BACKGROUND INFORMATION
o Disadvantaged business enterprise
o USDOT’s DBE Program was established to:o Remedy ongoing discrimination and the continuing effects
of past discrimination in federally-assisted highway,
transit, and airport contracting markets
o Level the playing field by providing small businesses
owned and controlled by socially and economically
disadvantaged individuals a fair opportunity to compete
for federally funded transportation contracts*

DBE PROGRAM ELIGIBILITY GUIDELINES
o At least 51% ownership by socially and
economically disadvantaged individuals
o Small business (defined by SBA standards)
o Personal net worth <$1.32 million
o Independent business
o Disadvantaged owner(s) must manage and
control the business

SOCIAL DISADVANTAGE – INDIVIDUAL DETERMINATIONS
o If not a member of a disadvantaged group
as defined by SBA, the burden of proof lies
on the applicanto Race, ethnic origin, gender, disability, long-term
residence in environment isolated from mainstream, etc.
o Personal experiences of substantial and chronic social
disadvantage in American society
o Negative impact on entry into or advancement in the
business world because of the disadvantage

CERTIFICATION PROCESS – ON-SITE VISIT
o The on-site visit is an interview between
the business owners, key personnel and
the certifying agent or their designee
o Verifies information in application
o Determines if applicant has the knowledge
and equipment to perform work type(s) in
which they are seeking certification

CERTIFICATION PROCESS - TIMEFRAMES
o Certifying agency must request missing
documentation or notify applicant of
complete application within 30 days
o Certification process may take up to 90
days once application deemed complete
o Additional information may be requested
at any time during the process

INTERSTATE CERTIFICATION
o A firm must originally get certified in its
home state. Once a firm is certified its
owner(s) can seek DBE certification in
other states
o To apply in Ohio, out-of-state firms must
submit Interstate Certification Request
form and required documents

NOTICE OF CHANGE
o DBEs must provide timely notice of
changed circumstances affecting ability to
meet DBE program requirements or any
material change in application information
o Sworn affidavit or unsworn declaration
under penalty or perjury
o 30 days of occurrence

ANNUAL DECLARATION
o Each year, DBEs must (truthfully) declare
no changes* affecting ability to meet DBE
program requirements and no material
changes in application information
o Must submit most recent federal business
tax return

SUPPORTIVE SERVICES
o The DBE Supportive Services Program is limited only to DBE construction and consulting firms that have the capability, equipment, and experience to work on ODOT heavy highway construction and engineering projects

SUPPORTIVE SERVICES
o DBE firms will have an annual $10,000 assistance cap limit per federal fiscal year for supportive services on a first come first serve basis. The limit applies as long as funds are available
o DBE firms must submit a Needs Assessment Survey each calendar year to the Office of Small and Disadvantaged Business Enterprise prior to approval for any DBE Supportive Services
o Complete the Supportive Services Application

SUPPORTIVE SERVICES
o The Needs Assessment Survey is located on the Resources page at ODOT’s Division of Opportunity, Diversity, & Inclusion’s website:
o DBE firms must submit a business plan prior to requesting any DBE Supportive Services
o DBE firms participating in the Mentor/Protégé Program will receive priority Supportive Services over firms not participating in the Mentor/Protégé Program.

SUPPORTIVE SERVICES
o DBE firms that have no intentions of
performing or bidding on any ODOT heavy
highway construction or engineering
project will be denied supportive services.

REIMBURSABLE EXPENSES
o Technical training associated with the DBE firm’s core area of business operations
o Registration fees for industry related events/seminars associated with the DBE firm’s core area of business operations
o Software and/or software licenses associated with the DBE firm’s core area of business operations

REIMBURSABLE EXPENSES
o Financial Audit/Review will be reimbursed up to $10,000 (this counts toward the $10,000 per company cap limit) for the DBE firm’s ODOT prequalification
o Books associated with the DBE firm’s core area of business operations
o Consulting Services (new) – includes Business Development/Marketing, Estimating and Bidding, Bond Readiness/Packaging and Insurance, Accounting, Website Development, and Legal Services

REIMBURSABLE EXPENSES
o Lodging up to $85.00 per night to DBE firms that attend seminars/trainings/industry related events within the United States that are directly related to the company’s core area of business operations. Travel, meals, and parking are non-reimbursable expenses
o Tuition expenses for one undergraduate course per quarter, semester, or trimester. Lab fees, costs associated with purchasing books and materials may also be reimbursable providing the course is related to the company’s core area of business operations

PROCESS FOR REQUEST FOR REIMBURSEMENT
o All requests for reimbursement must be received at least thirty (30) days prior to the course/seminar/training date, purchase of software or the performance of the financial audit/review
o Reimbursements will not be processed for any purchases made prior to receiving approval from ODOT

APPROVAL/DENIAL OF REQUEST FOR REIMBURSEMENT
APPLICATION
o The Request for Reimbursement Application will be approved or
denied within fifteen (15) days of receipt of application
o DBE will need to provide supporting documentation for the
course/seminar/training that was attended, proof of purchasing
the computer software or the financial audit/review that was
performed

MENTOR/PROTEGE
o This is a two year partnership involving existing businesses
that agree to work together to address matters necessary to
help enhance the protégé business’s success
o Ohio Contractors Association and the American Council of
Engineering Companies are devoted to support the growth of
heavy highway and consulting engineering firms

MENTOR/PROTEGE
o Admission to the ODOT Mentor/Protégé Program is by application
o Once accepted, each Protégé is paired with a Mentor
o Working together, the Mentor focuses on assisting the Protégé in developing a business plan, developing marketing strategies, understanding financial statements, and identifying and implementing other action items needed to meet the Protégé firm’s goals

o When Supportive Services Application is released in January, firms can
apply to Capacity Building and Mentor Protégé.
o All firms will need to complete the application to participate in
supportive services programs.
