APPLICANT'S JUSTIFICATION

6.8 Visual Privacy Requirements

The front window of bedroom 5 on the upper floor facing east shows a setback of 3.65 m in lieu of 4.5 metres at 45 degrees.

The variation should be considered minor as the area over looked contains no active habitable spaces, no major openings and as such will have a minimal impact on the adjoining property. The area over looked can be clearly seen from the street.

Street Tree

The subject site has two street trees, the more substantial one being on the southern side of the verge. It is impractical to have the driveway in the centre of the site between the two verge trees and we seek to remove the verge tree to the northern side of the verge and replace it on the other side of the proposed driveway.

We have already sought and received advice from the Town and attach a copy of the correspondence for your reference.

Conclusion

The client has chosen this design to maximize their use and function of the property. The designer has been instructed to create a modestly sized home which has been thoughtfully designed by achieving the most out of the site and maintaining the external amenity of the dwelling. Applying the Design Principles against the proposal, in consult with the R-Codes and its explanatory guidelines, demonstrates that this design proposal has been able to suitably address the relevant criteria. Accordingly, the above justification is submitted for the Towns approval.

NEIGHBOUR COMMENT

Objection 1

I would object to the side set back [car garage] being on the perimeter of the north side as the bedrooms of my house are along the south side the thought of the noise/headlights of cars coming and going and garage doors opening and shutting let alone if they use garage as a workshop etc. alongside bedrooms is far from ideal.

Visual privacy setback should be 4.5 meters they have applied to be 2.12 meters again with the 4 bedrooms all having windows facing south. It will be a complete invasion of privacy as we constantly have the curtains open to let the natural light in as well bedroom 2 is used as an office as well as a bedroom and we wouldn’t like people being able to look in while working at the desk.

Objection 2

1. Side setback (south): The minimum required setback of the proposed feature nib wallshould be 1.1m in line with residential design codes. Proposed plans would reducethe separation between our properties, reducing privacy, restricting natural light andcreating congestion.

2. Upper floor side setback (south): The minimum required setback for the proposedbedroom 3, bathroom and bedroom 4 wall should be 1.8m in line with residentialdesign codes. Rationale as detailed in (1) above.

3. Wall height: the maximum permissible height to the top of eaves, measured verticallyabove the ‘natural level’ immediately below the relevant point on the wall should be6.0m in line with residential design codes. Permitting additional vertical height ofproperty (above 6.0m) would restrict natural light to adjacent properties.

4. Retaining walls and filling of land: the maximum permissible height of a retaining wallwithin 3.0m of the front boundary should be 0.5m in line with residential designcodes. Proposed plans would result in additional height above grade, furtherrestricting natural light to our property.

We have no issue with the minimal exceedance of visual privacy setback from bedroom 4 (of 4.14m).
