AGENCY: Office of the Secretary, HUD.ACTION: Notice of Final Fiscal Year (FY)2002 Fair Market Rents (FMRs).

SUMMARY: Section 8(c)(1) of the UnitedStates Housing Act of 1937 requires theSecretary to publish FMRs annually tobe effective on October 1 of each year.FMRs are used for the Housing ChoiceVoucher program, the ModerateRehabilitation Single Room Occupancyprogram, the project-based voucherprogram, and any other programsrequiring their use. Today’s noticeprovides final FY 2002 FMRs for allareas that reflect the estimated 40th and50th percentile rent levels trended toApril 1, 2002.EFFECTIVE DATE: The FMRs published inthis notice are effective on October 1,2001.

Housingassistance payments are limited byFMRs established by HUD for differentareas. In the voucher program, the FMRis used to determine the ‘‘payment

standard’’ (the maximum monthlysubsidy) for assisted families (seeSection 982.503). In general, the FMRfor an area is the amount that would beneeded to pay the gross rent (shelterrent plus utilities) of privately owned,decent, safe, and sanitary rental housingof a modest (non-luxury) nature withsuitable amenities.

How HUD Sets FMRs

HUD Standard for Setting the FMR

FMRs are gross rent estimates thatinclude both shelter rent paid by thetenant to the landlord and the cost oftenant-paid utilities, except telephone.HUD sets FMRs to assure that asufficient supply of rental housing isavailable to program participants. Toaccomplish this objective, FMRs mustbe both high enough to permit aselection of units in neighborhoods andlow enough to serve as many families aspossible. FMRs are set at a percentilewithin the rent distribution of standardquality rental housing units in eachFMR area (see 24 CFR 888.113, asamended by interim rule publishedOctober 2, 2000 at 65 FR 58870,effective December 1, 2000). FMRs arebased on the distribution of rents forunits that are occupied by recentmovers—renter households who movedinto their units within the past 15months. Rents for units less than twoyears old and public housing units arenot included. Rents for subsidizedhousing units are adjusted by addingback the amount of the subsidy.

HUD sets FMRs either at the 40thpercentile rent or at the 50th percentilerent. For most FMR areas, the FMR is setat the 40th percentile rent—that is, therent for 40 percent of standard rentalhousing units is at or below this dollaramount. For some FMR areas, the FMRis set at the 50th percentile rent—that is,the median rent—the rent for 50 percentof standard units is at or below thisdollar amount.

When HUD Sets FMRs at the 50thPercentile Rent

On October 2, 2000 (65 FR 58870),HUD published an interim rule(effective December 1, 2000) thatprovides authority for HUD to set 50thpercentile FMRS in metropolitan areaswhere a higher FMR (i.e., exceeding the40th percentile FMR) is needed topromote residential choice, helpfamilies move closer to areas of jobgrowth, and deconcentrate poverty. Therule provides (§ 888.113(c)) that HUDwill set FMRs at the 50th percentile rentfor all unit sizes in each metropolitanFMR area that meets all of the followingcriteria:

• The FMR area contains at least 100census tracts;

• 70 percent or fewer of the censustracts with at least 10 two bedroomrental units are census tracts in whichat least 30 percent of the two bedroomrental units have gross rents at or belowthe two bedroom FMR set at the 40thpercentile rent; and

• 25 percent or more of the tenant-based rental program participants in theFMR area reside in the 5 percent of thecensus tracts within the FMR area thathave the largest number of programparticipants.

On January 2, 2001 (66 FR 162), HUDfirst established 50th percentile FMRsfor 39 fair market rent areas, based onthe criteria specified in the interim rule.

Schedule B of this Notice lists the FY2002 FMRs for all areas of the UnitedStates including:

• the 39 FMR areas where the FMR isset at the 50th percentile rent, and

• FMR areas, where the FMR is set atthe 40th percentile rent.

An asterisk in Schedule B identifieseach of the 39 FMR areas for whichHUD has set 50th percentile FMRs. Data SourcesHUD has used the most accurate and

current data available to develop theFMR estimates. The sources of surveydata used for the base-year estimatesare:

(1) The 1990 Census, which providesstatistically reliable rent data for allFMR areas;

(2) The Bureau of the Census’American Housing Surveys (AHS),which are used to develop between-Census revisions for the largestmetropolitan areas and which haveaccuracy comparable to the decennialCensus; and

(3) Random Digit Dialing (RDD)telephone surveys of individual FMRareas, which are based on a samplingprocedure that uses computers to selectstatistically random samples of rentalhousing.

The base-year FMRs are updatedusing trending factors based onConsumer Price Index (CPI) data forrents and utilities or on HUD regionalrent change factors developed fromregional RDD surveys. Area-specificannual average CPI data are available for99 metropolitan FMR areas. RDDregional rent change factors aredeveloped annually for the metropolitanand nonmetropolitan parts of each ofthe 10 HUD regions. The RDD factorsare used to update the base yearestimates for all FMR areas that do nothave their own local CPI survey.

Utility CostsHUD’s standard methodology for

incorporating changes in utility costs indetermination of the FMRs relies on themost current CPI data on annualchanges in residential utility costs.Annual rather than point-to-pointmonthly comparisons (e.g., July 1999 toJuly 2000) are used because monthlyutility price indices are volatile andoften not reflective of the annualizedcost of utilities. The annual cost indicestake into account changes in prices andconsumption patterns over the course ofa year.

In developing the FMRs for FY 2002,HUD has determined that the standardmethodology does not adequatelycapture the unusual increases in naturalgas prices that occurred at the end ofcalendar year 2000. (The standardmethodology does capture increases infuel oil prices.) The standard FMRmethodology captures a 17 percentincrease in natural gas prices from 1999to 2000, but December 1999 toDecember 2000 prices increased by an

average of 37 percent. Department ofEnergy projections for 2002 are similarto the December 2000 prices. Forpurposes of estimating FY 2002 FMRs,HUD has therefore modified the naturalgas inflation component to useDecember-to-December costs whenavailable, and to use second half tosecond half of the year figures for CPIareas where December 2000 data werenot available. This is a one-time changemade to respond to unusualcircumstances; HUD expects to return tothe standard methodology next year.

For these three reasons, the impact ofthis change is modest for most areas:

• First, the change accounts forincreases in the price of natural gas perunit of consumption, but not forincreases in consumption associatedwith the unusually cold winter of 2000–2001.

• Second, on a national level, naturalgas comprises only 27 percent of utilitycosts, and utility costs typically average8–15 percent of total rent costs inmetropolitan areas. This means, forinstance, that a 50 percent increase innatural gas prices only increases FMRsby a little over 1 percent in the typicalmetropolitan area.

• Third, since FMRs reflect monthlyhousing costs, the increase in FMRs dueto this methodological change is spreadacross the course of an entire year ratherthan just the December-February heatingseason.

State Minimum FMRs

With the exception of areas with 50thpercentile FMRs, FMRs are establishedat the higher of the local 40th percentilerent level or the Statewide average ofnonmetropolitan counties, subject to aceiling rent cap. The State minimumalso affects a small number ofmetropolitan areas whose rents wouldotherwise fall below the Stateminimum.

Bedroom Size Adjustments

FMRs have been calculated separatelyfor each bedroom size category. In areaswhere FMRs are based on the Stateminimums, the rents for each bedroomsize are the higher of the rent for thearea or for the Statewide average ofnonmetropolitan counties for thatbedroom size. For all other FMR areas,the bedroom intervals are based on datafor the specific area.

Exceptions to bedroom size intervalsthat are below normal ranges have beenmade for several areas (usually smallnonmetropolitan counties). For theseareas, the intervals used are based onthe typical minimum ratios found afteroutliers have been excluded.

Higher bedroom size intervals areused for three-bedroom and larger sizeunits than would result from using theactual market relationships. This isdone to assist the largest, most difficultto house families in finding program-eligible units. The FMRs for unit sizeslarger than 4 bedroom are calculated byadding 15 percent to the 4 bedroomFMR for each extra bedroom. Forexample, the FMR for a 5-bedroom unitis 1.15 times the 4 bedroom FMR, andthe FMR for a 6 bedroom unit is 1.30times the 4 bedroom FMR. FMRs forsingle-room-occupancy (SRO) units are0.75 times the 0 bedroom FMR.

Public Comments

In response to the May 9, 2001 (66 FR23770) proposed FMRs, HUD received25 public comments covering 23 FMRareas. Rental housing surveyinformation of some form was providedfor 15 of those FMR areas. All surveyinformation submitted was evaluatedand, based on that review, the FMRs for10 areas are being revised upward. Theinformation submitted for the otherFMR areas was not considered sufficientto provide a basis for revising the FMRs.

about the impact of higher utilities onFMRs: the Michigan State HousingDevelopment Authority noted thatwhile FY 2001 FMRs were based onfrozen natural gas rates, these rates willbe deregulated for most of FY 2002; theCuyahoga Metropolitan HousingAuthority noted that utility increaseshave taken up most of the increase inthe FMR over the past year; and theRochester Housing Authority noted thatincreases in FMRs have not kept pacewith natural gas increases. As notedpreviously, these concerns were takeninto consideration in developing FY2002 FMRs.

Four commenters requested changesto their FMR area geographic coverage:the Housing Authority of the city ofSanta Barbara (CA) requested a north/

south split in the county; the AmherstHousing Authority (MA) requested thatthe Springfield MSA be subdivided byplacing the towns of Amherst,Northampton, and Sunderland in aseparate, new, FMR area; the HousingAuthority of the City of Charlotte (NC)asked that Charlotte-Mecklenburg standalone when calculating FMRs; and theHousing Authority of the City of Dallas(TX) suggested the removal of the ruralcounties of Ellis, Hunt, Kaufman andRockwall from the Dallas metropolitanFMR area. HUD does not supportsplitting FMR areas. FMR areas areintended to correspond to housingmarket areas, which HUD defines basedon the Office of Management andBudget’s metropolitan area definitions.While there often are large differentialsbetween rents in the highest and lowestcost sections of an FMR area, currentFMR exception rules permit geographicarea exceptions sufficient to account forthese differences, especially now thatexceptions can, in special cases, exceedthe previous 120 percent limit.

RDD Surveys

This notice makes effective two of theproposed three FMR decreases that werebased on RDD surveys conducted in thefirst two months of 2001:

Dallas, TX (HUD FMR Area)Newark, NJ PMSAIn the preamble for the proposed

FMRs, Hartford (CT) was mistakenlylisted as a decrease.

Comments on the proposed decreasefor Dallas (TX) were provided by theHousing Authority of the City of Dallas.A review of these comments led to arequest for the PHA to replace itsoutdated utility schedule. Use of thisschedule eliminated most of theproposed FMR decrease.

No comment was received for:Newark, NJ PMSAThere was a proposed decrease for the

Detroit (MI) PMSA based on a winter2001 RDD. Use of an updated utilityschedule for Detroit (MI), submitted bythe PHA, produced a rent estimatewithin the confidence interval thatincluded the current FMR, therebyeliminating the proposed reduction.

Summer RDDs

Based on RDDs conducted by HUDthe summer of 2001, FMRs for thefollowing areas are being increased bymore than the normal adjustments:New Orleans, LABoston, MA–NH MSAPortland, ME MSABuffalo-Niagara Falls, NYMemphis, TN–AR–MS

Summer 2001 RDDs also were donefor the following areas, but they resultedin no change in the FMRs:Charlotte-Gastonia-Rock Hill, NC–SCAnchorage, AK MSASyracuse, NY MSA

There were no summer 2001 RDDsthat showed FMRs needed to bereduced.

American Housing SurveyThere were no AHS surveys with

results that alter proposed FY 2002FMRs.

FMR Area Definition ChangesThere were no changes in OMB

metropolitan area definitions affectingthe FY 2002 FMRs.

Manufactured Home Space SurveysFMRs used to establish payment

standard amounts for the rental ofmanufactured home spaces in theHousing Choice Voucher program are 40percent of the applicable Section 8existing housing program FMR for atwo-bedroom unit. HUD will considerpublic comments requestingmodifications of these manufacturedhome space FMRs where commentorsclaim that the 40 percent FMRs areinadequate. In order to be accepted as abasis for revising the FMRs, commentsmust contain statistically valid surveydata showing the 40th percentilemanufactured home space rent(including the cost of utilities) for theentire FMR area. Manufactured homespace FMR revisions are published asfinal FMRs in Schedule D. Onceapproved, the revised manufacturedhome space FMRs establish new baseyear estimates that are updated annuallyusing the same data used to update theother FMRs.

HUD Rental Housing Survey GuidesHUD recommends the use of

professionally-conducted RDDtelephone surveys to test the accuracy ofFMRs for areas where there is asufficient number of Section 8 units tojustify the survey cost of $14,000–$20,000. Areas with 500 or moreprogram units usually meet thiscriterion, and areas with fewer unitsmay meet it if local rents are thought tobe significantly different than the FMRproposed by HUD. In addition, HUD hasdeveloped a simplified version of theRDD survey methodology for smaller,nonmetropolitan HAs. Thismethodology is designed to be simpleenough to be done by the HA itself,rather than by professional surveyorganizations, at a cost of about $5,000.

HAs in nonmetropolitan areas may, incertain circumstances, do surveys of

groups of counties. All grouped countysurveys must be approved in advance byHUD. HAs are cautioned that theresulting FMRs will not be identical forthe counties surveyed; each individualFMR area will have a separate FMRbased on its relationship to thecombined rent of the group of FMRareas.

HAs that plan to use the RDD surveytechnique may obtain a copy of theappropriate survey guide by callingHUD USER on 1–800–245–2691. LargerHAs should request ‘‘Random DigitDialing Surveys; A Guide to AssistLarger Housing Agencies in PreparingFair Market Rent Comments.’’ SmallerHAs should obtain ‘‘Rental HousingSurveys; A Guide to Assist SmallerHousing Agencies in Preparing FairMarket Rent Comments.’’ These guidesare also available on the Internet athttp://www.huduser.org/datasets/fmr.html.

HUD prefers, but does not mandate,the use of RDD telephone surveys, or themore traditional method described inthe small HA survey guide. Othersurvey methodologies are acceptable ifthey provide statistically reliable,unbiased estimates of the 40thpercentile gross rent. Survey samplesshould preferably be randomly drawnfrom a complete list of rental units forthe FMR area. If this is not feasible, theselected sample must be drawn so as tobe statistically representative of theentire rental housing stock of the FMRarea. In particular, surveys must includeunits of all rent levels and berepresentative by structure type(including single-family, duplex andother small rental properties), age ofhousing unit, and geographic location.The decennial Census should be used asa starting point and means ofverification for determining whether thesample is representative of the FMRarea’s rental housing stock. All surveyresults must be fully documented.

The cost of an RDD survey may vary,depending on the characteristics of thetelephone system used in the FMR area.RDDs (and simplified telephonesurveys) of some non-metropolitan areashave been unusually expensive becauseof telephone system characteristics. AnHA or contractor that cannot obtain therecommended number of sampleresponses after reasonable efforts shouldconsult with HUD before abandoning itssurvey; in such situations HUD isprepared to relax normal sample sizerequirements.

Accordingly, the Fair Market RentSchedules, which will not be codified in24 CFR part 888, are amended asfollows:

Fair Market Rents for the HousingChoice Voucher Program Schedules Band D—General Explanatory Notes

1. Geographic Coverage

a. Metropolitan Areas—FMRs arehousing market-wide rent estimates thatare intended to provide housingopportunities throughout the geographicarea in which rental housing units arein direct competition. The FMRs shownin Schedule B incorporate OMB’s mostcurrent definitions of metropolitanareas, with the exceptions discussed inparagraph (b). HUD uses the OMBMetropolitan Statistical Area (MSA) andPrimary Metropolitan Statistical Area(PMSA) definitions for FMR areasbecause they closely correspond tohousing market area definitions.

b. Exceptions to OMB Definitions—The exceptions are counties deletedfrom several large metropolitan areaswhose revised OMB metropolitan areadefinitions were determined by HUD tobe larger than the housing market areas.The FMRs for the following counties(shown by the metropolitan area) arecalculated separately and are shown inSchedule B within their respectiveStates under the ‘‘Metropolitan FMRAreas’’ listing:

Once approved, the revisedmanufactured home space FMRsestablish new base–year estimates thatare updated annually using the samedata used to estimate the HousingChoice Voucher program FMRs.
