Formulate uniform compensation scheme for rape victims: SCNEW DELHI, Feb 11:

The Supreme Court todaydirected all states and UnionTerritories to formulate a uniformscheme to provide compensationto the victims of rape and sexualexploitation, especially thosewho are physically handicapped,saying there was “need to intro-spect” on their rehabilitation.

The apex court said theyshould consider and formulateprogrammes for such victims inthe light of the scheme framed inGoa which provides compensa-tion of up to Rs 10 lakh.

“All the States and UnionTerritories shall make all endeav-our to formulate a uniformscheme for providing victim

compensation in respect ofrape/sexual exploitation with thephysically handicapped womenas required under the law takinginto consideration the schemeframed by the State of Goa forrape victim compensation,” abench of Justices M Y Eqbal andArun Mishra said.

It said the authorities shouldlook into Victim CompensationScheme under Section 357-A ofCrPC for providing compensa-tion to the victim or dependentswho have suffered loss as a resultof such crime.

“It is clear that no uniformpractice is being followed in pro-viding compensation to the rapevictim for the offence and for herrehabilitation. This practice of

giving different amounts rangingfrom Rs 20,000 to Rs 10,00,000as compensation for the offenceof rape under section 357 A needsto be introspected by all the Statesand the Union Territories...

“Indisputably, no amount ofmoney can restore the dignity andconfidence that the accused tookaway from the victim. No amountof money can erase the traumaand grief the victim suffers. Thisaid can be crucial with aftermathof crime,” the bench said.

The apex court was hearingan appeal by a rape convict chal-lenging a Chhattisgarh high courtdecision which had upheld theorder of a trial court awardinghim seven year jail for raping a18-year-old blind and illiterate

girl on the false promise of mar-riage.

Observing that being physi-cally disadvantaged, the victimwas already in a “socially disad-vantaged position”, the courtdirected the State Government topay Rs 8,000 per month throughher life time.

“Victim being physically dis-advantaged, she was already in asocially disadvantaged positionwhich was exploited maliciouslyby the accused for his own illintentions to commit fraud uponher and raped her in the garb ofpromised marriage, which hasput the victim in a doubly disad-vantaged situation and after thewaiting of many years it hasworsened. Army jawan dies in accidentBATALA, Feb 11:

An army jawan was killedwhen his motorcycle collidedwith a tipper at Bhandoi villageunder Ghoman police stationtoday.

According to police,Dharminder Singh (21), whowas recruited in the first Sikhinfantry two years ago anddeployed in the Jammu andKashmir recently, was on leave.

When he went to market, hismotorcycle collided with a tip-per and he died on the spot. Thetipper driver escaped from thespot.

Police said that a youthunder suspicious circumstanceswas noticed moving close tothe LoC. He was arrested andtaken to nearby camp. He waslater identified as Abu Tahir(18), son of Abdul Manaf, resi-dent of Mathas village in Salardistrict of Bangladesh. Hewas trying to corss over toPoK.

After questioning he waslater handed over to Mandharpolice. A case FIR No. 17/ 2016was registered against him.

Both thegirls are neighbours and close toeach other. They told police thatthey had gone at their own.After completion of legal for-malities, they were handed overto their parents at Bharakh.
