DESIGN GUIDELINES CHANGES AND UPDATES

ARTICLE I GENERAL INFORMATION: Removed Tortolita approval verbiage; Tortolita Golf Club has approved our Design Guidelines as being in compliance with the Tortolita Golf Club Association. ARTICLE I GENERAL INFORMATION: Added variance verbiage in the last two paragraphs. DEL WEBB AT DOVE MOUNTAIN HOA STATEMENT

The Architectural Review Committee has been founded in accordance with Del Webb at Dove Mountain Homeowners Association CC&Rs, Article XI, Section 11.2, Architectural Review Committee. The following standards and rules of the Covenants, Conditions and Restrictions for Del Webb at Dove Mountain Homeowners Association (CC&Rs) regulates application by review, approval and inspection of modifications and additions to existing improvements on any lot. In the following text, the single word “Committee” means the Architectural Review Committee of Del Webb at Dove Mountain Homeowners Association, or a designated agent of the Architectural Review Committee (ARC). The single word “work” means any modification of or addition to the existing improvements on any lot within the subdivision. The single word “owner” means owner(s) of record of the lot on which the work is to be performed. ARTICLE I – GENERAL INFORMATION

Del Webb at Dove Mountain is one of the most attractive adult communities in Arizona. In the interest of maintaining the harmonious theme and aesthetic beauty of the community consistent with its surrounding native desert environment, the Del Webb at Dove Mountain Board of Directors (Board) and the Architectural Review Committee (ARC) have a responsibility to administer the Design Guidelines (Guidelines). The Guidelines are intended to protect the community and its values. The ARC Design Guidelines for Del Webb at Dove Mountain are constantly under review by the ARC members and may be updated from time to time. It is the responsibility of the homeowner to confirm that they are working with the most recent Guidelines. Homeowners may contact Del Webb at Dove Mountain Homeowners Association Office (HOA) or go to the HOA website and print the most current version. Nothing contained herein shall be construed as altering, amending or changing the Declaration of Covenants, Conditions and Restrictions (CC&Rs) as recorded in the County of Pima or the Articles of Incorporation and Bylaws of Del Webb at Dove Mountain Homeowners Association. In the event of a conflict, the following shall be the order of priority, CC&R’s, Articles, Bylaws and the ARC Design Guidelines. To the extent that any Government Ordinance, Building Code or Regulation requires a more restrictive standard than in these Guidelines or in the CC&R’s, the government standards shall prevail. All external modifications to home or landscape require ARC approval, prior to the modifications being made, with exception of those modifications on the Improvements/ Maintenance Processes List (Appendix A). Approval by the ARC of any construction, Installation, addition, modification or other work pursuant to these Guidelines, shall not be deemed a waiver of the ARC’s right to withhold approval of any similar construction, installation, addition, modification or other work subsequently submitted for approval. There may be special or unusual cases in which a homeowner, while in compliance with the Guidelines, might be denied approval by the ARC. Such cases could concern landscaping, alterations, construction or other modifications which cannot be anticipated or defined by this document. All cases of such a nature would be unique and judged on individual, particular circumstances. A homeowner may appeal a decision made by the ARC. Appeals shall be in writing and addressed initially to the ARC. In the event that the ARC does not change its position and the ARC decision is still disputed,

the homeowner may next appeal the decision in writing to the Board. Appeals to the ARC or the Board, must be made within fifteen (15) days of the application denial (per CC&Rs Section 11.2 (c)). Such appeal shall be heard at the next regularly scheduled meeting of the Board or at a special meeting called for such purpose. It is the responsibility of the homeowner to obtain permits as required by the Town of Marana and/or Pima County. No work shall commence prior to receiving approval from the ARC or before the closing date on the home. These Guidelines, and any updates as approved by the Board, supersede any prior Guidelines. It is the responsibility of the homeowner to make certain they have the most recent copy of the Guidelines. Any uncertainty about this should be verified with the HOA. Original and successive homeowners shall be responsible for maintaining all landscaping and construction records, as well as permits. Homeowners cannot expect views, which exist at the time of purchase, to remain unchanged over time. Property may eventually be improved upon and landscaping, both on residential lots and in common areas, will mature. Tree location, number and species are key considerations in the ARC landscape plan approval process. The use of trees within Del Webb at Dove Mountain is encouraged. The ARC or Del Webb at Dove Mountain HOA shall not be under a duty to homeowners to protect views or view expectations. Homeowners are responsible to abide by all property line and setback restrictions. Homeowners are responsible for seeing that plant materials, trees, exterior additions to, or modifications of their property, do not adversely affect or compromise their neighbors, the common areas or the community. The ARC and HOA shall not ensure that homeowners’ views will be protected. As stated above, trees and plant materials are essential to the landscaping of Del Webb at Dove Mountain, both on individual lots and in common areas. If a homeowner desires that dead plant material or a dead tree in the common area be pruned or removed, such requests shall be subject to the prevailing policy on tree pruning or removal in the CC&Rs and current ARC policies. The Design Guidelines are intended to provide a framework for improvements but they are not all-inclusive. In its review process, the ARC may consider the quality of workmanship and design, harmony of externa; design with existing structures, and location in relation to surrounding structures, topography, and finish grade elevation, among other things. ARC decisions may be based on purely aesthetic considerations. However, the ARC shall not grant approval for proposed construction that is inconsistent with the Design Guidelines unless a variance is granted. The ARC may grant variances when circumstances such as, without limitation. Topography, natural obstructions, hardship or environmental considerations require. The ARC may grand a variance so long as the variance does not result in a material violation of the Declaration and is compatible with existing and anticipated uses of the adjoining properties. No variance shall be effective unless in writing signed by a majority of the ARC members. ARTICLE II – PERMITS AND APPROVALS

It is the homeowner’s responsibility to obtain all required Town of Marana and/or Pima County permits prior to making any exterior alterations or installing any landscaping as covered in

these Guidelines. Permits must be available to both the HOA and the ARC upon request. For further information, please contact the Pima County Development Services in Tucson or Planning & Zoning in the Town of Marana. NOTE: Pima County currently requires a permit for exterior 110 volt electrical installations, natural gas lines buried in the ground, swimming pools, some spa installations, some utility modifications, exterior construction alterations and additions. NO EXTERIOR ALTERATION, ADDITION, OR RENOVATION TO ANY DWELLING UNIT OR COMMON AREA, NO MODIFICATIONS TO PORCHES, PATIOS, LANDSCAPING, WALLS OR FENCES WILL BE ALLOWED ON ANY LOT, WITHOUT APPLICATION TO, AND WRITTEN APPROVAL BY, THE ARC. The ARC requires that a homeowner apply for an ARC approval, (Appendix D) prior to landscaping, alterations to existing landscaping, or any exterior modification. Approval application forms are available from the HOA or may be downloaded from its web site. Application forms must be completed in full, signed by the homeowner and presented for review with all appropriate supporting documentation. ARC application review meetings will be held monthly. The ARC will review the submitted application and, if necessary, call the homeowner or visit the proposed site. Any changes or additions to an approved application require re-submitting the modifications to the ARC for approval. No exterior construction, alteration, addition, or renovation to any structure or improvements on a Lot; no modifications to patios, and no landscaping, hardscape, walls or fences will be allowed on any Lot, without application to, and written approval by, the Architectural Committee. Each Owner is responsible for removing or otherwise curing, at its expense, non-complying and/or unapproved improvements. Any exterior modification made to a Del Webb at Dove Mountain property without prior written approval by the Committee will be subject to a $500.00 fine and possible forced removal of the installation. If the unapproved modification is not approved or removed within thirty days of the date of violation, additional fines of $500.00 per month will be assessed until the modification is either approved or removed. A member of the management team will inspect the job site to be certain all hardscape was completed in accordance with the approved application as submitted by the homeowner and approved by the ARC. NON-COMPLIANCE If a homeowner receives a non-compliance letter from the ARC, the homeowner will be given fifteen (15) days in which to comply. If the homeowner has not complied within this fifteen (15) day period, the homeowner will incur a fine. Homeowner will be given an additional fifteen (15) days in which to comply. If the homeowner is still not in compliance after the additional fifteen (15) days, the non-compliant issue will be referred to the Board. VERIFICATION PROCESS The ARC will review each submittal and respond within 60 days after receipt of the subject submittal, by written letter indicating the Committee’s decision, in one of the following three forms:

Approved – The entire project is approved as submitted in total.

Approved with Stipulations – The project is partially approved. An Owner may proceed with the work to be performed; however, the Owner must comply with any and all notations on the submittal. The response will set forth the reasons for disapproval of items and suggestions for bringing disapproved items into conformity with the Declaration and these Design Guidelines.

Not Approved – The entire project is not approved and no work may commence. The response will set forth the reasons for disapproval of items and suggestions for bringing disapproved items into conformity with the Declaration and these Design Guidelines.

Tabled – The Committee requires collecting additional information before a decision can be determined. After the additional information is complied, the Committee will review the submittal again at the next scheduled Architectural Review Committee meeting.

The Owner is ultimately responsible for Design Guidelines compliance. If a non-compliance issue is not seen and/or recognized and inadvertently approved on the plans submitted to the ARC for approval, the homeowner maintains complete responsibility for correcting the non-compliance issue and bringing it into compliance. In the event the ARC fails to respond by the Response Date, the project will be deemed 'not approved', except as to those submittal and requirements which are otherwise imposed by or required under these Design Guidelines. The ARC may, but will not be required to, discuss a submittal with the submitting Owner at a regularly scheduled meeting of the ARC, in order to request and/or receive additional information or clarification regarding a submittal. However, Owners have no right to attend a hearing respecting a submittal, and ARC decisions may be based solely on the information contained in the submittal. The approval of the ARC may contain a deadline (typically ninety (90) days) for commencement and/or completion of work from date which plans have been approved. If no deadline is specified in the approval, the deadline for completion of the approved shall be deemed to be 90 days. If construction is not timely commenced and/or completed, the Committee's approval will be deemed withdrawn and such incomplete construction will be deemed to be in violation of these Design Guidelines (subject to the authorization and veto rights of the Declarant). In accordance with Section 11.2 (e) of the Declaration the ARC may establish and change reasonable fees for review of applications hereunder and may require such fees to be paid in full prior to review of any application. Any fees incurred by an architect, engineer or any other third party professional consultant for review of an Owner’s architectural submittal will be charged to that Owner. If the plans submitted by an Owner require a building permit, the approval by the ARC is not a guarantee that such plans will be approved by the Town of Marana. If the Town of Marana requires modification to such plans, such modifications must also be approved by the ARC for the Owner to remain in compliance with these Design Guidelines. Rubbish, debris or materials from homeowner landscaping or construction projects may not be stored or left on any lot. The Community Manager has the authority to have the rubbish, debris or materials removed and to invoice the homeowner for the removal. Damage to any property by a contractor retained by the homeowner is the responsibility of the homeowner who retained that contractor.

Failure to clean up the property upon completion of the work will incur immediate penalties plus the cost of clean-up, payable to the HOA. After fifteen (15) days, any fine still delinquent will be referred to the Management Team and ultimately to the Board. ARTICLE III – CONTRACTOR SELECTION

For their own protection, homeowners should exercise due diligence in selecting a contractor for all landscaping and construction needs. Selecting a contractor is the responsibility of each homeowner. The Board and the ARC do not have authority over any contractor conducting business in Del Webb at Dove Mountain and is not involved in the licensing of contractors. The ARC works directly with the homeowner and not with the contractor. Contractors doing work in Del Webb at Dove Mountain must conform to the ARC Design Guidelines. Prior to selecting a contractor, homeowners are urged to check the licensing status and record of complaints against specific contractors by contacting the Arizona Registrar of Contractors office in Phoenix, or at their website at www.Azroc.gov. The ARC and the Board will not intervene on behalf of the homeowner if a problem arises between homeowner and contractor. ARTICLE IV – ARCHITECTURAL LANDSCAPE STANDARDS & REQUIREMENTS

The design, style, detailing, materials and color of any addition or exterior renovation shall conform to that of the original house. Town of Marana and/or Pima County Permits may be required for most additions and modifications. All additions to the original home shall be built within the setback and building envelope lines originally established for Del Webb at Dove Mountain, regardless of more lenient requirement of any local governmental authority. These setbacks are shown on the original plot plan provided by the developer at the time of purchase. The height of any addition to an existing home shall not exceed that of the original roof or parapet line. All materials used in additions, alterations and landscaping, shall conform to those in the ARC Design Guidelines. The ARC may allow substitute materials that are considered compatible with the theme of the community. Substitutions are approved at the discretion of the ARC. When any building additions, alterations or renovations are made to an existing home, the lot drainage to the street, as established by the developer, shall be maintained. All roof or gutter installations shall drain to the ground solely within the deeded lot line. Common walls do not exceed a height of seventy-two (72) inches. The height of walls are measured from the original final finished grade elevation by developer, on the highest grade side of the inside wall. The maximum height of all common walls follow any grade change along the wall so that no more than seventy-two (72) inches is visible at any one point along the wall. All proposed walls require a Town of Marana permit. Due to the complexities involved in building retaining walls, a detailed, separate drawing must be furnished to the ARC showing site location of the wall, detailed sections of the slope and wall for each condition, material, construction detail, drainage, etc. All drawings are to be fully dimensioned. Some walls may require structural engineering and the ARC may require a sealed drawing to show the completed engineering.

LANDSCAPING The use of native and/or drought-tolerant desert adapted species is strongly recommended for all landscaping. High water consuming plants should be confined to small areas as recommended in Xeriscape landscape planning. For plant materials and trees that are prohibited in Del Webb at Dove Mountain, see Prohibitive Plant Materials & Tree List (Appendix B). For plant materials and trees that are approved at Del Webb at Dove Mountain, see Approved Plant Materials & Tree List (See Appendix C). Compatible community groupings should be taken into consideration to allow for appropriate irrigation system planning. Underground irrigation is required. Protection for young/new plant materials may be provided with hardware gauge cloth, 1/8” to 1” square galvanized or green metal. ARC approval is required for all “cage” protection in the front yard. This “cage” should be secured in the soil with either two or more pieces of rebar, the same color as the hardware cloth, or with long staples driven into the ground. The cage should be no higher than 36”. The cage is permitted around the plant material for a maximum of two years. Sufficient landscape materials shall be used to maintain harmony with surrounding areas. The minimum requirement for plant materials in front yards is detailed in Minimal Landscaping (Appendix E) as approved by the ARC. The ARC, at its discretion, may require additional plantings or grant variances to the number of living plant materials predicated on the size and shape of lot. The ARC reserves the right to limit planting and will require tree or plant removal if the ARC, in its collective judgment, determines that the landscape contains too many plants and/or trees. Homeowners, in residence or not, are required by the CC&Rs to keep lots free from rubbish, litter and noxious weeds. Weed growth or other nuisance plant materials shall be controlled with herbicides and/or manual weeding and removal of dead material. After notice has been given for violation of weeds or rubbish, the HOA has the ability to provide for such maintenance and charge the expense to the negligent homeowner as a reimbursement expense (per CC&Rs Section 5.2). Plastic sheeting may not be placed under crushed rock for weed control. In planning landscaping and construction, consideration must be given to allow access for the maintenance of areas that have TV cable, electrical boxes, water meters, etc. Plants will not be allowed, that will hinder utility maintenance personnel or meter readers. Utility companies may remove plants that hinder their access, and the replacement will be the responsibility of the homeowner. No landscaping or construction materials owned or contracted for by the homeowner may be left on any Del Webb at Dove Mountain street for more than 48 hours. All materials encroaching on any street in Del Webb at Dove Mountain must be placed on a heavy duty drop cloth or tarp. Additionally, BMP socks must be used in compliance with HOA policy. (See Appendix F) The area must be clearly marked with orange traffic cones. Any materials stored on the street must provide 20 feet of street clearance for emergency vehicles. Small concrete mixers and/or wet saws temporarily placed on any street or roadway must be placed on heavy duty drop cloth without exception. See Article VII – Specific Guidelines &

Requirements – Environmental Materials Management. CONTRACTOR PARKING AND EQUIPMENT Contractor vehicles, tractors or equipment are prohibited from parking overnight on any HOA street. Equipment must be placed on homeowner’s property. Portable toilets must be placed on homeowner’s property. Care must be used when landscaping along roads or corners, to avoid creating visual obstructions that may compromise the safety of pedestrians, bicyclists or other vehicles. ARTICLE V – LANDSCAPING GUIDELINES GRADING & DRAINAGE Original grading and drainage as established by the original developer shall not be altered. All roof or gutter installations shall drain to the ground solely within the deeded lot line. Lots have been designed and graded to provide positive drainage from the Lot and to protect environmental resources. The Architectural Review Committee's approval of any plan shall not be deemed to constitute an assurance that the grading or drainage change is properly engineered to avoid any undesirable impact. IRRIGATION All landscaped areas shall be provided with an underground, automatic, time irrigation system. Drip irrigation is recommended for trees, shrubs, ground covers and large pots, to conserve water. Bubblers are discouraged. Spray or subterranean systems shall be used for turf areas. All irrigation shall be installed and working prior to plant material installation. Irrigation shall be automatic and of sufficient size and capacity to irrigate all plant materials. All systems shall have a backflow prevention device to prevent non-potable water from entering the potable water system. Systems shall be designed to minimize run off and loss of water. Use of tension meters and rain guards are encouraged to prevent the unnecessary watering of the landscape during rainstorms. Exposed sprinkler heads are prohibited. Where spray heads are used, they shall be pop-up type. Turf irrigation systems shall be designed for the scale of the yard. Spray heads shall have a maximum fifteen (15) feet radius throw, unless otherwise approved by the ARC. Overspray shall not be permitted off property. No irrigation shall occur within the area that is four (4) feet from the Dwelling Unit. IRRIGATION MAINTENANCE Irrigation systems are to be kept in proper working condition to avoid unnecessary loss of water. The irrigation system shall be designed and checked regularly to ensure that water from emitters or spray heads are not spraying onto walks, spraying off the homeowner’s property causing excessive water loss, staining or irrigating areas not designated to receive water. Homeowners shall be responsible for adjusting, repairing and cleaning such systems on a regular basis. LANDSCAPE BOULDERS Boulders shall be placed so as to appear most natural looking. Boulders shall be desert colors, consistent with the surrounding native desert environment. Boulders shall be sunk a

minimum of one-third (1/3) below grade. LANDSCAPE MAINTENANCE The homeowner shall insure that all plantings are maintained in a healthy, growing condition. Fertilizer, cultivation and pruning shall be carried out on a regular basis. Dead or dying plants shall be removed and replaced promptly with one of the approved plants. ARC approval is not necessary, if replaced with the same type and variety of plant from the Approved Plant Materials & Tree List (Appendix C). LANDSCAPE SETBACKS & PLANT/TREE ENCROACHMENT No plants or vegetation shall be planted within twenty-four (24) inches of any exterior building wall. No trees shall be planted within forty-eight (48) inches of any exterior building wall. No tree, shrub or planting of any kind on any Lot, Parcel or other property shall be allowed to overhang or otherwise to encroach upon any sidewalk, street, bicycle path or pedestrian way from ground level to a height of eight feet (8’) and may not obstruct any street signs. Produce bearing plants and trees shall be contained in the back and side yard only. Flowering annuals, in the front yard, must be in containers or pots. An irrigation drip system is recommended for all containers and pots. Planted pots in the front yard must be free-standing and cannot be buried. LANDSCAPING REQUIREMENTS AND GUIDELINES Rear yards Visible from Neighboring Property must install basic minimum landscape within ninety (90) days from close of escrow. All other lots must install basic minimum landscape within one hundred twenty (120) days. Each Owner will submit rear yard landscaping plans for review by the ARC within thirty (30) days after the close of escrow. All residential plantings must come from the approved plant palette for Del Webb at Dove Mountain. A list of the pre-approved plantings is set forth in Appendix C. MINIMAL LANDSCAPING Plant/tree materials, viewable by the public in front yards, shall be installed at the following minimum sizes and quantities. The plants/trees must be selected from Appendix C, which lists the approved trees, shrubs, plants and ground covers:

Two Native or Desert Adapted Tree from Appendix C, minimum fifteen-gallon size or larger (Required Front Lot Tree) Eight Five Gallon Plants “N” (natural) or “T” (transitional) Five One Gallon Plants/Ground Cover “N” (natural) or “T” (transitional) One Automatic Irrigation System For definition of “N’ and “T” see Appendix C

Ground cover rock to be installed in front and front side with a minimum size of one-half (1/2) inch Apache Brown. Larger rock can be used in drainage areas such as rip rap/river run in Santa Fe Brown.

Approval Required for Front Lot Tree Removal An application is necessary prior to removing the required native or desert adapted front lot tree. Tree must be replaced within sixty (60) days of written notice unless otherwise stated by the ARC. An application for an alternative to the required native or desert adapted tree may be

considered by the ARC. An alternative plant species from the cactus family with a height of at least sixty (60) inches from ground level when planted will be the alternative. (Examples: Saguaros or multi stemmed organ pipe cactus are acceptable. Mexican fence post cactus or ocotillos are not acceptable as an alternative.) The ARC shall review photos or descriptions before approval of an application. Ground cover rock installed in front and front side with a minimum size of one-half (1/2) inch Apache Brown color. Larger rock may be used in drainage areas in Santa Fe Brown. GRANITE AREAS All ground not covered by plantings, including rear side and rear yards, shall be covered with inert material, which includes crushed desert-tone native colored rock, or decomposed granite (1/2” to 1”). Native river rock, cobble, and boulders may be used for accent purposes. White and black lava rock, white boulders, white rip rap, artificially colored rock, or crushed man-made materials are prohibited. Road base and foundation materials are also prohibited. Mounds, in front and rear yards, shall not exceed eighteen (18) inches in height from original final finished grade level by developer. Mounds shall be constructed of natural materials and should not be constructed to drain onto neighboring property. TURF AREAS Turf areas are prohibited in front areas viewable by the public. Artificial grass used for decorative purposes and/or a putting green is permitted in rear or side yards only. While natural grass or sod is not recommended due to the high water usage, the ARC will consider the use of low-pollen producing, non-allergenic types of grasses in small areas, in rear yards only. Spray or subterranean watering systems shall be used for turf areas. All living sod and turf must maintain a three (3) foot setback from any lot line, and must be bordered by a permanent border such as, extruded concrete curbing, brick border, or other material approved by the Architectural Review Committee. WEED CONTROL Weed control including removal of dead material is the responsibility of the homeowner. To help prevent weed growth, it is recommended that non-turf areas be treated with a pre-emergent prior to and after placing landscape topping. Application of a pre-emergent is recommended on an on-going basis. Use of fabric or plastic lining is prohibited. ARTICLE VI – SPECIFIC GUIDELINES & REQUIREMENTS

AIR CONDITIONING/EVAPORATIVE COOLERS Air conditioning units shall be ground mounted on a concrete base or a thick resin/plastic base specifically designed for this purpose. Evaporative coolers, installed by the homeowner, shall also be ground mounted on a concrete base. The top of the unit shall be no higher than forty-eight (48) inches above original developer grade. It is recommended that air conditioning units be screened by plantings or concrete block walls, stuccoed and painted to match color of house, so that they are not visible from the street, golf course, common areas or neighboring properties.

Portable window-type units are prohibited for use in any structure, including installation in a window, through a wall, or mounted on the ground.

ANTENNAS, OVER-THE-AIR RECEPTION DEVICES Pursuant to FCC Regulations, the ARC does not require approval for the installation of satellite dish or over-the-air reception devices (wireless internet broadband antennas). Over-the-Air Reception Devices (OTARD) are defined by the FCC as any device used for the reception of video or audio television broadcast signals, Direct Broadcast Satellite Services (BS), or Multi-Channel Multi-Point Distribution Services (MDS), and reception or transmission of fixed wireless communications signals. Any mast, cabling, supports, guy wires, conduits, wiring, fasteners or other accessories for the proper installation, maintenance and use of an antenna, shall be considered part of the antenna. The FCC requires that subscriber antennas must be labeled to give notice of potential radio frequency safety hazards of these antennas. For two-way fixed Wireless Internet Broadband antennas mounted on a mast, the ARC requires subscriber equipment installation be performed by professional personnel. Homeowners are cautioned to make sure that antennas attached to a mast are properly grounded. Homeowners should investigate the possible dangers of lightning strikes inherent to this area and are encouraged to check with their insurance agents to verify coverage of lightning strikes to antennas mounted on masts. Devices shall not exceed one (1) meter (39.4 inches) in diameter or less, and shall be installed solely on the homeowner’s property, not encroaching on adjacent common areas or another homeowner’s property. Satellite dishes or other devices shall be installed in the most unobtrusive manner. The ARC recommends the satellite dish or device be placed as close to the rear of the house as possible, preferably ground mounted. If the satellite dish or device is mounted on the house, the brackets and cables must be painted color of house. Present and future aesthetic value of the community must be considered when installing the satellite dish. Homeowners are responsible for the maintenance and repair of antennas. Antennas must not be allowed to fall into disrepair or become safety hazards. ART/ARTIFACTS, YARD ART, STATUES Any item not on approved plant list is considered “yard art” or “decorative pieces” and must conform to the following:

1. Must be located on the front courtyard patio, inside an enclosed courtyard patio, front house wall or on back patio.

2. Cannot exceed a maximum of three (3) feet tall and a maximum of three (3) feet wide for front courtyard patio, inside an enclosed courtyard patio or the front house wall.

3. Cannot exceed a maximum of four (4) feet tall on back patio. 4. Cannot exceed a maximum of three (3) such pieces in one location of, either on the

front courtyard patio, inside an enclosed courtyard patio, front house wall or on back patio.

5. Such ornamentation must be of a muted, flat or matte finish. Neither primary colors nor whites are allowed. Metallic designs or sculptures (such as burnished or flame-treated copper “suns”, Kokopellis, lizards, or pre-rusted designs) are allowed in Front Yards as long as they are generally muted, not polished, and do not create glare that can affect neighbors.

6. Front yard, front courtyard patio, inside enclosed courtyard patio, golf course and view fencing lots must be consistent with the native desert environment. Native desert art/artifacts include pieces which are complimentary to classic and traditional

Southwestern art. Landscape saguaros that have died and any ribs must be removed from the front yard. Plastic and/or silk materials are prohibited. Nothing should be added to the front of the garage door. Wall murals, including pictures or images on tile, or any other type of surface material, shall be limited to the confines of a private, rear covered patio area only. Total dimensional area, including border, may not exceed sixteen (16) square feet, and must be consistent with the surrounding native desert environment. BARBECUES / SMOKERS Portable barbecues will be fired by natural or propane gas only. Portable barbecue and smoker units are to be contained within the confines of the rear yard or back patio area. Caution must be exercised to avoid the proximity of smoke to neighboring residences. Built-in barbecue units will be fired by natural or propane gas only. Built-in barbecue units shall be no closer than sixty (60) inches from property line. The total built-in structure, including barbecue cover, shall not exceed fifty-four (54) inches in height from original developer patio slab. Exterior of built-in barbecue shall be stuccoed and painted to match color of house. Town of Marana and/or Pima County permits may be required. Permit copies may be requested by the ARC and the HOA. BIRDHOUSES & BIRD FEEDERS Bird feeders and/or birdhouses are permitted in rear yards only. Bird feeders are strongly discouraged. Birdseed blocks are prohibited. Bird feeders and/or bird houses are prohibited in front yards and common areas. Bird feeders, birdhouses and birdseed blocks may be removed if placed in common areas. A maximum of two (2) bird houses and two (2) bird feeders is permitted in the confines of your own back yard, and shall not be more than sixty (60) inches in height above the original developer patio slab. Hummingbird feeders are permitted in rear yards only. Placement of feeders in front yards and common areas is prohibited. DRIVEWAY & WALKWAY COATINGS/STAINING The color of driveway or walkway coatings must match the color of the house. Pattern design, if used, shall be unobtrusive with the color matching the color of the house or trim, and shall cover the entire driveway and/or walkway. Public sidewalks are not permitted to be coated. (see also Driveway under External Modifications) ENVIRONMENTAL MATERIALS MANAGEMENT The Storm Water Pollution Prevention Plan, (SWPPP), is a government environmental policy. This policy is enforced at the state, county and city levels. The HOA has adopted a policy to prevent run-off from waste materials from entering its sewer and drainage systems as stated in Appendix F. Dumping of sand, dirt, rock, CMU block or building materials directly on any HOA street or roadway is prohibited. All material, including masonry saws and cement mixers used at the building site, must be placed on heavy duty drop cloths or tarps. Additionally, BMP socks are

to be used in compliance with Appendix F. These restrictions must be strictly adhered to. If a homeowner/contractor does not comply with the policy (See Appendix F), the homeowner can be charged the cost of clean-up, street or roadway repairs, as well as fines which may be levied by the HOA (Appendix G). EXTERIOR REPAINTING Repainting of the exterior or house trim to match the original developer’s colors does not require ARC approval. Exterior house or trim color changes require ARC approval. The new color shall not be the same as houses in close proximity (either side of house) and must be selected from the ARC approved color pallets in accordance with the roof tile color. Exterior body and trim paint colors must be selected from each roof tile grouping to match the roof tile color. The ARC approved color pallets are available from the HOA. Prior to starting the color change painting, an Approval Application must be submitted to the ARC. If color change painting is started prior to ARC approval, the homeowner will incur a fine (Appendix G). Front door color changes require ARC approval. Door must match existing door in color, match the color of house or an approved stain color. EXTERIOR TILES Ceramic tiles on the front of the house, around windows and doors or on return walls are prohibited. EXTERNAL MODIFICATIONS – DOORS (FRONT ENTRY, SIDE, BACK AND GARAGE) / DRIVEWAY / WINDOWS Requests must include a plan with detailed dimensions. The design, style, detailing, and materials shall conform to that of the original home. It is the responsibility of the homeowner to obtain permits as required by the Town of Marana and/or Pima County. Doors All The size of the door must conform to those of the existing house. The height of the door shall be the same height as the existing doors. The exterior trim must be the same width and height of existing door. If there is a change in the color, it shall be listed on the application. Doors Garage The garage doors must be complimentary to the existing paint palette and the existing trim banding must be continued around the new door. Plans must include the location of any garage front light and street address numbers, both of which shall be comparable to the existing style, as installed by the developer and be complimentary to classic and traditional southwestern design. Driveway Concrete driveway may be removed and replaced with pavers. Pavers shall be desert colors of the area, consistent with the surrounding native desert environment. Windows Overall size of new or replacement windows must be kept in scale and design with those found in community or with those originally installed. The exterior trim shall be the same width, height and color as the existing windows.

FIREPLACES, CHIMENEAS, KIVAS & FIRE PITS FIREPLACES, KIVAS, PERMANENT/PORTABLE CHIMENEAS, AND PERMANENT/ PORTABLE FIRE PITS SHALL BE FIRED BY A GAS DEVICE ONLY, WITH CERAMIC LOGS OR LAVA ROCKS. PRESSED LOGS, NATURAL WOOD OR CHARCOAL ARE PROHIBITED. Fireplaces may be placed in rear yards and enclosed courtyards only. Fireplaces must be constructed of concrete block or brick, stuccoed and painted to match color of house. Fireplaces shall not exceed sixty-six (66) inches in height including base, chimney and clay tile stack from original developer patio slab. Fireplaces shall be setback a minimum of five (5) feet from neighboring property lines. Fireplace massing should be sized proportionally to the relative size of the area in which it is to be constructed. Kivas may be placed in rear yards and enclosed courtyards only. Kivas must be constructed of concrete block or brick, stuccoed and painted to match color of house. Kivas shall not exceed sixty-six (66) inches in height including base, chimney and clay tile stack, from original developer patio slab. Kiva massing should be sized proportionally to the relative size of the area in which it is to be constructed. Permanent Chimineas may be placed in rear yards only. Chimineas must be constructed of concrete block or brick, stuccoed and painted to match color of house. Permanent chimineas shall not exceed sixty (60) inches, including the base, from original developer patio slab. Chimineas massing should be sized proportionally to the relative size of the area in which it is to be constructed. Portable Chimineas shall not exceed a total height of sixty (60) inches, including the base, from original developer patio slab. Portable chimineas shall be colored clay, terra cotta or other earth tone color, consistent with the surrounding native desert environment. Portable chimineas do not require ARC approval. Permanent Brick Fire Pits may be placed in rear yards only. Permanent brick fire pits shall not exceed thirty (30) inches in height from original developer patio slab and the base may remain natural. Stuccoed fire pit base must be painted the color of house. Portable Fire Pits shall not exceed thirty (30) inches in height from original developer patio slab. Portable fire pits do not require ARC approval. Fireplaces, Kivas, Permanent Chimineas and Permanent Fire Pits require ARC approval and require a Town of Marana and/or Pima County permit. FLAGPOLES & FLAGS Wall mounted flag poles shall be a maximum of five (5) feet long, with the brackets painted to match the attachment area or trim colors of the house. No more than one permanent, removable or freestanding flag pole or one wall-mounted pole will be permitted per residence. A permanent flagpole must be placed or installed a minimum of ten (10) feet from the street or sidewalk of the house and must be anchored in a concrete base. The placement of flagpole is to be on the front entrance side of the driveway. Flagpole maximum height shall not exceed the height of the rooftop of Owners home.

Telescoping flagpoles are recommended. A permanent flagpole must be constructed of metal or fiberglass, silver, dark bronze, black, white or the color of the house, one and one-half (1-1/2) to two (2) inches in diameter. Flagpole must have a pulley and cord system for raising and lowering the flag. The size of the American flag shall not exceed thirty-six (36) inches by sixty (60) inches. Only Authorized Flags may be displayed. Authorized Flags are The American flag or an official or replica of a flag of the United States Army, Air Force, Marine Corps or Coast Guard, the POW/MIA flag, the Arizona state flag, an Arizona Indian Nations flag or the Gadsden flag. The American flag or military flag shall be displayed in a manner consistent with the federal flag code. The American flag should not be displayed on days when the weather is inclement, except when an all-weather flag is displayed. It is universal custom to display the flag only from sunrise to sunset. If properly illuminated during hours of darkness, the flag may be displayed 24 hours a day. A single lighting source shall be placed either at the base of the flag or at the top of the pole. All lighting must be of the shielded variety and directed towards the flag only and meet the Town of Marana low light requirements. No ornamental flags or windsocks are permitted to be Visible from Neighboring Property. GUTTERS & DOWNSPOUTS Gutters and downspouts shall match or approximate the color of house or trim. Every effort should be made to see that the runoff is not diverted to neighboring property or common area. When gutter installation also includes fascia board, colors shall match the existing surface to which it is being applied. HOLIDAY DECORATIONS & LIGHTING Winter holiday decorations may be displayed from November 15th to January 15th. Other holiday decorations will be allowed thirty (30) days before and must be removed within fifteen (15) days following the holiday. Lighting may not create a nuisance to neighbors and must meet Marana City code requirements for outdoor lighting. LIGHTING & LIGHT FIXTURES The CC&Rs state that exterior lighting must not create a nuisance to neighbors. All landscape lighting shall be shielded to prevent nuisance glare to adjacent properties. Motion sensors are prohibited. Security floodlights are only to be used on an intermittent basis and not to illuminate landscaping and/or patios. Floodlight dimmers are recommended. All decorative yard and post lights shall be automated and controlled by timer and /or photoelectric system, to include those periods when house is vacant. Permitted hours of operation are dusk until midnight. Accent lighting shall be concealed as much as possible by boulders and/or plants, to decrease their visibility during the daytime and may not exceed 18 watts per bulb. All lighting must conform to Town of Marana and/or Pima County’s Outdoor Lighting Code. All outdoor fixtures, other than approved post light and garage light fixtures shall be low voltage and use incandescent or florescent lamps. Colored lenses are prohibited. Pathway light fixtures shall be of high quality, finished to blend with the surroundings, and be compatible with the native desert environment. Lighting fixtures shall not exceed fifteen (15)

inches in height. All fixtures shall be low voltage. No exposed bulbs shall be permitted. Low voltage lighting is permitted along walkways, driveways and around patios. Lighting of glass blocks in courtyards and all other walls is permitted. Tree lighting, directed upward, should not create an undue glare to neighbors and/or towards the street. The only allowable light fixtures(s) installed on the front of a garage, on the front of a house or in the front porch area shall be comparable to the existing style as installed by the developer and be complimentary to classic and traditional Southwestern design. No more than one (1) bug light/zappers will be permitted in rear yards only. Bug light/zappers may not be located more than seventy-two (72) inches above the original developer patio slab. MAILBOXES Mailboxes must be standardized black mailboxes with red flag, identical to the type used by the original developer and approved by the U.S. Postal Service. Replacement red flags can be purchased at most local hardware stores. It is the responsibility of the homeowner to maintain the post, mailbox and tube in good condition and have it repainted black when needed. Only numerical addresses on front of mailbox door are permitted. NAMES IN FRONT YARDS & HOUSES Names located on houses or garages are prohibited. OUTDOOR COOLING SYSTEMS Micro misting systems permitted in backyard only. Every effort should be made to obscure it from public view. Misting systems must be painted to match color of house or trim. OUTSIDE PIPE INSULATION Aluminum colored insulation is prohibited. Should a homeowner elect to insulate outside water pipes, it is highly recommended that the homeowner purchase insulation that is foam in nature and colored gray or a neutral earth tone. PATIO ROOF EXTENSIONS Patio extensions cannot be free standing structures and must be attached to the rear of the house. House or patio roof extensions must be supported by posts or other single pole supports and constructed of the same materials as the house (columns and gables stuccoed and painted to match the house and/or roof tile to match the existing roof). Patio extensions should not exceed ninety-six (96) inches from the rear of house and not encroach on rear fifteen (15) foot setback. Detailed and dimensional plans must be submitted with the application request for ARC approval. An attached Alumawood lattice patio cover cannot be located outside the building setback area, however; if the rear yard has additional area inside the BSL, then the posts must be placed at a maximum of ten (10) feet from the house or standard patio cover, and at least fifteen (15) feet from the rear property line and five (5) feet from any side property line. Structures must match body or trim color of the house.

PATIO SLAB EXTENSIONS Ground level patio extensions may not encroach more than 65% of the yard depth to the property line, or eighteen (18) feet from the house, whichever is less. Concrete/Hardscape extensions, except pool or in ground spa only cool decking, shall be no closer than three (3) feet to the rear property line and eighteen (18) inches from the side property line. Cool decking for pools & in ground spas only may be three (3) feet from any property line. The Architectural Review Committee will consider concrete surfaces that exceed the 65% requirement, provided surfaces are intermittently broken up with appropriately positioned in-ground planters providing for landscape within the extension area. Patio extensions may be concrete, pavestones, or a variety of tile, natural stone, Saltillo, and natural color concrete stamp finishes. PET HOUSES/SHELTERS/OUTDOOR PENS/KENNELS AND RUNS No Owner shall be permitted to raise, breed, or keep animals or poultry of any kind for commercial or business purposes. Pet houses, shelters, outdoor pens, kennels and runs are permitted in rear or side yards not Visible From Neighboring Property. Structures shall not be attached to any party walls and may not alter any lot drainage. PLANTERS Raised landscape or garden planter boxes may not be attached directly to common party walls of adjacent lots or Dwelling Unit and may not exceed twenty-four (24) inches in height. Plant height may not exceed height of surrounding walls. A maximum of five (5) pots are permitted in the front of the house. PROHIBITED STRUCTURES The following structures shall be prohibited from use in Del Webb at Dove Mountain:

Fixed frame or permanently extended awnings or Ramadas Clothes lines, clothes poles, or other drying devices Detached garage Free-standing trellises, privacy structures, arches, casitas Golf ball barriers Kithaus Metal or decorative window bars Play structures or trampolines Storage buildings or sheds Tents of a permanent nature

RAMADAS/GAZEBOS AND PERGOLAS Ramadas/gazebos and pergola structures may be erected in rear yards only, subject to prior review and approval by the Committee and subject to the following guidelines: (a) the maximum roof height is ten (10) feet at the highest point; (b) ramadas or gazebos must be painted or stained to complement the house color; (c) pergolas must contain an open slatted roof and must be painted to complement the body color of the home; (d) support pillars must be painted to complement the body color of the home or faced with stone accents as applicable to the Community; (e) palapas or tiki huts will not be considered for approval.

All structures must be setback a minimum of three (3) feet from all surrounding property lines and shall require shielding with approved landscaping material on Lots with view fencing. Any lighting proposed for ramadas or pergolas must be included in the submittal and approved by the Committee prior to installation.

RETRACTABLE PATIO AWNINGS Fabricated retractable extensions are allowed on the rear and/or side of a covered patio and/or house to provide passive cooling and may also provide shade to a patio area when in use. Retractable awnings shall be fixed at the current roofline or at the level of the horizontal roofline of the house. In certain situations they may be installed at the top of the opening between the masonry patio columns. They shall be operated either manually or mechanically and shall not have separate poles for support. The housing of the retractable extension and all exposed metal must be made of non-corrosive metal with a factory coating that does not require painting. Color samples of the metal and materials must be provided to the ARC with application materials. The shading fabric must be made of a durable acrylic or Sunbrella® type material that has a 10 year warranty against sun-fade or sun-rot. The metal housing and fabric color must be solid, neutral and/or as close as possible to the color of the house and shall not incorporate stripes, patterns, deep scallops or fringe. Wind sensors are recommended for all installations; however, wind sensors are required for any retractable awning that does not have a documented rating to withstand 60mph wind gusts. When extended, the minimum clearance from the patio surface must be 6.5’. The extension may have up to a 6” valance below the end bar as long as the 6.5’ minimum clearance is maintained. No enclosures or side panels of any kind are permitted to be attached to the extension and storage of any vehicle, tool, building and gardening materials or supplies is prohibited. Retractable awnings must not extend beyond the corners of the house, must not extend more than 10’ beyond the rear or side exterior wall of the house or patio and must not extend over the lot line of the home to which it is attached.

Retractable awnings are intended for passive cooling and active use purposes and shall be extended only between sunrise and sunset unless the resident is actively using the area under the awning after sunset. Awning fabric that is vinyl, acrylic or flammable in any way shall not cover grills, fire pits, smokers or propane heaters. Residents shall not suspend anything from the awnings that is prohibited elsewhere in the CC&Rs or Guidelines. Applications shall include documentation and specifications that show compliance with fabric and housing color, design, durability, wind resistance, flammability, and extension height. The guideline does not imply nor endorse that awnings are “solar energy devices” as defined by Arizona law. SCREENS/SUN SCREENS/SHADES/SHUTTERS/SECURITY DOORS/ SECURITY BARS/RETRACTABLE SCREEN DOORS/ENTRY WAY ENCLOSURES & PATIO ENCLOSURES

Original Window Screens Frames of window screens will be the color of the original frames, or the body color of the house. Screening material will be original material color. Window Sun Screens Frames of sunscreen will be the color of the original frames, or the body color of the house. Screening material will be black or bronze. Exterior Roll-Down Screens Exterior metal hardware and tracks for roll down screens will be the color of the house or trim. The screening material will be color of house, black or bronze. Exterior screens must be able

to be fastened down when extended. Exterior roll-down screens are limited to the rear and sides of the developer built patio. Plastic, reed or bamboo screens are prohibited. Exterior Roll-Down Shades All roll-down shades on rear patio will be the color of the house or trim. Roll-down shades must be able to be secured when extended. Exterior roll-down shades are limited to the rear and sides of the developer built patio. Plastic, reed or bamboo shades are prohibited. All sunscreens must remain in rolled up condition when sun is not a factor. Exterior Roll-Down Shutters All roll-down shutters must be bronze or black in color or closely resemble a color that presents the appearance of a window. Roll down shutters cannot be the same color as the base color of the home. Roll down shutters must be installed by a professional representative of the manufacturer, and be of roll formed aluminum material. Roll-down shutters are limited to the rear of the house. The mechanical housing mounted to the home must be painted the same color as the home or the color of “pop out” above the window if mounted to such. A detailed description of materials, installation procedures, and manufacturer’s literature must be included with submittal for approval. Roll down shutters must be maintained and in an operable condition. Security Doors Wrought iron security doors do not need to be submitted for ARC Committee approval if all requirements are met:

1. The color of security door is the same color of the house or trim color. 2. Screening material is the color of the house or trim color. 3. Designs on doors must be consistent with the native desert environment.

Security doors are approved for front, rear and side doors. Aluminum screen doors doors are prohibited. Security Window Bars Metal or decorative window bars are prohibited. Retractable Screen Doors Color of retractable screen doors will be the color of the house or trim. Screening material will be color of house, bronze or black. Retractable screen doors may be single or double doors and will be approved for rear doors only. Front Entry Way Enclosures Color of entry way enclosure must be color of house, trim or dark brown, dark rust, bronze or black. Screening material must be color of house, bronze or black. Designs on doors must be consistent with the native desert environment and included with ARC application. Screen Enclosures of Rear Patio Enclosed sunrooms are different from room additions and do not need to meet the same criteria of a room addition. Enclosed sunrooms are allowed under the following conditions:

1. The delineated outline of the sunroom may only include the area of the original patio footprint and/or the optional space provision which was available through the builder at the time of construction.

2. The area to be enclosed must have a twenty-four (24) inch high masonry pony wall on all sides, which include a window sill to match/blend with the original construction.

3. All constructed wall surfaces, not screened or windowed, must be stuccoed and painted to match the color of the existing house.

4. If adding additional patio space in the optional areas, the roof addition of the new patio must match the existing patio roof structure in design, materials and color.

5. Glass windows and/or vinyl screens may be used for the enclosure. The approved screening material colors are beige, tan, brown or black. The glass and/or screen surface area must be a minimum coverage of 65% of the wall surface area on each wall side. Supports for the screening and/or glass may be placed up to a maximum of five (5) foot intervals around the enclosure.

6. The glass window frames design, configuration and color must match the existing window frames of the house. The screen frames and screen support frames must match the original base color of the house. The screen fabric must be UV resistant and match the existing sun screen material and color screen guidelines.

7. There must be at least one 36” or 42” exit door into the back yard. The door must meet the community standards for exterior doors. If using a door that swings out, the door must open at least 90 degrees from the face of the door to the opposite stop. Sliding screen doors are permitted with only the approved screening materials and colors.

8. Ceiling fans are permitted in the interior of the enclosed area. 9. Roof gutters and down spouts must be installed on all sides of the enclosed

structure. Water runoff must remain on the homeowner’s lot. 10. The enclosed patio area may be used for living space only, not used for any type of

storage. The patio enclosure must not be used for housing for animals, pets, boats motorcycles, off road vehicles or the like.

The enclosed patio area must be maintained to remain in like new appearance as originally constructed. COURTYARD WALL/PONY WALL/SEAT WALLS Inside the building set back line, walls may not exceed 16 feet in continuous length and forty-two (42) inches in total height. No walls over twenty-four (24) inches may be constructed outside the setback areas around the home. Walls must be stuccoed and painted to match the body color of the home. Walls must be located a minimum of five (5) feet from the rear property line and three (3) feet from the side property lines. SECURITY CAMERA INSTALLATION Reason(s) for equipment usage and viewing area under examination must be included with application. External surveillance equipment shall not be installed so as to be intrusive on neighboring property. SIGNAGE All signage must be of a professional nature and comply with the CCRs. Political signs do not require ARC approval. Political signs must be in compliance with the Town of Marana and/or Pima County guidelines. Political signs are permitted to be placed in front yards within seventy-one (71) days before an election, and must be removed three (3) days after an election. The number of political signs on a property is not limited, but the maximum aggregate total dimensions of all political signs shall not exceed nine (9) square feet. One (1) “for sale” or one (1) “for rent” sign by homeowner is allowed and does not require

ARC approval. Licensed Realtor® professional signage is excluded from prior approval. Two riders for each licensed Realtor® professional “for sale” or “for rent” signs are permitted without ARC approval. Open House (OH) directional signs which give directions to a house which is for sale or for lease to which the public is invited for a walk-in inspection are permitted under the following conditions:

1. OH signs are permitted Saturday and Sunday between the hours of 8 am-4 pm. 2. OH signs shall be contained to a maximum height of no more than three (3) feet

from the ground to the top of the sign. 3. No more than four (4) OH signs will be permitted per lot. This excludes the one (1)

For Sale or For Lease sign allowed to be posted on the Lot. 4. OH signs will be permitted to be placed on a. different resident's Lot, provided that

the lot Owner's permission has been previously obtained. 5. No attachments or riders are permitted, including flags, balloons, etc. 6. OH signs will not be permitted on any main arterial streets 7. OH signs will not be permitted in the medians. 8. OH signs will not be permitted on any side or rear yard walls, sidewalks or roadways. 9. OH signs will not be permitted at the main entrances.

A homeowner may display a maximum of three (3) signs, showing that the property is protected by a security system. Owners will be permitted to post 'no soliciting' signs near or on the front door, or in the front yard near the entrance to a courtyard. Such 'no soliciting' signs shall not exceed one (1) foot in height if placed in the ground and, additionally, shall not exceed a size of thirty-six (36) square inches (e.g., three (3) inches by twelve (12) inches.) Address numbers do not require approval. Signage, advertising or promoting of a contractor, company or service is prohibited. SNAKE/RODENT BARRIER To block snakes or rodents hardware cloth may be attached to gates and/or fences. Hardware cloth shall be placed on the interior side of the fence or gate, must be 1/8” galvanized metal to ½” galvanized metal and not exceed thirty-six (36) inches in height from developer’s final grade. Should colored galvanized metal be used must match wrought iron color of fence or gate (green or black). SOLAR PANELS & COLLECTORS Any Solar panels not originally installed by the Developer must comply with the following Rules: The ARC acknowledges the applicable Arizona Revised Statutes that regulate their ability to review and approve solar energy devices. However, those same statutes also allow the ARC to create “reasonable rules regarding the placement of a solar energy device.” This section outlines the ARC expectations and requirements for any solar energy device installation project within the Association.

Placement 1. In reviewing any proposed location, the ARC prefers locations that eliminate or

minimize the potential visual exposure of the installation. In addition, their expectation is that the size or scope of any installation is consistent with the normal energy demands of a typical Residence within the Association.

2. In reviewing any proposed location, the ARC considers: a) the potential visual exposure from adjacent streets or other Common Areas; b) the design integration with the Residence, Structure or other Improvements; c) the topography and vegetation context on the Lot; and, d) the relationship to adjacent Lots.

3. A ground mounted installation is preferred if: a) the resulting potential visual exposure is reduced when compared to a similar

roof mounted installation; b) the appropriate building envelope response is maintained; c) existing vegetation and other natural features of the Lot are not disturbed or

eliminated; and, d) related visual mitigation screening (such as walls, landscape, etc.) is included.

4. A roof mounted installation is preferred if the resulting potential visual exposure is reduced when compared to a similar ground mounted installation. In most instances, a roof mounted installation on flat roof areas of the Residence or Structure is preferred to any installation on pitched roof areas of the Residence or Structure.

5. Any flat roof mounted installation is preferred to incorporate collectors or panels that: a) are mounted directly to and parallel with the roof plane; and, b) maintain a height profile that is below the height of the lowest surrounding

parapet wall top condition. A reasonable increase in the total collector area or array size may be necessary to maintain these criteria.

6. Any pitched roof mounted installation is preferred to incorporate collectors or panels that:

a) are mounted directly to and parallel with the roof plane; and, b) maintain a height profile that is below the height of the lowest adjacent roof

ridge top or peak condition. A reasonable increase in the total collector area or array size may be necessary to maintain these criteria.

Appearance

1. As a part of the above placement criteria, the ARC considers the appearance of the related equipment components of any installation. As applicable, these include but are not limited to mounting frames, hardware, piping, conduit, storage tanks, inverters, etc.

2. All related equipment components are preferred to be: a) concealed by the Residence, Structure or other Improvements; and/or, b) positioned below the footprint of the collectors or panels so as not to be visible.

3. Excluding the surface face of the collectors or panels, all related equipment components not complying with item number one above are considered to be visible. As applicable, visible components of the entire installation are preferred to:

a) match the adjacent ground or roof material color; b) be a uniform dark color; or, c) match the adjacent surface finish color of the

Residence, Structure or other Improvements whenever possible. 4. The finish color of the surface face of the collectors or panels should be considered

when manufacturing options are available. Finish color options that are more compatible with the adjacent surface finish color of the Residence, Structure or other

Improvements are preferred. A reasonable increase in the total collector area or array size may be necessary to maintain this criterion.

Modifications Prior to Approval In considering any proposed solar energy device installation the ARC reserves the right to request modifications to any proposed installation prior to granting approval. However, such modifications will not unreasonably:

a) incur an increase in the cost of the installation; and/or, b) decrease the efficiency of the installation. SOLAR TUBE SKYLIGHTS Solar tube skylights are permitted. They do not require an ARC approval. The HOA, the ARC and the Board are not liable to the property owners for roof damage or effects to roof warranties. Roof mounted solar tubes and skylights shall have flashing colored or painted to closely match the adjacent roof color. All glazing shall be solar bronze or clear with no whit glazing allowed. SOUND SPEAKERS External speakers are discouraged. Televisions, stereos or any sound emitting devices should not be audible so as to disturb neighbor’s peace and quiet. Sound speakers are limited to rear of house. SPAS Hot tubs and spas shall be located in a manner to be the least obtrusive and the least viewable from neighboring Lots and streets. Above ground spas shall be permitted on Lots with view fencing subject to Committee approval. Spas must be setback a minimum of five (5) feet from all surrounding property lines and shall be shielded from view with landscaping as approved by the Committee. Spa equipment must be concealed or screened by vegetation from the view of neighboring Lots and streets or by screen walls. Screen walls may not exceed forty-two (42) inches in height and must be located at least three (3) feet from the property lines and three (3) feet from any rear yard or fence. Walls must be painted to match color of home or trim color. STONE VENEER/STACK STONE Cultured stone veneer or flagstone may be used on the front elevation of a Dwelling. Cultured stone may cover up to a maximum of 35% of the surface of the front elevation of the Dwelling (which shall include stone already installed by Declarant and may include windows and doors for calculation purposes). The quality of any stone veneer must be equal to or better than that used by declarant for Dwellings within the Community. The color of the stone veneer/stack stone shall be consistent with native desert colors of the area and must be approved by the ARC. Front Of House And Courtyard Accents Stone veneer/stack stone is permitted for use on courtyard walls and as an option to painted stucco on the exterior and interior of courtyard walls, pillars, planters (inside or outside) and accessories included inside the courtyard. Rear Yard Or Rear Patio Stack stone/stone veneer is permitted for use in the rear yard or rear patio as an alternative to painted stucco on the sides of barbecues, seat walls, fire places,

fire pits, spas, planters or raised patios only as approved by the ARC as permanent structures. Height of stone veneer/stack stone is limited to the height of the structure as specified in these guidelines. Stone veneer/stack stone may cover an entire rear wall or column that is under a rear covered patio. SWIMMING POOLS Above ground pools are prohibited. Swimming pools should be designed to visually connect to the residence through the use of similar materials and color schemes. Pool equipment must be concealed or screened by vegetation from the view of neighboring Lots and streets or by screen walls. Screen walls may not exceed forty-two (42) inches in height and must be located at least three (3) feet from the property lines and three (3) feet from any rear yard or fence. Screening shall be constructed of CMU block walls, stuccoed and painted to match color of house. Plantings may also be used to screen pool pumps and other mechanical equipment. Pool equipment shall be placed in locations on the Lot so that the noise generated by the equipment will be the least disruptive to neighbors. The ARC may require that existing landscaping or other structures be modified or removed to accommodate the placement of pool equipment for the purpose of mitigating noise disruption. Water flowing from pool or spa equipment or from water features, must be directed so that it does not run onto neighboring property, common areas or golf course. TRASH AND RECYCLE CONTAINER WALLS Container(s) must not be visible from the street, golf course, common areas and/or neighboring property. If trash container(s) are not kept in the garage, they must be kept behind a wall. Trash container(s) should be removed from the curb as soon as possible after trash collection. TRELLISES Planting trellises must be submitted for approval by the Architectural Committee prior to installation and are permitted under the following guidelines:

A trellis may be installed against the Dwelling Unit (it is suggested that the installation be at least 18 inches from the Dwelling Unit to avoid violating the termite barrier).

Trellises must be constructed of metal. Pre-manufactured wooden or plastic trellises will not be considered. All trellises must be anchored in concrete, covered with live, approved plant materials from the Del Webb at Dove Mountain approved plant list.

Trellis finishes may be of natural rust, black or natural earth tone colors that blend into the environment.

A trellis may be installed a minimum of three (3) feet from a fence/perimeter wall, but may not exceed the height of the fence-perimeter wall.

A free standing trellis, used for privacy may be considered by the ARC. Privacy trellises must be anchored in concrete, meet all of the above stated criteria, and be approved by the ARC.

UMBRELLAS Sun umbrellas are permitted in both front courtyard and rear yard areas. It is strongly recommended that sun umbrellas in front courtyard areas, visible from the street, be of earth tones or neutral colors, and be consistent with the native desert environment. Bold, bright-colored umbrellas are not permitted in front courtyards.

UTILITY BOXES/FIRE HYDRANTS Control of vegetation around public utility boxes must allow for observation, maintenance and repair crews to access front panels and utility box doors. No structure or other obstacle may be installed blocking utility box access. Fire hydrants require an unhindered and unobstructed distance of three feet radius around hydrant except as otherwise noted or approved. WALLS Common walls to consist of standard Del Webb at Dove Mountain block wall or wrought iron fencing, installed on side and rear yard property lines, shall not exceed seventy two (72) inches in height from original developer final grade and shall not project past the front corners of the house. Front courtyard or patio walls shall not exceed a height of forty-eight (48) inches from the original developer final grade, measured from inside courtyard or patio wall, stuccoed and painted to match color of house. Courtyard walls less than thirty-six (36) inches high, and those with openings facing the street and openings with decorative wrought iron fencing which allow views inside the wall make the courtyard space subject to the same limitations as front yards without courtyards. Approved gates and side panels shall not constitute such an opening. Combined height of wall and fence shall not exceed forty-eight (48) inches above final finished patio grade by developer. Decorative wrought iron fencing within said wall shall not exceed one-third of the total length of wall. Decorative fencing colors shall be consistent with guidelines for wrought iron fencing or wrought iron gate colors. Design on courtyard wall openings must be consistent with native desert environment and submitted with ARC application. Any return wall visible from the street shall be as specified for front courtyard or patio walls, stuccoed and painted to match color of house. RETURN WALL/FENCING: Return fencing can be added to either side of the house with the following conditions;

The additional return wall must abut the existing common party walls/Party Structure that were originally installed by the Developer;

Must be setback a minimum of ten (10) feet from the front corner of the house;

Must match the material and colors of the existing common party walls/Party Structure;

If there is not an existing common party wall/Party Structure for the requested new return wall to abut into, neighbor to neighbor consent must be given in writing before submitting to the ARC.

All external modifications to homes or landscaping that have rear yards adjacent to the golf course require ARC approval, and the approval of Tortolita Golf Club, LLC prior to the modifications being made. WATER FEATURES Water features shall not exceed thirty-six (36) inches in height from original developer patio slab as viewed from owner’s patio, be composed of natural materials and incorporate a re-circulating pump. Water features shall be located within private court yards and/or back yard areas only. Water feature pumps shall be screened from street, common areas, golf course views or neighboring properties and located to minimize noise transmission.

The ARC requires that a water features incorporate a draining system. Water features may not drain into common area or neighboring lots. Water features may not be attached to a common wall of paired homes. Water features may require a 110 volt connection, and a ground fault interrupter (GFI) outlet. WEATHER REPORTING EQUIPMENT Weather reporting equipment may not be placed on the roof or chimney of any residence without the review and approval of the ARC. A drawing is required showing the placement and size of such equipment. WROUGHT IRON FENCING Wrought iron fencing enclosing a swimming pool or spa, shall not exceed a height of sixty (60) inches from original developer grade, and shall be painted.

Wrought iron fencing when connecting CMU block or stuccoed wall to a pillar or the house and which are visible from the street shall be painted the color of house, trim or black. WROUGHT IRON GATES Wrought iron gates installed on front courtyard pillars, wrought iron fencing, patio walls, or any painted stuccoed wall, shall be uniform in height with the wall and or pillars. Gates and side panels installed on a front courtyard shall not exceed sixty (60) inches width in total for both the gate and panel(s). Wrought iron gates installed on front courtyard walls or pillars shall be painted to match the color of house, trim, dark brown, dark rust, bronze or black. Wrought iron gates installed on wrought iron fence in side or back yards shall be painted to match color of fence. Wrought iron gates installed on block walls in side or back yards shall be painted to match the color of house, trim, dark brown, dark rust, bronze or black. Designs on gates must be consistent with the native desert environment and submitted with ARC application. Gates on community perimeter fences/walls are not permitted. OTHER SIDE YARD GATES: All side yard gate changes must be approved by the Architectural Review Committee; gates may be natural wood or stained a natural wood color with black metal frames, or

may be a wood composite to match natural wood with black metal frames. Gates may protrude height of attached fence or wall if slightly curved or decorative. See attached samples of side yard gates that may be approved by the Architectural Review Committee.

Perforated 24 gage steel or metal screening with hole size 0f 1/16 or 3/32 may be added to the back side of the wrought iron gate. It must match the existing gate in color. It must be professionally and securely attached. It is not allowed to hang loose or appeal in disrepair. It must be maintained in new condition at all times. A 24 gage steel panel may be added to the back side of the wrought iron gate. It must match the existing gate in color and cover the entire gate. It must be professionally and securely attached. CMU Block: Concrete blocks requiring stucco and paint to match house color or trim. APPENDIX F ENVIRONMENTAL MATERIALS MANAGEMENT In an effort to prevent run-off from waste and/or construction materials from entering our sewer and drainage systems causing harmful contamination and to encourage minimal soil surface disturbance, the following applications are standard industry practice and must be followed.

Heavy duty drop cloths or tarps must be placed under dumping of sand, dirt, rock, CMU block or building materials. Dumping directly on any street or roadway is prohibited.

Masonry saws and cement mixers used at construction sites must be placed on heavy duty drop cloths or tarps.

Best Management Practice (BMP) socks, compost filter berms, are generally placed along the perimeter of a site or at intervals along a slope to control run-off and reduce channels carrying unfiltered sediment.
