato del venditore o dell’organizzatore:a) rimborso del prezzo versato; b) rimpatrio nel caso di viaggi all’estero.Il fondo deve altresì fornire un’immediata disponibilità economica in caso di rientro forzato di turisti da Paesi extracomunitari in occasione di emergenze imputabili o meno al comportamento dell’organizzatore. Le modalità di intervento del Fondo sono stabilite col Decreto Ministeriale del 23/07/99, n. 349.

24. FORO COMPETENTE E CLAUSOLA COMPROMISSORIAIl Foro competente per qualsivoglia controversia nascente dall’applicazione delle seguenti condizioni generali di contratto o avente ad oggetto i pacchetti turistici sarà esclusivamente competente il Foro di Ancona.

25. INFORMATIVA AI SENSI DELLA LEGGE. COMUNICAZIONE OBBLIGATORIA AI SENSI DELL’ART.16 DELLA L. 269/98. La legge italiana punisce con la pena della reclusione i reati inerenti alla prostituzione ed alla pornografia minorile, anche se gli stessi sono commessi all’estero.

26. INFORMATIVA EX ART.13 D.LGS 196/03 (PROTEZIONE DATI PERSONALI). Il trattamento dei dati personali, il cui conferimento è necessario per la conclusione ed esecuzione del contratto, è svolto nel pieno rispetto del D.Lgs 196/03, in forma cartacea o digitale. I dati saranno comunicato ai soli fornitori dei servizi compresi nel pacchetto turistico. Il Consumatore potrà in ogni momento esercitare i diritti ex art.7 D.Lgs 196/03 contattando l’Organizzatore, titolare del trattamento.

ADDENDUM: ESCURSIONI E SERVIZI1. Escursioni e servizi non compresi nel prezzo del pacchetto turistico. Le escursioni, i servizi e le prestazioni acquistate dal Consumatore in loco e non comprese nel prezzo del pacchetto turistico, pur potendo essere illustrate e descritte in questo catalogo, sono estranee all’oggetto del relativo contratto stipulato dall’organizzatore. Pertanto nessuna responsabilità potrà essere ascritta all’organizzatore nell’eventualità che persone quali accompagnatori o corrispondenti locali provvedano per la prenotazione o vendita di tali escursioni.2. Escursioni e servizi inclusi nel prezzo del pacchetto turistico o prenotati unitamente al pacchetto turistico. Per le escursioni incluse nel prezzo del pacchetto (sia quelle inglobate a priori nel pacchetto, sia quelle aggiunte facoltative su richiesta del Consumatore) e la cui realizzazione è subordinata al raggiungimento di un numero minimo di partecipanti, sarà cura del booking Maraviglia comunicare la disponibilità del tour con congruo anticipo e comunque entro e non oltre 20 giorni

prima della partenza, salvo offerte speciali e salvo diversa specificazione all’interno del catalogo o all’atto della richiesta di prenotazione. In caso di mancato raggiungimento del numero minimo di partecipanti, il Cliente ha facoltà di recedere dal contratto o di pagare un supplemento esclusivity, che verrà indicato di volta in volta a seconda del tipo di attività, per la realizzazione congrua del tour anche con un numero inferiore di partecipanti. Per le escursioni che prevedono attività sostanziali da svolgere all’aperto (natura, avventura, mongolfiera, vela), in caso di impossibilità di realizzazione delle stesse nel giorno previsto causa maltempo, forza maggiore, caso fortuito o comunque un evento non prevedibile e pertanto non imputabile all’organizzatore, l’organizzazione Maraviglia, ove possibile, potrà decidere di rinviare l’escursione ad un altro giorno prima della partenza, comunicando tale variazione al cliente entro le 24 ore prima dell’ora prevista di ritrovo per l’escursione. In alternativa potrà offrire al cliente la possibilità di partecipare nello stesso giorno ad un' altra escursione comunque realizzabile in quanto non suscettibile alle suddette condizioni, senza con ciò dover pagare alcuna differenza di prezzo. Qualora nessuna delle soluzioni proposte sia ritenuta soddisfacente, il cliente sarà indennizzato mediante rimborso del prezzo pagato per l’escursione al netto delle spese operative, spese di gestione pratica e commissioni di agenzia.

SCHEDA TECNICAQuote di partecipazioneLe quote indicate in oppure fuori catalogo sono espresse in Euro e sono da intendersi per persona, ove non diversamente specificato. Le quote relative ai soggiorni sono relative all’occupazione in una camera doppia se in hotel. Per eventuale occupazione di camera singola verrà richiesto un supplemento, così come verrà applicata una riduzione, in percentuale/valore se indicato in catalogo, per sistemazione in terzo e quarto letto. L’età per la riduzione bambini è da intendersi non compiuta.Per il calcolo di eventuali variazioni di prezzo connesse alle oscillazioni dei tassi di cambio, i cambi di riferimento sono quelli rilevati dalla B.C.E/U.I.C. pubblicati su “IlSole 24ore” relativi al giorno 01/11/2010.PagamentiIl Consumatore è obbligato a corrispondere un acconto del 25% del prezzo del pacchetto turistico secondo quanto riportato agli artt. 8 e 9 delle Condizioni Generali di Vendita. Le prenotazioni vanno accompagnate anche dalla quota di iscrizione/gestione pratica, comprensiva di polizza assicurativa. Il saldo della quota del pacchetto prenotato deve essere versato almeno 20 giorni prima della partenza, salvo diverso specifico accordo e salvo eccezioni indicate nei singoli pacchetti. Modifica della prenotazione Qualsiasi variazione richiesta dal Consumatore successivamente alla conferma dei servizi facenti parte del pacchetto, comporta l’addebito al Consumatore di quanto specificato all’art. 11 delle Condizioni Generali.AnnullamentiAl Consumatore che receda dal contratto prima della partenza, fatta eccezione per i casi elencati al primo

comma dell’art. 8 delle Condizioni Generali e indipendentemente dal pagamento dell’acconto previsto all’art.5-1° comma, sempre delle Condizioni Generali, e tranne ove diversamente specificato all’interno del presente opuscolo e/o in fase di conferma dei servizi, sarà addebitata a titolo di penale la relativa percentuale della quota di partecipazione, in dipendenza del numero di giorni di calendario che mancano alla data di partenza del viaggio, oltre ad eventuali premi assicurativi:- 10% dal giorno successivo alla prenotazione fino a 30 giorni antepartenza- 30% da 29 a 20 giorni antepartenza- 50% da 19 a 10 giorni antepartenza- 75% da 9 a 4 giorni antepartenza- 100% da 3 al giorno della partenzaNel caso di gruppi precostituiti tali somme verranno concordate di volta in volta alla firma del contratto.Alcuni servizi potrebbero essere soggetti a differenti penali, le stesse saranno comunicate all’atto della prenotazione.Le medesime somme dovranno essere corrisposte da chi non potesse effettuare il viaggio per mancanza o irregolarità dei previsti documenti personali di espatrio. Le medesime penali di cui sopra si applicheranno al Consumatore che dovesse essere impossibilitato a viaggiare, quand’anche per causa a lui non imputabile. In alternativa il Consumatore potrà richiedere la sostituzione di un altro viaggiatore alle condizioni previste dalla clausola 13 delle Condizioni Generali.Le stesse somme dovranno essere corrisposte da chi non potesse effettuare il viaggio per mancanza o irregolarità dei previsti documenti personali per l’espatrio. Nel caso di gruppi precostituiti, tali somme potranno essere concordate di volta in volta alla firma del contratto. Alcuni servizi potrebbero essere soggetti a penali differenti e le stesse saranno comunicate prima della prenotazione.TrasportiIl Consumatore è trasportato esclusivamente ai Patti e Condizioni del Vettore, a disposizione presso gli uffici dell’organizzatore o sui siti internet dei vettori a cui si rimanda. A tal proposito si precisa che il nome del Vettore sarà specificato nel contratto di vendita del pacchetto turistico, per i pacchetti che prevedono anche il trasporto. Il Consumatore, acquistando il pacchetto turistico, accetta ipso facto tali Patti e Condizioni.Congressi ed eventi specialiNei periodi in cui si svolgono congressi od eventi speciali le tariffe alberghiere riportate in catalogo potrebbero non essere applicabili.Documenti per l’espatrioInformazioni sui documenti di espatrio ed eventuali visti/vaccinazioni sono riportati alle pagine di informazioni utili delle varie destinazioni del presente catalogo, secondo la normativa vigente.Si precisa che tutte le informazioni relative ai documenti di espatrio sono da considerarsi indicative, data la variabilità della normativa in materia. Tali informazioni si riferiscono ai cittadini italiani, maggiorenni. Per i Paesi aderenti all’accordo di Schengen, di regola non sono previsti controlli dei documenti. Tuttavia è indispensabile avere sempre con sé lacarta di identità valida per l’espatrio o il passaporto (non sono validi altri
