the importance of adjudication to

the construction industry, its

success and how the South African

courts support the system.

Master Class Curriculum

The concept of adjudication

Why adjudication?

The rise and rise adjudication

Adjudication in standard form

contracts

The approach of South African

courts through the cases

Proposed legislative support for

adjudication in construction

contracts.

Benefits of Attending

It is no secret that the local

construction industry lost interest in

domestic arbitration as the

favoured means of resolving

disputes some time ago. The cost

and time associated with resolving

generally complicated

construction disputes has meant

that it is simply not worth arbitrating

the vast majority of disputes arising

under construction contracts.

Additionally, the local Arbitration

Act allows wide latitude and scope

for the review of arbitration awards,

resulting in further delay and cost.

The inclusion of contractual

adjudication in standard form

contracts and the willingness on

the part of the judiciary to enforce

the decisions of adjudicators has

seen a significant increase in the

numbers of adjudications, mostly in

main contracts between

employers and contractors.

The speed and cost-effectiveness

of adjudication are of great benefit

year to give candidates an

opportunity to go through an internship

brief over and above existing

information from the SACPCMP.

In order to provide a balanced and

focused Masterclass programme to

candidates it expected that a formal

programme will be followed.

This framework proposal provides an

articulation of the specific outcomes

for Masterclass; General fundamentals

of Candidature; Specific issues under

each professional candidature;

Preparations for experiential reports

and reports content issues; and core

requirements for successful

candidature. Details of what will be

covered under each of the

documentation will be provided in the

next sections of this document.

Master Class Curriculum

What is candidature? – clear discussion

of what candidature entails and

generally what is expected of the

candidate serving the professional

candidate period

Discussion about candidate basic

norms during the candidature period

The candidate as a pro-active

individual – the need to remain

focused on professional knowledge

base and how it is linked to acquisition

of professional skills

Expected challenges which could be

faced by the candidate & how these

issues could be dealt with by the

candidate

Candidate relationship with the

mentor and the dynamics of learning

from the mentor.

Benefits of Attending

a one-day practical training

course should familiarise the

attendee with how to deal with

challenges (objections) to the

jurisdiction of the presiding

officer within the dispute

resolution process.

The purpose of the course is to

facilitate the understanding of

challenges to the jurisdiction of

presiding officers. The

knowledge gained might assist

those dealing with construction

disputes to operate in an

environment of trust and

transparency, with a clear

understanding of their

respective roles and

obligations when dealing with

challenges to the jurisdiction of

presiding officers.

Masterclass Curriculum

We answer the question: Does

the presiding officer have the

legal power and authority to

hear, act and adjudicate over

the dispute?

The course might equip the

attendee with a better working

knowledge and understanding

of how to deal with challenges

to the jurisdiction of the

presiding officer and provide

the attendee with tools and

techniques when confronted

with such challenges, usually

during adjudications and

arbitrations.

If a dispute is referred to

adjudication or arbitration as

part of the process to resolve

the dispute, the adjudicator or

arbitrator as the presiding

officer may be confronted with

a challenge by one of the

parties regarding his jurisdiction

to deal with the matter. The

to disputes which would be

uneconomical to arbitrate.

International experience has shown

that not only are disputes resolved

more quickly and cost-effectively,

but that arbitration has reduced

significantly.

There is no doubt that the ability to

resolve disputes swiftly and cost-

effectively through adjudication is

beneficial to the construction

industry. Understanding what the

process is and how it works is now a

crucial

Understand candidature challenges

and their respective solutions

Understand the dynamics of bridging

the gap between professional

knowledge-base and skills acquisition

during the candidature period

Understand the process of writing

project reports towards professional

interview

Understand professional specific issues

when writing projects

Understand the dynamics of

progression from the candidate stage

to professional interview stage

Understand underlying professional

registration issues and their implications
