Particularly issues of 4800 GP to Sr. Supervisors, 10:20:50 ratio to trackmen, 7,9 benchmark for MACP, filling of the vacancies etc. The Railway Board had issued their orders without any homework, because now they have started collecting numbers of safety category office bearers from Zonal Railways. They had surpassed all the rules and legal norms and issued the orders in violation of Indian Trade Union Act, 1926 as well as against violation of Fundamental Rights, which has provided us the Right of Association which cannot be violated by any executive order as per transaction of business rules. The Railway Board order has jeopardized the industrial peace prevalent over, the Indian Railways since last four decades. Looking onslaught on trade union rights, the federations had decided to fight it out, and now the ball is in the court of the MR and Railway Ministry. The Railwaymen have decided to face challenge, thrown by Railway Board, by organizing massive agitation on 16th March, 2017 at branch level, 23rd March at divisional level and 30th March, 2017 at zonal levels. In the DC/JCM Meeting, held on 07.03.2017 with the Railway Board, AIRF strongly lodged its protest against anti-labour steps of the Railway Board (Ministry of Railways) in general and encroachment on trade union rights by way of issuing orders dated 30.01.2017, in particular, debarring the Supervisory Staff, belonging to Safety Category, working in Grade Pay of Rs.4200 and above from becoming office-bearers of the railway unions. General Secretary AIRF, while expressing his anguish on the attitude of the Ministry of Railways, also pointed out that, despite already arrived at agreements on the following issues, Railway Board have failed to issue instructions for implementation thereof despite lapse of substantial period of time:- (i) Upgradation of apex level Group `C’ staff to Group `B’ Gazetted. (ii) Placement of the Supervisors in the erstwhile Grade Pay of Rs.4800 in place of GP Rs.4600. (iii) Non-implementation of the agreed structure of the Trackmen in the ratio of 10:20:20:50 and their

promotional avenue. (iv) Stepping-up of pay of the Loco Inspectors. (v) Issues related to Running Staff, already agreed upon in the Fast Track Committee. (vi) For financial upgradation under MACPS and regular promotions, existing Bench mark (prior to VII CPC)

should continue. (vi) Regularization of Course Completed Act Apprentices, trained in Railway Establishments, in the Railways,

etc. General Secretary, while expressing serious discontentment over these issues specifically, mentioned that, Ministry of Railways is directly interfering in the functioning of the trade union by issuing dictatorial instructions, which AIRF and the entire Staff Side is not going to tolerate, and that is why, meeting of the DC/JCM is boycotted. Pursuant to the above, it has been jointly decided by both the recognized federations to launch undernoted agitational programme all over the Indian Railways:-

a) 16th March, 2017 Mass agitations, dharnas, demonstrations at the Branch and Depot levels. b) 23rd March, 2017 – Mass agitations by holding dharnas, demonstrations, rallies at the

Divisional level. c) 30th March, 2017 – Massive demonstrations at the Zonal Headquarters, wherein

memorandum addressed to Minister of Railways be handed over to the respective GMs, mentioning therein that, if no corrective action is taken by the Ministry of Railways, organized labour shall be at liberty to go for direct action, entire responsibility of which shall squarely rest with the Railway administration.

All of you are requested to take appropriate action accordingly, and report of the same may be forwarded to AIRF for better appreciation.

PNM/AIRF ITEMS

Item no. 43/2002:-Review of system of construction reserve posts for non-gazetted staff.

On the issue of publication of seniority list of staff having lien in Zonal Railways and working in construction organization as raised by AIRF in PNM meeting, instructions were issued to GMs/CAOs of zonal Railways for further necessary action in this matter vide Board’s letter No.E(NG)II/2002/PO/IR dated 02.06.2016 and 07.09.2016. Federation demanded that feedback regarding the action taken in this regard may be obtained from Zonal Railways, which was agreed.

Item no. 56/2006:-Indian Railway Tourism and Catering Corporation – Catering staff on deputation.

Official side explained that in the case of Shri B.M. Ajith, the concerned employee took absorption in IRCTC and got benefits of an absorbee. Thus, his case is different. However, Federation requested that matter be further discussed with General Secretary/AIRF & EDE (N), which was agreed to. Item no. 26/2008:-Upgradation of Horticulture staff. Matter is under examination in consultation with Civil Engineering Directorate. Item no. 21/2011:-Implementation of recommendations of 6th CPC – Merger of grades – Revised classification and mode of filling up of non-gazetted posts.

Reply from RDSO/Lucknow has been received and the matter is under examination in consultation with the concerned Directorates.

Item no. 25/2011:-Selection for J.E. Pay Band Rs.9,300-34,800 – Eligibility thereof.

Federation requested for a Joint Meeting involving both the Federations, which was agreed to.

Item no. 4/2012:- Special concessions/ facilities to the Railway employees working in Kashmir Valley.

In regard to the demand for Special concessions/facilities to the Railway employees working in Kashmir Valley, Federation had agreed to give a list of other facilities that they demanded in the agenda but are not covered in Board’s letter dated 08.7.2015 and 26.10.2016. Reply has been received from the Federation only on date of holding of separate meeting i.e. 16.01.2017 only. Accordingly, Official side stated that the matter will be examined. Item no. 45/2012:-Appointment on compassionate grounds in the event of death of husband and wife who are both Railway employees. Federation earnestly submitted that, this is an extreme case of hardship and compassion, therefore, Railway Board should re-consider the matter sympathetically. Official Side stated that position already stands explained to the Federation in detail. (Finalised) Item no. 48/2012:-Revision of rate of incentive for acquiring higher academic/technical education during service. Position was apprised to the Federation that the case has been sent to DOP&T for consideration. Item no. 3/2013: Procedure for selection for promotion from GP Rs.1800 to GP Rs.1900 against Departmental Promotion Quota. During the discussion AIRF contended that Board are requested to allow continuance of the existing promotional scope of staff in Grade Pay Rs.1800 to GP Rs1900 and Rs.2000 against 33- 1/3% quota and 16-2/3% LDCE quota in all the zonal railway so as to facilitate promotion of staff of different categories of all the department possessing higher educational qualification. As requested by the Federation, the position would be called from NFR, SER, SR and ER and matter will be examined. Item no. 13/2013:-Non-finalization of latest Avenue of Promotion Chart in case of Parliament Catering Staff after implementation of VI CPC recommendations and merger of grades. Feedback is awaited from Northern Railway. Northern Railway has been reminded in the matter vide Board’s letter No.E(NG)I-2013/CFP/6 dated 09.11.2016. Item no. 16/2013: Appointment on compassionate ground to the wards of medically decategorized staff. Federation insisted that case be re-examined/reviewed. Item no. 19-A/2013: Absorption of contract paramedical staff in Railway Services.

Federation was advised that there is no precedence in this case. The proposal for regularising/absorbing of contract schools teachers in Railways cannot be agreed to. (Finalised) Item no. 30/2013: Fixation of pay of disabled/medically unfit running staff on being appointed against alternative (stationary) posts in revised (6th CPC) pay structure. Necessary instructions have been issued to all Zonal Railway vide Board’s letter No.E(P&A)II-2004/RS-05 dated 29.11.2016. (Finalised) Item no. 21/2014: Non-regularization of the Substitutes after 120 days of their engagement. Federation requested for holding a separate meeting with CPO/RWF/Bangalore in the matter pertaining to regularisation of the Substitute after 120 days of their engagement. Item no. 22/2014: Revision of percentage distribution of posts of Track Maintainers. Federation requested for a separate meeting with AM (CE) in the matter regarding revision of percentage distribution of posts of Track Maintainers. Item no. 26/2014: Allotment of GP Rs.1800 in PB-I to Commercial Porters and Safaiwalas of MTP Railway Kolkata. Federation requested for a separate meeting with DG (Pers.) along with CPO/Metro Railway. Item no. 4/2015: Acceptance of certificates/qualifications awarded by various Boards of School Education in India for the purpose of employment on the Railways. A clarification regarding verification of genuineness of Board and date of acceptability of certificates awarded by various Boards of School Education in India has been sought from Ministry of Human Resource Development and DOP&T. Federation requested to expedite the finalization of the matter. Item no. 20/2015: Mode of selection for promotion to the post of Shunting Jamadar (PB-I + GP Rs.2400) - Traffic/Transportation Department.

& Item no. 57/2015: Change in the promotional procedure of Shunting Master Gr. I & Gr. II. The case is under examination and necessary instructions in the matter will be issued within 15 days. Item no. 21/2015: Absorption of the staff who opted from various Zonal Railways etc. in RCF/RBL. A separate meeting to be held with EDE(N) and CPO/RCF, RBL. Item no. 33/2015: Residency period for promotion from Helper (placed in PB-I with GP Rs.1800) to Technician Grade III (GP Rs.1900). The matter is under review. Item no. 35/2015: Relaxation in educational qualification(i.e. Certificate in Library Science) for filling-up the post of Library Clerk at IRISET, Secunderabad, against Promotee Quota.

The position was explained to the Federation. (Finalised) Item no. 42/2015: Mandatory provision of passing Typing Test in case of promotion to the post of Jr. Clerk-Cum-Typist in the Railways. Instructions have been issued vide letter No. E(NG)I-2015 CPF/7 dated 16.01.2017. (Finalised) Item no. 58/2015: Grievances of RCF/RBL Staff - Incentive to serving railway employees on joining RCF/RBL. Federation requested to discuss the matter in a separate meeting. Item no. 02/2016: Recruitment Rules for introduction and filling-up the initial grade vacancies of Fire Cadre, Metro Railway Kolkata. Matter will be discussed with Metro Railway Administration. Federation requested that, the matter be discussed alongwith Item No.26/2014. Item no. 11/2016: Selection from Group ‘D’ to Group ‘C’ against 33-1/3 % quota and 16-2/3% quota in Civil Engineering Bridge Department of N.F. Railway. Matter to be discussed along with Item No.03/2013. Item no. 12/2016: Modification in the AVC for promotion to Guard (Goods) Grade Pay Rs.2800 against 60% D.P. Quota. Federation was apprised that the matter is under consideration and likely to be finalized in two weeks. Item no. 14/2016: Non-filling up the post of Material Collector/Chaser in Ajmer Workshop of NWR. The issue is being examined based on a reference received from North Western Railway. Item no. 18/2016: Merger of Senior Cashier’s grade with the ADC/IOC post. Matter to be examined in consultation with Pay Commission Directorate. Item no. 27/2016: Transfer of Trackmen/Gatemen and others to Workshop and Traffic Department. Federation requested that the age be reduced for seeking transfer of Trackman/Gatemen and others to Workshop and Traffic Department. Official side stated that age for seeking transfer has already been reduced considerably from 40 to 33 years vide Board’s letter No.E(NG)I-99/CFP/23 (Vol.II) dated 14.11.2013. No further reduction is, therefore, considered possible. (Finalised) Item no. 28/2016: Recording of qualification acquired during intervening period by compassionate ground appointees. It was apprised that though no circular has ever been issued by Board in connection with recording of qualification acquired during intervening period by compassionate ground appointees but as proposed by Federation circular to be issued from Board that Zonal Railway may examine, the requests for recording educational qualification of compassionate ground appointees who acquire such qualification during their waiting period for employment, on case to case basis.

Item no. 33/2016: Appointment on compassionate ground – acquisition of higher qualification. Federation urged that instructions issued vide Board’s letter dated 15.06.2007 be suitably modified in spirit of Railway Board’s letter No.E(NG)II/2003/RC-1/Gen/4 dt. 02.04.2004. Official side stated that the matter would be examined and put up to Board. Item no. 34/2016: Recording of higher academic / educational qualification in the service record of duly appointed candidates. Federation was apprised that while applying for some post through competitive examinations or in the documents during their appointment in Railways, applicants who have mentioned about their uncompleted higher education examination can be considered for recording their higher academic/educational qualifications in their service record. However, past cases for promotion will not be re-opened. Item no. 42/2016: Compassionate grounds appointment to daughter-in-law of the deceased railway employee. Official side stated that extant rules do not permit for such compassionate grounds appointments of near relatives. However, Federation insisted that there may be a situation where there is no other members present or willing to be considered for appointment on compassionate ground and only daughter-in-law is left, then individual cases can be sent to Board with the personal recommendation of General Mangers with due justification and decision can be taken on case to case basis on the merits of the case accordingly. Official Side agreed to Federation’s request. Item no. 43/2016: Filling-up of large number of vacancies of Goods Guard in North Western Railway.

The matter is under examination in consultation with the North Western Railway.

Item no. 44/2016: Eligibility criteria for appearing in selection to the post of OS, PB-II, GP Rs.4200, against 20% LDCE Quota.

The matter is under examination in consultation with the North Western Railway.

Item no. 51/2016: Increasing Promotion Quota percentage for Technician III posts in Diesel/Electric Loco/EMU Sheds on Indian Railways. The matter is under examination and the matter has been referred for re-consideration of Board (ML).

Item no. 55/2016: Advancement prospects for Lab Asstt. of CMT Organisation under Mechanical Department of Indian Railways.

The matter is under examination. Comments have been called from all Zonal Railways.

Item no. 56/2016: Earmarking of quota for employment to widowed/divorced daughters of the railwaymen in the recruitment from open market.

PROCEEDINGS OF THE AIRF WORKING COMMITTEE MEETING HELD ON 13-14 FEBRUARY, 2017 AT MADGAON (KON KAN RAILWAY)

As per notified schedule, Working Committee of All India Railwaymen’s Federation (AIRF) met on 13-14 February, 2017 at Madgaon (Konkan Railway). Com. Rakhal Das Gupta, President/AIRF, was in the chair. This meeting was hosted by National Railway Mazdoor Union (NRMU)(CR-KR), and the names of the Working Committee Members, who attended the meeting, are annexed to these proceedings.

At the outset, Com. Rakhal Das Gupta offered warm welcome to the Office Bearers and Working Committee Members of AIRF present in the meeting, and mentioned that the present Working Committee Meeting is of most significance as we have to discuss; how to face the present scenario in the wake of government’s anti-labour attitude as also to chalk-out detailed strategy to face the secret ballot election scheduled to be held in 2019 for the recognition of the unions in the Railways.

While thanking the host union for making nice arrangements, the President called-upon the participants to deliberate in detail. He reminded that; Konkan Railway was a dream project of Late Prof. Madhu Dandavate, which is now a reality and today we are holding the meeting in this Railway.

Thereafter, Condolence Motion was moved by the General Secretary AIRF, Com. Shiva Gopal Mishra, who read-out the names of the dignitaries who passed away during the intervening period, the names of whom are enclosed as “Annexure B”. A two minutes silence was observed by the House to pay tribute and pray the Almighty God for eternal peace of the departed soul.

The President, while taking-up the agenda, asked the views of the WCMs on the minutes of the last Working Committee Meeting, held at Allahabad (NCR) on 8-10 November, 2016,

which were confirmed unanimously. Thereafter, the President invited the General Secretary to submit his report. On being called-upon, The General Secretary presented his brief report in the House.

At the outset, Com. Shiva Gopal Mishra, General Secretary AIRF, offered warm welcome to all the Office Bearers and Working Committee Members of AIRF participating in the meeting as also to Bro. Mahendra Sharma, Former Regional Secretary (Asia/Pacific Region) ITF, who was Special Invitee on this occasion. He congratulated Com. Venu P. Nair, General Secretary, NRMU (CR), and his team, particularly from Konkan Railway, for making elaborate arrangements for the “Chintan Shivir” at Madgaon.

He then expressed heartily thanks to NCRMU for nice arrangements made while hosting 92nd Annual Conference of AIRF at Allahabad. The General Secretary mentioned that, all the serious issues, including secret ballot election, to be held in 2019, were discussed and deliberated in detail in the WCM held at Allahabad; that continued till late night on 8th November, 2016. He categorically mentioned that, if an organization is strong we can fight any struggle and win. Com. Mishra further added that, we do not want to criticize any other union or organization, but we have to identify our weaknesses and the measures to be adopted to overcome the same. He said that, we are meeting here at Madgaon, as decided in the Standing Committee Meeting of AIRF, held in AIRF Office, New Delhi, on 16.01.2017, as “Chintan Shivir”. He advised to focus on the organization and to analyze the situation created due to political parties in power influencing the Railway Trade Union Movement and impact thereof. The General Secretary further said that, a brief of the major achievements of AIRF would be made available to the participants and many more points may be added in the final document after detailed deliberations. The General Secretary then briefly informed the participants about the updated position and developments in various committees set-up by the government after strike negotiations. He

further said that, Committee on Pensioners was undesirable, but this committee was set-up to study the feasibility of implementation of recommendations of the 7th CPC in regard to Pension, but unfortunately, the committee did not find Option 1, as recommended by the 7th CPC, feasible for implementation. He informed the House that, the committee has finally recommended some new formula which is pending before the Union Cabinet for approval. He also mentioned that, the Staff Side had suggested that, committee’s suggestion should be taken as 3rd Option, and demanded to implement any of the options which is beneficial for the pensioners as per their choice, but the outcome is still awaited.

While talking about Committee on Allowances, he mentioned that, the committee is holding its final meeting to conclude the same shortly, and rumors are in the air including its implementation w.e.f. April 2017, whereby arrears of the allowances of more than one year are likely to be forfeited.

Briefing on Committee on NPS, he mentioned that, we met the Cabinet Secretary, Hon’ble Minister for Railways and other officials of the Government of India, apprising them that, the assurances given during discussions with the Group of Ministers, are not being fulfilled in true spirit.

He further mentioned that, we have demanded Defined Pension and Family Pension and 50% of the last pay drawn as “Minimum Pension” to the Committee on NPS, but it is observed that, this committee is working on streamlining the NPS rather than undertaking a complete review of the NPS. The Committee on NPS has further constituted three subcommittees, and meeting with the third sub-committee, which has been formed to frame the rules of NPS, was held on 10.02.2017. The General Secretary mentioned that, final outcome is yet to be assessed and not clear right now.

The General Secretary also mentioned that, regarding Minimum Wage and Fitment Formula only one meeting was held, and thereafter, there is no further progress in the matter.

The General Secretary further mentioned that, with the merger of the Rail Budget in the General Budget, there appears to be no gain except Rs.1,00,000 crore allocated for Railway Safety for five years virtually, Rupees Five Thousand Crore per year, and the Railways had to contribute Rupees Five Thousand Crore per year while 40% railway tracks need immediate renewal.

The General Secretary, while talking about Railway Board’s letter No.2017 /E (LR) III/ Ref./RB/1 dated 30.01.2017, mentioned that, with these directives, Sr. Subordinates cannot be the office-bearers of the unions. Com. Mishra informed that, Khanna Committee, constituted after a major rail accident of Golden Temple Mail, had also recommended the same thing long back, but the same could not be implemented. As such, without any consultation with the organized labour; Board have issued these orders, which is

a direct attack on the Trade Union Rights, Com. Mishra added. He informed the House that, he had discussed this issue with Hon’ble Minister for Railways, who directed the Chairman Railway Board to sort-out the issue, but our demand is; immediate withdrawal of said letter of the Railway Board, for which we can resort to direct action, if situation so warrants. The General Secretary further mentioned that, he underwent major surgery at Chennai, but in a short time of one-month only I am now in routine, only because of the blessing and good wishes of all of you.

He mentioned that, Bibek Deb Roy Committee Report is getting its way, not only by abolishing separate Rail Budget, but also by many other measures covered in the General Budget, like listing of three Railway PSUs in the finance market (SEBI), which was not even to the prior notice of the Financial Commissioner and Chairman Railway Board, as such, the situation is quite complicated. The General Secretary further mentioned that, by June 2017, nearly five lakh NPS covered employees will be in the Railway Industry and their career and future promotions is another challenge before us, besides around two lakh vacancies in Safety Categories. A Committee for organizing the youth was also formed in the Standing Committee Meeting of AIRF, held on 16.01.2017 in AIRF Office, with Com. S.K. Tyagi as Convener and Com. Venu P. Nair, Com. Mukesh Mathur and Com. Mukesh Galav as Members, to formulate the suggestions. Trainers’ Training Programme in four groups, covering all the Zonal Railways with the help of the ITF, has been chalked-out, and the first programme is scheduled to be held from 15-18 February, 2017 for NRMU(NR), ECRKU and NERMU in Com. T.N. Bajpayee Memorial Hall, 12 Chelmsford Road, New Delhi, and federation will keep record of the trainers, and those found active with the updated exposure will give training to Branch level youth activists in the field, the General Secretary added. The General Secretary, while congratulating the affiliates for well-managed observance of the “Black Day” on 6 th February, 2017, mentioned that, programme on short notice are always well-organized, reflecting vibrant unions He informed the House about the MOU arrived at between All India Railwaymen’s Federation and the Trade Union of Railwaymen and Transport Construction Workers of Russia (ROSPROFZHEL) regarding exchange of groups of officials of the unions. According to MOU, hospitality will be the responsibility of the host union as well two-way fare will be the responsibility of the participants/ unions. While concluding the report; the General Secretary said that, we should remain in all the preparedness for a complete struggle, if our demands are not met in near future.

Com. Mahendra Sharma, Former Regional Secretary (Asia/Pacific Region), ITF, while addressing the WCM, mentioned that, direction cannot be given, but observations can only be shared. He informed that, by 2019, the strength of the NPS Covered employees will be more than 50%. He mentioned that, he submitted a report to the ITF about his study on the youth, and in that he found that, their language

is different and it will be more fruitful, if youth are trained to organize the youth in their own language, keeping them in front and using social media campaign. The President informed the House that, there will be an Open Session of NRMU/KR from 5-7 p.m. and we all must attend the same. He mentioned that, all the unions have to ensure democratic functioning and to provide their accounts to the federation in time. Whenever there are differences within the unions, the federation has to play the role of the Arbitrator, and for that there must be some laid procedure. The WCM must think on these lines. He mentioned that, one spokesperson from one union will be allowed to speak in a limited timeframe.

Com. J.R. Bhosale, Treasurer AIRF, spoke on the background of this two days “Chintan Shivir”, and briefed the glorious history and major achievements of AIRF and mentioned that, AIRF is a federal body and needs strong unions, as such, our democratic functioning is essential. He mentioned that, AIRF has ever opposed to crafts unions/categorical associations, but we should believe in the democracy. He talked about sufferings of some of the zonal unions. He further mentioned that, frustration amongst Senior Supervisors is due to non-consideration of their future advancement in Gazetted Cadre. Railway Board could not manage so far to upgrade 3335 posts of the apex grade supervisors into Gazetted Cadre.

Com. Venu P. Nair, Vice President AIRF, thanked AIRF leadership for holding AIRF WCM at Madgaon in Konkan Railway and desired permission to hold “All India Youth Conference” in Mumbai, and assured that, only National Railway Mazdoor Union will win on Central and Konkan Railways whenever secret ballot elections are held and also NRMU (CR-KR) is in a position to stop the movement of the wheels all over the Central and Konkan Railways within half-an-hour of the notice from the federation.

Mondal, WCM/AIRF/ERMU, Com. Salil Lawrence, AGS/ AIRF, Com. R.C. Sharma, AGS/AIRF, Com. A.M. D’Cruz, AGS/AIRF, Com. Rajinder Singh, ZS/AIRF/RCRMU/KXH, took part in the deliberation and made valuable suggestions, both on the organizational front and various measures to be adopted for preparations of secret ballot elections to be held in 2019, focusing Youth and Women. They spoke on anti-labour policies of the government, backdoor amendment in the labour-laws, through the General Budget, by the government, merger of the Rail Budget the General Budget, National Pension System(NPS), various committees constituted by the Government of India on Minimum Wage/Fitment Formula, Pension/Family Pension, NPS and Allowances, achievements of AIRF, retrograde

recommendations of the 7th CPC, Mission 2019(secret ballot elections), outsourcing/privatization, organization of the Youth and Women and their active involvement in the union, communication, use of the social media, avoidable dragging organizational disputes into the courts, attracting the railwaymen through non-bargaining activities, including sports, cultural and social activities.

They all thanked and appreciated Com. Venu P. Nair and and their team for hosting AIRF WCM magnificently at Madgaon. Com Mukesh Galav presented the paper pertaining to “How to organizing the youth”, and there the committee suggested strategies for involvement of the youth in organization effectively. The General Secretary, while concluding the first day debate, mentioned that, we discussed many serious issues as also proposals of the Committee on the Youth put before you. Northern Railwaymen’s Union has made constitutional amendment for at least one woman office-bearer at all levels, right from Branch to Zonal level and assured that, the feasibility to meet the demand of one AIRF WCM for the Youth will be examined. He further mentioned that, the Standing Committee of AIRF will meet after the Open Session of the Special Convention of NRMU-KR/MAO. In the late evening, the Standing Committee met at 06:00 p.m. and continued its deliberations till 08:00 p.m., and after elaborate discussions, it was decided to strongly protest 30.01.2017 letter of the Railway Board, and in case Railway Board do not withdraw the said letter by the end of this month, AIRF should boycott the DC/JCM Meeting scheduled on 07-08 March, 2017, in consultation with other federation, and sustained struggle programme will be announced in consultation with the Standing Committee.

While continuing the debate; the General Secretary said, “we have to streamline our organization to face the future challenges, including the secret ballot elections, expected to be held in 2019, for the recognition of the unions”. He further added that, “keeping in view the activities of the Engineers’ Association of Railway, our affiliates have also organized well-attended Technical Staff Conferences at different important places”. He also spoke on, how to organize the “Youth and Women” Railway employees to bring them in our fold, for which he also gave some important tips. He opined that, in the wake of day-by-day increasing categorical feelings, it would be quite appropriate to revive Industrial Councils for organizing the staff of different important categories. Com. Mishra also pointed out that, all out efforts should be made to enroll maximum number of Railway employees, including new entrants and women strategically, and we should tackle; extending love and affection to the youth.

Talking about Railway Board’s letter dated 30.01.2017, debarring the Supervisors in erstwhile Grade Pay of Rs.4200 and above, becoming the office bearers of the recognized unions, Com. Mishra mentioned that, this is

direct interference of the Railway Board in the functioning of the unions, which has to be suitably responded.

The General Secretary advised that, we should wait for some time until Committees on NPS, Allowances, Minimum Wage and Fitment Formula submit their reports to the government, and thereafter date of implementation would be discussed in the meeting of the NJCA for deciding the future course of action. Concluding his speech, the General Secretary called upon the affiliated unions to strengthen the organization, right from the Branch level, so that we can successfully face all the challenges ahead.

On being called-upon by the President, Com. Ch. Sankara Rao, AGS/AIRF, placed “Draft Resolution No.1 – Charter of Demands”, which was seconded by Com. Mukesh Mathur, AGS/AIRF. Thereafter, Com. Mukesh Galav, AGS/AIRF, moved “Draft Resolution No.2 – Attack on Trade Unions”, which was supported by Com. S.K. Pandey, VP/AIRF. Subsequently, Com. J.R. Bhosale, Treasurer/AIRF, proposed “Draft Resolution No.3 – Merger of the Konkan Railway with the Indian Railways”, which was seconded by Com. A.M. D’Cruz, AGS/AIRF.

Taking part in the deliberations, Com. Venu P. Nair, VP/AIRF, Com. Bhupendra Bhatnagar, WCM/AIRF/ NWREU, Com. Shyambabu Srivastava, ZS/AIRF/WREU, Com. Sunil Kamthan, WCM/AIRF/NRMU (CR), Com. K. Shiva Kumar, WCM/AIRF/SCRMU, Com. Amit Ghosh, WCM/AIRF/ERMU, Com. Mrs. Harjeet Kaur, WCM/AIRF/NRMU(NR), talked about the onslaught on the trade union movement, Safety in Railways, organizing the youth and women to strengthen the organization and made valuable suggestions.

Com. J.R. Bhosale talked about mobilization of the Railwaymen and getting awakened the rank and file. He emphasized on self-introspection and asserted on organization of the Youth and Women. He also spoke on the achievements of AIRF and asked for widespread publicity of the same. He also talked about anti-labour policies of the Government of India. He stressed on strengthening of the union cadre.

General Secretary AIRF, while replying to the debate, informed the House that, Committee on Allowances is going to submit its report shortly to the Union Cabinet, perhaps recommending its implementation w.e.f. 01.04.2017. Speaking on the issue of the NPS, he emphasized that, two things are crucial, one is Guaranteed Pension and the other Family Pension, for which we are strongly pursuing with the committee. He also expressed the hope that, Committee on Minimum Wage and Fitment Formula would also recommend some improvements. Talking about the future action plan, the General Secretary suggested that, as we have already discussed in detail on the previous day on organizing the youth and women, we should take all steps to organize them in a proper way. He further added that, it would be quite appropriate that, we should hold regular education programmes to educate the youth and women for

bringing them under the fold of AIRF affiliates. He further mentioned that, Zonal Women Conference should also be convened at least once a year. He expressed his satisfaction that, on some of the Zonal Railways, Women Committees at the Zonal level have been properly formed and functioning well, and requested the others to take appropriate steps in this regard, and the Chairperson and Convener should be the Ex. Officio Invitees in different fora, both organizational and policy making. The General Secretary mentioned that, many of our affiliates have youth structure, right from Branch, Divisional, Zonal level, and their conveners are the ex. officio invitees to various meetings of the Branch Council Meeting, Divisional Council Meeting and Central Council Meeting etc. They are also participating in the PNM Fora at different levels. We can do it at the apex level also.

The General Secretary also spoke on merger of the Rail Budget in the General Budget and cautioned the House about the amendments in the labour-laws, which are going to be compiled in four codes, and a lot of retrograde amendments are under the pipeline, wherein “Right to Strike” is also in danger. He further informed that, “Right to Strike” would be restricted during conciliation by the Labour Officers, and no time defined for the same, and heavy penalty, including imprisonment to the leaders, if the unions fail to deposit the fine, registrations of the unions would be difficult and recognition on the mercy of the government/ employer. Heavy penalty to the unions in case of violation of terms and conditions signed during the course of registration, compounding against offences etc. are the provisions being made, the General Secretary informed. He suggested that, all the Central Trade Unions should unitedly fight against these atrocities and dictatorial attitude of the government to maintain democratic character of the trade union movement. Concluding his speech, Com. Mishra called-upon the participants to make appropriate preparations to face the challenges by organizing protest, mass movement etc., and in case the situation warrants, we would not hesitate to resort to “Indefinite Strike”. The President, while concluding the session, briefed about the present situation of the country as also challenges ahead and anti-labour policies of the government. He emphasized on strengthening of the organization. He thanked NRMU (CR) leadership and their entire team for hosting excellently WCM of the AIRF at Madgaon (Konkan Railway). The meeting was concluded with the thanks to the Chair.

Resolutions passed in the AIRF Working Committee Meeting held at Madgaon (Konkan Railway) on 13-14 February, 2017

RESOLUTION NO.1 - CHARTER OF DEMANDS

The Working Committee meeting of All India Railwaymen’s Federation(AIRF), held at Madgoan (Konkan Railway) on 13th and 14th February, 2017, notes with regret that, the assurances held out by the Group of Ministers, appointed for

the purpose of having negotiated settlement with the

Staff Side/NC-JCM and the Government of India on the Charter of Demands, which has resulted in postponement of the Indefinite Strike, which was scheduled to be launched from 06.00 hours of 11th July, 2016, for a period of four months, has not yet been fructified.

The Group of Ministers, headed by Shri Rajnath Singh, Hon’ble Home Minister, had assured the delegation of the Staff Side/NC-JCM on 29th June, 2016 and 6th July, 2016 that, different committees would be formed by the Government to decide the issues of Allowances, Re-fixation of Minimum Wages and Pay Fixation Matrix, Pension and New Pension Scheme. It was also assured that, the committees, so appointed, would decide the issues after discussion with the Staff Side/NC-JCM within a period of four months.

Different committees have been appointed by the Government, discussions were also held with the Staff Side/NC-JCM, but the issues are yet to be resolved. The grievances related to specific departments were also assured to be decided by the particular department in consultation with the Recognized Union/Federation. But these issues are also yet to be resolved, including positive recommendations of the 7th CPC in respect of revision of pay scales and granting of allowances to specific categories.

This has caused widespread discontentment amongst the Railwaymen, therefore, Working Committee strongly demands that, the following issues should be resolved without any further delay so as to ensure industrial peace in the Indian Railways.

1) Re-fixation of Minimum Wage at Rs.26,000 and revision of Pay Fixation Matrix.

2) Grant all the allowances and advances, as demanded by Staff Side/NC-JCM.

3) Scrap New Pension Scheme (now called National Pension System) and grant Pension and Family Pension to all the Railwaymen and other Central Government employees, irrespective of their date of appointment.

4) Implement all the positive recommendations of the 7th CPC in respect of pay sales and allowances to the specific categories.

5) Revise Pay Fixation Formula, rates of Running Allowance and all other allowances now admissible to Loco and Traffic Running Staff and extend Additional Pay to all the categories of Loco and Traffic Running Staff.

6) Settle all the outstanding grievances as embodied in the Strike Charter.

RESOLUTION NO.2 - ATTACK ON THE TRADE UNIONS

On 30th January, 2017, Railway Board have issued orders that, the Supervisors working in Safety Categories, having Grade Pay of Rs.4200 and above(in 6th CPC terms), can become a member of the union, but cannot hold any post of the office-bearers of any recognized union, so that, they could devote their undivided attention to their railway working.

As per provisions of the Indian Trade Unions Act, 1926, no member of a union can be deprived of his right to become an office-bearer of the union. By the instant order of the Railway Board, not only this is an attack on the trade unionism, but also denied the right of an individual to become an office-bearer of a recognized union, even duly elected.

There may be some accidents due to human failure, but according to best of our information, no accident is caused due to negligence of the Supervisors who are union officials. As such, this is an attempt to brandish all the Supervisory Staff, operating the train services, as negligent in their duties without specifying a single instance of dereliction of their duty in any area of their deployment. It amounts to indirect condemnation of their otherwise dedicated/devoted service to the Railways, which each one of them revere as their own department, which facilitate not only their bread and butter, but also help in grooming their wards/families. How can anyone remotely be blamed to be jeopardizing the functional safety of the running trains, which is an inseparable part of the Railwaymen, including the Supervisors.

The Working Committee Meeting of AIRF, held at Madgoan (Konkan Railway) on 13th and 14th February, 2017, registers its strongest protest on the attack on the trade unions by the Railway Board and the Ministry of Railways and demand for immediate withdrawal of Railway Board’s orders dated 30.01.2017 and allow full rights to the member of a trade union as guaranteed under the relevant statute.

RESOLUTION NO.3 – MERGER OF THE KONKAN RAILWAY WITH THE INDIAN RAILWAYS

This Working Committee Meeting of All India Railwaymen’s Federation (AIRF), held at Madgaon (Konkan Railway) on 13th and 14th February, 2017, reiterates the resolution, unanimously passed by the 92nd Annual Conference of AIRF at Jodhpur in October 2015 and further persuaded the same with the Ministry of Railways, for merger of the Konkan Railway with the Indian Railways for all-out development of the areas served by the Konkan Railway and the Railwaymen working in the Konkan Railway.

Sub: Revised Classification and mode of filling-up of non-gazetted posts – Scheme for filling-up of vacancies.

The scheme of filling-up of higher grade non-gazetted posts, both “selection and non-selection”, on the basis of benchmarking, is in vogue on the Indian Railways for quite some time and is working well, facilitating smooth and hassle-free promotions of the non-gazetted staff. This scheme has, therefore, proved its worth, and the delay in the name of selection has virtually been weeded out on its implementation. AIRF had therefore, requested to continue this scheme as “open-ended” forever rather than extending its currency from time to time in installments. In this connection, it is worthwhile to mention that, the undersigned has time and again requested the Railway Board in person and reminded the Board from time to time as also AIRF vide its letter of even number dated 15.12.2016 has requested the Railway Board, followed by reminder dated 20.01.2017, on the subject matter. We would, therefore, seek your personal intervention in the matter, so that timely instructions are issued to all the Railway Administrations to keep this scheme opened forever as the scheme has already expired on 31.12.2016.

Sub: Measures to improve Safety on Indian Railways.

The General Secretaries of the Federations (AIRF & NFIR) met you on 8th Feb 2017 and discussed at length on the above subject and impressed upon you the need to withdraw Board’s letter soon in view of tense situation in the field and widespread resentment among all categories of Railway employees. The Federations desire to re-iterate that the board’s instructions vide letter dated 30th Jan 2017 are blatant violation of the provisions of the Trade Union Act, 1926, industrial dispute Act 1947 as well as violation of fundamental rights to organize as provided in the Constitution. A message has reached far and wide among the Railway employees that the Railway Ministry has deliberately proceeded ahead to trample the constitutional rights of Railway employees. We intend to apprise you that

there is an uproar and fierce anger among all railwaymen against the Board’s decision to take away the rights of employees in violation of the Law of the Land. Though the federations have conveyed to the employees through its affiliated Unions that the CRB has been responsive and positive and decision would be taken by the Board to cancel its instructions, vast majority of Railway employees is unable to reconcile, as feeling of distrust in the management has developed wherein an average Railway worker feels that the Railway Board is pursuing anti-worker policies aggressively. This communication is being sent to you to convey the tense atmosphere in the railways against this draconian decision of the Board and request you to kindly arrange to take immediate action for cancelling Board’s letter dated 30th January 2017 latest before the end of this month in order to restore confidence among railway employees that the management’s attitude is responsive and positive. The Federations, at the same time reiterate their firm commitment that the railwaymen will leave no stone unturned to improve safety to ensure that each & every traveling public reach their destination safely.

Sub: Rates of Overtime Allowance (OTA) to the employees of RDSO.

Strong resentment is prevailing amongst RDSO staff on subjected issue on rates of OTA and NDA being paid to RDSO employees thereby putting them in financial loss since 01.01.2003 i.e. from the date the status of RDSO was changed from an attached office of Railway Board to a Zonal Railway, vide Gazette Notification No.2002/ER/3400/16 dated 11.10.2002. It is to mention that they are still being paid OTA as per rates and other terms of conditions specified in Railway Board’s letter No.E/91/OT/1/RB3 dated 29.5.1991, the rates of which were based on IV CPC rates ranging between Rs.6.25 to Rs. 16.50 per hour. Which is shear injustice with them when VII CPC pay scales are implemented. Further, attention is drawn towards Night Duty Allowance (NDA) being paid to RDSO employees is not based as per “continuous” staff which is clear violation of extant statutory provisions contained in section 130 of the Railway Act 1989. AIRF is of the firm opinion that Rules in vogue on Zonal Railways be strictly followed in RDSO also and same rate of OTA and also NDA treating them as “Continuous” employees be paid along with arrears.

Observance of the 3rd Death Anniversary of Late Com. Umraomal Purohit, former President AIRF

The 3rd Death Anniversary of Late Comrade Umraomal Purohit, Former President AIRF, was observed on 27th February, 2017 by all the affiliates of AIRF by paying floral tributes to him.

Office Bearers of the unions recalled their memories with Com. Purohit Ji and talked about the contributions made by him for the upliftment of the Railwaymen in particular and the working class in general.

In a well organized programme by NRMU (NR) in New Delhi, floral tributes were paid to Com. Purohit by the union office bearers and the activists present on this occasion.

Recalling his memories with Purohit ji, Com. Shiva Gopal Mishra, General Secretary, AIRF-NRMU, said, Com. Purohit ji was a great leader who dedicated his life for the upliftment of Working Class across the globe.

WREU observed ‘Mazdoor Ekta Diwas’ on 27.03.2017, on the occasion of 3rd Death Anniversary of Late Com. Umraomal Purohit, Ex. President / WREU / AIRF /ITF. A seminar on “12 Point Charter of Demands of Central Trade Union Co-ordination Committee and proposal of Government for replacing the existing labour laws into 4 Labour Codes” was organized by WREU. . All the leaders and participants paid floral tribute to Com. Purohit and observed two minutes silence in memory of Late Com. Purohit ji.

SPECIAL GENERAL MEETING OF NRMU (CR) HELD AT MADGAON (KONKAN RAILWAY)

The “Special General Meeting” of National Railway Mazdoor Union was held in the evening of 13th February, 2017 in the nicely decorated ground of the Community Hall at Madgaon under the leadership of Com. Nitin Pradhan and Com. Venu P. Nair, President and General Secretary of the union.

At the outset, Com. Nitin Pradhan, while delivering his welcome address, also pointed out that, an important resolution on Merger of the Konkan Railway with the Indian Railways was duly adopted by the 91st Annual Convention of AIRF, held at Jodhpur in 2015 and the same was also ratified by the AIRF WCM as well.

Shiva Gopal Mishra, General Secretary AIRF, appreciated that, the cadre of NRMU (CR) is continuing with the same zeal and enthusiasm as was after winning the KRCL elections in 2015. He further mentioned that, the name of NRMU (CR) – KRCL is called proudly and is highly popular among the Railwaymen and the two months long struggle of Com. Venu P. Nair and his team is unprecedented for. He stressed that, if Kolkata Metro Rail can become a Railway Zone, then why not the KRCL. He also talked about outsourcing/privatization in the Railways. Assuring the massive gathering he said that, the Government of India would have to pay due attention towards whatever decision is taken by AIRF at Madgaon. He emphasized that, AIRF would not tolerate any types of privatization/outsourcing in the Railways. He said that, all this is being done towards implementation of recommendations of Bibek Deb Roy Committee. He also talked about merger of the Rail Budget in the General Budget. He said that, efforts are on from the government to dismantle the unions and the federations; AIRF will fight it tooth and nail and will not allow it. He further said that, we have full believe that, whenever AIRF gives any call to stop train services, NRMU will do this successfully. He added that, while the committees constituted by the government are functioning, but positive outcome from these committees is still awaited. “If Railway Board do not take back their orders of 30.01.2017, AIRF

will be compelled to take concrete steps”, Com. Mishra warned. He further added that, AIRF is always with KRCL employees, and expressed his hope for a better future of these employees.

Shri Sanjay Gupta, Chairman-Cum-Managing Director, while thanking NRMU leadership for holding their Special Meeting at Madgaon, extended warm welcome to AIRF leadership at Madgaon. While appreciating the Railwaymen working in the KRCL, he said that KRCL plays a vital role in the Indian Railways and also sought cooperation from NRMU for smooth running of KRCL. Com. Rakhal Das Gupta emphasized on merger of the KRCL with the Indian Railways. He talked about retrograde recommendations of the 7th CPC and various committees constituted by the Government of India to review Minimum Wage and Fitment Formula, Allowances, Pension/Family Pension and NPS. He also spoke on major strike demands of the federation. Thereafter, a cultural programme was organized.

112th BIRTH ANNIVERSARY OF LATE. COM. MANIBEN KARA

WREU (E&M) BRANCH, DHD have observed 112th Birth Anniversary of Late Padmashree Maniben Kara on13th

February 2017. On this occasion, Com. P.S.Harsh, Com. C.J.Singh, Com. Naeem Ahemed, Com. Omprakash Pandey and Com. Imtiyaz Malik Joint Secretary WREU (W/S) and large number of WREU activists were also present at the Railway Secondary School Dahod.

On this occasion, A Health Education Programme was organised for the students. More than 200 students attended the same. This programme began with garlanding the potratit of late Com. Maniben Kara by Com. Imtiyaz Malik Joint Secretary WREU (W/S). Dr. Mohit Desai and Com. P S Harsh summoned the gathering by telling about general health education in detail and at the end the question answer session was also conducted in which many students actively participated. At the end of the programme, Com. P.S.Harsh, AGS/WREU and Branch Secretary WREU E&M DHD thanked all the activists and also appreciated the spirit of all.

Training for Trainers programme from 15th to 18th February, 2017

ITF and AIRF jointly organized four days educational programme for trainers at Com. T.N.Bajpai Hall, New Delhi from 15th to 18th February, 2017, large number of participants attended the programme. On the occasion of opening session, Com. Shiva Gopal Mishra, General Secretary/AIRF, said that, it is today’s need that, Railway Youth Worker should aware about their union and the activities. They should know, “What is trade Union, History of Trade Union, success, achievements and struggle of Trade Unions.”

He further said to the trainees that, after taking this training programme, you all would train your youth comrades in the branches.

Com. Mishra, told that we have took a decision at Madgao in AIRF’s Working Committee Meeting that we will organize such more training programmes. Wherein, training will be provided to all the zonal youth workers.

In this four days workshop, around 40 trainees were trained by Mrs. Nishi Kapahi, Com.Arvind Kumar, Com. Sangam Tripathi from ITF and Com. S.P.Singh/lecturer.

Major Issues discussed in the programme were “organizational development, leadership development, skill development, organisation’s history, social media, and other problems of the Youth Workers” etc.

OBSERVANCE OF THE “INTERNATIONAL WOMEN’S DAY – 8th MARCH 2017”

The “International Women’s Day - 8th March 2017” was celebrated across the country by the all affiliates of AIRF with full zeal and enthusiasm with the theme “Be Visible” to campaign for and secure women Transport Workers’ Rights and increase their visibility and participation in Trade Union Movement.

In the largely attended programmes, union officials, while briefing about the background of the International Women’s Day, talked about women empowerment as also their role in trade union movement.

Health check-up, blood donation camps, cultural programmes, sports activities, workshops/seminars focusing on women rights and their problems and many more activities were also organized by unions on this occasion.

In one of the well organize programme of Accounts Division of NRMU at New Delhi, International Women’s Day – 8th March, 2017,. The programme was inaugurated by Com. Shiva Gopal Mishra, General Secretary, NRMU-AIRF, while talking about the women empowerment he said, “it is a matter of satisfaction that, women are taking part actively in the trade union activities. He said, “I know that, major concern of the women employees is curtailment in the Child Care Leave by the 7th CPC”. He further said, “AIRF, being free, democratic and an independent organization, will leave no stone unturned for the sake of the employees as well as Railway Industry”. “We are committed to fight for justice and right for the last employee in the Railway Industry”, he added.

Sister Nishi Kapahi, Women Coordinator, Asia/Pacific Region ITF, also graced the occasion.

The programme was conducted by Com. Ms Jaya Agarwal, Convener, Women Wing AIRF. She explained

NRMU, Delhi Division also organized International Women’s Day at Rajdhani Complex, New Delhi on 08.03.2017 with enthusiasm and zeal.

On this occasion, Com S.K.Tyagi, President/NRMU congratulation to all women workers of Indian Railways. He further said “AIRF/NRMU knows all problems of women workers and always try to resolve them.”

A decent program was organized by NRMU Women’s Committee Headquarters Division in T.N. Bajpai Memorial Hall, 12 Chelmsford Road, New Delhi on 8 th March ,2017 to celebrate International Women’S Day where in around four hundered fifty women employees.

The function was inaugurated by Secy. NRWWO Smt. Anjana Kumar on behalf of President /NRWWO Smt. Manasi Kulshreshth. The General Secretary A.I.R.F Sh. S.G. Mishra was the Chief Guest of this function and Shri S.K. Tyagi President of NRMU was the guest of honour, and other hon’ble guests also attended the programme.

Smr. Anjana Kumar Secy./NRWWo also congratulated the women committee for organizing such a decent programme. In the speech, she further added social evil lie Dowry, gender discriminations, and exploitation women at work place and elsewhere are still prevalent in our society and need to be eradicated byu our sincere consistent efforts.

On this occasion Dr. Praveen Kumari Singh Cpo/admn also gave valuable thoughts on this occasion.

NRMU, Lucknow Division also organized International Women’s Day in Union Bhawan at Charbagh, on 08.03.2017 with enthusiasm and zeal. Large number of women workers attended the programme.

NRMU/CR- Zonal conferences

Zonal Conference of Engineering Staff was held at Kalyan Institute Mumbai on 03-03-2017. Com. Shiv Gopal Mishra, GS/AIRF has graced the occasion with his presence. Com. Subhash Patil, WP was in the chair.

An introductory speech was given by Com. Vivek Nair, AGS. He has presented various issues related with the engineering staff which includes P.way, Track machine depot, USFD, Civil engineering and bridge staff. Representatives from various divisions were invited to speak on their issues.

While addressing the Conference, Com. Venu P. Nair, General Secretary retorted that this conference is being organized not because that somebody demanded but is done as part of the vision of NRMU to organize the whole workers’ fraternity of Central Railway including Engineering

Staff, at various locations. He urged the workers to be trustful to the NRMU & AIRF as we only will be able to prevent the disintegration of the Railway industry.

Com. Shiva Gopal Mishra, GS/AIRF has thanked Com. Venu P. Nair, for inviting him to attend this conference. He elaborately explained the present development in regard to the delay of extending the benefit of allowances and various other issues such as the minimum pay of Rs. 26000/-, the revision of fitment factor, restoration of interest-free advances and other allowances. He called upon the staff to prepare them for aggressive agitations to withstand the identity of workers and to protect the staff. He also cautioned the staff about conspiracy of the Govt. to withdraw all privileges and rights of staff and to oppose the restriction being imposed upon the Trade Union activities. All were asked to commit themselves to render their maximum support in all its future struggle movements as it has become imperative due to the adamant attitude of the present Govt. He also explained about the demand of Federation to withdraw the NPS, implementation of LARSGESS Scheme to all Railway staff, need of reduction of workload, and working hours, fatal effect of privatization & infusion of FDI, enlistment of corporatized wings of Indian Railway to stock market, loss of autonomous identity of Railways after merger of Railway budget with General Budget, amendment on pass rules and proposals of amendment of Trade Union Act, Labour Laws and Industrial Dispute Act. He declared that AIRF is committed to oppose all proposed policies that are intended to aggressively enforce by the Govt. against the interest of staff. He reiterated his appeal to stand strongly behind Com. Venu P. Nair, General Secretary of the Union who is excellently leading NRMU with all its aggressiveness and complimented him to organize such a successful conference in this trying period.

Zonal Conference of Ministerial, Accounts & Stores held on 27-2-2017 at Mumbai.

The zonal staff conference of Ministerial, Accounts and Stores departments has held on 27-2-2017 at CSTM auditorium in a very impressive manner. Com. J.R. Bhosle, Treasurer, AIRF and GS/WREU, com. Mukesh Mathur, AGs/AIRF, GS/NWREU, Rajsthan State President of HMS have graced the occasion with their presence as chief guest. Com. Nitin Pradhan, President of NRMU was in the chair and have conducted the proceedings of the conference. Com. Arun Manore, WP, Com. Vivek Nair, Com. B.L. Yadav, Com. Jayalakshmi. M, Com. Kamakshi Bagalwadikar (AGSs/NRMU), Com. P.J. Shinde, Zonal Treasurer/NRMU and Com. Sunil Kamthan, DS/PA were on the dias.

Com. J.R. Bhosle has inaugurated the function. During his inaugural address to the audience, he has inspired them reminding the importance of these categories in regard to

Com. Mukesh Mathur, while delivering his keynote address, complimented Com. Venu P. Nair, GS for organizing such a successful conference amidst various challenges that are being faced by Railwaymen in general and staff of ministerial, accounts and stores in particular.

While delivering his address, Com. Venu P. Nair, GS complimented all for the success of the conference and have reminded the importance of the day as it is holding on Maharashtra Marathi Divas. He called upon the staff not to bear excessive stress due to extra workload and urged them to ensure active participation in all endeavours of NRMU to protect the rights and privileges of the staff. He extended vote of thanks to all the dignitaries and the participants for the success of the programme.

Railway Board’s Order

Sub: - Revised Classification and mode of filling up of non-gazetted posts – Scheme for filling up of vacancies after 31.12.2016.

Ref: - Board’s letters of even no dated 03.09.2009, 07.06.2010, 21.11.2011, 23.05.2012, 15.01.2013, 24.05.2013, 03.01.2014, 16.06.2014, 31.12.2014, & 09.02.2016 on the above subject.

Attention is drawn to Board’s order issued on 03.09.2009, consequent upon implementation of 6th CPC recommendations, regarding mode of filling up of Non-gazetted posts consequent upon merger of grades. The above scheme of such mode of filling up of non-gazetted posts has since been extended from time to time, last validity being till 31.12.2016.

2. 7th CPC, in its report in para 5.1.45 has recommended that benchmark for performance appraisal for MACP as well as for regular promotion be enchanced from ‘Good’ to ‘Very Good’. While recommendation for MACP has been accepted by Government and instructions in this regard have been issued vide Board’s letter NO.PC-V/2016/MACPS/1 dated 19.12.2016 (RBE No.155/2016), the issue regarding benchmark for regular promotion is still under examination in consultation with DoP&T.

3. Accordingly, it has been decided by the Board that till such time instructions for benchmark for regular promotion are issued, the existing methodology and benchmarks for promotion, as enumerated in the Board’s letters referred to above, may continue till further orders.

Sub: - Promotion from GP Rs.1800 (Level-I) to GP Rs.1900(Level-2) against 16-2/3% quota — Minimum eligibility condition of service for selection.

As the Railways are aware, in terms of Board’s letter dated 10.10.2000, 16-2/3% of the posts in the lowest grade of Commercial Clerks, Ticket Collectors, Trains Clerks, Offices Clerks and other categories of Clerks like Stores Clerks, etc. are filled by promotion of Matriculate erstwhile Group ‘D’ employees with a minimum of two years service

in the concerned seniority units entirely on merit on the basis of a competitive examination.

2. A question has now arisen as to whether any relaxation in two years of service condition is to be given to SC/ST candidates to appear in the selection for promotion from GP Rs.1800 (Level-I) to GP Rs.1900 (Level-2) against 16-2/3% quota being filled up on the basis of merit.

3. Accordingly, it is clarified that SC/ST employees in GP Rs.1800 (Level-I) will be eligible for consideration in the selection for promotion to GP Rs. 1900 (Level2 an above against 16-2/3% promotion quota only on completion of two years regular service in the concerned seniority unit.

Sub: - Setting up of Anomaly Committee to settle the anomalies arising out of the implementation of the Seventh Pay Commission’s recommendations.

Ministry of Personnel, public Grievances and Pensions, Department of Personnel & Training vide OM No. 11/2/2016-JCA, dated 20.02.2017 as incorporate the following modification in the definition of anomaly:

“Where the Official Side and the Staff Side are of the opinion that the vertical and horizontal relativities have been disturbed as a result of the 7th Central Pay Commission to give rise to anomalous situation.”

With the incorporation of the above Para in the OM the definition of anomaly will read as follow:

(1) Definition of Anomaly:-

Anomaly will include the following cases:

a) Where the Official Side and the Staff Side are of the opinion that any recommendation is in contravention of the principle or the policy enunciated by the Seventh Central Pay Commission itself without the Commission assigning any reason;

b) Where the maximum of the Level in the Pay Matrix corresponding to the applicable Grade Pay in the Pay Band under the pre-revised structure as notified vide CCS(RP Rules 2016, is

less than the amount an employee is entitled to be fixed at, as per the formula for fixation of pay contained in the said Rules;

c) Where the Official side and the Staff Side are of the opinion that the vertical and horizontal relativities have been disturbed as a result of the 7th Central Pay Commission to give rise to anomalous situation.

The rest of the content of the OM dated 16.08.2016 shall remain unchanged.

Sub: - Filling up of the posts of Dresser Gr.III/OTA Gr.III PB-1 Rs.5200-20200 + GP Rs.1900 (Level-2) in the Medical Department.

Reference Board’s letter of even number dated 03.05.2016 which, provides that 50% vacancies in the category of Dresser Gr.III/OTA Gr.III in GP Rs.1900 (Level-2) may be filled from amongst those Hospital Attendants who are having the qualification of Matriculation (10th Pass) as per the extant procedure contained in Railway Board’s letter No.PC-V/98/1/11/18(A) dated 10.05.1998.

2. A doubt has arisen as to whether only Hospital Attendants and not other erstwhile Group ‘D’ categories as mentioned below are eligible to appear in the selection. In terms of provisions contained in para 182 of IREM (Vol.I) all Railway servants employed in the Hospitals like Hospital Attendants, Orderlies, Dispensary Peons, stretcher Bearers, Watchmen, Safaiwalas or Sanitary Cleaners etc. should be eligible for promotion as Dresser and Laboratory Attendants. For this purpose the eligible railway servants should be screened by holding a suitability test to determine whether they are educationally up to the required standard and have the necessary aptitude. The Railway servants considered suitable should be given training as may be necessary which they should successfully complete before they are finally promoted.

3. the matter has been examined and it is clarified that in partial modification of Board’s letter under reference, all the erstwhile group ‘D’ categories like Hospital Attendants, Orderlies, Dispensary Peons, stretcher Bearers, Watchmen, Safaiwalas or Sanitary Cleaners etc. which are eligible otherwise in terms of para 182 of IREM (Vol.I) will continue to be eligible to appear in the selection for promotion as Dresser Gr.III/OTA Gr.III along with Hospital Attendants against 50% vacancies.

Sub:- Grant of Advances – 7th CPC recommendations amendment to rules on Computer Advance to Railway servants.

Consequent upon the decision taken by the Government on the recommendations of Seventh Central Pay Commission, the Ministry of Finance vide their OM No.

12(1)E.II(A)/2016 dated 07.10.2016 have amended the eligibility criteria in the existing provisions relating to the grant of Personal Computer Advance.

2. Amendment conditions of grant of Computer Advance are as follows:

Advance Quantum Eligibility Criteria

Personal Computer Advance

Rs.50,000/- or actual price of PC,

whichever is lower.

All Government Servants

The Computer Advance will be allowed maximum five times in the entire service.

The other terms and conditions governing the grant of Personal computer advance shall remain unchanged.

3. Further, Ministry of Finance in their ibid OM have also decided that the other interest bearing advances relating to Motor Car Advance and Motorcycle/Scooter/Moped Advance will stand discontinued.

4. the above mentioned OM of Ministry of Finance relating to grant of interest bearing advances will apply mutatis-mutandis to Railway employees also.

4.1 So far as the interest free advances are concerned, Bicycle and Warm clothing advances stands abolished for Railway employees also in terms of MoF’s decision.

4.2 Orders relating to other interest free advances will be issued separately by concerned Directorates.

5. Necessary advance Correction slip to the chapter XI of the Indian Railway Establishment Manual, Vol.I Revised Edition, 1989 will follow.

6. the revised orders are effective from 07.10.2016 i.e. the date of the issue of the aforesaid OM of the Ministry of Finance. Past cases where the advances have already been sanctioned under the Provisions of earlier rules on the subject need not be reopened. (No.F(E)Spl./2016/ADV.4/1(7th

Sub: Admissibility of Qualification Pay to Appendix III qualified staff in the V and Vi CPC from 01.01.1996 and 01.01.2006 or the date from which an individual elects to draw pay in the revised scale of pay under Railway Services (Revised Pay) Rules, 1997 and 2008.

The rates of Qualification Pay in respect of Appendix III qualified staff was revised in the V CPC period in terms of the instructions contained in Board’s letter No. E (P&A) I-98/SP-1/Genl/1 dated 09.10.1998 and were admissible from 01.08.1997. In the VI CPC the rates were revised vide

Board’s letter No.E(P&A)I-2009/SP-1/Genl.1 dated 30.04.2010 and were admissible from 01.09.2008.

2. The NFIR (Item No. 9/2012) and AIRF (Item No. 8/2016) had raised a demand in the PNM Forum for antedating the date of effect for grant of Qualification Pay to appendix III qualified staff in the V and VI CPC period.

3. The issue has been examined in Board’s Office and it has been decided that Qualification Pay to Appendix III qualified staff in V and VI CPC period may be made admissible as it was done in the case of Appendix II qualified staff vide Board’s letter No.E (P&A)I-2012/SP-1/Genl-1dated 19.06.2012 and No.E (P&A)I-2012/SP-1/Genl-1dated12.09.2012. Accordingly, the revised Qualification Pay as indicated in para1 above would be admissible in the following manner:-

a) In the V CPC pay structure, the revised rate of Qualification Pay to Appendix III qualified staff would be admissible from the date an individual

elects to draw pay in the revised scale of pay under Railway Services (Revised Pay) Rules, 1997, instead of 01.08.1997.

b) In the VI CPC pay structure, the revised rate of Qualification Pay to Appendix III qualified staff would be admissible from the date an individual elects to draw pay in the revised scale of pay under Railway Services (Revised Pay) Rules, 2008, instead of 01.09.2008. It is also clarified that the rate of Qualification Pay in respect of Appendix III qualified staff would not increase by 25% every time the DA payable on revised pay scale goes up by 50% as it is being treated as part of pay and is being taken into account for the purpose of pay fixation on promotion to the next higher post.
