It is no secret that the local
construction industry lost interest in
domestic arbitration as the
favoured means of resolving
disputes some time ago. The cost
and time associated with resolving
generally complicated
construction disputes has meant
that it is simply not worth arbitrating
the vast majority of disputes arising
under construction contracts.
Additionally, the local Arbitration
Act allows wide latitude and scope
for the review of arbitration awards,
resulting in further delay and cost.
The inclusion of contractual
adjudication in standard form
contracts and the willingness on
the part of the judiciary to enforce
the decisions of adjudicators has
seen a significant increase in the
numbers of adjudications, mostly in
main contracts between
employers and contractors.
The speed and cost-effectiveness
of adjudication are of great benefit

information from the SACPCMP.

hear, act and adjudicate over
the dispute?
The course might equip the
attendee with a better working
knowledge and understanding
of how to deal with challenges
to the jurisdiction of the

the attendee with tools and
techniques when confronted
with such challenges, usually
during adjudications and
arbitrations.
If a dispute is referred to
adjudication or arbitration as
part of the process to resolve
the dispute, the adjudicator or
arbitrator as the presiding
officer may be confronted with
a challenge by one of the
parties regarding his jurisdiction
to deal with the matter. The

that not only are disputes resolved
more quickly and cost-effectively,
but that arbitration has reduced
significantly.
