That for and in consideration of the loan of Nine Hundred Fifty Thousand Pesos (Php 950,000.00), Philippine Currency, extended to me by DAN OLIVER CARREON, Filipino, of legal age, single and a resident of Basak, Lapu-Lapu City, I the said YDREL OBSIOMA, in order to secure payment of said loan, do hereby mortgage in favor of DAN OLIVER CARREON the above described property together with all its improvements therein existing, within a period of three (3) years from the date of this document, provided that should I pay said loan of Nine Hundred Fifty Thousand Pesos (Php 950,000.00), Philippine Currency, together with the interest thereon at the rate of 3 per centum (3%) per annum, within the period of three (3) years, then this mortgage would be without effect, otherwise it should be made enforceable and demandable, and upon default, DAN OLIVER CARREON may immediately foreclose this mortgage, judicially or extra-judicially, pursuant to Act No.3135, as amended.

BEFORE ME this 30th day of June, 2014 in the City of Lapu-Lapu, personally appeared YDREL OBSIOMA, exhibiting his Community Tax Certificate Number 12895671 issued in Gun-ob, Lapu-Lapu City on January 5, 2014, and DAN OLIVER CARREON exhibiting his Community Tax Certificate No. 7891011 issued in Basak, Lapu-Lapu City on February 3, 2014, known to me to be the same persons who executed the foregoing Deed of Real Estate Mortgage and they acknowledged that the same is their free and voluntary act and deed.

This document consists of three (3) pages including the page on which this acknowledgment is written, all signed by the parties and the instrumental witnesses on every page thereof.

Attached are the Promissory Note, evidencing the debt and the Special Power of Attorney, in case of extra-judicial foreclosure.

I, DAN OLIVER CARREON, Filipino, of legal age, single and a resident of Basak, Lapu-Lapu City do hereby name, constitute and appoint NIKO YU, Filipino, of legal age, single and a resident of Pusok, Lapu-Lapu City to be my true and lawful attorney within a period of Three (3) years from today to perform and do the following acts and deeds:

To sell to the highest bidder in a public auction the following described property, in which the proceeds shall be applied to the outstanding debt of (Php 950,000) Pesos, Philippine Currency, to wit:

A parcel of land otherwise known as Lot 3425-A covered by TCT No. 12345 of the Registry of Deeds of Lapu-Lapu City, situated at Gun-ob, Lapu-Lapu City and measuring about Eight Thousand Eigth Hundred (8,800) square meters, the exact description of which is stated on the face of the aforesaid title.

HEREBY GIVING AND GRANTING unto my said attorney full powers and authority to do and perform all acts and deeds requisite or necessary to be done in order to carry into effect the foregoing authority to sell, as fully to all intents and purposes as I may regularly and legally do if personally present with powers of substitution and revocation and hereby ratifying and confirming all that my said attorney or his substitute shall lawfully do under the premises.
