Warranty - Fixture

Products stocked in the U.K.: Baselite will replace, F.O.B. Leicester U.K., freight prepaid. Products special ordered or not stocked in the U.K.: Baselite will repair or replace, F.O.B. Chino, CA, U.S.A., freight prepaid, any Baselite product defective in workmanship or materials. Such replacement is the exclusive remedy against Baselite should any fixtures delivered prove defective when installed and maintained in accordance with Baselite written instructions, and is limited to one year from date of shipment for materials and 90 days labor. No product will be replaced before the defective product is received buy Baselite or Baselite representative and inspected.

The foregoing warranties are exclusive and in lieu of any other warranty, expressed or implied, including but not limited to any implied warranty of merchantability or fitness for a particular purpose or patent or other intellectual property right infringement. Such warranties do not cover: Coated incandescent light bulbs, fluorescent lights, heat lamp bulbs, glass components and fuses. Product misuse, tampering or misapplication, improper installation, or application of improper voltage.

Baselite's liability and Buyer's exclusive remedy hereunder will be limited solely, at Baselite's option, to repair or replace, using new or refurbished parts or product by Baselite, or by a Baselite authorized agency, with respect to any claim made within the applicable warranty period referred to above. Baselite reserves the right to accept or reject any such claim in whole or in part. Baselite will not be liable, under any circumstances, for consequential or incidental damages, including but not limited to labor costs or lost profits resulting from the use of or inability to use the products.

No Charge-Back or charge for labor or material will be paid that does not have Baselite’s prior written approval. Components not manufactured by Baselite are subject to the original manufacturer’s guarantee.

Shipments subject to change of address are subject to a fee of £15.00. Incorrect address, Non deliverable address or re-fused shipments are subject to a fee of £10.00 plus freight expense. CANCELLATION REQUESTS MUST BE RECEIVED IN WRITING. Cancellation of order will only be accepted upon payment of reasonable charges based upon expenses already incurred by BASELITE.

Freight Claims - Shipments travel at purchaser's risk. Title passes to consignee on delivery to the carrier. All claims for loss or damage in transit must be made to the delivering carrier by the consignee.

Expediting Fee - £100.00 Minimum or 20% of total order, whichever is greater.

Return of Material - Material cannot be returned without prior written permission by Baselite. Request to return material must be made in writing within 30 days from the date of shipment and must show customer's order number, Baselite's invoice number and date. Material accepted for credit is subject to a 50% restocking charge, freight both ways, and any reconditioning and recartoning charges that are necessary. Custom-made or discontinued items are not returnable mate-rial. Return shipments must be made within 30 days from RGA. Material must be new and in original factory cartons. All returns subject to inspection.Damaged or unsaleable material will be credited at salvage value or less cost of repairs.
