Coyote Flats Multifamily Housing 2822 N 59th Ave Phoenix, AZ 85035 07.1.2020rev Project Information Zoning: PAD-14 Location: Approximately 250 feet south of the southwest corner of N 59th Ave
and W Thomas Rd Gross Acreage: 6.83 acres Applicant: Doug McCord, Architectural Resource Team Representative: Brandon Ryckman, Zekelman Industries Project Background In 1980, (application 43-80) the property was rezoned to PAD-14 with stipulations. In 2016, (application Z-43-80-7) a development plan was submitted and the stipulations were modified, but the development did not follow through. The stipulations currently in place are as follows: Request We are requesting modifications to stipulations on the property as a result of a previous zoning change. The subject property is located at 2822 N 59th Ave. The land is currently vacant. The applicant proposes to construct 180 units of multifamily housing, and a community building with community pool. Our proposed site plan and accompanying building plans and elevations are included with this application Proposed Modifications to Zoning Stipulations
1. That development shall be in general conformance to the site plan date stamped November 21, 2016 JULY 2, 2020 and the elevations date stamped November 3, 2016 JULY 2, 2020 with specific regard to a one-story building height limit within 75 feet of the south property line as approved by the Planning and Development Department.
The request is to modify this stipulation to reflect that development shall be in general conformance to the site plan and elevations submitted with this 2020 PHO application (omit all references to the 2016 plans elevations). Rationale: The modification of this stipulation will allow the new property owner to develop the property as their team thinks is in the best interest of owner, property, and neighborhood. The development will adhere to all other requirements of this case.
2. That the approval shall be conditioned upon development commencing within
36 months of the City Council approval of this Planning Hearing Officer action in 2016 2020 in accordance with Section 506.B.1 of the Phoenix Zoning Ordinance. For the purposes of this stipulations, development shall

commence with the issuance of building permits, and erection of building walls on site.
The request is to this stipulation to reflect that the development shall commence within 36 months of the City Council approval of this 2020 PHO action (omit any reference that ties our development timeframe to the 2016 action).
Rationale: The modification of this stipulation will allow the new property owner ample time to commence construction.
3. There is to be an eight-foot landscape buffer the full length of the south
property, and 4. The development units to be limited to 285. 5. Further, sufficient right-of-way to be dedicated by the property owner
within one year of final City Council action to provide for the following a. A 40-foot half street for Thomas Road.
Conclusion Zekelman Industries respectfully request that the Planning Hearing Officer approve its request to modify the stipulations detailed above. Overall, we feel this new development plan for the project will benefit the overall health and state of this area and be able to engage with the surrounding communities.
