    RE: MODIFICATION OF THE CURRENT STIPULATIONS FOR A SINGLE FAMILY RENTAL HOUSING PROJECT TO BELOCATED ON PARCEL 158 06 021H (south parcel).

    Dear Planning Official:

    Our proposed project of up to 276 rental homes will be located on a site comprised of two parcels with acombined total of approximately 19.03 acres. These parcels were two of a larger group originally rezonedtogether under zoning case Z 50 08. Subsequently, these parcels were developed separately and through theentitlement process, the original zoning ordinance generated under the initial zoning case was modified severaltimes.

    As a result, each parcel is governed by a different set of zoning ordinance stipulations. We will therefore addresseach parcel separately through the Planning Hearing Officer (PHO) process for project design review, minorstipulation modification and approval. As a result, we have filed a separate PHO application for each of our twoparcels.

    We submit this letter to specifically address parcel 158 06 021H which is the south half of our site.

    In order to provide some context for our project and the intended use and disposition of this parcel, we will beginwith a general description of the project, and then address the specific zoning ordinance stipulations related tothis parcel.

    Our project is located immediately south of 21st Avenue and Butler Drive on property that was formerly a golfcourse. The golf course lay over 4 parcels arranged in quadrants with a condo development located at the center.The north and south parcels on the west were sold and approved for development and we have acquired thenorth and south parcels on the east.

    Construction and sales are already underway on the west half with 198 new, for sale, 2 and 3 bedroom homes,averaging approximately 1,450 sf each or about 287,000 total project square footage.

    Where the size of the average American home is 2,600 sf, our new community is based on many of the ideasdeveloped in the Tiny House Movement. Concepts originally proposed in the 1997 book ‘The Not So Big House’ bySarah Susanka, the Tiny House Movement marks a return of houses less than 1,000 sf in size. Smaller homesdesigned with greater efficiency, innovative modern kitchens, fewer bedrooms and a lighter environmental

  • footprint are homes that take up less space, afford more open space, use less land, are positive solutions to helpmeet the housing shortage, appeal to young couples with less complicated lifestyles, professionals and studentsthat appreciate modern efficiencies or folks interested in down sizing from much larger homes that cost far moreto heat, cool and maintain.

    With these ideas in mind, we plan a 2 phase approach, that will develop the north parcel of 8.32 ac with up to 96new rental homes first, and the south parcel of 10.71 ac with up to 180 homes second. Our 276 new rentalhomes of mostly 1 and 2 bedroom units with only 14 3 bedroom units will average just under 900 sf each. All ourhomes are configured as duplex units which means just 138 buildings, of just 248,000 total project square feet.

    If our total project area was divided by the KHOV average unit size, 1,450 sf, we would have 171 units. While ourunit count is slightly higher, our total project square footage is actually less dense by 14% and has fewer totalbedrooms.

    We are sending this letter with attachments to submit our proposed site plan and elevations (EXHIBIT A Site Plan,Landscape Plan and Elevations) for your review and shall seek the modification of those relevant existingstipulations for the south parcel number 158 06 021H (EXHIBIT B) cited in PHO 3 15—Z 50 08 08, Ordinance G6132 (EXHIBIT D), as follows;

    STIPULATIONS | South Parcel 158 06 021H:

    A. PROPOSED CHANGE TO STIPULATION 1. (Z 50 08 5, Ordinance G 5292):

    1. That the elevations for the residential portions of the site shall be approved by the PlanningHearing Officer through the public hearing process prior to Planning and Development Departmentpreliminary site plan approval with specific regard to the inclusion of the below elements. This review isfor conceptual purposes only. Specific development standards and requirements will be determined bythe Planning and Development Department.

    The development elevations (EXHIBIT A) date stamped _______, 2020, shall be in compliance with therequirement for residential elevations to be approved by the PHO through the public hearing process.

    PROPOSED REASONING FOR OUR REQUEST: We request this change in language to reflect the pending review ofour building elevations for approval as required per stipulation 1, that we may revise and update the ordinancefrom those elevations that were previously approved, and substitute our current project elevations.

    B. PROPOSED CHANGE TO STIPULATION 1a. (Z 50 08 5, Ordinance G 5292):

    a. Building entries shall be oriented towards common areas/pathways. EXCEPT FOR ANYSINGLE FAMILY RESIDENCES WHICH SHALL PROVIDE FOR THE ORIENTATION OF SUCHSTRUCTURES BEING TOWARD THE ROAD OR VEHICULAR ACCESSWAY. , or sidewalks that provideaccess to common or active open space areas.

    PROPOSED REASONING FOR OUR REQUEST: We request this change to add specific reference and clarify the typeof pedestrian connection the building entries shall be oriented towards in our site plan.

  • C. PROPOSED CHANGE TO STIPULATION 2. (Z 50 08 5, Ordinance G 5292):

    2. That the residential portion of the site shall develop in general conformance to the site plan datestamped August 29, 2008, , ____________, 2020, and for the 5.0 acre site which is a portion ofParcel 158 06 021 C to be in general conformance with the site plan date stamped January 31,2013 and for the 9.547 acre site which is a portion of parcel 158 05 021e to be in substantialconformance with the site plan date stamped January 20, 2016, as approved by the Planning andDevelopment Department, with specific regard to:

    PROPOSED REASONING FOR OUR REQUEST: We request this change in language to reflect the pending review ofour site plan for approval, that we may revise and update the ordinance from that which was previously approved,and substitute it with our current site plan.

    D. PROPOSED CHANGE TO STIPULATION 2b. (Z 50 08 5, Ordinance G 5292):

    b. The residential buildings site plan shall be designed so that the mature trees identified onExhibit B, The Tree Preservation Plan DATED AUGUST 29, 2008, will remain in place as anintegral part of the site design, or as modified by the proposed tree locations depicted onthe proposed tree preservation exhibit (EXHIBIT F) and as approved or modified to be ingeneral conformance by the Planning and Development Department. All treerelocations and replacements shall provide at a minimum a tree or trees of an equal orcombined equal caliper size, as approved by the Planning and Development Department.

    PROPOSED REASONING FOR OUR REQUEST:

    We request a change to Stipulation 2 b, due to changes in the number of mature trees that have survived sinceinitially identified on the original Exhibit B, Tree Preservation Plan and prior to our acquisition. The result is that itis no longer possible to literally comply with 2b as currently written, and we therefore seek to revise the languageof Ordinance G 5292 to reflect current conditions and to allow our revised tree preservation plan.

    Of the (3) existing trees originally identified for preservation on parcel 158 06 021H, (3) have died. The (3)deceased trees will be replaced by new mature trees of equal or combined equal caliper size per City of Phoenixrequirements.

    E. PROPOSED CHANGE TO STIPULATION 2c. (Z 50 08 5, Ordinance G 5292):

    c. The number of units shall be a maximum of 11.12 dwellings per acre except for thatportion of Parcel Number 158 06 021 C being developed under the site plan date stampedJanuary 31, 2013, which shall provide for a residential density of 19 dwelling units peracre. a maximum of 16.81 dwelling units/acre.

    PROPOSED REASONING FOR OUR REQUEST: The portion our project located on parcel 158 06 021H, proposes upto 16.42 dwellings per acre. Under PHO 3 15—Z 50 08 08, the currently allowed density is 11.12.

    Notwithstanding the fact that our unit count is well below the maximum allowed under R 3A zoning at23.1DU/acre, the reason we believe strongly that our proposal is acceptable is because although our unit count peracre is only slightly higher by 5.69 DU/ac, our much smaller unit design with fewer bedrooms than the averageAmerican home, achieves far greater site design efficiency with 20% less lot coverage at 23.3% proposed, versus

  • 29% allowed, and far more open space at 14% greater than what is required, with our proposed 27,913 sf of grossarea, versus the 23,334 sf of gross area that is normally required.

    We are asking for approval of just 5.69 DU/ac more homes while proposing 14% greater open space and 20% lesslot coverage and we believe this should meet with your approval.

    Except for the modifications described above, we commit to adhere to all of the other stipulations relevant tothese parcels.

    Please see the attached letter from the City of Phoenix (EXHIBIT G) confirming that our project is consistent withthe 2010 Traffic Impact Study and therefore meets the requirements under the relevant stipulation for bothparcels.

    We are excited by this project and we believe our new proposed single family rental development will provide ahighly compatible land use complementing the existing townhomes to the west, the existing and plannedapartments to the east and south, and the greater community as a whole with increasing property values and ahigher level of public safety.

    The City of Phoenix received and approved a Traffic Impact Study in 2010 consistent with the approved zoning of case Z-50-08. The proposed development filed under KIVA 20-359 is consistent with the framework of the prior traffic study. As such, the stipulation requiring a traffic impact study has been satisfied for the purposes of this site development project.
